1 - 1 - THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA REGULATION OF MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA NUMBER 14/M-DAG/PER/3/2016 CONCERNING THE AMENDMENT OF THE REGULATION OF MINISTER OF TRADE NUMBER 77/M-DAG/PER/12/2013 ON THE ISSUANCE OF TRADE BUSINESS LICENSE AND COMPANY REGISTRATION CERTIFICATE FOR TRADING COMPANIES BY THE GRACE OF GOD ALMIGHTY THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA, Considering : a. that in order to assist the trading company that will begin the business, it is necessary to accelerate and simplify the process of issuance services of Trade Business Permit and Company Registration Certificate simultaneously; b. that in accordance with the considerations as referred to in paragraph a, it is necessary

2 - 2 - to change some provisions in the Regulation of Trade Minister No. 77/M-DAG/PER/12/2013 on issuance of Trade Business Permit and Company Registration Certificate simultaneously for Trading Company; c. that in accordance with on the considerations as referred to in paragraphs a and b, it is necessary to stipulate the Regulation of the Minister of Trade on the Amendment of the Regulation of the Minister of Trade No. 77/M-DAG/PER/12/2013 on issuance of Trade Business Permit and Company Registration Certificate simultaneously for Trading Company; In view of : 1. Presidential Regulation No. 27 of 2009 on One-Stop Integrated Services on Investment; 11. Presidential Regulation No. 7 of 2015 on the Organization of State Ministries; 12. Presidential Regulation No. 48 of 2015 on the Ministry of Trade;

Regulation of the Minister of Trade No. 37/M-DAG/PER/9/2007 on the Implementation of Company Registration as has been amended by Regulation of the Minister of Trade No. 116/M-DAG/PER/12/2015; 17. Regulation of the Minister of Trade No. 77/M-DAG/PER/12/2013 on the Issuance of Trade Business License and Company Registration Certificate Simultaneously for Trading Company; 18. Regulation of the Minister of Trade No. 08/M-DAG/PER/2/2016 on the Organization and Administration of the Ministry of Trade; DECIDED: To stipulate : THE AMENDMENT OF THE REGULATION OF MINISTER OF TRADE NUMBER 77/M-DAG/PER/12/2013 ON THE ISSUANCE OF TRADE BUSINESS LICENSE AND COMPANY REGISTRATION CERTIFICATE FOR TRADING COMPANIES. Article I Some Provisions on the Trade Minister Regulation No. 77/M-DAG/PER/ 12/2013 on the Issuance of Trade Business License and Company Registration certificate Simultaneously for Trading Company are amended as follows: 1. The provisions of Article 3 is amended, thus it shall read as follows:

7 - 7 - Article 3 (1) The application as referred to in Article 2 paragraph (1) shall be applied by the Management, Trading Company Person in Charge or Third Parties to the Issuing Official simultaneously by completing the application forms of SIUP and TDP. (2) The application form as referred to in paragraph (1) is as stated in the Appendix of this Regulation. (3) The application form as referred to in paragraph (1) shall be signed by the Management or Trading Company Person in Charge with duly stamped. (4) In the case of the application as referred to in paragraph (1) shall be filed by a Third Party, the application shall be attached by a power of attorney that is duly stamped and signed by the Management or the Trading Company Person in Charge. 2. The provisions of Article 5 are amended thus it shall read as follows: Article 5

8 - 8 - (1) The Official shall Issue SIUP and TDP simultaneously not later than 2 (two) working days from the date of receipt of complete and correct application. (2) SIUP and TDP as referred to in paragraph (1) shall be issued in a separate document with the SIUP and TDP formats Guidance as regulated by the Ministry of Trade Regulation on SIUP and Regulation of the Minister of Trade on TDP. (3) In the event that the application is not considered to be complete and correct, the Issuing Official shall prepare a rejection letter to the Applicant no later than 1 (one) working days from the date of receipt of the application. (4) The Trading Company whose application is rejected may reapply for issuances of SIUP and TDP simultaneously according to the requirements as stated in this regulation. (5) The issuance of SIUP and TDP simultaneously as referred to in paragraph (1) may apply online company information system administered by the Ministry of Trade.

9 The provision of Article 6 is amended thus it shall read as follows: Article 6 To develop and supervise the Trading Company, Issuing Official shall deliver every SIUP and TDP that have been issued to the Head of Department in charge of trading field in the form of copies. Article II This Regulation shall come into force on the date of its promulgation. For public cognizance, this Ministerial Regulation shall be promulgated in the State Gazette of the Republic of Indonesia.
