Sir, Ref: - Tender Notification: No.TF/ELEC/1851/ /Voll-III, dated *** 1) I / we of hereby offer my / our tender in accordance with the conditions for supply of packing machine spares. 2) (a) I/we enclose herewith a Bank Draft for the sum of Rs.1145/- (Rupees One Thousand One Hundred and Forty Five only) bearing No. and date towards the non-refundable cost of Tender Schedule Documents in favour of Telangana Foods. (b) I/we enclose herewith a Bank Draft for the sum of Rs. 10,000/-- (Rupees Ten Thousand only) bearing No. Dt. as Earnest Money Deposit drawn in favour of Telangana Foods to be returned to me/us if this offer is not accepted. 3) I / we furnish the following details for your consideration of (Here tenderer should give the details pertaining to the experience and also other particulars connected with the business)

2 :2: GENERAL INSTRUCTIONS TO TENDERERS 1) The Sealed Tenders i.e. Technical Bid and the Financial Bid i.e., the Price Bid should reach the Managing Director, Telangana Foods, Nacharam, Hyderabad by 2.00 PM on along with required Demand Drafts as indicated in tender notification payable to Telangana Foods, Nacharam, Hyderabad, towards the cost of Tender Schedule and EMD (Separate Demand Drafts). 2) Technical Bid will be opened in the presence of the tenderers or their authorized Representatives who choose to be present at 3.00 PM on and the Price Bid will be opened on at AM. 3) The tenderer has to enclose required cost of Tender Schedule and EMD for the item mentioned in the Tender Schedule in the form of Demand Drafts drawn from any Nationalized Bank or Scheduled Bank (excluding Urban Co-operative Bank, Grameena Banks and Foreign Banks) in favour of Telangana Foods, Hyderabad. 4) The tenders received without the above requirements shall be summarily rejected. The tenders with over-writings, alterations etc., will not be admitted unless they are attested by the tenderer. Tenders should be neatly written and every correction should be invariably attested by full signature with date before submission of tenders to the authority concerned, failing which the Tenders will not be eligible for further consideration. Errors, if any, will be corrected/ accepted by the tender accepting authority at its discretion as follows: (i) Where there is a discrepancy between the rates in figures and in words, the rate in words will govern and (ii) Where there is a discrepancy between the unit rate and the line item, the total resulting from multiplying the unit rate by the quantity, the unit rate as quoted will govern. 5) Conditional offers will not be accepted.

3 ::3:: 6) No tenderer should either withdraw before the finalization of the tenders or seek to increase the rate or seek for change in the rates after finalization or at any time after allotment of contract or during the execution of the contract and if they do so, they shall be disqualified forever for submitting the tenders to Telangana Foods and the EMD shall be forfeited. 7) The lowest rate quoted alone shall not be the criteria for awarding the contract. It is entirely left to the discretion of the Telangana Foods in accepting the tender whether it is reasonable or not and whether a particular tenderer is capable of executing the contract satisfactorily. 8) The decision of Telangana Foods shall be conclusive and binding on all the parties to the contract on all questions relating to the meaning of specifications or quality of materials supplied relating to this contract, interpretation of these conditions or otherwise concerning the contract of execution or failure to execute the same whether arising during the progress of this contract or after the completion or determination thereof of the contract. TERMS AND CONDITIONS: 1) The Bids should be as Technical Bid and Financial Bid, the Technical Bid should contain copies of Firm/Proprietary Registration, PAN Certificates/ CST Registration Certificate. Turn-over details & Income-tax Returns duly attested by Chartered Accountant for last 1 year &Latest Income Tax Assessment Order copy are also to be enclosed to the technical bid. The Technical Bid document should be put in envelope along with EMD and Documentation cost in the form of D.D. from a Nationalized or Scheduled Bank (excluding Urban Co-operative Banks, Grameena Banks and Foreign Banks) as indicated in tender schedule and put in the Envelope No- A and sealed, and write on top of envelope as Technical Bid, Tender Notification No., Date, Due Date, and Name of the Quoted Item Tenders without EMD and documentation Cost will be rejected..

4 :: 4 :: 2) The Financial Bid should be put in another Envelope B and sealed, and indicate on top of envelope as Financial Bid with Tender No. Date and due Date of the item. Viz. Supply of spares of 2.5 Kg Packing Machines (Nichrome makes). 3) Both the envelop A & B to be put together in a bigger envelop C duly sealed and submitted before the due date. 4) I/We note that I am/we are invited to be present either in person or through my/our authorized representative at the time of opening of tenders or for negotiations if necessary, but I shall not insist for negotiations. I/we further agree that the A.P.Foods shall have the right to conduct negotiations with me/us if necessary before finalizing the contract. 5) The rate offered is inclusive of all taxes and delivery at Telangana Foods. 6) The accepted rate shall be fixed till delivery of material as per specification and no change in rates will be allowed at any stage of time under any circumstances. 7) The supply shall be made as per the requirement of Telangana Foods the quantities indicated in the list enclosed to Financial Bid may vary depending upon the requirement of Telangana Foods. 8) Payment will be made for supplied items after inspection and duly certification within 15 to 30 days. 9) The item should not deviate from the given specification; other wise it will be rejected and no correspondence entertained in this regard. 10) The method of Testing / Certification of the item shall be of Telangana Foods and the decision is binding. 11) No complaints will be entertained by the Management regarding rejection of the item or the procedures of testing or any other method of testing. 12) If the tenderer is not able to supply any item at the accepted rate, the same will be purchased from open market at the prevailing rate and the difference of amount shall be deducted from the Party s EMD.

5 ::5:: 13) The Purchaser reserves the right to accept or reject any bid totally or in part and to annul the bidding process and reject all bids at any time prior to award of contract, without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the grounds for the Electrical Maintenance Section. 14) Telangana Foods reserves the right to add/delete/change/modify any or all the conditions mentioned in the tender schedule and the said addition/ deletion/ changes/ modifications can be incorporated in the agreement to be entered into with the supplier irrespective of tender conditions mentioned in the notice inviting tender or in the tender schedule or the same can be incorporated in a form of codicil as the case may be and the same will be binding on the supplier without any recourse. 15). The tender is required to sign on all pages of tender schedule forms in and affixing the rubber stamp with the designation or the status enjoyed by the signatory in the business entity of the supplier and the same signatory shall be required to execute agreement under signature only. The signatory should produce documentary evidence of empowering him to do so, if called upon at any time during the contract period. In case of change in the Authorized Signatory, it is binding on the supplier to inform the changes to the Telangana Foods. 16) No exemption of EMD for NSI, SSI units or any other Agency. 17) All disputes shall be subject to the jurisdiction of Hyderabad Courts only.
