17 Benefits of paint stewardship legislation for the Northeast 7.5 million gallons of paint go unused each year in the Northeast. The Northeast could gain a total financial benefit of over $60 million annually if all paint were to be managed through EPR. In addition, a paint stewardship law would result in: Reduced government/taxpayer cost. Green sector jobs. More recycling opportunities. Less disposal, more recycling. Less waste. 21 Why Paint 50% of household hazardous waste (HHW) products received by municipal HHW programs is paint Studies show that approximately 10% of purchased paint goes unused, remains leftover 70 millions gallons available for recycling in the U.S. annually (10% of annual sales) National dialogue seeking to find a solution to postconsumer paint management began in 2003 with participation from the American Coatings Association Dialogue led to drafting of the model, state-level, industry supported legislation that passed in California 21

23 About the Paint Stewardship Law Manufacturers selling paint into the state must operate paint management system for leftovers: Reduce the generation of postconsumer paint; promote reuse, and provide system for recycling and proper disposal Requires a plan to be approved by state environmental agency Requires convenient paint drop-off sites Requires environmentally responsible paint management Require goals for reuse, recycling and proper disposal Requires education and outreach
24 About the Paint Stewardship Law Requires an annual report to the state Total volume of paint collected by type Method of disposition (reuse, recycling, proper disposal) for all paint collected Independent financial audit Education and Outreach Reporting and Evaluation of program goals Requires annual fee to state agency for plan and annual report review and for oversight and enforcement
25 PaintCare Funding Financing through a per can assessment fee added to the product price of each container sold. Half pint or less: $ 0.00 More than half pint to 1 less than 1 gallon: $ gallon: $ 0.75 More than 1 gallon to 5 gallons: $ 1.60 Manufacturers pay the fees to PaintCare, on a monthly basis based on sales in the state and pass them through to distributors and retailers who add them to the final purchase price of new paint
26 Program Products Collect the following architectural coatings in 5 gallon containers or less: Interior and exterior architectural paints: latex, acrylic, water-based, alkyd, oil-based, enamel (all types of finishes and sheens, including textured coatings) Deck coatings, floor paints (including elastomeric) Primers, sealers, undercoaters Stains Shellacs, lacquers, varnishes, urethanes (single component) Waterproofing concrete/masonry/wood sealers and repellents (not tar or bitumen-based) Swimming pool paints (single component) Metal coatings, rust preventatives Field and lawn paints

29 Collection Site Requirements Clean storage area -- 1 yd 3 space for each bin Impermeable surface (concrete, asphalt, sealed wood floor, etc.) Storage area should not be accessible to the public this is not a self-serve program Away from: Ignition sources Storm or floor drains Preferably indoor or covered area, protected from temperature extremes If outdoors, cover with lid to keep out rain Maintain enough space around bins for emergency access and inspecting for leaks

43 OR Paint Retailer Comments The amount of paint that we have taken in is over the last two years is mind boggling. It is nice to know that it is being disposed of properly. Efforts should be made to make it easy for people to get rid of other items that contaminate our ground water, etc. like aerosol paints & solvents. People assume that we can take these things as well. Being in a rural area it is difficult to properly deal with this kind of waste. Paint Care has made this process absolutely painless. We had a huge turnout for such a small community when we first started and it's amazing how many people are still bringing old paint in. It should be permanent so that buildup of old paint does not happen!!! It just begs for mishandling of paint without this program Product Stewardship Institute,
44 OR Paint Retailer Comments Continued It's a great program! We get more foot traffic in our store (which is sorely need these days) and our customers (as well as, potential new customers) feel great about recycling their old paint in turn helping our environment. Customers do not mind the fee when they purchase, but if they had to pay to recycle I think most would just dump it. This program needs to be at every location if it is to be permanent. I also feel that it should be an item line on the invoice, because many people say "I am not being charged that fee at other stores when we buy paint". Product Stewardship Institute,
