5 Summary This leaflet is binding for all UIC railway undertakings involved in the international carriage of exceptional consignments and - defines the term "exceptional consignment"; - governs the approval and authorisation procedure for international transport; - lists the contacts of the individual groups for exceptional consignments and national approval offices. The following basic documents apply for the international carriage of exceptional consignments: - General contract for the use of wagons - GCU; - UIC loading guidelines - volumes 1, 2 and 3; - Convention concerning international carriage by rail CTIF 99; - Uniform Rules concerning the contract for the international transport of goods by rail - CIM (CTIF 99 Appendix B); - Uniform Rules concerning the contract for the use of infrastructure in international rail traffic - CUI (CTIF 99 Appendix E); NB: the CTIF 99 is not yet ratified by all countries. - Agreement governing the reciprocal use of passenger coaches in international traffic (RIC); - Agreement governing International Railway Freight Traffic (SMGS). The preparation and implementation of the carriage of a consignment requires a co-ordinated approach between the railway undertakings (RU), infrastructure managers (IM) or railways involved. Railways in the sense of this leaflet are railway undertakings for which there is no separation into RU and IM. The tasks involved in organising exceptional consignments are to be performed either by the railway, IM, or RU. Individual RUs and IMs can also conclude agreements with one another that deviate from the provisions of this leaflet. This only applies for the exceptional consignments referred to in this leaflet and only for the carriage of consignments between the contractual partners. Special arrangements are laid down in UIC Leaflet for the coding of out-of-gauge consignments in accordance with the outline procedure. The carriage of exceptional consignments on railways with a track gauge of 1520 mm will be governed by UIC Leaflet once the content thereof has been coordinated and agreed with SJD

6 1 - Exceptional consignments A consignment is considered to be exceptional if its external dimensions, its weight or its properties give rise to particular difficulties in relation to the fixed equipment or wagon for anyone involved in the carriage of the consignment, and it can therefore only be accepted under special technical or operating conditions which must be agreed in advance between all RUs/railways (see List of abbreviations - page 32 und Glossary - page 34) involved in the carriage thereof. For exceptions to this rule, (see point page 8) The following are exceptional consignments (also bearing in mind the regulations of the CIM (see List of abbreviations) and the UIC Loading Guidelines): a) Consignments which are not secured in accordance with the UIC Loading Guidelines, Volumes 1 or 2 and which have no equivalent alternative securing systems, e.g. in accordance with the loading examples (information sheets) published on pink paper; b) Consignments which exceed the smallest loading gauge of one of the railways/ims (see List of abbreviations and Glossary) on the route, bearing in mind the restrictions of the loading width according to the UIC Loading Guidelines; c) Rigid load units loaded on two wagons with pivoted bolster/rotary sliding bolster; including barrier/ intermediate wagons; d) Flexible load units loaded on more than two wagons NB: n certain railways such consignments are moved taking into account the loading examples provided in the Loading Guidelines:. For block trains: SZDC (CZ), DB, SBB, ZSR (SK), ProRail (NL), MAV, CFL. For wagonload traffic: DB, SBB. Loaded on three wagons of max. length 36m: RFI (FS); e) Load units which cannot be forwarded to the destination station (see Glossary) without transhipment, if they weigh more than 25 t or are loaded on low-loader wagons (only applies for the transhipment to railways with different track gauges); f) Consignments to be transhipped to a ferry if they do not meet the regulations of GCU, Appendix 14, Part A (see List of abbreviations and Bibliography); g) Wagons with more than 3 axles per bogie, if loaded; h) Railway vehicles, loaded on their own wheels, which are themselves the subject of a freight contract if they bear neither the RIV or RIC marking, the TEN marking (valid in EU Member States) (see List of abbreviations) or the derogation plate in accordance with GCU Appendix 11, Point 2.1 or 2.2; i) Vehicles whose load exceeds the permissible load limit for the class of the line to be negotiated; j) Vehicles loaded in excess of the maximum load limit marked on them (load limit label/additional load limit label) up to the maximum design carrying capacity; k) Loaded vehicles which do not have details of their load limits marked on them;

7 l) Vehicles on their own wheels not authorised by the IM (motive power units, multiple units, trams, civil engineering vehicles, cranes, etc.) which may only be carried under special operational arrangements and with specific approval; m) Vehicles that are overdue for repair 1. If one of the above conditions is not met then the consignment is no longer considered to be a combined transport consignment and shall be subject to the provisions of this leaflet. 1. 8 2 - rganisation, basic regulations Each railway/im/ru shall nominate one or more independent groups to be responsible for the technical, operational and commercial management and for the authorisation of exceptional consignments. This group (GEC - see List of abbreviations - page 32) collects the facts and coordinates the management of exceptional consignments The term "GEC" includes each of the groups bearing national responsibility, whether this be the RU (RU GEC), the IM (IM GEC) or the railway (railway GEC). If a railway/im/ru nominates several independent groups, the responsibility of each group must be delimited vis-à-vis that of the others Rules covering the relationships between RU GECs and IM GECs are the subject of the "Contract for the use of infrastructure in international rail traffic" (CTIF 99, Appendix E (CUI) - see Bibliography - page 37) The RU GEC performs the following basic services: - It takes orders from customers for the carriage of exceptional consignments, - It defines the transport conditions (selection of a suitable wagon and suitable loading method and load securing system, etc.) and the delivery deadlines, - It proposes the forwarding route to the next RU, including transit stations, - It issues the approval application to all RUs involved in the carriage of the consignment, to the IM on whose network its own RU has a safety certificate entitling it to operate in connection with an infrastructure usage contract, and for which this RU acts as transport manager (see Glossary), - It issues a handover approval to the participating RUs, - It notifies customers and its own personnel of the conditions for the implementation of the freight contract (transport authorisation). The GECs responsible for the exceptional consignment approval process at the RU, IM or railways are cited in Appendix E - page

9 The IM GEC co-ordinates the activities for the determination and specification of the operational forwarding conditions under the responsibility of the infrastructure manager, checks the completeness and plausibility of the consignment data received from the RU GEC and where appropriate assigns the forwarding number to the consignment. - It checks the assigned forwarding route, - It determines the operational and technical conditions on the basis of information provided by the RU, and announces these, - In the case of border-crossing routes it agrees the operational and technical conditions with the neighbouring RU GECs, - It works out the procedure for notifying operational personnel involved in the carriage of the exceptional consignment of the train run and forwarding conditions, - It prices the infrastructure services The railway GEC performs all tasks that are performed individually by the RU GEC and IM GEC. Each railway adapts the assignment of tasks to suit its own organisational arrangements Separate documents/certificates are required in accordance with point A.2 - page 23 - number 6 for the carriage of vehicles for which there is no authorisation to place in service. According to the TEIV (Regulation concerning the interoperability of the trans-european railway system), authorisation is required from the national safety authority or a notified body for: - Test runs, - Transfer operations if these exceed the permissible maximum loading gauge. Applications to national safety authorities (listed in Appendix E - page 31) can be made by manufacturers, keepers or RUs. Railways without a national safety authority (approval body) issue approval under their own responsibility Any changes to the contacts listed in Appendix E must be notified without delay by the RU/IM/ railway concerned to gas.technik@railcargo.com The IM/railway GECs shall immediately notify all those RU GECs listed in Appendix E ( of all changes that have been made in their area between the dates of issue of corrections to the international regulations and UIC leaflets (Loading Guidelines, Volume 3, UIC Leaflet 502-2, Appendices A and B) Communication between GECs shall generally be in writing. In urgent and exceptional cases this can take place in advance by telephone. All communications should take place in one of the UIC working languages (German, French, or English). The numerical code in accordance with point A.1 - page 20 of this leaflet shall be quoted in such communications Approval or refusal must be provided as soon as possible (within 14 calendar days at the latest). If this timescale cannot be met, all GECs involved in the transport operation shall be notified, stating the reason for the delay and a date by which the situation can be resolved

11 4 - Management of exceptional consignments Administration manager and transport manager The RU/railway GEC in whose field of responsibility the transport operation begins is the administration manager and is responsible for the approval and authorisation procedure (see Glossary - page 34) The RU/railway GEC with which the freight contract is concluded is the lead GEC for the transport operation (transport manager). This GEC discusses any errors and claims that may have arisen concerning the transport operation with the customer and hands over his arrangements to any further participating RUs (CIM article 18, 1-5, article 19, see Bibliography - page 37). See also point 10 - page The transport manager must always be notified of the arrangements made at the request of the consignee in accordance with CIM (article 17 3, article 18, 3-5) Submission of application by the customer The application for the carriage of an exceptional consignment shall be made in writing by the consignor to the RU/dispatching railway (see Glossary) Applications must contain at least the following information: - Name and address of the applicant, (see Glossary), - Type of load, dimensions and weight of the payload, - Number of identical units, - Forwarding station,(see Glossary), - Destination station, - Border and handover stations, - RU(s) that is/are to perform the transport operation, - Consignee, - Freight payer (optional),(see Glossary), - Provisional dispatch date. If the payload has a complicated shape, a sketch of the consignment (see Appendix B - page 26) in three views should be attached showing all the critical points for the consignment and the position of the centre of gravity If the sender wants to apply for a particular type of wagon to be used, this should be stated in the application

12 For the carriage of vehicles on their own wheels, additional technical and operating data is necessary, which can be obtained from the vehicle documentation or the vehicle markings. A summary is provided in point A.2 - page Application for approval The RU/railway GEC under whose responsibility the transport operation begins (administration manager) shall check all documents and assemble the "Approval application for an exceptional consignment" (see point A.1 - page 20) The approval application only applies for one consignment with certain dimensions, weight and loading type If several different exceptional consignments are carried together in a group/train, this should be indicated. In this case, a summarised approval application can be made for several consignments under one forwarding number. Exceptional consignments subject to the same forwarding conditions at an IM/railway can be summarised in a single approval application. Exceptional consignments that are subject to special conditions only for the dispatching RU/IM/railway can be handed over to the other RUs/IMs/railways on the route as normal consignments. In such cases, the RUs/IMs/railways participating in carriage do not need to be involved in the approval process; rather, the forwarding number simply needs to be indicated in the consignment note (see Glossary - page 34) and Label U, specifying in addition that it is a "Normal consignment for IM(s)..." (e.g. DB, SNCF) The numerical code specified in point A.1 shall be used in the approval application. This appendix lists all important points for the consignment. In the case of out-of-gauge loads carried in accordance with a particular profile, UIC Leaflet is to be applied and the profile number of the consignment to be indicated. If vehicles are to be conveyed on their own wheels, point A.2 is also to be completed and attached to the exceptional consignment approval application (see point A.1) or the relevant information included in the approval application itself The coordinates of a defined out-of-gauge consignment are considered the critical points The details of the position of the centre of gravity are given in point 19 as specified in Appendix A - page 20 as follows: The figures represent the following (in order): - height above the base of the goods, / /00000 (mm) - distance from the side of the goods in the transverse direction, - distance from the ends of the goods in the longitudinal direction A route is to be planned and proposed by listing the transhipment and handover stations (see Glossary - page 34)

13 4.4 - Administration of the consignment Unless otherwise provided for, the RU GEC shall forward the approval application prepared in accordance with point page 8 to the IM GEC for checking vis-à-vis completeness and plausibility, supplying also, where relevant, the loading sketch in accordance with Appendix B - page 26. Any discrepancies shall be resolved by mutual consultation The IM GEC shall assign the consignment a forwarding number (see Glossary - page 34), unless a forwarding number has been issued by the RU. This forwarding number will be quoted in all correspondence between any parties involved in the transport operation (RU GEC, IM GEC, railway GEC) After receiving the forwarding number for the consignment, the RU or railway GEC that is to conclude the freight contract (administration manager) shall send the "Approval application for an exceptional consignment" to all RU or railway GECs involved in the transport operation. RU, IM or railway GECs which receive an approval application for the carriage of an exceptional consignment shall check whether in view of the parameters quoted the consignment can be transported in the area for which they are responsible IM agreement to accept consignment Each RU GEC involved in the transport operation shall send the approval application it has received to the IM GEC upon whose network the RU intends to carry the consignment (assuming no other rules are in force allowing the RU to decide alone). For the IM or railway GEC at which the coded out-of-gauge consignment is to be carried in accordance with the provisions of UIC Leaflet 502-2, this approval application serves as advance notification of the transport operation (see Glossary - page 34) The IM GEC checks whether the RU which is the transport manager has concluded the infrastructure usage contract (e.g. in accordance with CTIF Appendix E - CUI, Article 5). If it has not concluded this contract the carriage of the consignment is refused The "IM GEC Handover Approval" indicates the conditions for the forwarding of the requested exceptional consignment At least the following are stated in this IM GEC handover approval: - Forwarding number of the transport manager, - Period of validity, - Defined forwarding route, - The forwarding conditions for its own field of responsibility, - The handover conditions for the adjoining IMs or railways, - The costs of the IM GEC's services and for additional and any other services

14 If carriage by the route proposed in the approval application is not possible and there are potential alternatives, the IM GEC shall agree any changes with the RU GEC before issuing a refusal The IM GEC shall send the handover approval to the requesting RU and also to each of the adjoining IM/railway GECs. Exceptions to this rule can be agreed upon bilaterally or multilaterally by the IMs RU/railway agreement to accept consignment The "RU GEC handover approval for the carriage of the exceptional consignment" in accordance with point A.1 - page 20 is a notification by means of which the RUs/railways involved in the transport operation confirm their part in the freight contract to the transport manager. This confirmation by the participating RUs/railways may not take place until the IM GEC handover approval with all technical and operational conditions has been issued. The GECs for all participating RUs listed in point 20b of the approval application also grant one another reciprocal handover approval The freight contract (authorisation) for the carriage of the exceptional consignment may not be concluded unless the handover approvals of all participating RUs have been received Miscellaneous The period of validity of the IM handover approval and RU handover approval must be at least three months and can be restricted to certain periods of time (e.g. specific timetable periods - see Glossary - page 34) If the consignment cannot be forwarded by an RU, IM or railway, the GEC participating in the transport operation must be advised. The reason for the refusal to carry out the transport operation and, where possible, an alternative proposal shall be given (e.g. reduction of the height of the load, loading on another type of wagon, etc.) The processing of the application will be discontinued: - If the RU GEC that made the application withdraws its application, - If one of the RU/IM GECs or railways participating in the transport operation refuses the consignment If the authorisation for an exceptional consignment expires within the time period allotted for the carriage of the consignment due to unforeseen delays to transport operations, the consignment can be carried on to its destination station and may not be refused on the grounds that its authorisation has expired. This overshooting of the allotted time period may not exceed seven calendar days Does not apply at PKP, SNCF, HZ, CFL and ADIF

15 5 - Transport authorisation As soon as the handover approvals have been received from all the GECs participating in the transport operation (RU/railway), the consignor shall receive the "Transport authorisation" The transport authorisation must contain at least: - All forwarding numbers of the GECs involved in the transport operation (RU/railway), - Details of the type, dimensions and weight of the consignment - The period of validity, - Approved types of wagon, - Conditions for the loading of the consignment (e.g. critical points, arrangement of the consignment at time of departure, earthing of the load, submission of further documents, etc.), - Dispatch station, destination station, handover stations, - Information for the marking of the consignment, - Information for the calculation of freight costs Registration of the goods shall be taken to mean that the above conditions are accepted The consignor is responsible for preparing the consignment note If the transport operation is not possible, the consignor shall be advised

16 6 - Loading and preparation for transport The goods may only be loaded on the approved type(s) of wagon and in accordance with the method of loading specified in the transport authorisation The method of loading shall jeopardise neither the goods nor the safety of railway operation; nor shall either of the above be jeopardised as a result of impacts and other movements that occur during normal railway operation. The objects loaded should be fastened safely and securely so that they do not move whilst in transit. For certain goods it is possible to provide for longitudinal displacement, but this should be limited by suitable means. In general, the regulations of the Loading Guidelines apply, provided nothing else has been agreed in writing The consignor may not make any modifications to the wagons provided for the consignment, such as drilling holes, welding on fastenings or burning off parts, etc without the agreement of the keeper The consignor shall arrange for vehicles to be carried on their own wheels as rolling goods without their own power equipment (e.g. tractive units, civil engineering plant, crane wagons) to be prepared for towing. This should be confirmed in writing and this written confirmation attached to the accompanying papers Furthermore, CIM, Article 13 applies

17 7 - Acceptance, marking and carriage (CIM Art. 13, Art. 14, Art. 15) Acceptance The consigning RU is responsible for ensuring that the exceptional consignment matches the transport authorisation. This match should be checked upon acceptance. If it does not fully match the consignment should be refused Marking The satisfactory acceptance of the exceptional consignment shall be confirmed by affixing the "Label for exceptional consignments - Label U" (blue or white, point C.1 - page 27, GCU Appendix 9, Annex 11). Direction-sensitive consignments are indicated in the transport authorisation and are to be marked with the "Label for direction-sensitive consignments" (see point C.2 - page 29) n Label U, the markings and the forwarding numbers of the participating RUs/railways are to be listed in the order of the forwarding route of the consignment. The same applies to the small section for the consignment note (see point page 16). The details of the total weight, load per metre, maximum axle load and the critical points should be copied over from the transport authorisation Labelling with Label U as described under point page 13 is not required: - on block train consignments of accompanied combined transport (RoLa) from terminal to terminal), - on consignments of unaccompanied combined transport (CT) in agreed codified trains, - if agreed between all the RUs participating in the transport operation (transport authorisation) If the "Label for direction-sensitive out-of-gauge consignments" cannot be affixed directly to the payload, it should be affixed to a board which should be fastened to the goods in a suitable manner

18 7.3 - Carriage The RU GEC shall agree with the IM GEC the minimum period for notification before the planned train departure, the forwarding number of the consignment and the trains to be used. The IM GEC shall inform all national infrastructure bodies involved in the train run by means of the forwarding instruction (timetable instruction), as well as neighbouring IMs and the RU executing the carriage (see Glossary - page 34) An exceptional consignment may not be taken on board trains until the forwarding instruction (e.g. timetable), in which the transport date, the trains to be used and the forwarding conditions are set down, has been received. The forwarding instruction is not required if no special forwarding conditions apply. In such cases, the handing-over RU shall send an announcement to the accepting RU/neighbouring railway In the case of cross-border traffic, advance notification should be given of exceptional consignments by the handing-over RU. Specific agreements between individual RUs, IMs and railways are possible If an exceptional consignment is carried by a special train, a certain advance notice period can be stipulated

19 8 - Calculation of costs It is the responsibility of all RUs participating in the transport operation to determine their forwarding price, taking into consideration the forwarding conditions specified for their stretch of line and the costs calculated by the IM If necessary, the IM can report a forwarding price as a total price (freight + IM's costs - see point A.1 - page 20, code 38) on behalf of an RU Each RU can conclude a specific commercial agreement with the customer for the carriage of the consignment. This specific agreement is concluded with the customer on behalf of one or more of the RUs participating in the transport operation

20 9 - Consignment note (CIM Art. 6, Art. 7, Art. 8, Art. 10, Art. 12) nly the holder of the transport authorisation of the dispatching RU or railway may appear as the consignor on the consignment note Field 22 of the consignment note, "exceptional consignment", should be marked with a cross Each RU or each railway involved in the transport operation and the forwarding numbers must be entered in the "Consignor's declarations" field of the consignment note (field 7) The detachable part of Label U must be attached to the top right-hand edge of the paper consignment note. This part of Label U need not be attached to the electronic consignment note If the consignment is to be accompanied, the following note must be entered in the "Consignor's declarations" field of the consignment note (field 7): Accompanied from... to...by... (number) of accompanying persons (names), by agreement with the RU... For each accompanying person, an authorisation for escort is to be produced in accordance with the CIT Handbook for Freight Traffic (GTM-CIT), Section B - Process, 6 Working Sheet 02, "Acceptance for carriage", and the template in Appendix 13 thereof. The escort must be able to produce this authorisation at any time upon request The number of the specific agreement, of the freight quotation or of the tariff requested by the consignor must be entered in the "Commercial conditions" field. Likewise the route, the specified handover stations and the RU entrusted with executing the carriage must be stated

21 10 - Delivery periods, carriage period (CIM Art 16, 1, 4, Art. 22, Art 33, Art a), b), c), d)) The agreed delivery period is the period from the acceptance of the consignment for carriage to the handover to the authorised consignee The carriage period is determined by each RU for its section. The carriage period is stated in the transport authorisation. The carriage period is the time interval between the acceptance of the consignment for carriage (from the consignor or the previous RU) and the handover of the consignment (to the next RU or the authorised consignee) The delivery periods for exceptional consignments may be excluded by the RUs

22 11 - Problems with carriage, adjustment of the load, transhipment, repair of the wagon so that it is able to run (CIM Art. 20, Art 21, Art. 22, Art. 24, Art. 26, Art. 27) If problems occur with the carriage of the consignment it may be necessary to convey the carriage on a different route than that envisaged. In this case, the consignment must once again be processed in accordance with the provisions of point 4 - page 7 of this leaflet It is necessary to suspend an exceptional consignment if: - it is found during the journey that the goods must be adjusted or transhipped, - it is not possible to carry the consignment further, - the train has to be diverted via a line that has not been checked or approved for the transport operation, - the consignment had not previously been recognised and marked as an exceptional consignment. If in combined transport a loaded wagon whose combined transport profile exceeds the dimensions given in the Loading Guidelines (Volume 1 (Tables) or Volume 2 (Loading Guidelines 9.0)) is removed from a combined transport train and cannot be forwarded in another appropriately-coded combined transport train, it becomes an exceptional consignment If a consignment has to be adjusted or transhipped during the journey, the provisions of the GTM-CIT, 05, 05-01, Point 1.2 are to be applied After each adjustment of the load or transhipment of an exceptional consignment, there must be a new acceptance as specified in point page 13. This new acceptance shall be confirmed in the accompanying papers If the new acceptance results in changes in relation to the existing transport authorisation, a new approval application shall be prepared. 38 Glossary Administration manager Advance notification Announcement Applicant Border-crossing route Consignment note Consignor Customs station Destination station A railway undertaking in whose field of responsibility the transport operation begins and which is in charge of the administration with other participating RUs. Report by means of which a dispatching RU notifies all the other RUs involved in the transport operation that the coded out-of-gauge consignment is to be carried using a particular profile. The details of the consignment correspond to those in the approval application. Report by means of which a handing-over RU announces the exceptional consignment to the accepting RU. It contains, at a minimum, the date, hour, authorisation number and the number of the train that is to carry the consignment. The party applying for the organisation of an exceptional consignment. The route section between two stations situated either side of a national border, which are stipulated in the application agreement (see UIC Leaflet 471-1). A document which: - is used for the freight contract, - is filled in by the consignor of the goods, - accompanies the consignment(s) throughout the route, - provides information about the key data of the consignment(s) for the customer/ru/authorities, etc. - serves as an accounting document at the end of the transport operation. UIC member railways/rus use the CIM consignment note. The consignment note is produced in paper format or electronically. The organisation or person entered in field 10 of the CIM consignment note, who gives the forwarding papers to the transport manager. The station at which the customs administration is performed. The customs station can be a border station or another station. The station specified by the consignor in the consignment note at which the carriage of the consignment(s) ends and to which the consignment(s) are delivered. The infrastructure manager also takes charge of the operation of the associated train control and signalling systems, plus the associated equipment for the provision of traction current on each line.
