You will also be aware of the discussions that have taken place between the F A and the Agency with regard to the submission of this information. In these circumstances, I am to inform you that the Agency is now writing to all applicants informing them of the information required fiom applicants, who wish to carry out landspreading as a means of recovery of slunylmanure generated fiom their installation. You are required to comply with Sections 1, 2, 3 and Attachments 1, 2 and 3 of the attached document in relation to the submission of information to the Agency for approval, the preparation of a Nutrient Management Plan 0) and information to be retained on site. The requirements of this notification should be complied with by no later than Friday 27th July I am also to point out that should you fail to comply with the requirements of this notification, the Agency will be left with no option but to reject your application, consider it withdrawn or refuse the application, as appropriate. 3 IWORMATION REQUIRED IN A NUTRIENT MANAGEMENT PLAN (NMP) PREPARED UNDER THE REQUIREMENTS OF AN IPC/IPPC LICENCE OR LICENCE APPLICATION (1) Information to be submitted to the Agency I a) Nutrient Management Plans shall be prepared according to Section (3) below, using the format in Attachment 1 as a template for individual farms. The NMP including map(s) must be submitted to the Agency for approval under the relevant condition of the licence, or as part of the IPPC application process. This information will be assessed by the Agency and may be returned to the licensee/ applicant following such assessment. If the licensee/applicant wants the NMP to be returned to them, it shall be submitted in a standalone envelope with a cover letter stating that the information is provided in order to demonstrate adequate capacity for slurry recovery and that it shall be returned to the site once the assessment is completed. The following items must be submitted to the Agency and will be put on public file. b) Sign-off by a suitably qualified person (agricultural science graduate or other suitably qualified professional) using the template specified in Attachment 3; c) Summary table or customer list using the template specified in Attachment 2 containing Farmer Reference Code, county and townland(s) where slurry/manure may be spread, and total amount of slurry/manure that may be spread per farm (extracted from Nutrient Management Plan/ Fertiliser Plan); d) Total amount of slurry/manure to be produced at the licensed facility per year; e) Total amount of slunylmanure that may be applied to lands within the Nutrient Management Plan/ Fertiliser Plan; f) N and P content of slunylmanure produced by the licensed site. This section also applies to any proposed additional lands to be added to the Customer List during 2007 by an existing licensee. (2) Information to be retained on-site The licensee/applicant shall retain all the information specified in this document on-site for inspection by the Agency or by any other authorised person or member of the public. The licensee/applicant shall also keep on-site maps to a scale of 1:10,560 identifying each parcel of farmland included in the NMP, and the buffer zones applicable under the licence Schedule for existing licences, or under S.I. 378 for licence applicants. These maps shall be available for inspection by the Agency or by any other authorised person or member of the public.

4 (3) Preparation of an NMP a) Nutrient Management Plans shall be prepared using up to date S.I. 378/Teagasc/REPS fertiliser application rates, and the licensee must specify which is used. The NMP must show the farmer s name and address, agronomic requirement of each parcel of farmland for nutrients, the amount of pig slurry that may be applied to satisfy these requirements, together with the total amount of nutrients and the total amount of pig slurry supplied from the licensed site. Attachment 1 shows the Table 1 lb(ii) for NMP calculations, which shall be used as a format for each farm. All sections of the Table shall be completed with the information as specified. b) Map(s) to a scale of 1:50,000 shall be included, identifying each parcel of farmland included in the NMP prepared under point 3(a) above. c) Soil P tests shall be completed every three years and the results shall be used to verify the fertiliser requirements in the Plan, as required under existing licences. P Index 3 may be assumed for new lands in the first season of their proposal for use by an IPPC applicant or for additional lands proposed by an existing licensee. d) Lands shall be assessed for suitability and unsuitable lands excluded based on the following. 0) Conditions of an individual IPUIPPC licence; (ii) The provisions of the European Communities (Good Agricultural Practice for Protection of Waters) Regulations, 2006 (S. I. No. 378 of 2006); (iii) Land that is subject to any restriction by virtue of its inclusion in a designated area, e.g. NHA, SAC or Protection Zone for a public water supply. Check with the Heritage Section of the Department of Environment, Heritage & Local Government, and/or the Local Authority, as relevant, for designated sites/protection zones within the spreadlands; Sand or gravel soil/subsoil, or shallow limestone soils. Regard shall be had in the preparation of this section to Geological Survey of Ireland publications (e.g. Groundwater Protection Schemes), to Teagasc records and publications on soil types, and to the Agency s guidance on landspreading of organic wastes. Persons signing the assessment form specified in Attachment 3 of this document must be able to demonstrate that the lands submitted have been appropriately checked against available data. In particular they must walk the land and mark the specified features on a map(s). Copies of the map(s) with all the buffer zones and excluded areas marked in shall be maintained on-site for inspection and shall be provided to the person spreading the manure/nutrients so that they are aware of any such restrictions.

In my professional opinion, animal manures/nutrients may be used to fertilise any of those farmlands, and the application of pig manurehutrients from the licensable site to any of those lands in a quantity identified in the Fertiliser Plan and manner that complies with the requirements of the Code of Practice and Buffer Zones of IPC licence Reg. No. POXXX-XX, and European Communities (Good Agricultural Practice for Protection of Waters) Regulations, 2006 (S. I.
