1 LUXEMBURG - COUNTRY REPORT 1.1 Response questionnaire Questionnaire 1 : The Ministère du Logement (Ministry of Housing), shortened hereafter as ML), filled in on 23/7/2010. Draft country report checked by ML 1.2 Rule system Type of regulation ML: Laws and regulations at national level in combination with a relatively small number of regulations at local level Regulated sustainability topics for new buildings In Luxemburg quite a lot of topics related to ecological quality are regulated. However topics related to water conservation, water efficiency techniques and water metering and topics related to the minimization of resources are not regulated. Only a few topics of economic quality are regulated, namely the topics related to the density of the development and to mixed land use. About half of the topics mentioned in the questionnaire in the field of social quality are regulated. Topics which were not regulated include the provision of housing for the elderly and all topics related to the subject integrate development in local context. In Luxemburg most of the topics related to functional quality are not regulated. Amongst the topics which are regulated are: indoor air-quality, thermal comfort, acoustic comfort and accessibility for disabled. Three topics related to technical quality are regulated namely the structural safety and fire resistance of the construction and the safety of a construction during a fire Rules for existing buildings and for renovation of existing buildings As far is known is known to ML, in Luxemburg all regulations on sustainable construction topics which apply to new buildings, do not apply to existing buildings and renovation of existing buildings, with the exception of regulation on energy Level of regulation In Luxemburg most regulation is at national/federal level. However some requirements are set at local level, including topics such as waste separation/recycling, support to local economic diversity and access to green space. 2 1.2.5 Background in EU-Directives As far is known to ML relatively few topics have a background in EU-directives. In particular energy performance, minimization of pollution and fire resistance have a EU-background Ordering of the regulations ML is not quite clear on the ordering of regulations and has not answered all the questions on this subject. In the opinion of ML regulations on energy performance and social quality only apply to dwellings. Regulations on waste minimization only apply to commercial and industrial buildings Type of requirements and deemed-to-satisfy solutions Regulations on energy performance are drawn up as functional regulations (goals are specified). ML does not know how the regulations on the other subjects of the questionnaire are drawn up. As far is known to ML documentary on accepted or deemed-to-satisfy solutions is not available Process of implementation In Luxemburg the process of implementation of regulations for all aspects related to energy was a government led process (top-down). ML does not know how the regulations on the other subjects were implemented. 1.3 Enforcement regime Building plans are monitored on energy, social quality and technical quality. The actual control on energy is done by architects, the control on social and technical quality is done by architects or by technical advisers on behalf of the (future) owner. Building plans are normally monitored superficially by means of a visual check. This monitoring process is regulated in law at national/federal level. If non-compliance is found, the building permit will not be issued. If the monitoring shows compliance with sustainability regulation, for most subjects, this is reported to the future owner of the building and/or the builder. Work under construction is monitored on the sustainability aspects: energy, waste and technical execution. The monitoring process is regulated in law at national/federal level. Architects and technical advisers are involved in the actual control. The technical execution/construction process is monitored by technical advisers on behalf of insurers. Work under construction is normally monitored by means of visual check and in a superficial way. However, technical execution is checked thoroughly. If non-compliance is found in the field of energy, the contractor is requested to solve the problem. If non-compliance is found in the field of waste a penalty is used, but work may continue. If noncompliance is found in the field of technical execution the work is halted until the problem is solved. If everything is OK, a proof on paper is issued to the future owner of the building and/or the builder. Prior to occupation the finished work is checked thoroughly on energy related aspects only by means of a visual check. In case of non-compliance the building may be occupied under the condition that this non-compliance is solved within a certain time-frame. A proof on paper is issued if monitoring shows compliance with sustainability regulation. Existing buildings in use are not monitored. Y , Screening nat. building regulations - Luxembourg febr. 2011
3 1.4 Sustainable construction initiatives including public and joint public-private initiatives ML gives four examples of public-private initiatives: The Superdreckskescht system, aimed at the collection and waste reclamation of special wastes from households and industries The Greng Hausnummer project aimed at stimulating environmental-friendly and sustainable building Leitfaden für nachhaltiges Bauen, a checklist fur sustainable building Myenergy, a web-site aimed at the reduction of energy and the use of renewable energy sources 1.5 Role of EU In the opinion of ML the EU has an important role in stimulating sustainable construction in Luxemburg.
