2 May 20th, 2015 TIMBER SALE PROSPECTUS Bevan Forestry, Inc. on behalf of American Forest Management, Inc. (AFM), a forest resource consulting firm acting as the agent for the property owners, LHF Black Walnut (NY), LLC (hereinafter referred to as Grantor), is soliciting for the timber marked and otherwise designated for harvest as described below. The timber will be sold on a sealed bid, Lump Sum Basis. Timber Sale Name: Waterville 1 Location: Timber Ownership: Town of Marshall, County of Oneida, New York State. Access to the site is made in the Town of Sangerfield off of Tower Road. (See attached map.) LHF BLACK WALNUT (NY), LLC AFM and Bevan Forestry do not guarantee title to property sold. Buyers should have attorney conduct routine examination. Bid Opening Date: Bid opening will be Friday June 26 th, 2015 at 5:00 pm at the Bevan Forestry, Inc. office in Livingston Manor, New York. To be considered for this sale, a bidder must submit the attached bidding form with a 10% bid deposit, bid to chris@bevanforestry.com or fax a bid to All bidders submitting bids that are faxed or ed must present a bid deposit check within two business days of the bid opening. The successful bidder will be chosen from the top bidders but may not necessarily be the highest bidder. In ranking success and ability of a company to conduct any given timber sale the following will be taken into consideration: The amount of the bid Whether the logging company has logger training/certification Past experience the logging company has had with Bevan Forestry, Inc. The equipment the company has available for the job being bid on The number of bids received on the job The Seller, Bevan Forestry, Inc. and AFM reserve the right to reject any or all bids. Bids may be brought to the office at 604 Grooville Road, Livingston Manor, NY or mailed but must arrive before 5pm on Friday, June 19 th. Faxed bids will be accepted at fax # until 5pm on bid day. However, please call Chris at immediately before sending fax bids. The words, Bid June 19 th Waterville 1, should appear on the sealed envelope containing the bid. The attached bid form should be used when submitting bids. The Grantor reserves the right to reject any and all bids for any reason at its sole discretion. Any bid made subject to conditions contrary to those contained in this notice may be rejected. Phone bids will not be accepted. Type of Sale: Estimated Acreage: Estimated Volumes: This is a Lump Sum sale of marked timber. All merchantable trees to be cut and removed are marked with blue timber paint. The Waterville 1 sale unit contains 73 harvest acres. The harvest boundaries are marked by triple blue paint along all property or sale boundaries except where sale area adjoins existing Walnut plantations owned by Grantor. The Waterville 1 sale unit is estimated to contain approximately MBF Intn l or MBF Scribner (See attached summary), 60 cords of firewood and 27 cords of softwood pulpwood. VOLUMES ARE BELIEVED TO BE REASONABLE, BUT VOLUMES ARE NOT GUARANTEED. BIDDERS ARE URGED TO MAKE THEIR OWN INSPECTION AND ESTIMATE OF VOLUME AND QUALITY. 3 Terms: Performance Bond: The successful bidder, or Grantee, shall have 14 calendar days from the bid acceptance to close the sale by signing a Timber Sale Agreement. This is a lump sum sale and funds will be due at the contract signing. The Sale Agreement term is 18 months (1½ years), with six (6) month extension granted for wet weather. The successful buyer s 10% bid deposit shall be held as a Performance Bond with the Grantor to be held in escrow to assure fulfillment of the Grantee s obligations. All or any portion of the bond may be applied by Grantor s agent toward repairs necessitated by damage by Grantee. The bid deposit bond shall be in the form of a check payable to LHF Black Walnut (NY), LLC and is due at closing. Permits Required: There is one stream crossing permit required for this job. The permit will be processed after the successful bidder is selected. Other Work Elements Require: The approach from Tower Street will need to have about 60 yards (plus or minus) of gravel added to the on-property road. The Grantee will be responsible for maintaining all onproperty roads during the timber harvesting. Restrictions: Contact Information: The log landings, road and trails will be left free of logging residue and logging debris. All roads and trails will be graded at the completion of the job with BMP s installed per the recommendations found in the New York State Forestry Best Management Practices for Water Quality, BMP Field Guide.
