16 Identifying Heading causes & improving evidence the management of work-related road risk clearly lags behind the management of more general health and safety. Page 10 there seems to be an underlying attitude that managing road risk is not a legitimate use of time. Page 12 it can be seen that the area not directly or indirectly visible on the mixer (21m 2 ) is 50% greater than that of the curtain side (14m 2 ). Page 15 16
17 Road Heading risk less important than site risk So would you report [an on-road collision] to the site management here? No, because it s in the roads, it s nothing to do with the site. So if it happens on site then it s generally, it s a totally different story, but if it happens in the street then it s down to whoever it is these people have got enough to do. 22 Construction Heading Logistics & Cycle Safety (CLOCS) Project Goal: To deliver a step change in work related road safety in the construction industry Project Outcomes: 1.1 Increased availability and uptake of new lorries with 100 percent all round vision and maximum driver direct vision 1.2 All existing lorries are fitted with appropriate all round vision equipment as standard 2. For work related road safety cultures within construction logistics operations to be considered as important as that of health and safety culture on construction sites 3. An (Approved) Code of Practice for the construction logistics sector that enables transparency and ownership of work related road risk for developers, their clients and construction logistics operators Workstream 1: Improving vehicle safety Workstream 2: Addressing the safety imbalance Workstream 3: Encouraging adoption of best practice 22

58 Why are PCNs a problem for the freight industry? Millions every year! Not just the cost of the PCN, but also the administration 50% over the last 3½ years (to June 2012) London is the biggest problem: 80% by 10 London authorities 60% by 4 authorities (TfL, Westminster, Camden & City of London) The rules for loading/unloading can be complex. The rules vary from council to council Have to take into account other restrictions Sometimes there is nowhere suitable to stop legally or the time allowed is too short

60 What should the freight industry do to reduce its PCN bill? 1. Read FTA s PCN compliance guide to understand the full process 2. Educate your drivers on the rules of loading/unloading (using FTA s PCN driver card) 3. Issue your drivers with an FTA PCN report pad from Shopfta to fill in when they receive a PCN. 4. If you receive a PCN, decide whether to pay or appeal quickly (if paying, do so within the 50% discount period). 5. Record your PCNs in a spreadsheet FTA has a good (free!) template and so does FORS 6. Analyse your PCN data to understand where your hotspots are using FTA s Delivery Assessment Guide 7. 66 What should local authorities do to help? Understand the delivery needs in their area Recognise that needs change over time Work with their neighbouring authorities and develop a consistent system (i.e. 40 minutes loading/unloading on yellow lines) Plan delivery needs into new developments (don t forget home deliveries for residential properties) Ensure that enforcement officers understand the definition of loading and unloading Help advise drivers on where to stop enforcement should be the last resort Manage enforcement contracts effectively If lots of PCNs are being issued in the same area it is a failure in the system. Investigate Whilst PCNs can be appealed, this is resource intensive. Provide a back office service which can talk to companies about PCNs in bulk and run reports on outstanding PCNs. (City of Westminster is a great example)
67 What can TfL do to help? Increase loading bay times from 20 to 30 (or even 40) minutes as is being rolled out with parking bays. Scrap code 46 and use specific codes for specific contraventions Dedicated staff in back office to deal with PCNs
68 What should the Government do to improve the parking policy framework? Review the Traffic Management Act 2004 It s over 5 years since part 6 of the TMA came into operation Review the supporting operational guidance and provide more clarity around timescales for correspondence There are minimum time limits for issuing NTOs and Orders for Recovery but no clear maximum Consider merging PATAS and TPT Will give operational savings as only administering one service Will allow appellants wanting to appear in person for London hearings to be able to attend a hearing nearer to where they are based

72 London s challenges London suffers from poor air quality Causes and exacerbates health problems London at risk of being fined by the EU for missing targets on: NO 2 (Nitrogen Dioxide) not expected to comply with EU limit values until after 2020 PM (Particulate Matter) This year, four monitors have already recorded more than their daily allowance for PM 10 exceedance, with a further four monitoring sites having surpassed ¾ of their annual allowance for daily PM 10 exceedance so likely to go on to break their allowance for However none of these sites are part of the monitoring network used by Defra to assess compliance with the EU Directive, and as such do necessarily meet the strict location and equipment criteria. There is also strong policy drivers from the Government to encourage reduction in levels of carbon created by vehicles road transport responsible for 21% CO 2 emissions in central London, which equates to around 4% of the emissions across the Capital TfL Planning - Environment 72
