12 RCRA The Resource Conservation Recovery Act (RCRA) of 1976 regulates the generation, treatment, storage, handling, transportation, and disposal of hazardous waste. Under RCRA, the US Environmental Protection Agency (EPA) clearly states that spent fluorescent, high intensity discharge (HID) lamps, computers and electronics are hazardous waste, and it is illegal to dispose of them as a solid waste in the dumpster or compactor. There are fines for improper disposal. Under the US EPA regulations, fines can be up to $25,000 per occurrence. Universal Waste Rule (UWR) In 1995 the US EPA adopted a set of regulations called the Universal Waste rule. The UWR significantly reduced the regulatory burden for business that generate these wastes. UW was defined as batteries, mercury thermostats, and pesticides. In 1995 the US EPA added hazardous waste lamps. This designation reduces paperwork and transportation requirements to promote recycling. Universal wastes, including fluorescent lamps and batteries, must either be recycled at a licensed facility or treated at a permitted hazardous waste facility. Solid waste disposal is not a legal option. 12
13 Adoption Although the law was federally adopted, the rules did not become effective in an individual state until that state adopted the rules. By 2003 all states had adopted UW. States are allowed to add wastes to their UW rules. Many states have added low level mercury lamps, as well as electronics and aerosol cans. Exemptions Certain small companies may be exempt from these federal requirements. Under RCRA, conditionally exempt small quantity generators (CESQG) are exempt from these federal requirements. These generators must generate less than 100 kilograms (220 pounds) of hazardous waste, including Universal Wastes, in any calendar month. This equates to approximately 440 four foot lamps. Some states do not allow this small quantity exemption, regardless of size, such as California. 13
14 Land Bans At this time, states that prohibit mercury lamps from landfill are: California, Connecticut, Florida, Maine, Minnesota, New York, Rhode Island, Vermont. Some states and counties have rules that allow CESQG s to dispose of lamps in the garbage, but also have solid waste rules that prohibit the landfills from accepting lamps! Since each state can make their own rules, it is important to check with the state environmental agency. Again, there are fines for improper disposal. Superfund The most important law to understand is the federal hazardous waste cleanup law known as Superfund, which supercedes all others we have covered thus far. The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980 established a program for the investigation and cleanup of facilities from which there has been a release of any hazardous waste substance into the environment. 14
15 Act (SOX) The Sarbanes-Oxley Act mandates the security of companies' financial systems and the IT infrastructure that supports those systems. Specifically, Section 404 holds that the confidentially and security of information are crucial foundations of compliance. As such, identity and proprietary data theft is one of the greatest challenges facing small businesses as they work to comply with this legislation that protects consumer financial, credit and health information. SOX requires that electronic data is erased and irretrievable at the end of the useful life of the IT asset. Gramm Leach Biley Act (GLB) The Safeguards Rule under the GLB Act, requires that financial institutions take proactive steps to ensure the security of customer information. The Federal Trade Commission defines "financial institution" for the purposes of GLB compliance as any organization that works with individual's money. 15
16 Legal and Financial Liability The legal and financial liability under Superfund is cradle to grave meaning the liability exists as long as waste remains. Superfund is strict meaning intent does not have to be proved. Superfund is joint and several. Each party involved is individually liable for the entire cost of clean up. Under the Superfund law, no contract, indemnification or any other agreement among the parties can remove this potential liability from any of the parties. There is no small quantity exemption from the liability for future site clean up if mercury contamination shows up at a disposal facility where fluorescent lamps have been sent. 16
17 The bottom line The most effective way to protect against future liability is to ensure that the mercury in lamps is reclaimed by a reliable, reputable environmental service company. The same holds true for all types of universal wastes including batteries and electronic equipment. 17
18 If you send lamps to a recycler that ends up causing problems, are you potentially liable? That s why, if you decide to recycle, for either COMPLIANCE or RISK MANAGEMENT, remember 2 very wise sayings: YES - if the recycling company does not have the financial resources to correct the problems it created. caveat emptor (buyer beware) you get what you pay for 18
19 These are not just buzz words, it s now the way of life. Being green and environmentally responsible makes sound business sense. Studies have shown that consumers today and those of tomorrow will be more conscious of the practices of manufacturers and businesses and will take allegiance with those demonstrating a strong commitment to the environment. Consumers are more savvy than they have ever been and have access to information resources that simply did not exist 20 years ago, that's why its critical to not only appear green but to actually do something with substance that has a measurable and positive effect. That is were Veolia steps in. We help you turn your waste into a resource! 19
20 It is no secret that becoming more energy efficient by doing things such as lighting retrofits can increase the profitability and asset value of your customers business while lowering operating costs and carbon footprint. LEED credits are given for the amount of reusable material that a construction company diverts from landfills to recycling or to salvage. A 50 percent minimum is required for certification. That is were Veolia steps in. We can take the spent waste that your customer used to get more energy efficient. They then will qualify for LEED certified credits to put towards there certification 20

22 Large Quantity or Bulk Recycling Recycling for large Bulk quantities (greater than a pallet of lamps) is done with Veolia owned trucks or approved third-party transporters. We schedule pickups as needed or scheduled milk runs in some states upon request of the customer. The bulk pick up program is good for re-lamp and retrofit projects and also for large facilities and consolidators of waste. Small Quantity Recycling Recycling for small quantities, less than a pallet of lamps (25 cases) is best accomplished with the RecyclePak program. The RecyclePak program includes prepaid boxes and pails for universal waste. There is a wide selection of packaging supplies. RecyclePak allows for quick turnaround, and on time waste pickup at the customers convenience. The RecyclePak program is great for ongoing facility maintenance. 22
23 How Large Quantity or Bulk Recycling Works Customer s or faxes Veolia customer service representatives a complete Bulk Service Request Form This form includes the generator address and contact information, material type, and quantity. Veolia enters this information into our computer system. Veolia schedules the pickup directly with the generator within 7-10 working days. The waste is transported to the nearest Veolia facility, where it is received, recorded, and recycled. Our driver arrives with pre-printed waste labels and shipping documents (either hazardous waste manifest or bill of lading). Customer receives the invoice from Veolia Environmental Services accounting department in Port Washington, Wisconsin, along with a copy of the Certificate of Recycling for billing purposes. Waste is billed on a unit basis with transportation and/or packaging charges. 23
24 How Small Quantity or RecyclePak Works Customer orders online, s or faxes Veolia customer service representatives a complete Order Form. Order is received and entered into our computer system. Order is billed on a per container basis upfront. RecyclePak containers are shipped from Greenville, WI. Please allow 3-5 days for delivery of RecyclePak containers. Customer receives RecyclePak containers and follows the instructions to properly assemble, fill, seal and ship the container. When the RecyclePak container is sealed and ready for shipping, customers contact FedEx Ground toll-free at to request a pickup. RecyclePak containers are delivered the nearest Veolia recycling facility, where they are recycled. A Certificate of Recycling is issued to the customer. 24

Data displayed includes the date the order was placed, order number, PO or credit card transaction number, items ordered, the quantities ordered and tracking number of the shipment. 32 All large quantity or bulk recycling reports are available in excel or.csv format by contacting customer service. Online reports available through CIMS (Customer Information Management System) for RecyclePak Returned Containers with Recycling Data Access to all returned containers with recycling data for one location or multiple. Report can be run over time and can be exported to excel for further data manipulation. Data reported includes: Unit type (lamp type, size, etc.) Number of each unit Location number and/or delivery address Location name and/or delivery address Container order date Unique container ID Container tracking number Container received date Certificates of Recycling Repository Access a repository of certificates of recycling, all available for immediate download or sign up for automatic delivery upon receipt.
