1 Noise Variance #: NVAR Noise Variance Review The noise variance (NVAR ) request dated May 5, 2017 was evaluated based on the information provided in the variance submitted and any additional information communicated during review. The request is to install a new 16 gas main via a combination of horizontal directional drilling and open trench related to Work Order WO The pipeline within the city of Tacoma would extend southeast from East 11th Street on Taylor Way for approximately 2.3 miles to the City of Tacoma/City of Fife boundary. The work is believed to exceed noise limits set forth in Tacoma Municipal Code The information was reviewed based on 1)The character and degree of injury to, or interference with, the health and welfare of the reasonable use of property which is caused or threatened to be caused by the sound to result from the permit of variance. 2) The social and economic value of the activity for which the variance is sought. 3) The ability of the applicant to apply best practical noise control measures. 4) Physical conditions that create a significant financial hardship in complying with the provisions of this chapter. Approved with conditions Denied Evaluation: Per the submittal and conversations with the applicant, this project duration is proposed to start May 15, 2017 and extend until approximately September 15, Work approved in the City Traffic Control Plan associated with the Work Order number WO is from 7pm to 5am Monday through Friday and Saturday 6am to Monday 5am. Per discussion with City Traffic Engineer, the requirement to night work is due to traffic at the arterial street, impacts to local businesses, and nearby high volume intersections. Per conversation with the applicant the Work order and Traffic Control plan accurately represents the work areas, see attached. Staff compared the site to City of Tacoma GovME website to determine proximity of nearby residents. See the Notification Area Maps attached. Residential structures in Tacoma are identified 2100 northeast from the work site. The applicant has indicated that the proposed equipment consists of various items identified on the attached Applicant Provided Equipment Noise Levels Table. The proposed equipment noise levels were compared with the Federal Highway Administration for Construction Noise Handbook Table 9.1 and 9.9 for verification. Approximate levels at 50 feet are: Excavators to 85 dba, front end loader to 80 dba, backhoe to 80 dba, hydro excavator dba, dump truck 84dBA, Boom truck/flat-bed truck 84 dba, night lite/generator 73 dba, welding rigs 74 dba, hoe pak on excavator 83 dba, Breaker on excavator 90dBA, air compressor 80dBA, asphalt zipper/grinder 85 to 90dBA, ditch witch/drill rig 84dBA. The applicant estimates the maximum equipment sound to be 115 db near the equipment and this would be consistent with the levels near 85 to 90 dba at 50 feet. During the day time, construction activity noise is allowed from 7am to 9pm weekdays and 9am to 9pm on weekends and holidays. TMC limits work between 10pm and 7am to not exceed 5 dba above ambient. The ambient noise in the work area is estimated to range between 60 without vehicle traffic and up to 85 dba with traffic. Further up the hillside near residential areas the ambient consists of distant port activities and vehicle traffic near 63 dba. Noise impacts to residents are anticipated to be consistent with current port activities considering the substantial distance from the work site and traffic noise levels. Concrete breaking and hydro excavator equipment with higher potential for sound spikes required special consideration. Conditions of approval: 1. Use best management practices to shield noise from nearby residents by using a sound absorbing barrier after 9pm, as proposed by the applicant. The noise barrier will assist with mitigating potential sound impacts. The concrete breaker and hydro excavator noises proposed above 85dBA shall be used prior to 9pm or during the weekend daytime when they are allowed without limitation. 2. Notification shall be provided by the applicant via first class mail to the owners of property and/or taxpayers of record as per the records of the Pierce County Assessor/Treasurer within 2500 of the boundaries of the Manufacturing/Industrial Center consistent with the City of Tacoma, Planning and Development Director s Rule # for Expanded Notification, see the Notification Area Map. The notification shall be provided 5 days prior to the start of work and indicate the date, times, and applicant contact for questions relating to the work. Provide City review staff list of properties for neighborhood notice sent for verification. 3. This approval applies to work and impacts created within the City of Tacoma jurisdiction. Additional and separate approvals may be necessary for proposed impacts to other jurisdictions outside of Tacoma. This determination was the result of staff review. If the accuracy of the information submitted and/or approval conditions are not complied with, then the noise variance may be voided. Additional submittal, review, and fee may be required for reinstatement.
