R (h) for 2016 because Staff already maintains information concerning new generation in Texas by fuel type, and this information is available to the public on the Commission's website.' In addition, the information shows that about 90.6 percent of all new, non-renewable generation constructed since 2000 has used natural gas as a primary fuel, and therefore there is no need to establish a natural gas energy credits trading program in order to meet the Goal for Natural Gas established in PURA In light of similar findings in the past, the Commission has granted a waiver of the reporting requirements in all previous years since Subst. R was adopted. Subst. R (e) provides that the Commission shall activate a natural gas energy trading credits program if it determines that within three years from the date of the evaluation, new generating capacity in Texas fueled primarily by natural gas may fall below 55 percent of all new generating capacity, excluding renewable capacity, since January 1, Attachment 1 to this memo provides a list of all new non-renewable generating capacity in Texas since 2000, and Attachment 2 provides a list of new non-renewable generating capacity that may come online in the next three calendar years.2 As shown in the summary below, assuming the new generation in the next three years, the percent of new generating capacity using natural gas would be 92.4 percent by Thus, the share of new capacity using natural gas will continue to be well above the 55 percent threshold in See "New Electric Generating Plants in Texas Since 1995" at the following location: 2 Consistent with Subst. R (h) for The reports to be waived include (1) filings that would be due from Generators4 by February 14, 2016 concerning their new and planned generating facilities, and (2) an annual report that would be published by the Commission on or before May 15, 2016 showing the current and projected fuel mix of generation installed after January 1, In support of this recommendation: Staff currently maintains information about new generating capacity in Texas by fuel type. Sources for this information includes the PUCT, ERCOT, TCEQ, U.S. Energy Information Administration (EIA), generation developer press releases, and trade publications such as SNL Financial. The information obtained is substantially the same as that which would be filed by Generators pursuant to Subst. R (h).5 2. A list of new and announced generation including capacity and fuel type is posted on the Commission's website and updated at least annually. 3. Subst. R requires Generators to file annual Generating Capacity Reports which also contain most of the information required by Subst. R (h). 4. Excluding renewable capacity, about 90.6 percent of new capacity installed in the state since January 1, 2000 has been fueled by natural gas. Based on current information, about 557 MW of coal and other non-renewable capacity may be added in the next five years; however, this would leave the share of new natural gas capacity at 92.4 percent, which is still well above the 55 percent threshold trigger for a natural gas energy trading credits program. 3 Consistent with Subst. R (c)(1), new generating capacity in this table is based on nameplate values and does not include modifications to previously installed generating facilities for increased efficiency or reduced emissions. 4"Generators" include registered Power Generation Companies, Municipally Owned Utilities, and Electric Cooperatives. Consistent with PURA , the term also includes electric energy storage facilities that are intended to be used in the wholesale market. 5 Staff does not maintain complete information on the ownership share of each generating unit or the TCEQ turbine or boiler permit number and date; however, none of that information is necessary for the determination of the new generation fuel mix. 5 Public Utility Commission of Texas Memorandum If the Commission waives the filing requirement and annual report for 2016, Generators would file information in 2017 covering their historical activity from January 1, 2000 as well as their projected capacity additions for the next three years (five years for coal, lignite, or nuclear). I have attached a proposed Order that would waive the filing requirement and annual report. If the Commission does not wish to waive these requirements, Staff requests that the Commission grant a good cause exception to extend the deadline for Generators to file the required information to 3:00 PM on March 15, In addition, since a form for the filing has not been developed, we also request that Generators be allowed to file the information in Project using any reasonable format with a signed and dated cover letter attesting to the accuracy of the enclosed information. If the 2016 filing is required, it should cover capacity additions since January 1, 2000 and provide all information as required by Subst. R (h). Page 3 of 3 004

12 PUC DOCKET NO GOAL FOR NATURAL GAS PUBLIC UTILITY COMMISSION OF TEXAS ORDER GRANTING GOOD CAUSE EXCEPTION TO THE ANNUAL REPORT AND FILING REQUIREMENTS OF PUC SUBST. R This Order grants a good cause exception pursuant to P.U.C Proc. R. 22.5(b) to the 2016 filing requirements and annual report set forth in P.U.C. Subst. R (h). DISCUSSION P.U.C. Subst. R (h) requires that each registered power generation company, municipally owned utility, or electric cooperative (Generator) file information with the Commission needed to prepare an annual report on the fuel mix of new generation installed in the State after January 1, Capacity based on renewable energy is exempt from these reporting requirements.] The Commission maintains a database that tracks the installation of new power plants in Texas. This database compiles the type of information requested from the Generators in P.U.C. Subst. R , and the information is published on the Commission's website. According to this database, most of the new thermal generating capacity completed since January 1, 2000 was fueled by natural gas. As such, the marketplace is greatly exceeding the targets for gas-fired generation in Texas that are set forth in PURA and P.U.C. Subst. R (b) and (e). About 557 MW of coal and other non-renewable capacity may be added in the next five years ( ), and in that event the natural gas fuel mix would be 92.4 percent, which is still well above the target of 55 percent set forth in PURA. Accordingly, the Commission finds good cause to grant an exception to P.U.C. Subst. R (h)(1) and waive the requirement that Generators file information by February 14, 2016 ' P.U.C Subst. R (c)(1) ^ Public Utility Regulatory Act, Tex. Util. Code Ann (Vernon 1998 & Supp. 2003)(PURA). 0011
