1 5.10 HAZARDOUS/REGULATED ATERIALS ESA Report Summary A Phase I Environmental Site Assessment (ESA) was performed by LOPEZGARCIA GROUP (LGGROUP) in order to identify significant environmental concerns for the Dallas Area Rapid Transit s (DART) light rail transit (LRT) line to Irving/DFW. For purposes of this assessment, the property of concern is defined as the right-of-way (ROW) that is currently owned by DART and the areas that will be used or acquired running from the intersection of Denton Drive and Community Drive in to near the Belt Line Road and Valley View Lane intersection in Irving. The ROW extends from Storey Lane (Spur 482), along SH 114 to Las Colinas. At Las Colinas, the ROW crosses SH 114 near the intersection with Spur 348. The ROW continues to the west across North Lake College and then to the northwest across DFW Airport land near the intersection of Valley View Lane and Belt Line Road. The complete Phase I ESA is included in the Existing Conditions Technical emorandum (DART, October 2005). This section summarizes the findings of the ESA. In order to accomplish the NW Corridor LRT line to Irving/DFW, a significant amount of construction will take place within the property, including the construction of new rail, supporting infrastructure, and stations. The purpose of the ESA is twofold: 1) to identify and document areas within the property and surrounding area that could negatively impact construction activities, and 2) determine the potential for environmental liabilities as a result of past or present practices on the property and adjacent properties. Banks Information Solutions, Inc. (Banks) provided the regulatory agency database information and historic aerial photographs. LGGROUP reviewed this information and 97 database citations were identified at sixty-nine facilities or areas of concern located within the American Society for Testing and aterials (AST) search radii. A visual inspection of the study area was conducted to verify locations and evaluate current conditions. Using the information provided by Banks, study area visual inspection results, historical aerial photographs, topographical and soils information, the database citations were evaluated and sites with the potential to possess recognized environmental conditions (RECs) were identified. The facilities or areas of concern that were identified by the database were then categorized as having high, moderate, or low potential for RECs. High Potential Facilities or areas of concern found within the AST search radii that are located on or immediately adjacent to the subject property and have documented contamination that has not been fully delineated, is undergoing monitoring, has conditions that do not meet current regulatory standards, or has a history of regulatory action were classified as high potential for RECs. No locations identified in the regulatory agency database were classified as high potential. oderate Potential Facilities or areas of concern found within the AST search radii that are located adjacent to the subject property and have documented contamination that has not been fully delineated, is undergoing monitoring, has conditions that do not meet current regulatory standards, or has a history of regulatory action were classified as moderate potential for REC s. Twelve facilities or areas of moderate concern were identified in the regulatory agency database. These sites include three spill sites (site ID#s 2, 3, 27), two Leaking Underground Storage Tank (LUST) sites (site ID#s 22 and 55), five State Voluntary Clean-up Program (VCP) sites (site ID#s 25, 54, 61, 63 and 67), one Resource Conservation and Recovery Information System (RCRA) site (site ID# 24) and one Corrective Action site (CORRACTS) site (site ID# 68). Additionally 3 sites were identified during the site reconnaissance that could be classified as having a moderate potential for REC s. These sites include 2 piles of soil of unknown origin (site ID# 70 and 71) and Elm Fork of the Trinity River sediments (site ID# 72). Draft Environmental Impact Statement 5-39

2 Low Potential The remaining 57 facilities or areas of concern found within the AST search radii were classified as low potential for REC s. These locations have a lower potential of being contaminated or, due to their distance from the property or type of contamination, of having any contamination associated with them that would impact construction activities at the property. The facilities mentioned above were identified during the Phase 1 ESA as having a moderate potential for REC s. These facilities could affect the proposed construction. Additional environmental investigations may be required (Phase II Site Assessment) to detect and delineate contamination associated with these facilities or areas of concern. The twelve sites of moderate concern and the three reconnaissance sites are described in Table 5-14 and shown in Figures 5-3 and Hazardous/Regulated aterials itigation Further investigations will be performed during final design for at-risk areas. The investigations will focus specifically on areas where construction activities involve soil excavation and/or dewatering operations. In addition, any existing structures will be surveyed for the presence of hazardous/regulated materials such as asbestos-containing materials, lead-based paint, chemical storage, etc., prior to their demolition or modification. These investigations will provide a basis for determining construction health and safety specifications, contaminated soil and groundwater remediation, and disposal procedures and asbestos or lead-based paint management or remediation practices. The design and preparation of required monitoring and remediation plans would be coordinated with the TCEQ. If unanticipated sources of hazardous or regulated materials are encountered during construction activities, the construction manager or designee will immediately notify DART s Environmental Compliance Division. Specific mitigation activities, which address the type, level, and quantity of contamination encountered, will be immediately implemented. The handling, treatment, and disposal of any hazardous materials will occur in full compliance with all federal, state, and local requirements. The discharge of any wastewater suspected of containing hazardous/regulated materials is prohibited without first obtaining a TPDES Permit issued by the TCEQ covering the one-time discharge of wastewater containing known and specific hazardous constituents. Such a permit may be obtained from the appropriate regulatory agency providing the discharge is well characterized, meets discharge standards and does not pose a threat to the ultimate surface water body receiving the discharge. If fill material is required in the construction of proposed LRT facilities, the construction contractor will be required to ensure that the sources of any fill material are free of contamination. As part of the property acquisition process, sites within the proposed right-of-way that have structures will be surveyed for the presence of asbestos-containing materials (AC). The results of these surveys will determine whether or not additional impacts exist due to the presence of these hazardous/regulated materials. If the presence of these materials is confirmed during the survey, mitigation measures will be initiated as part of demolition and construction activities. DART has in place an on-going due diligence policy and program to assess the environmental condition of all properties contemplated for purchase as right-of-way or for the siting of transit facilities. Under this program, DART performs a separate Phase I Environmental Site Assessment (ESA) of each parcel or site under consideration for purchase in order to assess its specific probability for contamination. A Phase II ESA may also be undertaken to identify and quantify hazardous/regulated materials so the resulting need for cleanup or mitigation can be factored by Real Estate Draft Environmental Impact Statement 5-40
