3 1. Introduction The Department of Toxic Substances Control (DTSC) has prepared this Statement of Basis presenting the proposed final remedy to complete corrective action at the former Xerox Teller Avenue Parcel, located at Jamboree Boulevard in the city of Irvine, California. This document presents a description of the proposed final remedy and the basis for the selection. DTSC invites the public to comment on the proposed final remedy. The proposed final remedy consists of the removal of contaminated soil and institutional controls (limiting the site to commercial/industrial use through the recording of a land use covenant). If approved, the proposed final remedy will cleanup the site for the protection of human health and the environment and allows redevelopment and reuse of the property for commercial industrial uses. No residential, day care, hospitals, nursing homes, or schools are permitted with out prior approval of DTSC. After remediation of the site is completed, the property is proposed to be redeveloped into a multi-story building(s). DTSC is issuing this Statement of Basis as part of its public participation responsibilities pursuant to the California Health and Safety Code, Chapter 6.5, Hazardous Waste Control. This Statement of Basis summarizes information presented in greater detail in the Corrective Measures Study (CMS) dated July 12, 2012, updated on August 1, 2013, and other documents contained in the administrative record available for review at the information repository located at DTSC s Chatsworth Regional Office located at 9211 Oakdale Avenue, Chatsworth, California and online at DTSC s web page at DTSC encourages the public to review these documents in order to gain a more comprehensive understanding of the facility and proposed corrective action activities that have been conducted and are being proposed. Attachment A presents a list of documents available for review at the reference desk at the University Park Library located at 4512 Sandburg Way, Irvine, California 92612, and the DTSC file room located at 9211 Oakdale Avenue, Chatsworth, California Proposed Remedy The proposed remedy based on the removal/remedial action screening process is: Address contaminated soil through an excavation clean-up. Approximately 8,100 cubic yards of soil, which includes clean overburden soil as well as contaminated soil, will be excavated. Approximately 3,300 cubic yards of contaminated soil will be excavated from five impacted areas and disposed of off-site at a state permitted facility.
4 The proposed final remedy also consists of recording a Land Use Covenant (LUC) to restrict current and future use of the property to commercial/industrial uses. The LUC will be signed by DTSC and the current owners of the properties and recorded with the Office of the County Recorder. The LUC will run with the land limiting current and future owners and operators of the site to only commercial/industrial land uses. The LUC will also prohibit sensitive site uses such as residential, hospitals, school, and child care facilities. 3. Project Background Xerox formerly occupied this site from the early 1970s until December The facility is a rectangular property of approximately 7.0 acres located at Jamboree Boulevard. This facility was used as a refurbishing center for office equipment until The refurbishing process included use of a variety of chemicals. Xerox ended its refurbishing and warehousing operations at the Site in December The Jamboree facility was then leased and occupied by Mallinckrodt Medical, Inc., from 1994 until 2003, upon which it was vacated. The Jamboree facility then remained unoccupied until it was demolished between March and July of 2007 for future redevelopment. The property is now owned by General Investment Funds Real Estate Holding Company who, as property owner, will be included in this Corrective Action process. The chemicals of potential concern (COPCs) include chlorinated solvents and volatile organic compounds such as tetrachloroethylene (PCE), trichloroethene (TCE), 1,1- dichloroethane (1,1-DCA), 1,1-dichloroethene (1,1-DCE), 1,1,1-trichloroethane (1,1,1- TCA) and cis-1,2-dichloroethene (cis-1,2-dce) and metals such as arsenic. 4. Summary of Facility Investigations Initial site soil and groundwater investigations began in Soil and groundwater remediation began in 1987 using soil vapor extraction, groundwater extraction, high vacuum remediation, and excavation. In December 1993, the on-site groundwater remediation systems were removed from the Site, in accordance with a Santa Ana Regional Water Quality Control Board approval for Site closure. At the request of the DTSC, a RFI was conducted between January and March Despite extensive past remedial efforts employed at the Site and on the neighboring Teller Ave. parcel at different times over the past 20+ years (pump and treat, soil vapor extraction, dual phase vapor extraction, and excavation) the results of the RFI indicate residual chemicals remain in soil, groundwater, and/or soil vapor at concentrations which, based upon the Baseline Health Risk Assessment and certain hypothetical exposure scenarios, may pose a potential health risk to construction workers or future occupants if they were exposed.
5 The adjacent warehouse located at Teller Avenue was also used by Xerox for refurbishing and warehousing activities. However, because of site development schedules, the Teller Avenue facility is not part of this project. It has been addressed previously. 5. Summary of Remedial Alternatives Eight remedial alternatives were evaluated in the CMS. The eight alternatives for this were: Based primarily on their effectiveness of protecting groundwater, human health, the environment, ability to implement, and over all cost: Alternative 1 No Action (included by law as a baseline and for comparison purposes) Alternative 2 Localized Shallow Soil Excavation Alternative 3 In-situ Zero Valent Iron Reduction via Soil Mixing Alternative 4 Electrical Resistive Heating Alternative 5 Permeable Reactive Barrier Alternative 6 Large Scale Excavation Alternative 7 Multi-Phase Extraction Alternative 8 Deed Restriction with Land Use Covenant
6 6. Evaluation of Proposed Remedy and Alternatives Each remediation alternative was evaluated using nine thresholds and balancing criteria. Table IV of the CMS presents each alternative and the criteria used to evaluate each alternative. 7. Recommendation for Final Remedy The proposed remedy must protect groundwater resources, human health, the environment, and be available for review to the community. The Study proposes the most suitable corrective measure for the Site based upon these factors is a combination of Alternatives 6 and 8. Alternative 6 will provide excavation and offsite disposal of the contaminated soil and backfill of excavation with clean fill. Alternative 8 will implement a LUC to limit current and future land use to commercial/industrial uses. The LUC will prohibit against residential, hospital, daycare and schools. 8. Public Participation The DTSC is soliciting comments from the public on the proposed final remedy presented in the CMS. A public notice in English will appear in the Orange County Register. DTSC has scheduled a 30-day public comment period from May 29, 2014 to June 27, 2014 to encourage public participation in the decision process. 9 Attachment B T E R M I N O L O G Y Administrative Record - The documents and information that are considered or relied upon to make a remedy selection decision for a site. These documents are available for public inspection usually at the nearest public library to the site and the DTSC=s office. California Environmental Protection Agency, Department of Toxic Substances Control (DTSC) -The state agency which is responsible for regulating hazardous waste in California. DTSC has the authority to enforce federal and state hazardous waste regulations. Chemicals of Potential Concern - Chemicals associated with releases from the site, which are of potential concern due to their current or future potential effects on human health or the environment. Corrective Action - Action to be taken to investigate and cleanup contaminated releases from hazardous waste treatment, storage, and disposal facilities. Corrective Measures Study (CMS) - A study to address the elevated levels of contamination detected at the site, submitted by the facility owner/operator. Baseline Health Risk Assessment - A qualitative and /or qualitative appraisal of the actual or potential health risk from contamination. Institutional Controls - Non-engineered controls (such as land used covenants) that help to minimize the potential for human exposure to contamination and/or protect the integrity of a remedy. Land Use Covenant (LUC) - A land use restriction. Statement of Basis - Document explaining how and why the proposed remedy was selected. Volatile Organic Compound (VOC) - Any organic compound which vaporizes and reacts with the atmosphere.
