BACKGROUND Over the last 3.5 years the Ministry of Education (MOE), with support from development partners and education stakeholders, has successfully completed a three-phase Comprehensive Education Sector Review (CESR). CESR Phases 1 and 2 established an extensive evidence base on the situation of education in Myanmar. Phase 3 focused on the drafting an evidence-based National Education Strategic Plan (NESP) for Recently development partners, Denmark, European Union and UNICEF, offered funding support to the MOE, through the Building on Quality Basic Education Programme (BoQBEP), to assist with the revision, completion and launch of the NESP This support was provided under a NESP Phase 1 Package for the period August 1st to December 31st, and it included technical assistance (TA) from three senior national education advisers and one international adviser. 1
2 Organizational Context Under the BoQBEP support, development partners have agreed to fund a NESP Phase 2 Package to support the MOE to support NESP operationalisation during the period March 1st, 2017 through June 30th, 2017 (four months). The position will be procured by Ministry of Education directly, with UNICEF technical support and quality assurance. The MOE has currently allocated approximately MMK 347, million (US$289 million) for the implementation of the NESP in the current financial year. This funding includes: (a) on-going MOE programmes that fully align with the NESP, such as school construction, school grants and stipends, and management training for head teachers; and, (b) new NESP programmes, such as the development and taking to scale the School Quality Standards Assessment Framework, establishment of the Teacher Education Council, revision to the curriculum in Education Colleagues and partnerships with Universities overseas among other programmes. Under the NESP Phase 2 Package the MOE has identified the need for continued technical assistance from an international adviser Chief Technical Adviser (CTA). The CTA is needed to assist senior officials to put in place key systems and processes that will support the startup and institutionalisation of the NESP. At this time the MOE has yet to decide on hiring senior national advisers to support NESP start-up during Jan. 1st to June 30th, This is because the government has recently established the National Education Policy Commission (NEPC) and this body of senior education experts will be expected to provide long-term strategic policy advice and recommendations to the MOE. The three senior national advisers hired by the MOE under NESP Phase 1 Package have now been appointed to the NEPC. The role of the CTA under this TOR is principally that of transfer of know-how and capacity development of MOE staff, rather than capacity substitution, in order to maximise the sustainability of the inputs. Therefore, the CTA will focus on developing capacities of officials to undertake assigned tasks and on facilitating such processes during the period of the assignment. To reflect this developmental approach, the following TOR will not list outputs such as strategies, plans, tools, and so on, as these are the responsibility of MOE to produce. The following TOR outlines the roles and responsibilities for the Chief Technical Adviser (CTA). All of the key tasks outlined in the Scope of Work below will be implemented by CTA and CESR officers (seconded MOE staff from various Departments). The Union Minister has recently extended the assignment of CESR officers from September to the end May 2017 so 2
3 that they can support NESP start-up and the full integration and insitutionalisation of NESP Programmes and Programme Components within MOE Departments 1. The objective of the TOR is to support the Union Minister, Permanent Secretary, Directors General, senior MOE officials and implementing departments to operationalise NESP through the following activities: (i) human resource capacity development for NESP Secretariat establishment, and sub-national accountabilities; (ii) rapid infrastructure needs assessment of a sample of basic education schools; (iii) inter-departmental coordination; (iv) NESP Annual Planning Cycle; (vi) NESP Annual Performance Review; and, (v) flexible technical support. 2. SCOPE OF WORK, RESPONSIBILITIES AND DESCRIPTION OF THE PROPOSED ANALYTICAL WORK Please see TOR attached. 3. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS Please see TOR attached. 4. DOCUMENTS TO BE INCLUDED WHEN SUBMITTING THE PROPOSALS Interested Individual Consultants must submit the following documents/information to demonstrate their qualifications: Proposal: o Application Letter o Explaining why the consultant is the most suitable for the work o Provide the methodology on how the consultant will approach and conduct the work Financial proposal Personal CV including past experience in similar assignments carried out for other organizations and at least 3 references 5. FINANCIAL PROPOSAL Fees The financial proposal shall specify the consultancy fees and all costs in relation to the scope of work of the consultancy. Travel All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general, the Ministry of Education will not accept travel costs exceeding those of an economy class ticket. 1 This decision was made in a meeting with the Union Minister on Saturday, September 24 th in NPT. 3
4 In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses shall be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed. PROJECT TITLE: Chief Technical Adviser to Support National Education Sector Plan (NESP) Operationalisation (March 1st, 2017 through June 30th, 2017); Ministry of Education, Myanmar B. C. SCOPE OF WORK The following Scope of Work outlines the key tasks the CTA will undertake over a six-month period of NESP Phase 2 Package (Jan 1 st 2017 to June ). The MOE understands that there will be flexibility in implementation of the following Scope of Work. Flexibility is essential in order to ensure the effective start-up and operationalisation of the NESP over the six-month period. New requests by the Union Minister and the Director General DAE and the future DG of the NESP Secretariat, that are approved by the Building on QBEP Management Committee, may lead to adjustment of some of the tasks listed below. Due to unexpected circumstances, it may not be possible to implement some of the tasks as they are outlined below. This will be decided on a case by case basis by the Building on QBEP Management Committee. C.1 NESP Secretariat establishment; NESP Annual Capacity Development Plan As outlined in the Terms of Reference for technical support to NESP Phase 1, one of the five Drivers of Change in the NESP covers human resource capacity (see NESP Chapter 13, draft, August 2016). The most critical area of human resource capacity development during the NESP operationalisation initial phase involves the full integration of NESP Programmes and Programme Components within MOE implementing Departments. Therefore, the MOE will need support to help ensure that NESP Secretariat is institutionalised within the Ministry and that programmes and programme components are strategically distributed across MOE 2 This decision was made in a meeting with the Union Minister on Saturday, September 24 th in NPT. 11
12 Departments and across existing staff positions located in the divisions/units/sections within each Department. MOE will further need support for assessing whether the necessary HR capacity for implementation is available in these divisions/units/sections and if not, support for identifying where new staff positions need to be created within existing divisions/units/sections. The Union Minister has recently decided that CESR officers will formally support transition from NESP development to NESP operationalisation, and support implementation of NESP Programmes and Programme Components, with assigned Department officers over a period of five months from January through May The CTA will work closely with CESR colleagues to support this transition, which will involve the full transfer of all relevant information, as well as knowledge and skills to the assigned MOE Department officers to enable them to operationalise implementation. This will include the need for standard operating procedures, guidelines and ToRs, as well as increasing awareness and ownership of the NESP in states and regions, and deepening understanding of the roles and responsibilities of the various implementation levels in relation to the specific reforms they will have to carry out. Chapter 13 of the draft NESP notes that under the NESP, MoE will develop and implement an Annual Capacity Development Plan (CDP). The CPD will be closely aligned with the Annual Priorities Plan and linked to Department Annual Implementation Plans. This work will be initiated by MoE in the period prior to the commencement of the current Terms of Reference, and will be further supported under the current ToR to operationalise the handover. It will be critical that this work is informed by the findings of the QBEP 4 -supported Capacity Gap Analysis, 5 and well-coordinated with the upcoming DFAT-supported My-EQIP programme 6, both of which are led by the Department of Research, Education Planning and Training. The CPD should articulate with the state-level HRD Plans to be developed as a follow-up to the Capacity Gap Analysis initiative, under a separate component of the Building on QBEP package of support. 13 (3) Build on previous groundwork laid and ensure assigned MOE Department officers are equipped with knowledge and skills to enable them to support effective operationalisation of NESP C.2 Rapid infrastructure needs assessment of basic education schools The Union Minister has recently decided that CESR officers will support the MOE to undertake a rapid needs assessment of a representative sample of basic education schools during the period January through February The overall aim of this activity is to document school infrastructure development priorities relating to implementation of the new curriculum and the KG+12 system outlined in the Na NESP Chapter 6 Basic Education, Access, Quality and Inclusion, see Strategy 1, Programme Component 1 (Draft, August 2016). The data from this assessment will be used to develop an evidence-based, equitable and costed National School Infrastructure Plan (NESP Chapter 6, Strategy 1, Programme Component 2). C.2.1 Key tasks Provide technical support to the MoE to enable the Ministry to: (1) Design, test and implement the rapid needs assessment of infrastructure of basic education schools. (2) Analyse the data from the rapid needs assessment of basic education schools and draft a detailed report with recommendations (3) Draft evidence-based, equitable and costed National School Infrastructure Plan, based on the recommendations C.3 NESP Annual Planning Cycle NESP Phase 2 Package will support the MOE to successfully operationalise the NESP Annual Planning Cycle. This cycle will build upon and strengthen existing annual planning systems in the MOE, and on the work initiated during the period prior to commencement of the current ToR to ensure institutionalisation of NESP within the Ministry s annual planning and budgeting cycle. C.3.1 Key tasks Provide technical support to the MoE to enable the Ministry to: (1) Review the MOE NESP Priorities Plan for following the decision by the government on Supplementary Grant funding. (2) Finalise the budget for FY that is fully aligned with the NESP Annual Priorities Plan for and includes all investment and recurrent costs (3) Develop ( Department Annual Implementation Plans for the financial year, following approval of MoE budget by the Parliament) (4) Develop an Annual Monitoring and Evaluation Plan for that is fully aligned with the MOE NESP Programmes Budget Summary C.4 Annual Performance Review (May 2017) 7 This decision was made in a meeting with the Union Minister on Saturday, September 24 th in NPT. 13
14 Under Chapter 13 of the NESP (draft, August 2016) the MOE will implement a new sectorwide co-ordination mechanism called an Annual Performance Review (APR). The APR is a one-week joint assessment of what has been achieved in the sector over the last 12 months. The APR, led by the MOE, involves a wide range of education stakeholders, such as senior officials from the MOE and partner ministries, state/region ministers of education and senior officials, senior education advisers, development partners, and representatives from nongovernmental organisations. The APR can provide a useful opportunity to involve education managers from districts and townships. The overall aim of the APR is assess the achievement of results across the sector over the last 12 months. C.4.1 Key tasks Provide technical support to the MoE to enable the Ministry to: (1) Develop a TOR for implementation of the Annual Performance Review (2) Consult with DPs on the APR TOR (3) Develop and publish an MOE Annual Report for (4) Implement the TOR and hold the first APR (5) Produce and disseminate an APR Recommendations Report C.5 Demand-driven technical support for the Union Minister, Directors General and MOE implementing officers Under NESP Phase 2 Package the CTA may provide flexible, demand-driven technical support to the Union Minister, Directors General and appointed MOE Department officers responsible for NESP Programmes and Programme Components, in order to assist the Ministry to respond to emerging priorities as agreed,. The CTA may also provide similar support to Programme Management Teams (PMTs) as needs emerge and are agreed. Such support would be consistent with the overall objective of the ToR, within the area of the CTA s expertise, and avoid distracting from the main activities and achievement of the overall assignment. Any significant deviations from the main tasks would need to be approved by the BoQBEP Management Committee. C.5.1 Key tasks Provide technical support to the MoE to enable the Ministry to: (1) Provide regular advice and support as requested and agreed by the Union Minister, Directors General and MOE Department officers responsible for NESP Programmes and Programme Components. (2) Report on all activities in monthly reports. D. EXPECTED OUTCOMES AND DELIVERABLES The CTA will submit bi-monthly reports to the Union Minister and the BoQBEP Management Committee on the achievement of the tasks listed in the above Scope of Work, identifying key bottlenecks to be addressed, and outlining next steps with work plans for the coming month and timeline 14

INSTITUTIONAL ARRANGEMENTS The CTA will report to the Union Minister through the NESP Secretariat Director General or DDG, assuming the NESP Secretariat is established following completion of the new MOE building in Nay Pyi Taw prior to the commencement of the assignment. If the NESP Secretariat has not yet been established by the commencement of the assignment, a temporary arrangement whereby the CTA reports to the Director General, DAE (i.e. the Focal Point for Building on QBEP support to the MOE) and DDG, DAE may be initiated. F. DURATION OF THE WORK The duration of the work is four months, from 1 March to 30 June G. DUTY STATION It is anticipated that the CTA will be based at the Department of Alternative Education (DAE) office in Yangon where he/she will work closely with CESR team members (i.e. staff seconded from MOE Departments). On a daily basis the CTA will work with and support and report to the DDG, DAE based at the DAE office in Yangon. The CTA will make frequent (i.e. weekly) trips to Nay Pyi Taw to work with relevant MOE officers and to implement the Scope of Work in this TOR. The CTA will manage his/her own travel arrangements and costs for travel to and from NPT, which are included in the NESP Phase 2 Package international adviser budget line that will be paid monthly by the Ministry. H. QUALIFICATIONS OF THE SUCCESSFUL CANDIDATE General Requirements At least MSc in development studies, education or a related field More than 15 years experience working in international development More than 8 years work experience in South East Asia in international development A good understanding of the public sector context in Myanmar A good understanding of all education sub-sectors in Myanmar A good understanding of the latest international research relating to education reform in developing countries Excellent communication skills Good experience in supporting institutional development and change management in developing countries Specific Requirements Experience in supporting a Government institution to design and successfully implement capacity development training programmes. Experience in human resource capacity development through transfer of know-how and capacity development of a Government institution. Experience, technical knowledge and skills in supporting a public institution, preferably a MOE, to successfully undertake a rapid needs assessments of schools or similar research activities, including data analysis and reporting. Experience, technical knowledge and skills in supporting a Government institution to successfully establish effective inter-departmental coordination mechanisms. 16
17 Experience, technical knowledge and skills in supporting a Government institution to successfully implement an annual planning cycle that fully aligns a national strategic plan with a government budget cycle, including consultative mechanisms for performance reviews. Proven experience with providing demand-driven technical flexible support to senior officials in a public institution in developing countries. I. PRESENTATION OF OFFER Offers submitted must include the following documents: a) Cover letter for submission of offer; b) Personal CV indicating all past experience from similar projects, as well as the contact details ( and telephone number) of the Candidate and at least three (3) professional references; c) Brief description of why the applicant him/herself as the most suitable for the assignment, and a methodology on how they will approach and complete the assignment; d) Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template (Annex A) provided. If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to MOE, the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to MOE. K. CRITERIA FOR SELECTION OF THE BEST OFFER Offers will be appraised using a Combined Scoring method. The qualifications, professional experience and methodology will be weighted at 70%, and combined with the price offer which will be weighted at 30%. Evaluation Criteria Offerors will be evaluated based on the cumulative analysis of the technical evaluation (weight: 70%) and financial criteria (weight: 30%). Only candidates obtaining a minimum of 49 points from the technical evaluation would be considered for the financial evaluation. 21 Annex II: GENERAL TERMS AND CONDITIONS OF CONTRACTS FOR THE SERVICES OF CONSULTANTS / INDIVIDUAL CONTRACTORS 1. LEGAL STATUS The individual engaged by Ministry of Education (MOE) under this contract as a consultant or individual contractors (the 'Contractor') is engaged in a personal capacity and not as representative of a Government or of any other entity. The Contractor is neither a "staff member" under the Staff Regulations of the Government of the Union of Myanmar and MOE policies and procedures nor a Government Official". The Contractor may, however, be afforded the status of "Expert on Mission", and if the Contractor is required by MOE to travel in order to fulfill the requirements of this contract, the Contractor may be issued government approval for travel. 2. OBLIGATIONS The Contractor shall complete the assignment set out in the Terms of Reference for this contract with due diligence, efficiency and economy, in accordance with generally accepted professional techniques and practices. The Contractor must respect the authority of MOE and the Government of the Union of Myanmar and in connection with this contract must neither seek nor accept instructions from anyone other than MOE. During the term of this contract the Contractor must refrain from any conduct that would adversely reflect on MOE or the Government of the Union of Myanmar and must not engage in any activity that is incompatible with the administrative instructions and policies and procedures of MOE. The Contractor must exercise the utmost discretion in all matters relating to this contract. In particular, but without limiting the foregoing, the Contractor (a) will conduct him- or herself in a manner consistent with professional ethical standards; and (b) will comply with the administrative instructions and policies and procedures of MOE relating to fraud and corruption; information disclosure; use of electronic communication assets; harassment, sexual harassment and abuse of authority; and the requirements set forth in the Government of the Union of Myanmar regulations. Unless otherwise authorized by the appropriate official in the office concerned, the Contractor must not communicate at any time to the media or to any institution, person, Government or other entity external to MOE any information that has not been made public and which has become known to the Contractor by reason of his or her association with MOE or the Government of the Union of Myanmar. The Contractor may not use such information without the written authorization of MOE, and shall under no circumstances use such information for his or her private advantage or that of others. These obligations do not lapse upon termination of this contact. 3. TITLE RIGHTS MOE shall be entitled to all property rights, including but not limited to patents, copyrights and trademarks, with regard to material created by the Contractor which bears a direct relation to, or is made in order to perform, this contract. At the request of MOE, the Contractor shall assist in securing such property rights and transferring them to MOE in compliance with the requirements of the law governing such rights. 21
22 4. TRAVEL If MOE determines that the Contractor needs to travel in order to perform this contract, that travel shall be specified in the contract and the Contractor as travel costs shall be set out in the contract, on the following basis: (a) travel in economy class via the most direct and economical route. (b) Reimbursement of the Contractor for out-of-pocket expenses associated with such travel by paying an amount equivalent to the daily subsistence allowance that would be paid to staff members undertaking similar travel for official purposes. 5. PENALTIES FOR UNDERPERFORMANCE Payment of the fees to the Contractor under this contractor, including each installment or periodic payment (if any), is subject to the Contractor's full and complete performance of his or her obligations under this contract with regard to such payment to MOE's satisfaction, and MOE'S certification to that effect. 6. LATE DELIVERY MoE reserves the right not to pay the Contractor or withhold part of the payable amount if one or more requirements established for this assignment is not met or deadline set for the accomplishment of the tasks is missed. 7. STATEMENT OF GOOD HEALTH Before commencing work, the Contractor must deliver to MOE a certified self-statement of good health and to take full responsibility for the accuracy of that statement. In addition, the Contractor must include in this statement of good health (a) confirmation that he or she has been informed regarding inoculations required for him or her to receive, at his or her own cost and from his or her own medical practitioner or other party, for travel to the country or countries to which travel is authorized; and (b) a statement he or she is covered by medical/health insurance and that, if required to travel beyond commuting distance from his or her usual place or residence to MOE (other than to duty station(s) with hardship ratings "H" and "A", a list of which has been provided to the Contractor) the Contractor's medical/health insurance covers medical evacuations. The Contractor will be responsible for assuming all costs that may be occurred in relation to the statement of good health. 8. INSURANCE The Contractor is fully responsible for arranging, at his or her own expense, such life, health and other forms of insurance covering the term of this contract as he or she considers appropriate taking into account, among other things, the requirements of paragraph 5 above. The Contractor is not eligible to participate in the life or health insurance schemes available to MOE and United Nations staff members. The responsibility of MOE and the United Nations is limited solely to the payment of compensation under the conditions described in paragraph 7 below. 9. SERVICE INCURRED DEATH, INJURY OR ILLNESS If the Contractor is travelling with MOE's prior approval and at MOE's expense in order to perform his or her obligations under this contract, or is performing his or her obligations under this contract in a 22
23 MOE or Government of the Union of Myanmar office with MOE's approval, the Contractor (or his or her dependents as appropriate), shall be entitled to compensation from MOE in the event of death, injury or illness attributable to the fact that the Contractor was travelling with MOE's prior approval and at MOE's expense in order to perform his or her obligations under this contractor, or was performing his or her obligations under this contract in a MOE or Government of the Union of Myanmar office with MOE's approval. Such compensation will be paid through a third party insurance provider retained by MOE and shall be capped at the amounts set out in the Administrative Instruction on Individual Consultants and Contractors. Under no circumstances will MOE be liable for any other or greater payments to the Contractor (or his or her dependents as appropriate). 10. ARBITRATION (a) Any dispute arising out of or, in connection with, this contract shall be resolved through amicable negotiation between the parties. (b) If the parties are not able to reach agreement after attempting amicable negotiation for a period of thirty (30) days after one party has notified the other of such a dispute, either party may submit the matter to the Union Minister for arbitration. This will involve the Union Minister appointing a Special Committee of MoE officers, Chaired by a senior officer, (DG) to undertake an independent investigation, assessment and recommendations for review by the Union Minister. The Union Minister will make a final decision on the dispute after weighing all the evidence and recommendations submitted in the Special Committee Investigation Report. His decision will be final. 11. TERMINATION OF CONTRACT This contract may be terminated by either party before the expiry date of the contract by giving notice in writing to the other party. The period of notice shall be five days in the case of contracts for a total period of less than two months and fourteen days in the case of contracts for a longer period; provided however that in the event of termination on the grounds of misconduct by the consultant, MOE shall be entitled to terminate the contract without notice. In the event of the contract being terminated prior to its due expiry date in this way, the consultant shall be compensated on a pro rata basis for no more than the actual amount of work performed to the satisfaction of MOE. Additional costs incurred by the MoE resulting from the termination of the contract by the consultant may be withheld from any amount otherwise due to the consultant from MOE. 12. TAXATION The MOE undertake no liability for taxes, duty or other contribution payable by the consultant on payments made under this contract. No statement of earnings will be issued by the MOE to the consultant. 23
