1 1 Minutes of the 85 th meeting of State Environment Impact Assessment Authority held on , under the Chairmanship Sh. Bharat Bhushan IAS (Retd.), Chairman, SEIAA held in the meeting room of office of SEIAA Haryana, Sector-2 Panchkula, regarding Environmental Clearance under EIA Notification dated The full Authority is present. The Cases recommended by SEAC for Environmental Clearance or otherwise as listed in the Agenda item circulated vide letter No dated were discussed. Following decisions were taken:- Item No. [1] Environmental Clearance for construction of Industrial Unit (Unit- VIII) at Plot No-37, Sec-4B, IE, HSIIDC, Dist-Jhajjar, Bahadurgarh, Haryana by M/s Relaxo Footwears Ltd. The SEAC has examined the proposal in the light of amended Notification dated issued by MoEF&CC, GoI and recommended to exempt this project proposal from obtaining environmental clearance under EIA Notification dated Subject to compliance of sustainable environment management as per guidelines issued by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated The above recommendation of SEAC was taken up for consideration in the today s meeting. The Authority unanimously decided to agree with recommendation of SEAC and decided to grant exemption to the project proposal from obtaining environmental clearance subject to compliance to guidelines issue by MoEF&CC, GoI dated by the project proponent. Item No. [2] Environmental Clearance for Institutional project at Village- Aurangpur, District Jhajjar, Haryana by M/s Xavier Labour Relations Institute. The SEAC has examined the proposal in the light of amended Notification dated issued by MoEF&CC, GoI and recommended to exempt this project proposal from obtaining environmental clearance under EIA Notification dated Subject to compliance of sustainable environment management as per guidelines issued by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated The above recommendation of SEAC was taken up for consideration in the today s meeting. The Authority agreed with the recommendation of SEAC and decided to grant exemption to the project proposal from obtaining environmental clearance subject to compliance to guidelines issue by MoEF&CC, GoI dated by the project proponent Item No. [3] Environmental Clearance for Group Housing Complex at, Village- Nawada Fatehpur & Naharpur Kasan in Sector-81 & 86, Gurgaon, Haryana by M/s International Green Scapes Ltd. The SEAC in its 119 th meeting held on has recommended to de-list this case on the basis of report of sub-committee. The sub-committee visited the site on

2 reported that due to change in the concept and design the project proponent has not started the construction work so far and recommended to de-list the case. Finding no reason to disagree with recommendations of SEAC in this case the Authority decided to de-list this case. It was also decided that the decision of the Authority should be conveyed to the Project Proponent and copy of the same be forwarded to the Haryana State Pollution Control Board, DGTCP, Haryana & R.O. MOEF, GOI for information and necessary action. Item No. [4] Environmental Clearance for Group Housing Complex at Village Daulatabad, Sector-103, Gurgaon, Haryana by M/s Microtek Infratech Pvt. Ltd. The SEAC in its 119 th meeting held on has recommended to de-list this case on the basis of report of sub-committee. The sub-committee visited the site on reported that due to change in the concept and design the project proponent has not started the construction work so far and recommended to de-list the case. Finding no reason to disagree with recommendations of SEAC in this case the Authority decided to de-list this case. It was also decided that the decision of the Authority should be conveyed to the Project Proponent and copy of the same be forwarded to the Haryana State Pollution Control Board, DGTCP, Haryana & R.O. MOEF, GOI for information and necessary action. Item No. [5] Environmental Clearance for w.r.t Expansion of Ware House at Village Behrampur, Gurgaon, Haryana by M/s P.D.Enterprises. The recommendation of SEAC in its 89 th meeting held on to grant environmental clearance to this project was considered by SEIAA in its 60 th, 68 th, 72 nd, 76 th and 80 th meeting held on , , , and wherein, the representative of the project proponent again failed to submit the copy of validated CLU/approved building plan. The Authority decided to refer back this case to SEAC with the advice to inspect the site and to verify the status of construction. Accordingly the case was referred back to SEAC, due to lapse of term of SEIAA the case was transferred to MoEF&CC, GoI. No action was taken by MoEF&CC, GoI and the case was returned to SEIAA after its reconstitution. The SEAC in its 119 th meeting held on considered this project wherein, the request for exemption as per amended notification as submitted by the project proponent vide letter dated was discussed. The SEAC decided that SEIAA may seek clarification from the MoEC & CC, GoI regarding requirement of environment clearance in view of amended notification dated in this case. The observation of SEAC to seek clarification from MoEF&CC, GoI regarding requirement of environmental clearance in view of amended Notification dated was taken up for consideration in the today s meeting. It was noticed that the in the similar cases of warehouse projects in the same meeting the SEAC has considered

3 3 the project proposal for grant of environment clearance. The Authority was of the view that the stand alone warehouse projects are required to seek prior environmental clearance under EIA, Notification and are not exempted. It was also found that the MoEF&CC, GoI has also vide letter dated has clarified that the warehouse projects are not exempted from obtaining environmental clearance in view of amended Notification no. S.O (E) dated In view of the above discussions it was decided to refer back this case to SEAC with the advice to inspect the site and to verify the status of construction and send the recommendations within stipulated period as prescribed in the Notification. Item No. [6] Environmental Clearance for expansion of Industrial Building for testing of vehicles (R & D Centre) at Plot No. 1, Sector-33 B-33C IMT, Rohtak by M/s Maruti Suzuki India Ltd. The SEAC has examined the proposal in the light of amended Notification dated issued by MoEF&CC, GoI and recommended to exempt this project proposal from obtaining environmental clearance under EIA Notification dated Subject to compliance of sustainable environment management as per guidelines issued by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated The above recommendation of SEAC was taken up for consideration in the today s meeting. The Authority decided to agree with recommendation of SEAC and decided to grant exemption to the project proposal from obtaining environmental clearance subject to compliance to guidelines issue by MoEF&CC, GoI dated by the project proponent Item No. [7] Revision in EC for Residential Colony TDI City located at Sec-58, 59, 60, 61, 63 & 64 Sonepat-Kundli, Haryana by M/s TDI Infrastructure Ltd. The case was considered by SEAC in its 119 th meeting held on The SEAC observed that the EAC of MoEF, GoI in its 150 th meeting held on 29 to 31, July 2015 considered this case for finalization of TOR (F.no.21-98/2015-IA.III) and decided to have site visit but site visit report is not available in the records. The SEAC has requested SEIAA to obtain the site visit report from MoEF&CC, GoI in this case. The observation of SEAC was considered on the today s meeting. It was noticed that the EAC of MoEF&CC, GoI deferred the proposal for finalization of TOR in its 150 th meeting with the following remarks: The EAC observed that a huge amount of traffic from the project site opens straight way in to already congested National Highway No.1. There is no access to slip road and there appears to be a lack of perspective traffic planning. The Committee recommended a site visit by Dr. Anuradha Shukla, Member, Expert Appraisal Committee (Infrastructure & CRZ) to work out the access road planning so that traffic from the proposed township does not affect the traffic on National Highway-I.

4 4 The Authority decided to return the file to SEAC with the advice to obtain the site visit report from the MoEF&CC, GoI Expert Member Dr. Anuradha Shukla at their own level. Item No. [8] Environmental Clearance for the proposed Affordable Group Housing (5.0 acres) at Village Dhunela, Sector-35, Sohna, District Gurgaon, Haryana by M/s Tulsiani Construction and Developers Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of Affordable Group Housing (5.0 acres) at Village Dhunela, Sector-35, Sohna, District Gurgaon, Haryana on a total plot area of sqm (5 acres). The total built up area shall be sqm. The proposed Project shall comprise Residential units (850 DU), Commercial area, Community Building, Educational Facility (1 no. of Anganwadi). The maximum height of the building shall be 50 meter. The total water requirement shall be 640 KLD. The fresh water requirement shall be 403 KLD. The waste water generation shall be 524 KLD, which will be treated in the STP of 625 KLD capacity. The total power requirement shall be 6007 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 20.29% of project area (15.39% tree plantation % landscaping). The Project Proponent proposed to construct 05 rain water harvesting pits. The solid waste generation will be 2296 kg/day. The biodegradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 490 ECS. The above recommendation of SEAC was taken up for consideration. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated , recycle and reuse of water, parking plan, traffic circulation etc. It was found that the project proponent submitted the assurance of HUDA for supply of water along with copies of EDC/IDC paid to HUDA for the services for supply of water, sewerage connection and drainage system, NOC from DC Gurgaon regarding non applicability of Aravalli Notification and NOC from AAI regarding height clearance. It was noticed that the project proponent has given undertaking stating that no construction shall be raised in the ROW reserved for HT line. It was also noticed that the project proponent has earmarked the space for solid waste management site on the plan for collection, segregation and treatment of bio-degradable waste. In view of the above discussions, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall provide green area on 20.29% of the project area. [2] The project proponent shall install solar panel for energy conservation.

5 5 [3] The project proponent shall essentially provide two numbers of STPs preferably equivalent to 50% of total capacity or depending upon the initial occupancy as the case may be. [4] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. Item No. [9] Environmental Clearance for construction of Food Manufacturing Unit at Plot No. 4, 5, 6 & 7, Sector-30A, Industrial Estate, HSIIDC, IMT Rohtak Haryana by M/s Lotte India Corporation Ltd. The SEAC has examined the proposal in the light of amended Notification dated issued by MoEF&CC, GoI and recommended to exempt this project proposal from obtaining environmental clearance under EIA Notification dated Subject to compliance of sustainable environment management as per guidelines issued by MoEF & CC, GoI F.No. 19-2/2013-IA.III dated The above recommendation of SEAC was taken up for consideration in the today s meeting. The Authority accepted the recommendation of SEAC and decided to grant exemption to the project proposal from obtaining environmental clearance subject to compliance to guidelines issue by MoEF&CC, GoI dated by the project proponent Item No. [10]Environmental Clearance for proposed group housing project Ashiana Anmol at Village Dhulena, Sector-33, Tehsil Sohna & District Gurgaon, Haryana by M/s Universe Heights (India) Pvt. Ltd. The SEAC has recommended this project for Environmental Clearance subject to stipulation stated therein. The Project Proponent has proposed the construction of group housing project Ashiana Anmol at Village Dhulena, Sector-33, Tehsil Sohna & District Gurgaon, Haryana on a total plot area of sqm (13.33 acres). The total built up area shall be sqm. The proposed Project shall comprise 13 Residential Blocks, 01 Commercial Block, 01 EWS Block and 02 Schools, Club House, shops (15 nos.) etc. The proposed project shall have 1 Basement + maximum 14 floors, 780 MDU and 138 EWS units. The maximum height of the building shall be meter. The total water requirement shall be 827 KLD. The fresh water requirement shall be 464 KLD. The waste water generation shall be 623 KLD, which will be treated in the STP of 650 KLD capacity. The total power requirement shall be 6809 KW which will be supplied by DHBVN. The Project Proponent has proposed to develop green belt on 39.55% of project area (24.55% tree plantation + 15% landscaping). The Project Proponent proposed to construct 12 rain water harvesting pits. The solid waste generation will be 2511 kg/day. The bio-degradable waste will be treated in the project area by adopting appropriate technology. The total parking spaces proposed are 1404 ECS.

6 6 The above recommendation of SEAC was taken up for consideration. Detailed discussions were held regarding water requirement, quality of water, green belt development plan, Ambient Air Quality, NOC regarding non-involvement of Aravalli Notification dated , recycle and reuse of water, parking plan, traffic circulation etc. It was found that the project proponent submitted the assurance of HUDA for supply of water, NOC from DC Gurgaon regarding non applicability of Aravalli Notification and NOC from AAI regarding height clearance. It was noticed that the project proponent has given undertaking stating that no construction shall be raised in the ROW reserved for HT line. It was observed that the project proponent has not earmarked the space for solid waste management site on the plan for collection, segregation and treatment of biodegradable waste. In view of the above discussions, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice and subject to submission of plan earmarking space for solid waste management within 10 days. [1] The project proponent shall provide green area on 39.55% of the project area. [2] The project proponent shall essentially provide two numbers of STPs preferably equivalent to 50% of total capacity or depending upon the initial occupancy as the case may be. [3] The project proponent shall not raise any construction activity in the ROW reserved/acquired for High Tension Wire passing through the project area and shall maintain horizontal and vertical ROW as required under Indian Electricity Rules, 1956/DHBVN latest instructions. [4] The project proponent shall submit plan depicting the area ear marked for composting. [5] The project proponent shall obtain assurance of power supply as per prevailing rules/norms. Item No. [11]Environmental Clearance for proposed Warehouse Project at revenue estate of Village Binola, Manesar, District Gurgaon, Haryana by M/s India Land & Space Logistics Pvt. Ltd. The SEAC has referred this case to the SEIAA with the recommendation for initiating legal action in view of the MoEF&CC, GoI OM no. J-11013/41/2006-1A.II(I) dated The SEAC has considered the project proposal in its 120 th meeting held on and noticed that the project proponent has already completed the construction of the warehouse project without obtaining prior Environmental Clearance which amounts to violation of EIA Notification dated The project proponent submitted the copy of resolution ensuring that violation of provisions of the Environment (Protection) Act, 1986 will not be repeated in future and also admitted its mistake for carrying out construction without obtaining prior Environmental Clearance.

7 7 In the today s meeting the recommendation of SEAC in this case was examined. It was noticed that the Hon ble National Green Tribunal in OA. No. 37 of 2015 and 213 of 2014 in the matter of S.P. Muthuraman V/s Union of India & Others on has quashed the operation of MoEF&CC, GoI OM No. J-11013/41/2006-IA.II (1) dated and MoEF, GoI OM No. J-11013/41/2006-IA.II(I) dated It was noticed that MoEF & CC, GoI has not issued any fresh guidelines in view of the quashing of OM dated and by Hon ble NGT. In view of the above observations it was decided that: [1] The Principal Secretary Environment may be requested to initiate credible action on the violation by invoking powers under Section 19 of the Environment (Protection)Act,1986, for taking necessary legal action under Section 15 of the Act for the period for which the violation has taken place, against the M/s India Land & Space Logistics Pvt. Ltd, RZ-279 (A-55), Mahipalpur Extension, NH-8, New Delhi for commencing construction of Warehouse Project at revenue estate of Village Binola, Manesar, District Gurgaon, Haryana without obtaining prior Environmental Clearance under EIA Notification The Principal Secretary Environment may also be requested to provide the evidence of credible action taken against the project proponent. [2] The Principal Secretary Environment may be requested to issue directions under Section 5 of EPA Act, 1986 to the project proponent in respect of violations, as per the requirement of MoEF, GoI, OM No. J-11013/41/2006-IA.II(I) dated [3] Giving reference of NGT orders; the SEIAA may seek clarification/advice of MoEF&CC, GoI regarding operation of MoEF&CC, GoI OM No. J-11013/41/2006- IA.II (1) dated and MoEF, GoI, OM No. J-11013/41/2006-IA.II(I) dated Item No.[12]Environmental Clearance for Group Housing colony at village Naurangpur, Sector -79, Gurgaon, Haryana by M/s Sterling Infrastructure Pvt. Ltd. This case was lastly considered in the 84 th meeting of the SEIAA held on wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit details of solid waste management and also submit plan earmarking space for collection, segregation and treatment of biodegradable waste.

8 8 [2] The project proponent shall submit latest undertaking on non judicial stamp paper stating that no construction has been raised at site duly signed by the director. The project proponent shall also submit latest photograph of site. [3] The project proponent shall submit the plan depicting area clearly ear marked for composting. In the today s meeting the reply dated submitted by the project proponent was considered. It was observed that the project proponent has submitted details of solid waste management, earmarking space on the plan for treatment of biodegradable waste and undertaking stating that no construction has been raised at the site with photograph. In view of the above discussions, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall provide green area on 30.8% of the project area. [2] The project proponent shall essentially provide two numbers of STPs preferably equivalent to 50% of total capacity or depending upon the initial occupancy as the case may be. [3] The project proponent shall obtain assurance of power supply as per prevailing rules/norms. Item No. [13]Environmental Clearance for construction of Group Housing Colony located in the revenue estate of Village Sohna, Sector-2 of Sohna, District-Gurgaon, Haryana by M/s Shree Vardhman Developers Pvt. Ltd. This case was lastly considered in the 84 th meeting of the SEIAA held on wherein, it was decided to defer this case with the decision that the project proponent may be asked to submit reply to the below mentioned observations within 15 days or before next meeting. [1] The project proponent shall submit details of solid waste management and also submit plan earmarking space for collection, segregation and treatment of biodegradable waste. [2] The project proponent shall submit the plan showing area ear marked for composting. [3] The project proponent shall submit revised traffic circulation plan indicating dimension of entry and exit ramp of basement. In the today s meeting the reply dated submitted by the project proponent was considered. It was observed that the project proponent has submitted details of solid waste management, earmarking space on the plan for treatment of biodegradable waste and revised traffic circulation plan showing 4 meter wide entry and exit ramp of basement.

9 9 In view of the above discussions, the Authority decided to agree with the recommendations of SEAC to accord Environment Clearance to this project by imposing the following condition in addition to the usual conditions in practice. [1] The project proponent shall provide green area on 32.52% of the project area. [2] The project proponent shall essentially provide two numbers of STPs preferably equivalent to 50% of total capacity or depending upon the initial occupancy as the case may be. [3] The project proponent shall obtain assurance of power supply as per prevailing rules/norms. *****
