Robert Deutschmann, re: item 6 - Complaint Reference Number CCIC-004 Councillor Frank Monteiro Notice of Motion from Mayor Craig - Multi-purpose Sport and Recreation Facility WHEREAS Cambridge City Council ( Council ) is undertaking the task to construct a multipurpose sport and recreation facility; AND WHEREAS Council is in the process of reviewing multiple sites which would properly suit the location of a multi-purpose sport and recreation facility; AND WHEREAS an alternate site located at 355 Hespeler Road, known as the Cambridge Shopping Centre, has come forward expressing interest as a suitable location for a multipurpose sport and recreation facility; NOW THEREFORE BE IT RESOLVED THAT Council directs city staff to research and report back on the feasibility of constructing a multi-purpose sport and recreation facility (or part thereof) at this alternate site location which will form part of the review process and be included within the list of multiple site locations.

5 Meeting Date: 09/19/2017 Report #: (CRP) To: COUNCIL Report Date: 14/09/2017 Report Author: Dave Bush, Deputy City Manager Department: Division: Report Title: Corporate Services Fire Services Fire Command Unit #7577 Replacement Request File No: Ward No: RECOMMENDATION(S) THAT report (CRP) Fire Command Unit #7577 Replacement Request be approved. SUMMARY To approve a request to commence and issue a tender to replace Fire Command Unit #7577 (Car-6) in Q4 of 2017 due to the age and current state of the vehicle. BACKGROUND Project 18-Q-004 Car 6 Platoon Chief Vehicle was previously approved and scheduled for 2018, to provide a new Car 6 (replacement for 2004 Car 6). Under 1901 NFPA, this standard defines the requirements for a new automotive fire apparatus and trailers designed to be used under emergency conditions to transport personnel and equipment and to support the suppression of fires and mitigation of other hazardous situations. Upon a preliminary assessment of the vehicle, the age and deterioration of the vehicle are very evident. Considering the delivery timeline of the new vehicle will be approximately 6 months, it is recommended to commence the tender process in Q4 of 2017, subject to Council s approval.
6 ANALYSIS Strategic Alignment: PEOPLE To actively engage, inform and create opportunities for people to participate in community building making Cambridge a better place to live, work, play and learn for all. Goal #1 - Community Wellbeing Objective 4.4 Manage city resources in a responsible and sustainable manner, considering future needs for resiliency and community adaptation. Replacement of this vehicle improves the City s resources to effectively and safely serve the City of Cambridge community. Existing Policy/By-Law: Purchasing By-Law Financial Impact: There is no immediate financial impact from this request. Funding of this replacement will come from the Reserve Funds and payment would occur upon delivery of the vehicle in The expected cost of this replacement is $170, Public Input: N/A Internal/External Consultation: Consultation with Finance staff has taken place to determine the appropriate process. Comments/Analysis: The replacement of the Fire Command Unit #7577 was originally scheduled for In the attempt to decrease delay, with Council approval, it is requested that the tender process commence in Q4 of 2017 rather than in SIGNATURE Prepared by:

SUMMARY Attached as Appendix A is the final report completed by the Integrity Commissioner submitted in regard to a complaint about an alleged breach of the Council Code of Conduct. The Integrity Commissioner determined Councillor Monteiro breached section 4.1 of the Council Code (the Code ). As such, Council is entitled to determine the appropriate penalty, if any.
10 BACKGROUND A complaint was filed against Councillor Monteiro alleging a breach of the Code arising out of a telephone interview conducted on CBC Radio on November 16, In accordance the Code, 223.4(1) of the Municipal Act, 2001, the Integrity Commissioner conducted an investigation based on the complaint Chronology of events: Complaint filed with City Clerk on April 12, 2017 Councillor Monteiro filed affidavit dated May 26, 2017 Integrity Commissioner s draft report shared with complainant and Councillor Monteiro on or about July 11, 2017 Integrity Commissioner issued final report August 8, ANALYSIS Strategic Alignment: PEOPLE To actively engage, inform and create opportunities for people to participate in community building making Cambridge a better place to live, work, play and learn for all. Goal #2 - Governance and Leadership Objective 2.1 Provide a wide range of ways that people can become involved in city decision making. The Code confirms Council s commitment to transparency, openness and respect. Existing Policy/By-Law: The Code is the policy document which is used by the City to invoke an investigation by the Integrity Commissioner when there is a complaint lodged against a Member of Council, or others covered by the Code. Financial Impact: There is a financial cost to the City for each complaint forwarded to the Integrity Commissioner s Office. For this investigation/report, the total cost is $7, Public Input: Not Applicable Internal/External Consultation: Not Applicable Comments/Analysis:
11 The Integrity Commissioner s final report is attached to this Report. In accordance with the Code and the Municipal Act, 2001, the final report is as follows: Reporting the Results of an Investigation Any recommended corrective action shall be designed to ensure that the inappropriate behavior or activity does not continue and any reprimand will be in accordance with Section of the Act. Excerpt from the Municipal Act, 2001, (Section 223.4(5)) Penalties (5) The municipality may impose either of the following penalties on a member of council or of a local board if the Commissioner reports to the municipality that, in his or her opinion, the member has contravened the code of conduct: a) A reprimand. b) Suspension of the remuneration paid to the member in respect of his or her services as a member of council or of the local board, as the case may be, for a period of up to 90 days. 2006, c. 32, Sched. A, s.98. Based on the report findings, Council has the following options: Option 1 Option 2 Confirm the decision of the Integrity Commissioner and the proposed penalty Confirm the decision of the Integrity Commissioner but impose a penalty other than as recommended by the Integrity Commissioner.
