1 1 A selection of requirements in legislation regarding POPs, including limit values Submitted by the German Delegation The following table is a compilation of limit values from different legislation in and outside Germany. The limit values have been set for different purposes: Wastes containing or contaminated with POPs in a concentration higher than the limit value given are considered as hazardous and have to be disposed of according to the respective legislation. For special cases of material recycling lower limit concentrations have been established (e.g. wood, oil). Above the limit values, sewage sludge may not be used as fertilizer. Limit values given for feeding stuffs, foodstuffs, and soil have been chosen in order to minimize the daily intake of POPs. Above these values detailed checking or measures have to be carried out (identify a source of contamination and to take measures for its reduction or elimination). Basel Convention, PCT, PBB, PCN to be characterized as hazardous according Annex VIII 50 mg/kg Stockholm Convention stockpiles to be disposed of according to Art. 6 of the Convention (cf. Annex A, Part II of the Convention) per cent (= 50 mg/kg) (depending on volume and time frame) Regulation No. 850/2004 (European Union) POPs stockpiles transposition of the Stockholm Convention pending Directive 96/59/EG (European Union), PCT, Monomethyl-dichlorodiphenyl methane, Monomethyldibromo-diphenyl methane equipment stockpiles to be disposed of according to the operations mentioned in the Directive per cent by weight (= 50 mg /kg)

5 5 Commission Recommendation 2002/201/EC on the reduction of the presence of dioxins, furans and s in feeding stuffs and foodstuffs dioxin-like feeding stuffs foodstuffs reduction/elimination of the POPcontent ng TEQ/kg (action level for different feeding stuffs) pg TEQ/g fat (action level for different foodstuffs) 0.4 ng TEQ/kg (action level for fruits, vegetables and cereals) 3 pg TEQ/g fresh weight (action level for muscle meat of fish and fishery products and products thereof) on the maximum permissible quantities of contaminants in foodstuffs (Schadstoff-Höchstmengenverordnung, foodstuffs to interdict the circulation of contaminated foodstuffs on a commercial basis Target levels will be set before 31 December mg /kg (dependent on the congener and the respective foodstuff) In order to reduce the bioaccumulation in the food chain as well the air transport of POP substances, there are several legislations in force, for example regulating concentration limits of hazardous substances in drinking water, feeding stuffs, and air, e.g.: Drinking Water (Trinkwasserverordnung, Germany; e.g. Aldrin, Dieldrin, Heptachlor) Council Directive 1999/29/EC of 22 April 1999 on the undesirable substances and products in animal nutrition (e.g. Aldrin, Dieldrin, Chlordane, DDT, Endrin, Heptachlor, Hexachlorobenzene) Council Directive 2001/102/EC of 27 November 2001 amending Directive 1999/29/EC on the undesirable substances and products in animal nutrition (Polychlorinated dioxins and furans, dioxin-like ) Directive 96/23/EC of 29 April 1996 on measures to monitor certain substances and residues thereof in live animals and animal products and repealing Directives 85/358/EEC and 86/469/EEC and Decisions 89/187/EEC and 91/664/EEC (organic chlorinated compounds, inclusively )
