The application for the temporary non-compliance is to support a trial which will be contained to the "Trial Area" which comprises of the Rugby Maintenance Delivery Unit and Rugby Operations in Network Rails, London North Western Route. Reference: 10/181/TNC Page 3 of 6
4 8. Impacts of complying with the current RGS requirement: The Rule Book requires a COSS to use the template form RT9909 as shown in Rule Book Module T7. A trial was conducted November/December using a design of the RT9909 form that accommodated the space for the inclusion of a diagram, the circling of the SSOW (rather than tick) and space for a change of COSS. The trial also involved COSS's completing the entirety of the form. There was a significant increase in the number of minor errors and it became apparent from analysing the documents that they did not know what to put in the boxes and which ones to complete. The circling also appeared to confuse and the change of COSS box did however prove popular. Following the trial we were also informed that it was not technically possible to include a diagram within the form itself. As a result of these findings from this initial trial, Network Rail wish to conduct a further trial of two revised versions of the form. One version is for static sites of work and the other is for moving worksites where the safe system of work changes. They have a new layout and design with shaded boxes to indicate which boxes the COSS/IWA needs to complete. They also contain additional information on calculating warning times and sighting distances. This temporary non-compliance is to enable a trial of these revised forms in planning and establishing safe systems of work. 9. Proposed alternative actions: The application will support trials of two revised COSS / IWA Record of Arrangements and briefing forms which have a new layout and design with shaded boxes to indicate which boxes the COSS/IWA needs to complete. They also contain additional information on calculating warning times and sighting distances. The only information that has been removed from the form is "limits of the working area" which has been replaced with a Start and End mileage for each site and safe system of work. The revised form will be trialled with the aim of it being simpler to complete and with the safety information more clearly presented to improve the quality of the COSS briefings. This will be determined by user feedback from those giving and those receiving the COSS briefing. Those completing the revised form will be limited to "nominated people" who currently hold the competence of COSS or IWA from: Rugby Signalling and Telecoms, Rugby Permanent Way and Rugby Mobile Operations Managers. The Planners and Section Managers responsible for planning work for COSSs/IWAs in these units will also be "nominated people" participating in the trial and will be also be trained on the completion of the new forms. The trial will be controlled by using a documented trial methodology. The "nominated people" using the revised Record of Arrangements and briefing forms (RT9909) will be trained on how to complete them and those affected by this change will be briefed fully to know what to expect duration of the trial. The trial will be on the Network Rail London North Western Route and contained to the "Trial Area". It will involve nominated staff in the Route Operations and Maintenance teams (List in Trial Methodology Document). As part of the training process, each COSS and IWA will be trained on how to complete the revised RT9909 forms and are required to undertake an exercise on completing them. These will then be checked by the project team before each individual is deemed competent to take part in the trial. During the trial each completed form will be returned to the Section Manager (Maintenance) or Local Operations Manager (Operations). On receipt of each form, the manager will immediately assure themselves that the individual shown as COSS/IWA on the revised RT9909 has been briefed and authorised to use the new process. Following a 20% assurance check of the forms, the manager will then pass all completed forms onto the project team who will audit and retain each one. The project team will also conduct a minimum of bi-weekly visits to the trial sites and will be constantly available over the phone for advice and support. The trial will be of a pair of new Record of Work Arrangements and briefing forms (RT9909). Only nominated people will be using the revised forms and they will be given full training on how to complete them before the trial starts. Those working under the COSSs participating in the trial will be briefed thoroughly on the arrangements of the trial before the trial starts. The nominated planners and section managers responsible for planning of work for the nominated COSSs/IWAs will be trained on the use of the new RT9909 forms. The trial will be carried out using a strict documented methodology. The trial will be limited to nominated people as described above. This group of 76 staff will be briefed on the new process by the Project Manager and Project Leader. Each briefing session is expected to take two hours. Following the training, the nominated people will complete an exercise involving a real Safe System of Work scenario and, as part of this, they will each be required to complete a new RT9909 form. The project team will check each of these forms and re-brief as required before deeming individuals competent to take part in the trial. Reference: 10/181/TNC Page 4 of 6
5 Once each person has been briefed and deemed competent, the individual will sign a training declaration form. This declaration states that the individual has been briefed and that in signing they acknowledge they have received and understood the training in how to complete the trial RT9909 forms. The project team will maintain a register of those briefed, passed as competent and authorised to use the new forms under the authority of this temporary non-compliance. During the trial, there will be a weekly review by the Project Manager and Leader and a weekly phone conference with the Rugby trial lead contact. The project team will also conduct a minimum of bi-weekly visits to the trial sites and will be constantly available over the phone for advice and support. 10. Impacts of the alternative actions: The overall vision is that the revised forms will: Improve the presentation of safety information Reduce the number of COSS made errors on Record Of Work Arrangements and Briefing Forms Improve the quality of the COSS briefings and Ultimately reduce the number of incidents where the RT9909 form is a contributory factor. 11. What other options have been considered? N/A 12. Consultation with affected parties Network Rail Maintenance and Network Rail Operations and Customer Services in London North Western route. 13. Additional actions/observations: Upon receipt, the applicant is required to identify affected, interfacing parties and copy this certificate, together with supporting information, to those parties. There will also be a review session with a selection of COSSs, IWAs and planners involved in the trail to review findings. Following this review the project team will compile a report to present their findings. This certificate is granted pending revision of Rule Book Module T7 which will become Network Rail s responsibility when Tranche 2 of the Rule Book comes into force. 15.
