(Part-1 off line cases) Item No : Confirmation of the minutes of 103 rd meeting of SEIAA held on The SEIAA noted that the proceedings of 103 rd meeting of SEIAA held on , were circulated to all concerned vide letter no dated No observation has been received from any of the members. As such, SEIAA confirmed proceedings of the said meeting. Item No : Action taken on the proceedings of 100 th, 101 st, 102 nd & 103 rd meetings of SEIAA held on , , & , respectively. It was seen by the SEIAA. Item No : Legal Notice regarding review/reconsideration of environmental clearance granted by State Level Environment Impact Assessment Authority, Punjab for setting up existing dumping site called Integrated Municipal Solid Waste Management Facility at Bhagtan Wala, under Municipal Corporation, Amritsar by Sh. H.C. Arora, Advocate on behalf of Sanjhi Sangharsh Committee, Kot Nangal Singh, Tarn Taran Road, Amritsar. The matter was considered by the SEIAA in its 104 th meeting held on and observed that the draft reply sent by SEAC needs more thrashing and requires greater deliberations and consultations for which more time is required. As such, the SEIAA decided to defer the matter. 1

2 Item no : Application for obtaining Environmental Clearance under EIA notification dated for construction of Group Housing Project namely "Sushma Chandigarh Grande Ext. Gazipur, Zirakpur by M/s SBL Builders Private Ltd. The SEIAA observed that: M/s SBL Builders Private Ltd has applied for obtaining Environmental Clearance under EIA notification dated for the construction of the a group housing project namely Sushma Chandigarh Grande Ext." in the revenue estate of the Village Gazipur, Zirakpur, Distt. S.A.S. Nagar (Punjab) on Form 1 and 1A and other documents. The project is covered under category 8 (a) of the Schedule appended to the said notification. The details of the project as given in Form 1 and 1A and other documents are as under: i. The total land area of the project is 124,03.85 sqm and total built up area of the ii. iii. iv. project will be about 35,007 sqm. The total estimated population of the project is 1200 person. Total water requirement for the project will be 162 KLD, out of which 120 KLD of water will be met from groundwater with the help of a bore well and remaining 42 KLD will be met from treated wastewater. The total wastewater generation from the project will be 130 KLD, which will be treated in the STP of capacity 150 KLD to be installed within the project premises. The project proponent has proposed to use 42 KLD of treated wastewater for flushing purpose, 12 KLD for irrigation of green area and remaining 76 KLD will be discharged into sewer during summer season. In winter season, 42 KLD of treated wastewater will be used for flushing purpose, 03 KLD for irrigation of green area and remaining 85 KLD will be discharged into sewer. In rainy season, 42 KLD of treated wastewater for flushing purpose and remaining 88 KLD will be discharged into sewer. v. The project proponent has proposed to provide rain water harvesting wells for vi. vii. recharging of 1725 m 3 /annum of rainwater. The total quantity of solid waste to be generated from the proposed project has been estimated as 480 kg/day, which will be collected separately as Biodegradable and Non-biodegradable waste as per Municipal Solid Waste (Management & Handling) Rules, The biodegradable waste would be sent to the disposal site of MC. The total load of electricity required for proposed project will be 1400 KW, which will be supplied by PSPCL. The project proponent has proposed to provide DG sets for backup power supply. 2

3 (ii) Earlier, the Environmental Engineer, Punjab Pollution Control Board, Regional Office, Mohali was requested vide this office letter no dated to visit the project site and submit report regarding latest construction status. Accordingly, the Environmental Engineer, Regional Office, Mohali vide letter no. 12 dated informed that the site of the subject cited project was visited by the AEE of this office on and Sh. Arvinderjeet Singh, Manager of the promoter company was contacted. The site as shown by the representative of the promoter company falls in the revenue estate of Village Gazipur. On the front side of project across the road, a residential project namely Alpine Residency exists. On the left side of the project, if view from the front side, there exists agriculture land. On the backside and the right side of the project site, there exists a residential colony namely Vishranti city. As such, no construction of the main project has been started on the site, however, the boundary wall has been constructed. Further, the project proponent has submitted a copy of the acknowledgement of the application submitted in the Deptt. of Forest and Wildlife Preservation, Punjab for obtaining the Wildlife clearance for housing project located in the revenue estate of village Gazipur, Tehsil. Zirakpur, Distt. Mohali. The case was considered by the SEAC in its 140 th meeting held on , which was attended by the following on behalf of project proponent: (i) Sh. Arvinderjit Singh, Senior Manager, of the promoter company Sh. Deepak Gupta of M/s Jalvayu Consultants, Environmental Consultant of the promoter company The SEAC observed that application for forest clearance has been submitted to Chief Wildlife Warden, Punjab whereas the wildlife sanctuary falls in Haryana. Thus, the project proponent is required to file an application with the Chief Wildlife Warden, Haryana and submit a copy of acknowlegdement alongwith set of application to the SEAC. After discussion, SEAC decided to defer the case till the project proponent submits the aforesaid documents. Now the project proponent has submitted a copy of acknowledgement alongwith set of application filed before Chief Wildlife Warden, Punchkula, Haryana for obtaining wildlife clearance from NBWL. 3

4 The case was considered by the SEAC in its 141 st meeting held on , which was attended by the following on behalf of project proponent: (i) (ii) Sh. Arvinderjit Singh, Senior Manager, of the promoter company Sh. Deepak Gupta of M/s Jalvayu Consultants, Environmental Consultant of the promoter company Sh. Deepak Gupta Environmental Consultant of the project proponent presented the salient features of the project as under: o The total land area of the project is 124,03.85 sqm and the total built up area is sqm. The project proponent submitted self declaration from the owner of the land to the effect that site falls within municipal limits and in residential Zone of proposals of Master Plan and as per instructions issued by the Local Self Govt. vide Memo dated , the CLU is not required. Further, the project proponent submitted the copy of the location plan marked on the revised road network of the master plan Zirakpur. o Total water requirement for the project will be 162 KLD, out of which 120 KLD of water will be met from groundwater with the help of a bore well and remaining 42 KLD will be met from treated wastewater. o The total wastewater generation from the project will be 130 KLD, which will be treated in the STP of capacity 150 KLD to be installed within the project premises. The project proponent has proposed to use 42 KLD of treated wastewater for flushing purpose, 12 KLD for irrigation of green area and remaining 76 KLD will be discharged into sewer during summer season. In winter season, 42 KLD of treated wastewater will be used for flushing purpose, 03 KLD for irrigation of green area and remaining 85 KLD will be discharged into sewer. In rainy season, 42 KLD of treated wastewater for flushing purpose and remaining 88 KLD will be discharged into sewer. The MC, Zirakpur vide the letter no dated issued NOC to the project proponent to the effect that the treated wastewater of the proposed project of quantity 110 KLD can be discharged into sewer after depositing requisite charges o Green area (2117 sq. mtr. ) will be developed to utilize treated domestic of quantity 12 KLD and the remaining excess water will be discharged into MC sewer. o The total quantity of solid waste to be generated from the proposed project has been estimated as 480 kg/day, which will be collected separately as Bio-degradable and Non-biodegradable waste as per Municipal Solid Waste (Management & Handling) Rules, The biodegradable waste would be sent to the disposal site of MC. 4

5 o The MC, Zirakpur vide letter no dated has issued NOC to the project proponent to the effect that M.C. will collect and dispose off MSW after deposition of requisite charges by the project proponent. o The total load of electricity required for proposed project will be 1400 KW, which will be supplied by PSPCL. The project proponent has proposed to provide DG sets for backup power supply o The e-waste generated will be stored in an isolated room and will be sold to the manufacturers. o Used oil to be generated from the DG sets will be managed & handled as per the provisions of the Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, o The project proponent has proposed to provide rain water harvesting wells for recharging of 1725 m 3 /annum of rainwater o The ambient air monitoring has been got done from M/s Chandigarh Pollution Testing Laboratory and the analysis results indicate that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2 and CO have been measured. Also, ambient noise monitoring has been got done from the said firm and the analysis results indicate that the noise levels during day and night times, have been measured 49.4 db(a) leq and 40.5 db(a) against the prescribed standards of 55 and 45 db(a). The analysis report of groundwater has also been submitted. o The General Manager (Projects) of the company will be responsible for implementation of EMP till the project is handed over to Association/M.C. Approx. capital cost of Rs.17.5 lacs will be incurred for implementation of EMP during construction phase and Rs.8.00 lacs/annum will be incurred as recurring cost during construction phase. Approx. capital cost of Rs.49.0 lacs will be incurred for implementation of EMP during operational phase and Rs.10.0 lacs/annum will be incurred as recurring cost during operational phase. o Rs lacs will be utilized for following activities under Corporate Social Responsibility and implementation of the CSR will be responsibility of Director of the company. 1. The management will give preference in job to people of nearby area. 2. Widening of road in the vicinity of the project. 3. Environment Awareness camps in 10 kms area. 4. Parks of M.C. Zirakpur will be maintained. 5. Toilets for girls in the nearby schools After presentation, following are the observation raised by SEAC and reply given by the project proponent :- 5

Planning of buildings has been done to make maximum use of natural light and cross ventilation. The Project Proponent has submitted that total quantity of solid waste to be generated from the proposed project has been estimated as 480 kg/day, which will be collected separately as Bio-degradable and Non-biodegradable waste as per Municipal Solid Waste (Management & Handling) Rules, The biodegradable waste would be sent to the disposal site of MC. The Non-Biodegradable and recycleable waste would be sold to authrorised recyclers. Segregation collection at its source. Chute will be provieded. Two rehries will be provided by the contractors for disposal at approved site. 5 Soil Monitoring report not submitted The project proponent submitted the soil monitoring report. 6. The Committee further observed that the project proponent has otherwise provided adequate and satisfactory clarifications to the observations raised by it. Therefore, the Committee awarded 'Silver Grading' to the project proposal and decided that case be forwarded to the SEIAA with the recommendation to grant environmental clearance to the project proponent, for construction of group Housing Project namely "Sushma Chandigarh Grande Ext." in a total area of 124,03.85 sqm having total built up area of sqm in the revenue estate of the Village Gazipur, Zirakpur, Distt. S.A.S. Nagar (Punjab), subject to the following conditions in addition to the proposed measures: PART A Specific Conditions: I. Pre-Construction Phase II. (i) (ii) (iii) (iv) (v) (vi) (i) Consent to establish shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase. A first aid room will be provided in the project both during construction and operation phase of the project. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, Construction Phase: All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site. 7

8 (ii) (iii) (iv) (v) (vi) (vii) Disposal of muck during construction phase should not create any adverse effect on the neighbouring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the groundwater. Construction/provision of the STP, tubewell, DG Sets, Utilities etc, earmarked by the project proponent on the layout plan, should be made in the earmarked area only. In any case the position/location of these utilities should not be changed later-on Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. The project proponent shall use only treated sewage/wastewater for construction activities and no fresh water for this purpose will be used. The project proponent shall treat sewage with UV/Ozonator technology prior to use in construction activities. (viii) Fly ash based construction material shall be used in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 and notification No. S.O (E) dated (ix) (x) (xi) (xii) Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices. Ready mixed concrete should be used in building construction as far as possible. The project proponent shall adopt dual plumbing system for reuse of treated wastewater for flushing system & HVAC etc. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code. (xiii) The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning. (xiv) The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards. (xv) The project proponent will provide dual plumbing system for reuse of treated wastewater for flushing/ HVAC purposes etc. and colour coding of different pipe lines carrying water/wastewater/ treated wastewater as follows: 8

9 a. Fresh water: : Blue b. Untreated wastewater: Black c. Treated wastewater : Green (for reuse) d. Treated wastewater : Yellow (for discharge) e. Storm water: Orange (xvi) The installation of sewage treatment plant (STP) and adequacy of disposal system should be certified by Punjab Pollution Control Board and a report in this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. (xvii) The solid waste generated should be properly collected and proper onsite storage facility (covered) should be provided at site. III. Operation Phase and Entire Life i) Consent to operate shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority at the time of start of operation. ii) The total water requirement for the project will be 162KL/day, out of which 120 KL/day shall be met through own tubewell and remaining 42 KL/day through recycling of treated wastewater. iii) The total wastewater generation from the project will be 130 KL/day (163 KLD during rainy season), which will be treated in a STP of capacity 175 KL/day to be installed within the project premises. As proposed, 42 KL/day of treated wastewater shall be used for flushing purpose, 12 KL/day for irrigation of green area and remaining 76 KL/day shall be discharged into sewer in summer season. In winter season, 42 KL/day of treated wastewater will be used for flushing purpose, 03 KL/day for irrigation of green area and remaining 85 KL/day will be discharged into sewer. In rainy season, 75 KL/day of treated wastewater will be used for flushing purpose and remaining 88 KL/day will be discharged into sewer. iv) The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for reusing the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis. v) The position / location of the STP, tubewell, DG Sets, Utilities etc, installed by the project proponent as per the provisions made in the layout plan, should not be changed later-on under any circumstances. vi) Rainwater harvesting for rooftop run-off only should be implemented. Before recharging the rooftop run-off, pretreatment must be done to remove suspended matter, oil and grease. 9

10 vii) viii) ix) Chute system shall be provided for the collection of solid waste as proposed by the project proponent. The collected solid waste should be segregated at site. After segregation, the biodegradeable waste will be composted using mechanical composter. The recyclable solid waste shall be sold out to the authorized vendors and remaining organic as well as inert waste shall be sent to the concerned collection centre of integrated municipal solid waste management facility of the area. Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the complex. Hazardous waste/e-waste should be disposed off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board. x) Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored. xi) xii) xiii) xiv) xv) xvi) xvii) Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized. The project proponent shall obtain completion and occupancy certificate from the Competent Authority and submit a copy of the same to the SEIAA, Punjab. Adequate treatment facility for drinking water shall be provided, if required. The green belt along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/variety. The project proponent should take adequate and appropriate measures to contain the ambient air quality within the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forests/ State Level Environment Impact Assessment Authority within three months. Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating. A report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about machinery of air conditioning, lifts, lighting, building materials, R & U Factors etc. and submitted to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA in three months time. xviii) Environmental Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project. xix) xx) Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase. Separation of drinking water supply and treated sewage supply should be done by the use of different colors. 10

11 xxi) Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control. PART B General Conditions : I. Pre-Construction Phase i) This environmental clearance will be valid for a period of five years from the date of its issue or till the completion of the project, whichever is earlier. ii) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit. iii) iv) All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, by project proponents from the competent authorities including Punjab Pollution Control Board and from other statutory bodies as applicable. The project proponent shall also obtain permission from the NBWL, if applicable. The project proponent should advertise in at least two local newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded environmental clearance and copies of clearance letters are available with the Punjab Pollution Control Board. The advertisement should be made within seven days from the day of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office, Ministry of Environment & Forests, Chandigarh and SEIAA, Punjab. v) These stipulations would be enforced among others under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environmental (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification, vi) vii) viii) ix) The project proponent shall obtain permission from the CGWA for abstraction of groundwater & digging of borewell(s) and shall not abstract any groundwater without prior written permission of the CGWA, even if any borewell(s) exist at site. The project proponent shall obtain CLU from the competent authority, if any authority insists. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the local NGO, if any, from whom suggestions / representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent. The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. 11

Construction Phase i) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit. ii) iii) iv) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB, the SPCB and SEIAA, Punjab. Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh and State Level Environment Impact Assessment Authority, Punjab. v) In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by State Environment Impact Assessment Authority, Punjab. vi) vii) viii) ix) Separate distribution pipelines be laid down for use of treated effluent / raw water for horticultural/gardening purposes with different colour coding. The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility and shall spend minimum amount of Rs.05 Lacs as proposed in addition to the amount to be spent under the provisions of the Companies Act The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. Separation of drinking water supply and treated sewage supply should be done by the use of dual plumbing line. III. Operation Phase and Entire Life i) Environmental clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. 13 ii) iii) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board. The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB, the SPCB and SEIAA, Punjab. iv) Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh and State Level Environment Impact Assessment Authority, Punjab. v) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levels namely; PM 2.5, PM 10, SO 2, NO x, CO, Pb, Ozone (ambient air as well as stack emissions) shall be monitored and displayed at a convenient location near the main gate of the company in the public domain. vi) The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility and shall spend minimum amount of Rs.05 Lacs as proposed in addition to the amount to be spent under the provisions of the Companies Act vii) The State Environment Impact Assessment Authority, Punjab reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner. The case was considered by the SEIAA in its 104 th meeting held on , which was attended by the following on behalf of project proponent: (i) (ii) Sh. Arvinderjit Singh, Senior Manager, of the promoter company Sh. Deepak Gupta of M/s Jalvayu Consultants, Environmental Consultant of the promoter company 13

14 Sh. Deepak Gupta Environmental Consultant of the project proponent presented the salient features of the project before the SEIAA and he requested for grant of environmental clearance. To a querry of SEIAA regarding requirement of submission of noise monitoring report from all the corners of the project, the project proponent submitted a copy of noise monitoring report & field data sheet dated from M/s Chandigarh Pollution Testing Laboratory, Mohali. As per the report the noise monitoring from four sides i.e. East, West, North & South has been carried out on and noise levels are in the range of dba during day time and dba during night time against the permissible levels of 55 dba and 45 dba, respectively. To another querry of SEIAA regarding water consumption requirement worked out by considering 135 lpcd of water in the area surrounding Chandigarh, the project proponent submitted revised water balance statement taking 200 lpcd water consumption. As per revised water balance statement, total water requirement for the project will be 240 KLD, out of which 198 KLD of water will be met from groundwater with the help of a bore well and remaining 42 KLD will be met from treated wastewater. The total wastewater generation from the project will be 192 KLD, which will be treated in the STP of capacity 200 KLD to be installed within the project premises. The project proponent has proposed to use 42 KLD of treated wastewater for flushing purpose, 12 KLD for irrigation of green area and out of remaining 138 KLD only 110 KLD will be discharged into sewer and rest of the wastewater will be used for construction purposes or supplied to the contractors for construction purposes during summer season. In winter season, 42 KLD of treated wastewater will be used for flushing purpose, 03 KLD for irrigation of green area and out of remaining 147 KLD, only 110 KLD will be discharged into sewer and rest of the wastewater will be used for construction purposes or supplied to the contractors for construction purposes. In rainy season, 42 KLD of treated wastewater for flushing purpose and out of remaining 150 KLD, only 110 KLD will be discharged into sewer and rest of the wastewater will be used for construction purposes or supplied to the contractors for construction purposes. During discussions, representative of the promoter company agreed to comply with fully all the conditions as mentioned by SEAC. The SEIAA observed that the case stands recommended by SEAC and the Committee awarded Silver Grading to the project proposal. The SEIAA looked into the details of the case and was satisfied with the same. Therefore, the 14

15 Authority decided to accept the recommendations of SEAC and grant environmental clearance to the project, subject to the conditions as proposed by the SEAC in addition to the proposed measures, to amend 'Specific Conditions' No. (ii) & (iii) of 'Operation Phase & Entire life and to impose an additional Condition No. (xviii) of 'Specific Conditions' of "Construction Phase" as under: Amended Conditon No. (ii) of 'Operation Phase & Entire life The total water requirement for the project will be 240 KLD, out of which 198 KLD of water will be met from groundwater with the help of a bore well and remaining 42 KLD will be met from treated wastewater. Amended Conditon No. (iii) of 'Operation Phase & Entire life The total wastewater generation from the project will be 192 KLD, which will be treated in the STP of capacity 200 KLD to be installed within the project premises. The project proponent has proposed to use 42 KLD of treated wastewater for flushing purpose, 12 KLD for irrigation of green area and out of remaining 138 KLD only 110 KLD will be discharged into sewer and rest of the wastewater will be used for construction purposes or supplied to the contractors for construction purposes during summer season. Additional condition No. (xviii) of 'Specific Conditions' of "Construction Phase" The project proponent will provide storage tank of adequate capacity for storage of wasteweater and efforts shall be made to supply the treated wastewater for use in construction activity to the extent possible and only left out wastewater shall be discharged into sewer. Item no : Application for obtaining Environmental Clearance under EIA notification dated for construction of Commerical Building namely Prime Business Park at NH-1 (Ludhiana-Delhi) Road, Near Apollo Hospital, Sherpur Chowk at G.T. Road, Ludhiana by M/s Angad Estates Pvt. Ltd. The SEIAA observed that: M/s Angad Estates Pvt. Ltd has applied for obtaining the Environmental Clearance under EIA notification dated for construction of Commerical Building namely Prime Business Park at NH-1 (Ludhiana-Delhi) 15

16 Road, Near Apollo Hospital, Sherpur Chowk at G.T. Road, Ludhiana. The project is covered under category 8 (a) of the Schedule appended to the said notification. The details of the project as given in Form 1 and 1A and other documents are as under: o The total plot area of the project is 2.05 acres ( sqm) and the total built up area will be sqm consisting of 121 no. of shops, 38 no. of offices, 107 no. of Services apartments and a Restaurant. o The cost of the project is Rs crores. o The total water requirement for the project will be 215 KL/day, out of which 205 KL/day will be met through MC supply and remaining 10 KL/day will be met through recycling of treated wastewater. o The total wastewater generation from the project will be 200 KL/day, which will be treated in a STP to be installed within the project premises. The project proponent has proposed to use 10 KL/day of treated wastewater for flushing purpose, 13 KL/day will be used for irrigation of green area and remaining 146 KL/day will be discharged into M.C. sewer in summer season. In winter season, 10 KL/day of treated wastewater will be used for flushing purpose, 04 KL/day will be used for irrigation of green area and remaining 155 KL/day will be discharged into M.C. sewer. In rainy season, 10 KL/day of treated wastewater will be used for flushing purpose, 1 KLD will be used fore irrigation of green area and remaining 158 KL/day will be discharged into M.C. sewer. o The total green area to be developed will be 2405 sqm. o The total quantity of solid waste generation will be 850 kg/day, which will be segregated at source as biodegradable and non-biodegradable components as per the Municipal Solid Waste (Management & Handling) Rules, The biodegradable waste will be converted into manure using Biodegradable Municiple Wast Management system which will convert the waste into compost. The inert waste will be dumped to MC dumping site. o The total load of electricity required for group housing will be 2634 KW which will be taken from the PSPCL. There is a proposal to install DG sets for stand-by arrangement. o The e-waste generated will be stored in an isolated room and will be sold to the manufacturers. 16

17 o Used oil to be generated from the DG sets will be managed & handled as per the provisions of the Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, Regional Office-2, Punjab Pollution Control Board, Ludhiana vide e- mail dated was requested to visit the project site and submit report regarding latest construction status. Environmental Engineer, Regional Office-2, Ludhiana vide letter no dated has intimated that the site was visited by AEE of this office on and observed that the proposed site is situated at Sherpur Chowk, Ludhiana near Apollo Hospital. The project proponent has constructed 02 no. basement floors for parking purpose in which only slab has been laid, but no finishing work done. The project proponent has not constructed boundary wall of the site. Presently, no activity is going on at site. The physical appearance shows that the project is in abandoned condition since long. The case was considered by the SEAC in its 124 th meeting held on , which was attended by the following on behalf of the project proponent: i) Sh. Charanjit Singh, Director of the Promoter Company. ii) Sh. Sandeep Garg of M/s Eco Laboratories & Consultants Pvt. Ltd., Mohali Environmental Consultant of the promoter company. Sh. Sandeep Garg informed that the project falls within the municipal limits of Ludhiana. Regarding construction already done at site, project proponent clarified that earlier in the year 2007, the project was a joint venture with M/s JMD Ltd and was having area less than 20,000 sqm. Layout map of the old project was approved by the Competent Authority and submitted a copy of the same which was taken on record. Now, the project has been revised with built up area as sqm and M/s JMD has opted out of joint venture. The SEAC observed that: (i) The area within the municipal limits of Ludhiana has been declared as Critically Polluted Area (CPA) by the Ministry of Environment & Forests. It is not clear whether the proposed site of the project falls in the critically polluted area of Ludhiana or not. 17

18 (ii) The project proponent has not submitted sanction letter vide which the old building plans have been approved by the M.C., Ludhiana. After discussions, the SEAC decided to ask (i) The project proponent to seek a clarification from the Punjab Pollution Control Board as to whether the site of the project falls in Critically Polluted Area (CPA) declared by the Ministry of Environment & Forests because if it is so, then the case will have to be decided by the Ministry of Environment, Forests & Climate Change. (ii) Submit a copy of sanction letter vide which the old building plans were approved by the M.C., Ludhiana. The SEAC further decided to defer the case till the project proponent submits the above noted documents. Now the project proponent vide letter date d received on has submitted reply to the observations of the SEAC as under: 1. Submitted a copy of letter no dated issued by Zonal Office-I, Punjab Pollution Control Board, Ludhiana intimating that Industrial Area-B in the pocket from Sherpur Chownk to Gill Road to Malerkotla road (left side of the road) has been declared as critically polluted area. The site of the project was visited by officers of the Board and observed that area does not fall in Industrial Area-B. It has been mentioned that therefore the site of the project proponent does not fall in the critically polluted area declared by Ministry of Environment, Forests & Climate Change, GOI, New Delhi. 2. A copy of the sanction letter no issued by Municipal Corporation, Ludhiana stating that application of the project proponent for grant of sanction to erect/re-erect/add to alter execute the work situated at GT Road, Sherpur Chownk has been sanctioned by the Commissioner Municipal Corporation subject to certain conditions as mentioned therein. The case was considered by the SEAC in its 141 st meeting held on , which was attended by the following on behalf of project proponent: (i) Sh. Charanjit Singh, Director of the promoter company. (ii) Ms. Tania Rana, EMS Incharge. 18

19 (iii) Sh. Sandeep Garag, M/s Eco Laboratories and consultant pvt. Ltd., Mohali. Sh. Sandeep Garag Environmental Consultant of the project proponent presented the salient features of the project as under: o The total plot area of the project is 2.05 acres ( sqm) and the total built up area will be sqm consisting of 121 no. of shops, 38 no. of offices, 107 no. of Services apartments and a Restaurant. Layout plan has been approved by MC Ludhiana. o The cost of the project is Rs crores.. o The total water requirement for the project will be 215 KL/day, out of which 205 KL/day will be met through MC supply and remaining 10 KL/day will be met through recycling of treated wastewater. o The total wastewater generation from the project will be 172 KL/day, which will be treated in a STP (200 KL/day) to be installed within the project premises. The project proponent has proposed to use 71 KL/day of treated wastewater for flushing purpose, 13 KL/day will be used for irrigation of green area and remaining 88 KL/day will be discharged into M.C. sewer in summer season. In winter season, 71 KL/day of treated wastewater will be used for flushing purpose, 04 KL/day will be used for irrigation of green area and remaining 97 KL/day will be discharged into M.C. sewer. In rainy season, 71 KL/day of treated wastewater will be used for flushing purpose, 1 KLD will be used fore irrigation of green area and remaining 100 KL/day will be discharged into M.C. sewer. o The M.C. Ludhiana has issued a letter no. 392 dated wherein it has been mentioned that the project proponent will have to pay sharing charges for the water and sewerage infrastructure and after completing the required conditions for availing the water and sewerage connection, the MC will not have any objection regarding this connection. o The total green area to be developed will be 2405 sqm. o The total quantity of solid waste generation will be 850 kg/day, which will be segregated at source as biodegradable and non-biodegradable components as per the Municipal Solid Waste (Management & Handling) Rules, The biodegradable waste will be converted into manure using Biodegradable Municiple Wast Management system which will convert the waste into compost. 20 o The project proponent will provide the arrangement for disposal of solid o waste within the project premises. The total load of electricity required for group housing will be 2634 KW which will be taken from the PSPCL. There is a proposal to install DG sets for stand-by arrangement. o The e-waste generated will be stored in an isolated room and will be sold to the manufacturers. o Used oil to be generated from the DG sets will be managed & handled as per the provisions of the Hazardous Wastes (Management, Handling & Transboundary Movement) Rules, o The ambient air monitoring has been got done from M/s ECO Laboratories & Consultants Pvt. Ltd. and the analysis results indicate that the concentration of various pollutants such as PM 2.5, PM 10, SO 2, NO 2 and CO have been measured. Also, ambient noise monitoring has been got done from the said firm and the analysis results indicate that the noise levels during day and night times, have been measured as 53.4 db(a) leq and 42.3 db(a) leq, respectively, against the prescribed standards of 55 and 45 db(a) leq. The analysis report of groundwater has also been submitted. o The Environment Management Cell will be responsible for implementation of EMP. Rs. 62 lacs will be incurred for implementation of EMP and Rs. 16 lacs/annum will be incurred on account of recurring charges. o Rs lacs will be utilized for following activities under Corporate Social Responsibility and implementation of the CSR will be responsibility of Sh. Charanjit Singh, Authorized Representative of the company. o Health camps o Social awareness programmes o Promotion of Sports, Arts and Culture After the presentation, the SEAC raised certain observations to which the project proponent replied as under: S.No. Query Reply of project proponent 1.
