1 SETTING UP AN APPROPRIATE INSTITUTIONAL STRUCTURE FOR IMPLEMENTATION OF PRTR PROTOCOL CASE STUDY SERBIA Nebojša Redžić, M.Sc. Serbian Environmental Protection Agency
2 Serbia has undertaken appropriate institutional changes, especially with respect to environmental data collection, and regular reporting and coordination of information systems, which is all in order to facilitate the implementation of the Aarhus Convention and PRTR Protocol. Institutional framework for the establishment and keeping of the PRTR register is clearly defined within the: 1. Law on Ministries and 2. Environmental Protection Law.

4 MINISTRY OF ENERGY, DEVELOPMENT AND THE ENVIRONMENTAL PROTECTION Ministry of Energy, Development and the Environmental Protection is responsible for state administration relating to: the basics of environmental protection, system protection and improvement of the environment; inspection in the field of environmental protection; application of scientific and technological research and development research in the field of energy and the environment; implementation of the Convention on public participation, access to information and the right to the protection of the environment; nature conservation, protection of air

6 SERBIAN ENVIRONMENTAL PROTECTION AGENCY Serbian Environmental Protection Agency performs technical tasks related to: The development, coordination and management of national information system for environment (monitoring of environment, register of polluter sources etc..) Collecting and integrating environmental data, processing and reporting on the state of the environment and policy implementation the environment; Development of procedures for processing data on the environment and their evaluation; Keeping information on best available techniques and practices and their application in the field of environmental protection; Cooperation with the EEA and EIONET.
7 SERBIAN ENVIRONMENTAL PROTECTION AGENCY
8 To monitor qualitative and quantitative changes in the environment and measures for the protection of the environment, the Environmental Protection Agency established the National Cadastre of Polluters in 2006, based on the principle of the PRTR protocol. In the process of establishing a PRTR register Guidance on Implementation of the Protocol on Pollutant Release and Transfer Registers, UNECE, 2008 were used, as a main manual for implementation. Other Guidances also used UNECE, EU, OSCE, UNITAR etc.
9 The activities of reporting and data collection was started in 2006 with establishment of an National Cadastre of Polluters. In National Cadastre of Polluters change name in National Register of Pollution Sources within process of harmonisation of Serbian legislation with EU legislation. National PRTR register is a set of systematized information and data on the sources of pollution of environmental media, ie, a register of all human activities that may have a negative impact on the environment in an area.
10 In order to provide more efficient data collection system, in cooperation with the Ministry Department of IPPC and Department of environmental inspection, SEPA prepared a preliminary list of PRTR operators. PRTR register includes around 270 facilities which are the most significant sources of pollution in the Republic of Serbia in the field of 1. Energy 2. Production and processing of metals 3. Mineral industry 4. Chemical Industry 5. Waste Management and Waste Water 6. Paper and wood products 7. Intensive livestock production and fisheries 8. Food industry 9. Other industries.
11 BYLAW These companies provide data in accordance with the Regulations on the development of a national and a local register of polluters, as well as the methodology for the types, terms and conditions of data collection ("Off. Gazette of RS", No. 91/2010). The only article that has not been implemented and harmonized due to EU legislation is thresholds for reporting. All companies must report all data.
12 Centralized system as much as possible to avoid mistakes. SEPA collect, manage and process all data from all facilities. SEPA prepares reports and disseminate data. SEPA sends data and indicators in the international exchange - EEA, EIONET, EUROSTAT. 13 MAIN PROBLEM: The SEPA has no legal competences for the supervision and control of the companies. ONGOING ACTIVITY: Establishing a network of environmental and communal inspection bodies at all levels for support of SEPA s activities. Inspection bodies State Province Vojvodina Local communities
14 The analysis of data submission noted several problems: Companies are not properly informed that there is a reporting obligation, Companies do not know how to fill out the required forms, Companies do not want to fill in forms delivered or provided incomplete or incorrectly filled data.
15 PERMANENT CHANGES IN THE LIST OF PRTR FACILITIES In the period there were a number of changes to the list of facilities that must submit reports. Company changed owners (privatization) - One of them changed owner 7 times in 3 years. Companies change activities - One year on PRTR list, the other is not. Companies operating at reduced capacity. Companies bancrot.

18 Data on waste from one company for 3 years. The company had a decline in production in 2008 and stagnation in the 2009th year.

20 In cooperation with the Ministry, SEPA works on : Increasing the level of awareness of citizens and businesses Increasing the capacity of the company in meeting the obligations due to environmental protection Additional expansion capacity of the Agency to increase the efficiency and effectiveness of the work and so on.

24 2011. Serbia ratified the PRTR Protocol. From SEPA send data from 2009 on a voluntary basis for the EEA E-PRTR priority data flow.
