1 PAGE 1 EU-OUTREACH NEWSLETTER 68 JANUARY 2016 IN THIS ISSUE 1 EU-Outreach In The Field of Conventional Arms (COARM) EU-OUTREACH IN THE FIELD OF CON- VENTIONAL ARMS (COARM) NEW COARM PROJECT 2 The EU ATT-OP 3 EU-Outreach On Export Control Of Dual-Use Items For Jordan And Kazakhstan 6 Activity Calendar 7 Points of Contact On December 21, 2015, a new agreement was signed paving the way for the start of implementation of the next COARM outreach project as set out in the EU Council Decision (CFSP) 2015/2309. Given its proven experience, qualifications and necessary expertise as the implementing body of EU-funded outreach activities in the area of conventional arms, BAFA has once again been tasked with managing and executing the newest COARM outreach project. The overarching goals of this project are to promote in accordance with the principles set out in Common Position 2008/944/CFSP and in the Arms Trade Treaty effective controls on arms exports in third countries through sound legislation, robust control mechanisms and transparent reporting. COARM projects, they will include regional workshops, study visits to EU Member States, and individual assistance measures. The scope of partner countries also remains the same: South East Europe (Albania, Bosnia, Kosovo, Macedonia, Montenegro and Serbia) Eastern Europe and the Caucasus (Armenia, Azerbaijan, Belarus, Georgia, Moldova and Ukraine) North Africa/Mediterranean (Algeria, Egypt, Libya, Morocco, Tunisia). In addition, a group of events on diversion-related issues will be carried out for countries of Western Africa and the Sahel. The duration of the project is 24 months. Federal Office for Economic Affairs and Export Control (BAFA), January 2016 This is the third installment of the COARM outreach project and it follows on the heels of the previous two, which ended in 2012 and 2014 respectively. In 2015, in order to bridge the gap until the start of the next COARM project, the German Federal Foreign Office funded an additional series of activities for countries that had specifically asked for a continuation of cooperation in the area of arms export control. 2 PAGE 2 THE EU ATT OUTREACH PROJECT EXPERTS MEETING AND ROUND TABLE On 8 10 December 2015, the meeting of ATT experts and ATT round table took place in Frankfurt am Main, Germany. The meeting marked the passing of the first year in implementation of the ATT- OP (scheduled for three years and finishing in April 2017). By bringing together experts, who had worked in the full range of partner countries, plus representatives of a wide range of international and civil society organisations who were involved in ATT-related activities, the meeting aimed to discuss three key topics that have been raised in the majority of roadmap countries, namely licencing, enforcement and reporting. A key objective of the first day of the meeting was to facilitate an exchange on best practices for the integration of these topics in the roadmaps and related activities. The second and the third day of the meeting gave partner countries the opportunity to share with the EU experts ideas and experiences as regards ATT ratification and implementation. dations on the provisions that need to be added to the legislation with regard to sanctions and embargoes. UPCOMING ACTIVITIES GHANA - FIRST ROADMAP ACTIVITY On 6-7 January 2016 the First Roadmap Activity for Ghana has been conducted within the framework of the ATT Outreach Project. Based on the needs assessment and the jointly developed roadmap, this event focused on discussions about the new Ghanaian legislation and the establishment of a comprehensive control list. Furthermore the Inter-agency coordination has been discussed. After the opening remarks by the Ghanaian Minister of Interior who thanked the EU and BAFA for their support, EU-experts and Ghanaian participants discussed the framework and the content of the new legislations for arms and ammunition. The EU experts highly recommended having the law of arms and ammunition separated from the export control law. Moreover, the experts gave recommen- COSTA RICA INITIAL VISIT In the framework of the EU ATT-OP, BAFA is currently in the process of organising an Initial Visit to San José, Costa Rica on January This two-day meeting will allow representatives from Germany, Mexico and the United Nations Regional Centre for Peace, Disarmament and Development in Latin America and the Caribbean (UNLIREC) and their Costa Rican counterparts to discuss both the project and to further define the pillars of cooperation within the project. Based on the findings of this Initial Visit, a jointly elaborated roadmap will be designed for the upcoming months.
3 PAGE 3 EXPORT CONTROL FOR DUAL-USE ITEMS FOR JORDAN AND KAZAKHSTAN KAZAKHSTAN SEMINAR ON IDENTIFICATION CEN- TER / CONCEPT DISCUSSIONS Kazakh colleagues were especially interested in items classification and identification of catch-all goods, interagency cooperation, different types of licenses as well as transfers within the EU territory. In the framework of EU-Kazakhstan Cooperation in Export Control of Dual-Use Items the first activity within the jointly agreed Action Plan between the implementing agent and Kazakh authorities took place from November in Astana, Kazakhstan. The next seminar on Identification Centre will take place end of January 2016 and focus on technical aspect of Identification Centre (methodology, procedures and technical rating of items). This event was the first seminar of the Implementation Phase started in August 2015 when the Long Term Expert arrived in Astana. The focus of the seminar which addressed relevant authorities involved in strategic trade controls like Ministry of Investment and Development, Ministry of Energy, Ministry of Foreign Affairs, Ministry of Finance (Central Customs Laboratory) and National Security Council was to adjust the Action Plan to the new time line and to discuss the foreseen changes in the export control legislation as well the Concept of the establishing of Identification Centre for nuclear and radioactive materials. EU Experts from Austria, Germany, Hungary and the Netherlands as well as the Long Term Expert from Slovenia supported this event by presenting national approaches of implementation of the common EU provision 428/2009. JORDAN - CUSTOMS WORKSHOP As the first activity in the framework of the EU-Jordan Cooperation in Export Control of Dual-Use Items a customs workshop was held on 1st and 2nd December 2015 in Amman, Jordan. One objective of the workshop was, to provide in particular Jordan Customs and the Ministry of Industry and Trade a forum to address the members of the export control committee, established under the Instruction No. 1/2009 to Regulation No. 114/2004 on Import and Export Licences and Cards, as well as the members of the Technical Risk Management Committee with in depth technical information on certain aspects of the update of the Jordanian dual use trade control system. The second aim was to raise the understanding that an entire control of all transit and transshipment movements that touch the Jordanian customs territory, on one hand, is impossible, and, on the other hand, bears the high risk of impeding legitimate trade. In this respect, in particular, the setting of the risk management system applied by customs, dual use control list related commodity identification techniques and tools as well as a system of licensing exemptions and exceptions and facilitating licensing procedures were brought to the attention of the participants. Seminar on Identification Center / Concept Discussions (Source: BAFA) The workshop was supported by experts from the Germany, the Netherlands and the United Kingdom.
4 PAGE 4 JORDAN - OUTREACH-TO-INDUSTRY INFORMATION EVENT The event is part of the joint EU, U.S., Jordan action plan. It addressed industry and trade associations as well as individual companies that are engaged in the cross border trade of dual use items. Experts from EU Member States, from the U.S. as well as representatives from different Jordanian ministries and government authorities imparted their expertise and experience in trade control. The attendees were informed about the international background of a today s trade control system and about various ways of its implementation into a legislative and administrative system. The present Jordanian trade control system on dual use goods was presented in a next session. This provided the attendees the possibility to compare the international requirements with the present system. As a result of this comparison the attendees were introduced into the recent amendment of the Jordanian trade control system, as well as of legal and regulatory measures that were already initiated towards the further alignment of the system with the international commitments. In this realm, in particular the adoption of the consolidated list of dual use goods was mentioned, as well as the further plans of its enforcement. Additionally, the adoption of control provisions for transit and transshipment activities, which has been brought on the way and is awaiting its legal implementation, was of topic. The further objective of the event was to initiate the establishment of a regular information exchange forum between industry and government authorities that have core competence in dual use trade control. Such a regular information exchange, on one hand, allows industry to set company s international structure and procedures in due time to the new requirements. On the other hand, government authorities gain information from industry on new economic and technological developments that may be considered in a trade control system. JORDAN - INFORMATION TO MINISTRIES AND GOVERNMENT AGENCIES ON DUAL USE TRADE CON- TROL do not have core legal capacity in dual use trade control. The event was opened by the EU Ambassador to Jordan, H.E. Andrea Matteo Fontana, and by representatives of the EU Commission, of the Jordanian Ministry of Industry, Trade and Supply and of the U.S. Embassy in Amman. In his welcome speech Ambassador Fontana reflected on the long lasting cooperation of the EU with Jordan and the EU s deepened engagement in the country. The objective of the event was to inform Jordanian ministries and government agencies that have responsibility in trade policy and regulatory measures different from dual use trade control, about the state of the play of the Jordanian dual use trade control system, its recent updates and the plan for its further alignment to the international commitments. Further aim was to raise the understanding of ministries and government agencies in the necessity to engage in the assessment of the respective legal and administrative provisions with respect to possible overlapping, even contradictious stipulations and procedures with dual use trade control. Experts from a range of EU Member States as well as of the U.S. introduced into the international legal background of a today s trade control system and ways of implementation into a national legaland administrative system. This included solutions of avoiding duplicating procedures. It became obvious that a number of different ministries and government authorities will have certain responsibility in the control of cargo that touches the Jordanian territory. As well, a number of projects are already or will be launched, including infrastructural projects, which may have an impact on the control of cross border movements of dual use goods. The participants agreed that closer information exchange and cooperation between the different ministries and government agencies should be thought to avoid contradictious developments, undue duplication of efforts and to ensure better intra-government coordination. The EU and U.S. programme representatives to this end encouraged to reflect on establishing a structured mechanism, e.g. by regular information exchange events, addressing the different ministries and government agencies under the inclusion of industry. The event is part of the joint EU, U.S., Jordan action plan and addressed those Jordanian ministries and government agencies that Both events in Jordan were supported by experts from Austria, Germany, the Netherlands and the United Kingdam.
5 PAGE 5 UPCOMING ACTIVITIES KAZKHSTAN - IDENTIFICATION CENTER SEMINAR In the framework of EU Cooperation in Export Control of Dual-Use Items with Kazakhstan a technical seminar related to licensing and commodity identification procedures as well as methodology of technical rating for establishing an Identification Centre will take place in Astana, Kazakhstan on January Experts from Germany, Hungary, Romania and UK as well as the Long Term Expert from Slovenia will support this event. The seminar is dedicated to licensing officers as well as technical experts from National Nuclear Centre and Central Customs Laboratory of Kazakhstan. The EU Delegation to Kazakhstan is also expected to participate.
