Recommendation Staff recommends the Planning Commission approve the Conditional Use Permit as outlined in the Recommendation and Alternatives section of the staff report. Request The application is requesting a Conditional Use Permit approval to upgrade and change the antennas on an existing monopole, including 3 additional antennas. Background On September 27, 2016, the City received an application for CUP for a Telecommunications Facility. The facility is an existing nonconforming monopole. Prior to the current Telecommunications ordinance, the pole was approved.
2 The pole is 100 tall and does not meet the current height or setback regulations. The applicant is requesting the CUP to change out the 6 antennas and add 3 more. The current code does not specify how many antennas can be on a single pole and encourages co-location. Due to the nonconforming status of the pole, a CUP is required, which gives the Planning Commission discretion of waiving the height and setback requirements. Process Section states that a nonconforming monopole may have height and setback requirements waives as a Conditional Use Permit that is approved by the Planning Commission. General Plan Staff Finding: Consistent. The application has come before the Planning Commission for consideration to waive the height and setback requirements. The land use map of the General Plan indicates this site as Industrial. Staff Finding: Consistent. The property is zoned as I-1 Industrial. Code Requirements The following is a summary of the code requirements. For a full analysis, see the attached checklist (Exhibit C). The application Can Comply with the code requirements as follows: Development Standards The existing tower exceeds the maximum height requirements, and does not meet the setback requirements Expansion, Alteration, and Nonconforming Uses The height and setback requirements of the existing pole may be waived by the Planning Commission as a CUP. Recommendation and Alternatives Staff Recommended Option Approval I move to approve the T-Mobile Conditional Use Permit with the Findings and Conditions in the Staff Report: Findings 1. The application complies with the Development Code. 2. The application is consistent with the General Plan.
3 Conditions: 1. All other code requirements shall be met. 2. Any other conditions or changes as articulated by the BODY:. Alternative 1 - Continuance I move to continue the T-Mobile Conditional Use Permit to another meeting, with direction to the applicant and Staff on information and / or changes needed to render a decision, as follows: Alternative 2 Denial I move to deny the T-Mobile Conditional Use Permit with the Findings below: 1. The T-Mobile Conditional Use Permit is not consistent with the General Plan, as articulated by the Planning Commission:, and/or, 2.
