1 DEFINITIONS H - O Hazardous Materials Manufacture Means any business involved in the manufacture of materials or substances that by reason of their toxic, caustic, corrosive, abrasive, or otherwise injurious properties, may be detrimental or deleterious to the person handling or otherwise coming into contact with such material or substance. Health Club Means a facility which provides fitness services, and facilities including, but not limited to weight rooms, swimming pools, sauna baths, whirlpool baths, tennis and racquet courts, and exercise equipment. Massages may be offered incidental to such a facility, but a facility where massages are the primary service offered is not an athletic or fitness center. Heavy General Manufacturing The manufacture, processing, fabrication, assembly, treatment and packaging of products or parts, and incidental storage, sales and distribution of such products, when any part of the manufacturing operation is done outside of a building and/or when in the opinion of the Director of Community Development, the operation is of a nature as to have the potential for producing detectable levels of the emissions identified in the Performance Standards of this ordinance. This is intended to be a general use category to cover other heavy manufacturing uses not described in the matrix. Heavy Recycling Processing Facility Means any processing facility other than a light processing facility (See light recycling processing facility). Heavy Retail Sales Shall mean a heavy sales and services use in which goods that primarily require delivery or pickup by truck are sold. Examples include but are not limited to the sale of construction materials, landscape materials, heating fuel, large household items, or industrial supplies. Height The distance allowed for a building or structure from the average ground level to the highest point of the building or structure directly above that point on the ground. Home Occupation "Home occupation" means a use which is clearly incidental and secondary to the residential use of the dwelling or mobile home, and which use: 1. Is confined completely within the dwelling or manufactured home and occupies not more than fifty percent of the gross floor area of one floor thereof; 2. Is operated by the members of the family occupying the dwelling or manufactured home with no non-resident employees on site.

Produces no evidence of its existence in the external appearance of the dwelling, manufactured home or premises or in the creation of noise, vibration, light or glare, electronic interference, odors and fumes, smoke, pedestrian or vehicular traffic, or other nuisances to a degree greater than normal for the neighborhood. Horticulture Production Hospital Means the commercial location for growing flowers, trees and ornamentals. Means an institution providing clinical and emergency services of a medical or surgical nature to human patients and injured persons. and licensed by state law to provide facilities and services in surgery, obstetrics, and general medical practice. Hotel, Motel Any group of dwellings or portion thereof, containing rooms or dwelling units designed for, or intended to be used for lodging purposes including groups designated as auto cabins, motels, inns, hotels, and similar designations. Improvement Means a structural addition or modification to an existing structure, or the addition of a structure to a vacant property, or the addition of an additional structure on a property with existing structure. Improvement, Non-conforming Means a structural addition or modification to an existing structure, or the addition of a structure to a vacant property, or the addition of an additional structure on a property with existing structure, which is in violation of current zoning or building codes. Independent Living Means group living quarters for handicapped persons where minimum supervision and/or assistance is provided. Indoor Recreation Means recreational uses that are conducted within an enclosed building including bowling alleys, billiard parlors, ice and roller skating rinks, and racquetball courts, and video arcades with more than four video machines as a primary use. Industrial Laundry Means any establishment that provides for the cleaning including dry-cleaning of clothing and uniforms for businesses. This use includes the pick up and delivery of clothing and uniforms. Janitorial services Means businesses engaged in the provision of cleaning, maintenance, and custodial services to firms.

3 Junkyard Kennel See Recycling and Salvage Yard. Kennel means any premises, except where accessory to an agricultural use, where five or more domestic animals which are not sick or injured and are ten weeks in age or older are boarded for compensation, cared for, trained for hire, kept for sale or bred for sale, and includes on-site veterinary care. See Animal Hospital. Kitchen - Kitchenette Means any space used or intended or designed to be used for cooking and preparing food, whether the cooking unit is permanent or temporary and portable. Hospice Means a residential facility for rooming and boarding of terminally ill persons. Laboratory, dental Means an establishment engaged in the testing and production of dental appliances for dentists. Laboratory, medical, optical Means an establishment engaged in the analysis and testing of samples, equipment or products for medical, dental or optical purposes. Laboratory, research, experimental Means a building or groups of buildings in which are located facilities for scientific research, investigation, materials testing, or experimentation, but not facilities for the manufacture or sale of products. Landscaping The minimum required percentage of the total lot area which must be landscaped. Landscaping consists of plants along with organic ground covers (bark, chips, etc.) planted to be completely covered by plants within 5 years. Rock does not count as landscaping. Laundromat Means any business that provides home-type washing, drying, and/or ironing machines for use to be used by customers on the premises. Large Recycling Collection Facility Means a center for the acceptance by donation, redemption or purchase, of recyclable materials from the public of more than 500 square feet and may include permanent structures.

4 Light General Manufacturing The manufacture, predominantly from previously prepared materials, of finished products or parts, including processing, fabrication, assembly treatment and packaging of such products, and incidental storage, sales and distribution of such products, when done completely within the confines of a building and producing no detectable levels of the emissions identified in the Performance Standards of this ordinance. This is intended to be a general use category for light industrial uses not included in the zoning matrix. Light Recycling Processing Facility Means a building or enclosed space used for the collection and processing of recyclable materials that occupies an area of under 40,000 square feet and has up to two outbound truck shipments per day. Such facilities are limited to baling, briquetting, crushing, compacting, grinding, shredding, and sorting of source recyclable materials and repairing of reusable materials. Liquor (Hard; Packaged Only) wine. Shall mean a distilled rather than a fermented alcoholic beverage, exclusive of beer and Living Quarters Means one or more rooms in a building designed for, intended for, or used by one or more individuals for living or sleeping purposes, with no cooking facilities. Loading Space "Loading space" means an off-street area of not less than two hundred fifty square feet, which area is a minimum of fourteen feet in height and is suitable and usable for the temporary parking of commercial vehicles while loading or unloading merchandise or materials, which area abuts upon a street or alley or has other appropriate means of access to and from public roads, and which area is on the same lot as the building which the area serves or on a lot contiguous to a building or group of buildings which the site serves. Locksmith Lot Area Means a business engaged in the repairing or making of locks. Means the total horizontal area included within lot lines, excluding any portion of the area which as been dedicated for public right-of-way purposes, any area under 30 feet in minimum dimension, and access easements serving more than two additional properties. Lot, Building Site "Building site lot" means a parcel of land, exclusive of public streets or alleys, occupied or intended to be occupied by main building or group of such buildings and accessory buildings, together with such open spaces, yards, minimum width and area as required by the provisions of this title, and having full frontage on an improved and accepted public street which meets the standards of widths and improvements specified by the city for the street in question, or having either partial frontage on the street or access thereto by a recorded right-of-way or easement is determined by the commission to be adequate.

5 In subdivision areas, building site shall be any portion of a filed and recorded lot or any combination of contiguous lands, including more than a lot, which meets the minimum area and dimension requirements of the zone in which located and which is so shaped that a building could be constructed in compliance with all the yard requirements of the zone. For the purpose of this title, a lot shall not be restricted to a parcel of land identified on a filed and recorded subdivision by lot number. Lot, Corner "Corner lot" means a lot abutting upon two or more streets at their intersection or upon two parts of the same street, the streets or parts of the same street forming an interior angle of less than one hundred thirty-five degrees. Lot Depth Lot, Flag Means the total distance between the front property line and the rear property line. Shall mean an interior parcel not having direct frontage to a public road or street, except for a narrow portion used for access purposes. Lot, Interior Lot, Key "Interior lot" means a lot other than a corner lot. "Key lot" means the first lot to the rear of a corner lot, the front line of which key lot is a continuation of the side line of the corner lot (exclusive of any alley) and fronting on the street which intersects or intercepts the street upon which the corner lot fronts. Lot, Lines Means the property lines bounding a lot. This applies to lots square or rectangular in shape. Irregular shape lots, such as triangular or wedge shaped lots, "lot lines" shall be determined by the Planning Director, subject to appeal and review by the Planning Commission. Lot Line, Front "Front lot line" means, in the case of an interior lot, the line separating the lot from the street right-of-way and, in the case of a corner lot, the shorter street frontage. Lot Line, Rear "Rear lot line" means the lot line opposite and most distant from the front lot line. Lot Line, Side "Side lot line" means a side lot line separating a lot from a street.

6 Lot, Through Shall mean a lot having frontage on two (2) dedicated parallel or approximately parallel streets. Lot, Width Means the horizontal distance between the side lot lines measured at right angles to the depth of the lot at the front yard setback line. When not applicable due to irregularity of lot shape lot width shall be determined by the Planning Director, subject to appeal and review by the Commission. Major Impact Service and Utilities Means large scale public utilities requiring substantial commitment of land and/or creating substantial physical or visual impacts on the surrounding area, such as sewer treatment plants, electrical substations, city corporation yards, communication towers, and wireless communication facilities as defined by the City s Wireless Communication Facilities Policy and any subsequent codification. Manufactured Home Means a vehicle, other than a motor vehicle, used as semi-permanent housing and designed for human habitation, for carrying persons and property on its own structure, and for being drawn by a motor vehicle. For the purposes of this title, manufactured home shall be considered structures when the mobile homes are parked in a manufactured home park. See also "Trailer". Manufactured Home Park Means any area or tract of land where one or more mobile home sites are rented or held out for rent. "Manufactured home park" includes the terms "manufactured home court", "trailer court" and "trailer park". See also "Trailer camp". Manufacturing, Light, Heavy See Light General Manufacturing and Heavy General Manufacturing. Massage Therapy Means the manipulation of body muscles or tissues, except specified anatomical areas as defined by Section L, by hand or mechanical device for therapeutic purposes, including prevention, rehabilitation, and healing, by a skilled professional who is certified by the State of California pursuant to Sections 4601 or 4604 of the California Business and Professions Code. Does not include specified sexual activities as defined in Section M. An individual providing massage therapy in accordance with this definition, and in compliance with all other applicable provisions of state law and the municipal code, is not engaged in an Adult Entertainment Use as defined in Section Master Subdivision A subdivision that contains 500 or more residential lots, a neighborhood park, and a school site.

7 Medical marijuana dispensary Means any facility or location, whether fixed or mobile, where medical marijuana is cultivated, provided, sold, made available, or otherwise distributed to three or more of the following: any individual, including but not limited to a primary caregiver, a qualified patient, or a person with an identification card, as those terms are defined in Health and Safety Code section et seq. A medical marijuana dispensary shall not include the following uses, as long as the location of such uses is otherwise regulated by this code or applicable law: A clinic licensed pursuant to Chapter 1 of Division 2 of the Health and Safety Code; A healthcare facility licensed pursuant to Chapter 2 of Division 2 of the Health and Safety Code; A facility licensed pursuant to Chapter 2 of Division 2 of the Health and Safety Code; A residential care facility for persons with chronic life-threatening illness licensed pursuant to Chapter 3.01 of Division 2 of the Health and Safety Code; A residential care facility for the elderly licensed pursuant to Chapter 3.2 of Division 2 of the Health and Safety Code; A residential hospice, or a home health agency licensed pursuant to Chapter 8 of Division 2 of the Health and Safety Code, as long as such use complies strictly with applicable law, including but not limited to, Health and Safety Code Section et. seq. Messenger Services Means a business that provides office delivery and dispatching services by transportation other than truck and does not include on site storage or vehicle repair. Mineral Extraction Shall include all types of mining, digging, drilling, and pumping of water, gases, minerals, or combustibles. Mini-Storage (Self-Service Storage Facility) A building or group of buildings consisting of small, self-contained units that are leased or owned for the storage of business and household goods. Minimum Lot Size The minimum amount of land needed on a legal lot created under this ordinance. AC means acre and k means thousands. Minimum Lot Width The minimum dimension which must exist between property lines measured by a perpendicular to the property line. Non-conforming Building Shall mean a building or structure, or portion thereof, which lawfully existed prior to the adoption of the zoning regulations on April 22, 1987, or a subsequent amendment to this title, but which, as a result of such adoption or amendment does not conform to all the height and area regulations of the zone in which it is located or which is so designed, erected or altered that it could not reasonably be occupied by a use permitted in the zone in which it is located.

8 Non-conforming Use Any use of land, buildings, structures which was lawfully established and maintained prior to the adoption of the Yolo County zoning regulations on November 18, 1963, or a subsequent amendment to the zoning regulations, but because of the application of this ordinance to it, no longer conforms to the specific regulations applicable to the zone in which it is located. Nursing Home, Rest Home, Sanitarium Shall mean any premises providing licensed health care pursuant to the provisions of the Welfare or Health Department of the County or State. Nurseries, Wholesale-Commercial "Commercial nurseries" shall mean the retail handling of any article, substance, or commodity related to the occupation of gardening, including the sale of plants, shrubs, trees, packaged fertilizers, soils, chemicals, and other nursery goods and related products. The bulk sale or bulk storage of fertilizers, soils, chemicals and other garden suppliers shall be within a completely enclosed building. "Wholesale nurseries" shall mean all nurseries other than those defined as commercial nurseries. Occupational Medical Outpatient Clinic Any medical office, including urgent care that primarily treats industrial and commercial injuries on an outpatient basis. Industrial patients must account for at least 50% of the clinic s overall patient base. Office, Business/Corporate/Administrative Means an office which has as its main functions the arrangement of business transactions, the holding of sales meeting and administrative conferences, the receiving of clients payments and the keeping of records and accounts pertaining to the particular business. Office, Medical or Dental "Medical office" means a place for the practice of physiotherapy or medical, dental, optical, psychoanalytical, osteopathic or chiropractic professions. Office, Professional Shall mean an office from which and at which an attorney, engineer, architect, accountant, real estate agent or similar professional person may offer services. Official Plan Line Means an officially established line defining the outer boundaries within which a public road right-of-way may be widened, constructed or extended and within which the construction of structures is prohibited. Open Space Land which is available for outdoor recreational activities on a residential property. Area which counts as open space includes; landscaping, decks, patios, including covered patios with

9 at least twenty-five percent (25%) of the wall area open; and the open aisles in parking lots, but not the parking spaces themselves. Ordinary Repair and Maintenance Ordinary maintenance and repair for existing nonconforming uses shall mean necessary repair and maintenance of existing operational, serviceable structures, facilities, pipelines, and/or equipment that involves no expansion of or change in the existing use beyond those that currently exist. The ordinary maintenance and repair of existing structures, facilities, and/or equipment including pipelines shall not increase volume levels of storage or pumping and any activity related to terminalling (including loading, unloading and storage). This shall not preclude the replacement of any pipelines and appurtenant equipment that is necessary to comply with federal and/or state regulatory requirements. Other Business Services Shall mean services rendered to a business establishment or individual on a fee or contract basis not identified in the Land Use Matrix (e.g. advertising agencies, employment agencies, consulting services, etc.) Outdoor Sales Means any retail business whose sales are conducted entirely outside of an enclosed building except for incidental storage of goods and customer transactions. This definition does not include farmers markets. Outdoor Storage Means the stocking, parking, stacking or holding of goods, materials or equipment in the open or in a partially closed structure. Outpatient Clinic (Formerly Outpatient Medical Care) Means a medical facility equipped for the diagnosis and treatment of human patients including performing minor surgical procedures with no overnight stays permitted. Owner Owner" means the person holding legal title to, or recorded contract of purchase of, the property in question.
