5 Purpose of the Guide This guide contains information which will be of assistance to persons running for office as a member of Council. This document is intended to be a guide to certain provisions of relevant legislation and does not purport to recite all applicable statutory references. Prospective candidates must satisfy themselves through their own determination that they are qualified to run for election and have complied with election financing regulations. The Municipal Elections Act sets out in detail the requirements to be met by candidates for office. These requirements have been summarized for your convenience. We urge you to download your own copy of the Municipal Elections Act from the Ministry of Municipal Affairs website or purchase a copy from the Ontario Government Bookstore. As this election year progresses, we will provide you with additional information as it becomes available, or at the appropriate time in the process. You are advised to read the enclosed material carefully. It is important that you are aware of your responsibilities as a candidate. 6 KEY DATES FOR THE 2018 MUNICIPAL ELECTIONS Electors in the Town of Mono will be voting electronically, by internet or telephone, in the 2018 Municipal Election. Date Tuesday, May 1 st, 2018 to Friday, July 27 th, 2018 Tuesday, May 1 st, 2018 to Monday, December 31 st, 2018 Event Nomination Period: Nomination forms may be filed by candidates beginning Tuesday, May 1 st, 2018 and on any day thereafter prior to Nomination Day, at any time when the Clerk s Office is open (Monday to Friday, 8:30 a.m. to 4:30 p.m.) and on Nomination Day, Friday, July 27 th, 2018 when nomination forms may be filed between the hours of 9:00 a.m. and 2:00 p.m. Campaign Period: The campaign period begins when a candidate has filed the nomination form and ends on December 31 st, Alternative time periods are in effect if the candidate withdraws the nomination, if the Clerk rejects the nomination, or the candidate extends his/her campaign and is continuing to campaign to erase a deficit. May 1 st to October 19 th, 2018 Third Party Advertising: Individuals, corporations or trade unions may file with the Clerk to be a registered third party for the election using the prescribed form. Restrictions apply as to who may register. Friday, July 27 th, 2018 Nomination Day: Last day for filing nominations. Nominations, in the required form, filed on this date may only be filed between the hours of 9:00 a.m. to 2:00 p.m. Third Party Advertising: filings for registration accepted July 27 th to October 19 th. Monday, July 30 th, 2018 Certification of Nomination Forms and Acclamations: The Clerk shall certify filed nomination forms prior to 4:00 p.m. Immediately after 4:00 p.m., the Clerk shall declare any acclaimed eligible candidates to be duly elected. Tuesday, September 4 th, 2018 Voters List: The Clerk shall make the list of voters available to persons entitled. Early October A Voter Information Letter will be mailed to residents directly in the month of October, providing them with a Personal Identification Number (PIN) which will allow them to vote 24 hours a day during the voting period from any touch-tone telephone, cell phone, computer or other device connected to the internet. 7 Friday, October 12 th, 2018 to Monday, October 22 nd, 2018 Advanced Polls open: Friday, October 12 th, 2018 at 10:00 a.m. to Monday, October 22 nd, 2018 at 10:00 a.m. Vote from any touch-tone telephone, cell phone, computer or other device connected to the internet. Voter Help Centre at the Town Office ( Mono Centre Road) Monday to Friday 8:30 a.m. to 4:30 p.m. during the entire election. Drop in or call: x221 or Monday, October 22 nd, 2018 Election Day: FINAL DAY to VOTE, by Internet or telephone, from 10:00 a.m. to 8:00 p.m. Tuesday, October 23 rd, 2018 Declaration of Results: The Clerk will declare the results of the election of candidates as soon as possible after voting day. First Week in December 2018 Term of Office Commences: Elected members must take the oath of office prior to taking their seat. Inaugural Meeting will be held during the first week in December at the Council Chambers at the Town Office. Monday, December 31 st, 2018 Campaign Period Ends for candidates and registered third parties. Nominations Every person who proposes to be a candidate for Council must file a nomination paper. The Municipal Elections Act now requires all nominations for an office on council to be endorsed by at least 25 persons, who must: be eligible to vote in an election for an office within the municipality if the election was held on the day that the person endorses the nomination and must o be a Canadian citizen o aged 18 or over o have a qualifying address in the municipality sign an Endorsement of Nomination Form School Board candidates are not required to submit endorsement signatures. A Nomination form must be filed prior to receiving any campaign contributions and prior to expending any funds on a campaign. 8 Process 1. Complete a Nomination Paper (Form 1). The nomination form will also be available at the Clerk s Office, located at the Town Office, Mono Centre Road, Mono. 2. Obtain the signatures of 25 eligible electors on the Endorsement of Nomination forms (Form 2). 3. File the Nomination paper and Endorsement of Nomination forms in person at the Office of the Clerk (this can be done by the candidate or his/her agent). The form may not be faxed, mailed or ed. Proof of the candidate s identity, qualifying address and Canadian citizenship are required. The candidate may file during regular business hours, or at other times as agreed upon with the Clerk, from Tuesday, May 1 to Thursday, July 26, 2018 or between 9 a.m. and 2 p.m. on Nomination Day, Friday, July 27, Pay the prescribed fee by cash, debit card, certified cheque or money order: $200 for the Office of Mayor and $100 for all other offices. The updated forms can be accessed by going to this link. The onus is on the person nominated for election to an office to correctly file a nomination paper and pay the prescribed fee prior to 2 p.m. on Friday, July 27, Nominations will be certified by 4:00 p.m. on Monday July 30, Name on Ballot The name shown on the candidate s nomination paper is what will appear on the ballot. First names can be shortened, for example, Michael can be Mike. Withdrawal of Nomination A candidate may withdraw his or her nomination by completing a Withdrawal of Nomination Paper and filing it in the Clerk s Office before 2 p.m. on Monday, July 30, A candidate must present identification to the election staff. Nomination Fee Refund A candidate is entitled to receive a refund of the nomination filing fee if the documents required under subsection (1) of the Municipal Elections Act (Financial Statements) are filed on or before 2 p.m. on the filing date. 9 Elected Offices for the Town of Mono At this election, members will be elected for the period commencing the first week of December 2018, and ending November 30, 2022, for the following offices: 1 Mayor To be elected by all electors of the Town of Mono (this office will also sit on Dufferin County Council). 1 Deputy Mayor To be elected by all electors of the Town of Mono (this office will also sit on Dufferin County Council). 3 Councillors To be elected by all electors of the Town of Mono. Mono does not use a ward system. School Board Members School Board/Representation Upper Grand District School Board 1 candidate to be elected. Dufferin Peel Catholic District School Board 1 candidate to be elected. Conseil scolaire catholique MonAvenir (French Catholic) 1 candidate to be elected. Conseil Scolaire Viamonde (French Public) 1 candidate to be elected. 10 Eligibility A candidate, if nominated, must remain qualified throughout the election, and, if elected, throughout the term of office. Council Upon nomination, a candidate for the office of Mayor, Deputy Mayor or Councillor must be a qualified elector and: a resident of the Town of Mono, or an owner or tenant of land in the Town of Mono, or the spouse of such an owner or tenant; a Canadian citizen; at least 18 years old; not prohibited from voting by law. School Board Member Upon nomination, a candidate for a school board must, be a qualified elector and: a resident within the jurisdiction of the board; a supporter of the board; a Canadian Citizen; at least 18 years old; pursuant to the Education Act, separate school board candidates are required to be Roman Catholic; not prohibited from voting by law. 11 Town of Mono Council Information The governing body of the Town of Mono is Council. It consists of a Mayor, a Deputy Mayor and three Councillors. Mono does not use a ward system and all members of council are elected at large. The ratepayers of the Municipality elect the Members of Council for a fouryear term of office commencing December 2018 to November Having both legislative and executive responsibilities, Council deals with matters that require policy direction, bylaws and responses or actions to pertinent issues. Council also provides local services, facilities, safety and infrastructure for the Municipality. Council Meetings Regular Council meetings are held twice a month on the second Tuesday (night 7 p.m.) and fourth Tuesday (day 9 a.m.) most months. Council meetings are open meetings, which members of the public are encouraged to attend. Certain portions of some meetings may be closed to the public for discussions regarding personal, legal, and property matters but all other matters are discussed in open council. All Council, committee and board agendas and minutes are posted on the town s website The website calendar lists Council, Committee and Board Meetings. Duties The Mayor is the Head of Council and his/her duties include: to act as Chief Executive Officer of the municipality; to preside over Council meetings; to authenticate, by his/her signature when necessary, all by-laws, resolutions, and minutes of Council; to provide leadership to Council; to represent the municipality at official functions; to carry out the duties of the head of council under the Municipal Act or any other Act; and to represent the municipality at County Council. Council Members (including the Mayor) duties include: to represent the public and to consider the well-being and interests of the municipality; to develop and evaluate the policies and programs of the municipality; to determine which services the municipality provides; to ensure that administrative policies, practices and procedures and controllership policies, practices and procedures are in place to implement the decisions of Council; to ensure the accountability and transparency of the operations of the municipality, including the activities of the senior management of the municipality; to maintain the financial integrity of the municipality; and to carry out the duties of Council under Municipal Act or any other Act. 12 2018 Election Process The conduct of municipal elections is governed by the Municipal Elections Act, The 2018 election will be conducted using Internet and telephone voting. Procedures and forms established for voting have been be established by the Clerk and are included in this package (see Telephone/Internet Voting Election Policies and Procedures for the 2018 Ontario Municipal Elections). Maximum Campaign Expense Limit (preliminary) The Municipal Elections Act establishes a maximum amount a candidate may spend during the campaign period: Mayoral candidates $7, cents per elector Councillor and School Board candidates $5, cents per elector The preliminary maximum campaign expense limits, based on 6,714 eligible electors on September 15, 2014, are: Mayor $ 13, Deputy Mayor $ 10, Councillor $ 10, The Clerk will issue a final Certificate of Maximum Campaign Spending Limits by September 25, Expense limits for the Dufferin Peel Catholic District School Board, Conseil Scolaire Viamonde (French Public) and Conseil Scolaire de district catholique centre-sud (French Catholic) school board elections will be provided by the municipalities responsible for running those elections. Financial obligations during and after campaign You must file a Nomination Paper before you collect or spend any funds. You should open a separate bank account immediately upon filing your Nomination Paper. All contributions and expenses must go through this account. Your campaign period runs from the day you file your Nomination Paper until December 31, 2018 (some exceptions may apply). 13 Maximum Campaign Contributions A campaign contributor cannot make contributions of more than $1,200 total to any one candidate, or more than $5,000 to two or more candidates for offices on the same council or local school board. Maximum contributions to a candidate s own election campaign The maximum amount a candidate for an office on a council and his or her spouse may contribute to the candidate s own election campaign is the lesser of $25,000 or: Mayoral candidates $7, cents per elector Councillor and School Board candidates $5, cents per elector The preliminary maximum campaign expense limits for candidates for Mono Town Council, based on 6,714 eligible electors on September 15, 2014, are: Mayor $ 8, Deputy Mayor $ 6, Councillor $ 6, Voting Day Voting Day is Monday, October 22, 2018 from 10 a.m. to 8 p.m. Campaign Material Election campaigning or the distribution of election campaign material in or on Townowned property is not permitted. Third Party Advertising The Municipal Elections Act now includes a framework for third party advertising. The framework came into effect on April 1, 2018 for the 2018 municipal election. A third party advertisement is a message in any medium (billboard, newspaper, radio, etc.) that supports or opposes a candidate or a question on the ballot. Advertising that does not cost money to post or broadcast, such as comments made on social media, is not third party advertising. Third party advertisers must register with the municipality where they want to advertise. If they want to advertise in more than one municipality, they must register in each municipality. 14 Certain individuals or organizations including candidates, federal or provincial political parties or constituent associations, municipalities and local boards cannot register as third party advertisers and cannot make contributions to third party advertisers. For a complete list of ineligible individuals and organizations, please refer to section 88.6(5) of the Municipal Elections Act. Third party advertising must be done independently of candidates. Candidates cannot direct a third party advertiser and cannot register as third party advertisers. Third party advertisements can only appear between May 1, 2018 and Election Day, October 22, 2018 and only after the third party has registered with the Clerk. Registration There is no registration fee for third party advertisers. Third party advertisers can register with the clerk between May 1 and October 19, Notice of Registration - Third Party Form 7. Mandatory Information Third Party Advertisements Third party advertisers must provide the following information to broadcasters or publishers in writing before any third party advertisements appear and must include the information on any signs: the name of the registered third party advertiser the municipality where the third party advertiser is registered the telephone number, mailing address or address at which the registered third party advertiser may be contacted regarding the advertisement Campaign Finances Third Party Advertisers Third party advertisers are subject to the following spending limits. $5, cents per elector to a maximum of $25,000 The preliminary maximum expense limit, based on 6,714 eligible electors on September 15, 2014 is: Third Party Advertiser $ 5, The maximum contribution from a single contributor is $1,200 to a registered third party advertiser and $5,000 to two or more registered third party advertisers in a municipality. Campaigning Campaign provisions have been clarified to allow candidates to access apartment buildings, condominiums, non-profit housing co-ops or gated communities from 9 a.m. Information for Candidates 2018 Municipal & School Board Elections Page 12 of 24

15 until 9 p.m. in order to campaign. Landlords and condominium corporations will not be allowed to prohibit tenants or owners from displaying campaign signs in their windows. Candidates and third party advertisers are required to identify themselves on campaign advertisements and signs, so that it is clear who is responsible for each sign and advertisement that appears or is broadcast. Candidate Use of Municipal & Local Board Resources No candidate shall use the facilities, equipment, supplies, services or other resources of the Town or local board (including candidates personal websites and social media accounts linked through the Town s website) for any election campaign or campaignrelated activities. On May 1 st links to incumbent candidates personal website and social media accounts shall be removed from the Town s website. No candidate shall use the services of the Town staff or local board for any campaign related activities during hours in which Town staff receive compensation from the Town. No candidate shall use photographs depicting any member of Town staff or local board in campaign literature or advertising. Election Signs The Municipal Elections Act, 1996 does not regulate signs. Municipalities may put in place rules about when you can put up campaign signs, and how signs may be displayed on public property. It is your responsibility to ensure that your campaign signs are removed within 48 hours after voting day. Municipalities can put in place sign deposits and penalties for failing to remove your signs. Use of Town Logo The use of any corporate logo, crest or images by candidates on signs, brochures, websites or any other election-related material is strictly prohibited. The reason for this prohibition is to remove any suggestion that the Town supports or otherwise endorses any candidate, campaign material or statements made by candidates. Notification to Candidates As much as possible, notification between the Clerk s Office and candidates will be done through . In some cases, it will be necessary for the candidate to pick up documents from the Municipal Office. Candidates should ensure the documents are picked up when they receive the notification. It is the candidate s responsibility to ensure all the requirements of the Municipal Elections Act, 1996 are fulfilled. Candidate s Change of Address Candidates must notify the Clerk s Department of their new address if they move before all the required forms have been filed. 23 Form 31 Notice of Penalties Municipal Elections Act, 1996, Section 33.1 Pursuant to Section 33.1 of the Municipal Elections Act ("the Act"), before Voting Day the Clerk is required to give to each person nominated for an office, notice of: (a) the penalties under subsections (2) and 92 (1) related to election campaign finances; and (b) the refund of the nomination filing fee that the candidate is entitled to receive in the circumstances described in section 34. Effect of default by candidate 88.23(1) A candidate is subject to the penalties listed in subsection (2), in addition to any other penalty that may be imposed under this Act, Penalties (a) if the candidate fails to file a document as required under section or by the relevant date; (b) if a document filed under section shows on its face a surplus, as described in section 88.31, and the candidate fails to pay the amount required by subsection (4) to the clerk by the relevant date; (c) if a document filed under section shows on its face that the candidate has incurred expenses exceeding what is permitted under section 88.20; or (d) if a document filed under section shows on its face a surplus and the candidate fails to pay the amount required by that section by the relevant date. 2016, c. 15, s. 60. (2) Subject to subsection (7), in the case of a default described in subsection (1), (a) the candidate forfeits any office to which he or she was elected and the office is deemed to be vacant; and (b) until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies. 2016, c. 15, s. 60. Cessation of penalty (9) The penalties set out in subsection (2) for a default described in clause (1) (a) do not take effect if, no later than 2 p.m. on the day that is 30 days after the applicable day for filing the document, the candidate files the relevant document as required under section or and pays the clerk a late filing fee of $ , c. 15, s. 60.

24 Offences re campaign finances Offences by candidate 92 (1) A candidate is guilty of an offence and, on conviction, in addition to any other penalty that may be imposed under this Act, is subject to the penalties described in subsection (2), Refund (a) if the candidate incurs expenses that exceed the amount determined for the office under section 88.20; or (b) if the candidate files a document under section or that is incorrect or otherwise does not comply with that section. 2016, c. 15, s. 68 (1). 34. A candidate is entitled to receive a refund of the nomination filing fee if the documents required under subsection (1) are filed on or before 2 p.m. on the filing date in accordance with that subsection. 2016, c. 15, s. 26.
