3 Welcome Message Thank you for your interest in the position of Non-executive Director, for Radioactive Waste Management Ltd. The Government has launched a plan to deal permanently with the country s radioactive waste. Radioactive Waste Management (RWM s) role is as the developer of a geological disposal facility (GDF); the public will be at the centre of any final decision-making on where it is sited. For more than 60 years, Britain has been accumulating radioactive waste which is currently stored safely at over 30 sites around the country. For the long term, we are responsible for making this waste even safer, by removing it from the surface, away from people and the environment and securing it in a number of vaults and tunnels deep underground. Radioactive Waste Management Limited (RWM) is the delivery organisation for a Geological Disposal Facility (GDF) and provision of radioactive waste management solutions. It is a wholly owned subsidiary of the Nuclear Decommissioning Authority, which is an Executive Non-Departmental Public Body of the Department of the Energy and Climate Change. RWM brings extensive and proven expertise in higher activity radioactive waste management and planning for a GDF and will work closely with interested communities and other stakeholders, with responsibility for planning and ultimately implementing geological disposal of higher activity wastes in accordance with Government policy. This includes ensuring such wastes generated throughout the UK are conditioned and packaged in a manner suitable for eventual disposal. In running the geological disposal programme, we bring significant experience of specification, design, assessments and research. Our approach is to be a lean, intelligent client organisation ensuring we remain robust to enable us to operate effectively as a prospective Site Licence Company (SLC). This provides for flexibility and efficiency, while retaining the necessary intelligent client and design authority core competencies. Our organisation of scientists and engineers is determined to tackle this legacy. We work closely with our counterparts worldwide to provide reassurance and solutions to the many technical aspects of the programme. Every step of the process will be scrutinized. If we cannot satisfy ourselves and the independent regulators that a GDF is safe, then it will not be built. We will review full investigations for the GDF programme - ensuring the right blend of skills and expertise to deliver the Business Plan and GDF programme which are critical to providing for flexibility and efficiency and operating as the intelligent client to deliver this multi-billion pound programme. The first steps will be to conduct a national geological screening exercise looking at the country s geology, working closely with other experts and with stakeholders. The process of finding a suitable site is going to take many years in total. We will explain, discuss and respond to the many questions the public will inevitably have, building relationships with communities around the country, so that they have trust and confidence that we are working in partnership with them throughout this exercise. As Independent non-executive director, you will play an important role on the board alongside RWM executives and non-executive colleagues from the NDA, offering a broader perspective and constructively scrutinising corporate strategy and operational performance. You will have an incontestable track record of achievement in earth sciences, combined with the delivery of comparable major projects. Your ability constructively to challenge the executive and contribute to the 2

4 development of strategy will support the transition of RWM from the planning stage to delivery of the Geological Disposal Facility. 5 Introduction The UK Government s policy for the long-term management of higher activity radioactive waste is geological disposal. In 2008 the Managing the Radioactive Waste Safely (MRWS) white paper was published which outlined a framework for implementing geological disposal based on the principles of voluntarium and partnership. Three local authorities formally expressed an interest in the MRWS programme: Copeland and Allerdale Borough Councils, and Cumbria County Council. In January 2013, the three local authorities voted on whether to proceed to stage 4 of the process. The two boroughs voted in favour, but the county voted against. The Government had in 2011 given a specific undertaking that the existing site-selection process would only continue in west Cumbria if there was agreement at both borough and county level. The county s decision therefore ended the existing site selection process in west Cumbria. Shepway District Council in Kent had also taken soundings from local residents, but subsequently decided against making a formal expression of interest in the current MRWS process. The Government remains firmly committed to geological disposal as the right policy for the long-term safe and secure management of higher-activity radioactive waste. The Government also continues to hold the view that the best means of selecting a site for a geological disposal facility (GDF) is an approach based on voluntarism and partnership - evidence from abroad shows that this approach can work, with similar waste disposal programmes based on these key principles making good progress in countries like Canada, Finland, France and Sweden. The fact that two local authorities in west Cumbria voted in favour of continuing the search for a potential site for a GDF demonstrates that communities recognise the substantial benefits that are associated with hosting such a facility both in terms of job creation and the wider benefits associated with its development White Paper In line with the Secretary of State s written Ministerial statement of 31 January 2013, Government considered what lessons can be learned from the experiences of the MRWS programme in West Cumbria and elsewhere and invited views on the site selection aspects of the ongoing MRWS programme. The White Paper released on 25th July 2014 set out the UK Government s framework for managing higher activity radioactive waste in the long term through geological disposal. This will be implemented alongside ongoing interim storage and supporting research. This White Paper updated (and replaced in England and Northern Ireland) the 2008 White Paper by the UK Government and the devolved administrations of Wales and Northern Ireland, Managing Radioactive Waste Safely A Framework for Implementing Geological Disposal. (As the Welsh Government is not issuing this White Paper, its current policy remains as set out in the 2008 White Paper). A geological disposal facility (GDF) is a highly-engineered facility capable of isolating radioactive waste within multiple protective barriers, deep underground, to ensure that no harmful quantities of radioactivity ever reach the surface environment. The development of a GDF will be a major infrastructure project of national significance. It will provide a permanent solution for the UK s existing higher activity radioactive waste (including anticipated waste from a new build programme). 4

6 To identify potential sites where a GDF could be located, the UK Government favours a voluntarist approach based on working with communities that are willing to participate in the siting process. A GDF is likely to bring significant economic benefits to a community that hosts it, in the form of long-term employment and infrastructure investment, and in the form of additional community investment that the UK Government has committed to provide. The White Paper set out a number of initial actions to be undertaken by the UK Government and by the developer (Radioactive Waste Management Limited) to help implement geological disposal. It also set out a number of key principles and commitments that will shape the subsequent process of working with communities to identify and assess potential sites. This White Paper provided background information in relation to: The radioactive waste (and other nuclear materials that may be declared as waste in the future) that will be disposed of in a GDF, and how it is currently managed; How geological disposal became UK Government policy a process informed by the recommendations of the independent Committee on Radioactive Waste Management (CoRWM), and in line with the preferred approach internationally; Information on what geological disposal is, including aspects of its design, how it is constructed and regulated, and the roles and responsibilities of those organisations involved in its implementation. It then set out the policy framework for the future implementation of geological disposal in the UK, including: Establishing an upfront process of national screening, based on known geological information. This process will be led by the developer, drafting national screening guidance that will be evaluated by an independent review panel, in an open and transparent manner, before being applied across the UK (excluding Scotland); In England, bringing GDFs, and the borehole investigations that support their development, within the statutory definition of Nationally Significant Infrastructure Projects within the Planning Act This will provide an appropriate process for planning decisions, making public consultation an integral part of this process. The UK Government will develop a generic (i.e. non-site specific) National Policy Statement to support the planning process, providing the framework within which the decision to construct will be taken, and further upfront information to inform discussions with communities; Developing the process of working with communities, including: o Deciding on an approach to community representation, which will be informed by a community representation working group convened following publication of this White Paper; o Providing high level information on community investment, including the process for deciding how and when this money will be invested, in relation to: - Communities engaging in the siting process; and - The community or communities that decide to host a GDF; Establishing a mechanism by which communities, the developer and Government can openly access independent, third party advice on key technical issues during the siting process. Formal discussions between interested communities and the developer will not begin until the initial actions set out in the White Paper have been completed, in around In the meantime, for those looking for more information about geological disposal, contact details are provided at the end of the document. 5

7 This new siting process will provide more information to communities before they are asked to get involved. With greater clarity on issues like geology and development impacts, community investment and community representation, communities will be able to engage with more confidence in the process to deliver this nationally significant infrastructure project. 8 Background Higher-activity radioactive wastes are produced as a result of the generation of electricity in nuclear power stations, from the associated production and processing of the nuclear fuel, from the use of radioactive materials in industry, medicine and research, and from military nuclear programmes. As one of the pioneers of nuclear technology, the UK has accumulated a substantial legacy of higher activity radioactive materials. Some of it has already been processed and placed in safe and secure interim storage on nuclear sites. However, most will only become waste over the next century or so as existing facilities reach the end of their lifetime and are decommissioned and cleaned up safely and securely. These higher-activity wastes can remain radioactive, and thus potentially harmful, for hundreds of thousands of years. Modern, safe and secure interim storage can contain all this material but this method of storage requires on-going human intervention to monitor the material and to ensure that it does not pose any risk to human or environmental health. While the Government believes that safe and secure interim storage is an effective method of managing waste in the short to medium term, the Government is committed to delivering a permanent disposal solution. In October 2006, following recommendations made by the independent Committee on Radioactive Waste Management, the Government announced its policy of geological disposal, preceded by safe and secure interim storage. The Government subsequently announced that it would pursue a policy of geological disposal with site selection on voluntarism and partnership. This remains Government policy. Geological disposal Geological disposal involves isolating radioactive waste in an engineered facility deep inside a suitable rock formation to ensure that no harmful quantities of radioactivity ever reach the surface environment. It is a multi-barrier approach, based on placing packaged wastes in engineered tunnels at a depth of between 200 and 1000m underground, protected from disruption by man-made or natural events. Geological disposal is internationally recognised as the preferred approach for the long-term management of higher-activity radioactive waste. It provides a long-term, safe solution to radioactive waste management that does not depend on on-going human intervention The United Kingdom has been producing radioactive waste since the 1940s and since the Flowers report in 1976 has recognised a need to establish arrangements for its long-term management. In 2001 Government initiated the Managing Radioactive Waste Safely (MRWS) programme to find a practicable solution for the UK s higher activity wastes. The Government established an independent Committee on Radioactive Waste Management (CoRWM) to review options and to recommend a long term solution to managing higher activity radioactive wastes in the UK. CoRWM set about a technical assessment of options, examined overseas experience and undertook a wide ranging programme of engagement both with the public and other stakeholders to come to their recommendations. In October 2006 the UK Government accepted CoRWM s recommendations of implementing geological disposal through a voluntarism and partnership approach, coupled with safe and secure interim storage along with a programme of ongoing research and development as the way forward. CoRWM stated that the aim should be to progress disposal as soon as practicable, consistent with developing and 7

9 maintaining public confidence. The UK Government gave the NDA responsibility for planning and implementing geological disposal. On 01 April 2014 NDA established RWMD as a separate legal entity Radioactive Waste Management Limited (a wholly-owned NDA subsidiary) that, with further development, can apply for and hold the regulatory permits and licences needed to construct and operate a geological disposal facility (GDF). RWM will continue to work with Government to implement the revised Managing Radioactive Waste Safely process, working with interested communities and other stakeholders. Following consultation, Government published the MRWS White Paper in June 2008 setting out the framework for the implementation of geological disposal based on a voluntarism and partnership approach. This was accompanied by an invitation for communities to express an interest in discussing with Government the possibility of hosting a geological disposal facility. This approach does not apply in Scotland. The Scottish Government has published Scotland s Higher Activity Radioactive Waste Policy Scottish Government Policy states that: The long-term management of higher activity radioactive waste should be in near-surface facilities. Facilities should be located as near to the site where the waste is produced as possible. NDA is supporting the Scottish Government in developing a strategy to implement this policy and RWM is contributing to this work. In addition, RWM will continue to apply the disposability assessment process, including issue of Letters of Compliance, where appropriate, to support long-term management of wastes covered by Scottish policy. Strategic Imperative The planning and preparation for implementation of geological disposal, including the continued development of RWM into the NDA s delivery organisation, is a Government policy commitment in the MRWS White paper. There is also a strategic imperative to progress geological disposal to support new nuclear build as part of Government s energy and climate change policy. The Nuclear Energy White Paper states that: Our policy is that before development consents for new nuclear power stations are granted, the Government will need to be satisfied that effective arrangements exist or will exist to manage and dispose of the waste they will produce. With the issue of the National Policy Statement for Nuclear Power Generation, Government has satisfied itself that: Geological disposal of higher activity radioactive waste, including waste from new nuclear power stations, is technically achievable and A suitable site can be identified for the geological disposal of higher activity radioactive waste. Interim stores provide safe and secure protection for waste packages for a period of around a hundred years. However, the higher activity wastes are potentially hazardous for hundreds of thousands of years. Rather than leave these wastes in interim stores requiring an indefinite programme of refurbishment and replacement together with waste package reworking, geological disposal deals with them as soon as is practicable. For new build wastes the availability of a geological disposal facility may also enable removal of wastes and spent fuel from generating sites. By implementing geological disposal the burden imposed by current actions on future generations is removed. Geological disposal will enable NDA to complete the decommissioning and clean-up of existing sites, genuinely reducing the liability. Progress with this demonstrates development of effective 8

10 arrangements to manage and dispose of new build wastes. Government and its agencies have invested much time and effort in getting movement on the long term management of higher activity wastes and it is important that momentum is maintained. Some of the legacy waste is stored in an unconditioned, potentially mobile form in facilities that do not meet modern standards. This waste and other waste as it arises, is being recovered and conditioned into a form suitable for disposal based on disposability advice from RWM through the disposability assessment process. Through this process, the risk of having to repackage the waste at some time in the future is minimised. The conditioned waste will be kept safely and securely in interim stores until a geological disposal facility is ready to accept such waste. Government leads the site selection process as set out in the Managing Radioactive Waste Safely White Paper which is based on voluntarism and partnership with potential host communities. The existing staged process will be revised following the launch of the new process. Following the closure of the MRWS process in West Cumbria, Government undertook an exercise to reflect on the MRWS process and will launch a renewed drive for volunteer communities in due course. Government remains committed to geological disposal of higher activity waste and to voluntarism and partnering with potential host communities. Government reflected on the experience of the process in west Cumbria and issued a call for evidence to see what lessons could be learned. Based on the feedback, to gather views on how aspects of the siting process for a geological disposal facility for higher activity waste could be revised and improved, a Public Consultation was launched in September 2013 and ran until early December During the consultation period a series of regional stakeholder events took place. Contributions to the consultation will be used to develop an updated site selection process. RWMD published a supporting document to the consultation paper titled "An overview of international siting processes". This publication seeks to help inform readers of the consultation document about the approach used for similar projects in other countries. The consultation responses were analysed by DECC and a revised GDF siting process policy document was released on the 25 th July In general the public consultation document proposed: providing communities with more information on issues like geology and socio-economic impacts - at a much earlier stage; providing communities with an on-going right of withdrawal and a final decision on whether to proceed; communities would be represented throughout the siting process by one representative level of local government and that should be the relevant District (or unitary) Council in England (and its equivalent in Wales and Northern Ireland;) and, a two phase process, namely, the "Learning" and "Focusing" phases. From September to December 2015, a public consultation was carried out on National Geological Screening Guidance and providing information on geology. Accessible and appropriate information on geology (not only rock types and structures but also groundwater conditions, natural processes and past and potential exploitation of resources) is a key resource to help inform discussions with communities about their potential suitability to host a GDF. The consultation focused on information sources that may be useful and outputs in terms of information that consultees would find helpful. 11 About Radioactive Waste Management Limited Radioactive Waste Management Limited (RWM) was established as a wholly owned subsidiary of the Nuclear Decommissioning Authority (NDA) on the 1 April It is the delivery organisation for a Geological Disposal Facility (GDF) and for the provision of other waste management solutions. RWM has extensive and proven expertise in higher activity radioactive waste management and planning for a GDF. On behalf of Government and NDA we are running the geological disposal programme and have significant experience of specification, design, assessments and research. We offer our waste producer customers disposability assessments of proposals for packaging intermediate level waste. This is done within the regulatory framework described in The Management of Higher Activity Waste on Nuclear Licensed Sites. RWM provides support to NDA through upstream optioneering initiatives. This involves working proactively with waste owners to realise opportunities for the optimisation of the geological disposal system in combination with earlier phases of the waste management lifecycle in order to minimise factors such as safety and environmental impacts, hazard, cost, risk and volume of waste to be managed in a geological disposal facility. We operate under a Services Agreement and Client Specification between NDA and RWM to deliver our mission, objectives and plans. Our mission is to: Deliver a geological disposal facility and provide radioactive waste management solutions. Our objectives are to: Engage with national and local governments and communities to identify a geological disposal facility site. Develop the specification, design, safety case and environmental and sustainability assessments for the disposal system and obtain support from the regulators. Work with waste producers to identify and deliver solutions to optimise the management of higher activity waste. Develop and maintain an effective organisation and secure resources to deliver the geological disposal facility programme. Obtain and maintain stakeholder support for our activities. Deliver a focused programme to support geological disposal and optimised packaging solutions. Deliver sustainable, innovative and cost effective solutions that have public support and are in the best interest of the UK. Governance As a wholly-owned subsidiary of NDA, RWM has a board of directors and is chaired by an NDA Director. This is the primary mechanism for NDA s governance of RWM and its performance through monthly performance reports against its agreed business plan. Sanctioning of RWM s funding is carried out by the NDA. 10

Commercial Income Our commercial operations fall broadly into two areas: Disposability assessments activities. National and international research programmes. 13 Role Profile Non-executive Director Main Purpose of the Role As a member of the board to lead and direct corporate strategy and plans for the new siting process for a Geological Disposal Facility (GDF) in the UK (excluding Scotland) and the provision of waste management solutions. As a non-executive to provide independent scrutiny of performance and assure high standards of corporate governance. Duties and Responsibilities Among fulfilling all legal responsibilities of a company director, the post-holder will in particular: Contribute effectively to development of, and to delivery of, the Company s Business Plan and Strategy. Contribute to the legal, nuclear, health, safety, security and environmental requirements of the programme. Oversee and accept board member responsibility for the Company s annual report and accounts. Maintain appropriate control systems to identify and manage risk throughout the business. Advise on performance and transformation, operational issues and effective management. Provide support, guidance and challenge on the progress and implementation of the Company s programme. Position in Organisation Member of the board of Radioactive Waste Management (RWM) Limited, which sets the strategic direction of RWM Ltd and scrutinises operational effectiveness.
