JOWAR SSG-898 FOR THE YEAR MAHARASHTRA STATE SEEDS CORPORATION LTD., AKOLA registered under Companies Act, 1956 having its Head Office at MAHABEEJ BHAVAN, KRISHI NAGAR, AKOLA hereinafter called as Corporation is interested to purchase following truthful seeds for the year MSSCL intends to purchase fresh harvested & processed truthful seed of fodder Hy. Jowar SSG-898 from reputed and registered firm producers / seed suppliers hereinafter called as Supplier. The supplier should have good image all over the state, country and should have good technical staff support and should have higher quality production and processing capacity. Terms and Conditions of the tender: - 1) QUANTITY DETAILS - The tenders are invited to purchase the seeds. The variety wise details are as under. Sr. No. Crop / Variety Stage / Packing size Approx. No.70 / 126-D-18, N.H. No.7, Near Ambika Transport Kurnool ( A.P.) The tender forms shall be issued from 28/03/2012 during working hours to 04/04/2012 till a.m. Tender document can be down loaded from Mahabeej website and the parties who shall down load the tender document from the website shall have to deposit tender cost of Rs.250/- in the form of D.D. separately along with EMD. D.D. of Nationalized Bank only should be drawn in favour of M.S.S.C.Ltd., payable at Akola. 3) SUBMISSION OF TENDER FORMS 3:1) Before quoting the rate the supplier should read the terms and conditions of the tender form carefully. If, the supplier has any doubt as to the meaning of the conditions or the operations thereof, he shall get it clarified before submitting the tender. No complaints whatsoever shall be entertained once the tender from is submitted.. 2

4 :2) The supplier should submit their postal address, telephone numbers and other details in Annex. A. It should be enclosed along with tender form. 3:3) The supplier should quote the agreed rate in rupees per quintal F.O.R. delivery as mentioned in the Annexure- B, in figures as well as in words for the supplies in MAHABEEJ packing. 3:4) The supplier should quote the rates for fresh truthful seeds only. Rate should be competitive, in case parties quote reasonable rates, MSSCL may not negotiate the rates and decision will be taken from original rates quoted in the tender itself. However, MSSCL reserves the right of negotiation. Managing Director s decision will be final and binding on the suppliers. 3:5) There should not be over writing of the prices in the Annex. B. In case of any or all varieties if prices are written / quoted more than once for the same the lowest price quoted shall be deemed to be the correct price and accordingly considered. 3:6) The supplier should quote rate Rupees per quintal excluding cost of packing material like Cloth / Pouches / Gunny Bag and truthful label. The cost of outer packing material & Thirum, Thread, Lead seals and transportation, handling cost etc. will have to be borne by the supplier, where as, octroi charges and unloading charges will be paid by MSSCL. Taxes levied, if any during transit will have to be borne by the supplier. 3:7) PACKING SIZE - Packing size for seeds should be as prescribed by MSSCL. 4) TWO BID SYSTEM : Two independent sealed envelopes should be prepared as detailed below. 4.1) ENVELOP NO. 1 (SEALED) ; This envelop should be marked as ENVELOP NO. 1 COMMERCIAL AND TECHNICAL BID FOR SUPPLY OF FRESH TRUTHFUL FODDER HY. JOWAR SSG-898 SEEDS FOR THE YEAR and should contain following papers with covering letter on letter head (Supplier should invariably mention their name, address etc. on left hand side of envelop for clear identification) a. Annexure A (Commercial and Technical Bid) b. E.M.D. amount ( D.D.) 4.2) ENVELOP NO. 2 (SEALED) : This envelope should be marked as ENVELOP NO. 2 PRICE BID FOR SUPPLY OF FRESH TRUTHFUL FODDER HY. JOWAR SSG-898 SEEDS FOR THE YEAR , and should contain form no. B. (Supplier should invariably mention their name, Address etc. on left hand side of envelop for clear identification) 4.3) Both the envelops should be enclosed in one big sealed envelop super scribing TENDER FOR SUPPLY OF FRESH TRUTHFUL FODDER HY. 5 3 4.4) Supplier must affix seal and put address on each envelop. 4.5) IMPORTANT : If relevant papers/documents are not found in respective envelope or even if price bid is found in envelop no. 1, then also the tender may be considered as non- eligible. 4.6) TENDER OPENING (ENVELOP NO. 1 i.e. TECHNICAL BID): On the day of tender opening, only the envelope no. 1 i.e. Technical Bid will be opened and envelop no. 2 i.e. Price Bid will be opened if possible. 4.7 REJECTION OF TENDER : Any party not fulfilling the conditioning of Technical Bid (in Envelop no.1) shall be out rightly rejected. Offers with alternatives to the given items in the tender will be out rightly rejected. Conditional tender shall not be considered. Printed terms and conditions of the supplier shall not be considered as forming part of their tenders. In case any terms and conditions of the Contract applicable to this invitation to tender are not acceptable to suppliers, they should clearly specify deviation in their tender. The Corporation reserves the right to accept or reject them. The Corporation shall not be bound to give reasons for the refusal to consider the tender with deviations. Price bid (Envelop No.2) of the party, which is not found eligible, shall not be opened. 4.8 OPENING OF ENVELOP NO.2 : The Envelop no.2 i.e. Price Bid of all eligible parties will be opened on same day or on suitable date. The parties will be informed in advance for the same. 5) RE-TENDER: 5.1) The item shall be re-tendered under the situation that during evaluation of tender (Envelop no. 1) the no. of eligible parties found are less than two. However if competent authority thinks that the item required urgently, one eligible tender can be considered. 5.2) The item shall also be re-tendered when the lowest rate received in the tender is not acceptable to MSSCL. 5.3) Extension of Tender shall be considered, keeping in view the no. of tenders received up to due date. 6) EARNEST MONEY DEPOSIT: 6:1) The supplier will have to enclose the Demand Draft /Bankers cheque of Nationalised Bank only in favour of Maharashtra State Seeds Corporation Ltd. payable at Akola (M.S.) as Earnest Money Deposit (EMD) as mentioned at Sr. no. 1, along with tender form. The supplier should write name of the Bank and D.D. No. on Annex. A. 6:2) EMD of the successful tenderer will be converted as a part of the security deposit. EMD of the unsuccessful supplier will be refunded after 30 days period of the opening of tender. No interest will be allowed on the E.M.D. from the date of its receipt until it is so refunded.. 4

6 . 4. 6:3) Tenders received without E.M.D. will be treated as invalid. 7) LAST DATE OF ACCEPTANCE OF TENDER FORM. - The tender should be submitted in Two Bid System in sealed envelop super scribing TENDER FOR SUPPLY OF FRESH TRUTHFUL FODDER HY. JOWAR SSG -898 FOR THE YEAR on or before 04/04/2012. The tenders shall be accepted up to Hrs. on 04/04/2012 at M.S.S.C. Ltd., H.O. Akola and Regional Manager, MSSCL C/o M/s Pinakini Seeds Ankapur, Mdl Armoor, Dist. Nizamabad ( A.P.) The tenders (Technical Bid only (Envelop 1)) shall be opened preferably on the same day at Hrs. in the presence of the present suppliers. 8) VALIDITY OF TENDER FORM The validity of the rates/quoted submitted in the tender from shall be treated as valid for a period of 120 days from the date of opening of tender, however, MSSCL may extend the said period at its discretion. 9) AGREEMENT 9.1) The successful supplier will have to execute an agreement on general stamp paper of required value within 8 days of awarding the tender to him at his cost. 9:2) After finalisation of tender process the supplier will have to execute an agreement with the Corporation for agreed quantity. If the supplier failed to execute an agreement within 8 days period of the issuance of order, EMD will be forfeited. 9:3) The successful supplier will have to produce attested copies of partnership deed. In case of limited company power of attorney on stamp paper in favour of authorised representative for execution of an agreement and settling all matters related to this contract will have to submit. 10) SUPPLY TERMS 10:1) The Corporation shall issue Purchase Orders from time to time in phase manner as per requirement during the period 120 days against the accepted tender. The quantity to be purchased shall be at the sole discretions of the Corporation. 10:2) Successful supplier shall be required to supply the ordered quantity within 10 days from the date of receipt of the written movement order. For delayed supplies penalty of Rs. 5/- per day per quintal will be charged for late supplies. 10:3) The supplier will have to supply the ordered quantity within stipulated period, in case he failed to supply the committed quantity, the supplier shall be liable to pay 20% compensation of the total value of the short supplied quantity. The Corporation shall also have the right to make the short supplied quantity through alternative purchase at the risk and cost of the supplier. 11) QUALITY PARAMETER 11:1) The supplier will have to supply fresh truthful seed only. The seed should be qualified in minimum Seed Certification Standards of germination, genetic and physical purity... 5

7 :2) In case of quality complaint or non-germination, genetical impurity, the supplier shall be responsible for the losses suffered by the farmers/consumers and the cost will be recovered from the security deposit as well as losses over and above the security deposit will be borne by the supplier. 11:3) During the course of processing /despatches the MSSCL representative will be authorised to visit processing/packing units and he may verify the quality of the seeds stocks. In case grading of the stock is improper or having excessive low grade, nonlustrous, impure the stocks will be refused. In case defective stock is detected at consuming point, the cost of such stock will not be paid by MSSCL and in case it is already paid, the same shall be recovered from security deposit, retention money or any other dues payable to the supplier. 11:4) The seed being supplied should be duly treated with Thirum. 11:5) The supplier should process the seed with standard sieve size prescribed by Seed Certification Agency. If the low-grade percentage is found more than tolerance limit the seed shall be rejected. 11:6) Supplier shall have to produce Release Orders / Form No I and II along with bills without which payment will not be released. 11) TRANSPORTATION 12:1 ) The seed shall be required to be transported F.O.R. destination anywhere in Maharashtra State. The consignment will be preferably on truckload basis. However, one full truckload may contain consignment of maximum 2 different blocks. The supplier will be responsible for shortages/losses, if any during the transit period. 13) PAYMENTS 13:1) The supplier shall prepare a bill in the name of the MSSC Ltd., Akola in duplicate along with Delivery Orders. The receipts of authorized representative of MSSCL with stock book page entry details only shall be treated as final acknowledgement. 90% payment of the stock shall be released after submission of the receipt of the consignment. 13:2) MSSCL will retain 10% amount of the total supplies as retention money till 120 days along with security deposit and other credit amount if any. No interest shall be paid on retention money & security deposit. 14) OTHER TERMS AND CONDITIONS 14:1) MSSCL shall not be responsible for fluctuation of the market rate of the ordered seed. The supplier shall be required to supply the seed at agreed rate only. The agreement can be terminated at any time due to non-performance of any of the terms and conditions of the agreement to the satisfaction of the Corporation.. 6

8 :2) The Managing Director reserves the right to accept or reject either in full or part of the tender or all the tenders without assigning any reason. The Managing Director further reserves the right to award contract/ issue the order for supplies to more than one supplier. 14:3) In case of dispute arising out of the contract, the party/parties shall have to agree to the decision of the sole arbitrator Managing Director, MSSCL Akola, whose decision will have binding on both the parties. 14:4) The court of law situated at Akola will have the jurisdiction in matter related to this tender or any dispute during the performance of the contract. 14:5) The supplier shall be responsible for state Sales Tax/Central Sales Tax, VAT and Income Tax liabilities, if any. MSSCL will not carry any tax liability related with the transaction. 14:6) MSSCL will not be responsible for the losses incurred to the suppliers/ supplier due to change in Govt. decisions, natural calamities, which are beyond the control of MSSCL. 14:7) The ordered quantity may increase or decrease depending upon the directives given by the Govt. or due to natural calamities like drought, hail storm situation, which is out of control of MSSCL. 14:8) Govt. of Maharashtra Quality Control Inspectors may draw the samples of stocks. In case the stocks failed in sampling the supplier will be responsible for the consequences of violation of Seed Act and Seed Laws. 14:9) The weight of the seed container shall be checked at any point of transaction and in case shortages found in the container, MSSCL will not pay any cost against such supplies and the supplier shall be responsible for the legal consequences of Weights and Measures Department, if any. 14:10) Managing Director will be authorised to relax/alter any term and condition of the tender form. 14:11) The supplier will have to give name of the firm, name of the processing plant, godowns their postal addresses, telephone Nos., , name of the responsible person in the tender form itself so as to make further communication.
