2 The California Environmental Quality Act (CEQA) requires that when a public agency completes an environmental document which includes measures to mitigate or avoid significant environmental effects, the public agency must adopt a reporting or monitoring program. This requirement ensures that environmental impacts found to be significant will be mitigated. The reporting or monitoring program must be designed to ensure compliance during implementation (Public Resources Code Section ). In compliance with Public Resources Code Section , the following Mitigation Monitoring and Reporting Checklist has been prepared for the Initial Study/Mitigated Negative Declaration for Planning Area 6 North Elementary School Project. This Mitigation Monitoring and Reporting Checklist is intended to provide verification that all applicable Conditions of Approval relative to significant environmental impacts are monitored and reported. Monitoring will include: 1) verification that each mitigation measure has been implemented, 2) recordation of the actions taken to implement each mitigation measure, 3) retention of records for Irvine Unified School District. The Initial Study/Mitigated Negative Declaration discussed the following impact areas to require mitigation: Minor changes to the Mitigation Monitoring and Reporting Program, if required, would be made in accordance with CEQA and would be permitted after further review and approval by Irvine Unified School District. Such changes could include reassignment of monitoring and reporting responsibilities, program redesign to make any appropriate improvements, and/or modification, substitution or deletion of mitigation measures subject to conditions described in CEQA Guidelines Section No changes will be permitted unless the Mitigation Monitoring and Reporting Program continues to satisfy the requirements of Public Resources Code Section In addition to the mitigation measures described above, two key features will be implemented during construction. These have been added to the following table to ensure compliance. 2
3 Mitigation Measure Monitoring Process Monitoring Timing MM CUL 1: Unanticipated Discovery of Archaeological and Native American Monitoring shall be conducted for all ground disturbing activities that occur at a depth below fill and within native soils (soils not previously disturbed) of the site. Prior to conducting ground disturbing activities, the District will evaluate the depth of excavation and whether it will be located in engineered fill, bedrock, or native soils. Monitoring shall be performed for ground disturbance of native soils under the direction of a qualified archaeologist meeting the Secretary of Interior s Professional Qualifications Standards for archaeology (National Park Service 1983). If cultural resources are encountered during ground disturbing activities, work in the immediate area must halt, and the find must be evaluated by the qualified archaeologist. Depending on the nature of the find, if the discovery proves to be potentially significant under CEQA, as determined by the qualified archaeologist, additional work such as onsite monitoring by a qualified Native American Tribal representative, data recovery excavation, avoidance of the area of the find, documentation, testing, data recovery, reburial, archival review and/or transfer to the appropriate museum or educational institution, or other appropriate actions may be warranted. The archaeologist shall complete a report of excavations and findings and submit the report to the District. After the find is appropriately mitigated, work in the area may resume.
4 Mitigation Measure Monitoring Process Monitoring Timing MM CUL 2: Unanticipated Discovery of Paleontological Resources Prior to any grading at depth below fill within the site, the applicant shall retain a paleontologist to prepare and implement a Paleontological Resource Impact Mitigation Program to reduce direct and indirect adverse paleontological impacts on the site, specifically during earth moving activities. Said program shall provide for: (1) the recovery of some scientifically highly important fossil remains, should any be encountered by such activities; (2) their comprehensive treatment and transfer to a recognized museum repository for permanent storage and maintenance; (3) the recording of associated specimen data and corresponding geologic and geographic locality data and their archiving at the repository; (4) ensuring the availability of the remains and data for future study by qualified scientific investigators. The Paleontological Resource Impact Mitigation Program shall be in place prior to any grading activities. A summary report of paleontological findings shall be prepared and implemented and submitted to the District upon completion.
5 Project Feature 1 Project Feature 2 Project Features Monitoring Process Monitoring Timing Temporary hay bale sound walls to protect nesting birds from construction noise have been set up onsite and will remain during construction of PA 6 North. During construction, heavy equipment will be inspected before delivery to the site. The District will ensure that all the equipment being delivered is weed free, including: earth moving equipment and associated vehicles that could present a risk for spreading weeds (vegetation clearing has been previously completed so no further vegetation clearing and associated vehicles is not expected to be required).
