1 APPROVED BY THL BGAHD OF COUNly COidhllSIcr!E;s Ar TI!E~~: MEET~NG ORANGE COUNTY RESOLUTION NO. 84-SW-05 A RESOLUTION ADOPTING A REVISED ORANGE COUNTY WASTEWATER AND POLLUTION CONTROL CHARGE SCHEDULE; PROVIDING FOR AN AUTOMATIC ANNUAL RATE INCREASE; PROVIDING FOR MINIMUM COVERAGE; PROVIDING FOR BI- ENNIAL RATE REVIEW; PROVIDING FOR ANNUAL NOTICE TO USERS; PROVIDING AN ECONOMIC IMPACT DETERMINATION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. PREMISES 1. The Board of County Commissioners of Orange County establishes and collects rates, fees, and charges for its Wastewater System pursuant to Chapters 125 and 153, Florida Statutes. 2. Since the last rate increase of August 18, 1983, the Board has determined that it must review and modify certain specific charges related to septage disposal charges and account deposits, while continuing other rates, policies, and rules adopted August 18, 1983, by Resolution No. 83-SW The Board then adopted a Resolution setting forth a preliminary revised Wastewater and Pollution Control Charge Schedule pursuant to Section (3) (a), Florida Statutes, on March 5, The Board authorized and scheduled a public hearing to consider the adoption of the revised Wastewater and Pollution Control Charge Schedule for March 26, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ORANGE COUNTY : Section 1. Revised Wastewater and Pollution Control Charge Schedule; Minimum Coverage. The Board of County Commissioners hereby adopts the revised Orange County Wastewater and Pollution Control Charge Schedule attached hereto and incorporated herein as Exhibit "A". The attached schedule supersedes and hereby repeals the presently existing Wastewater and Pollution Control Charge Schedule, as adopted August 18, The Board hereby represents and states that these rates, fees, and charges provide revenue to cover operation, maintenance, debt service and simple replacement costs of the Orange County Wastewater System. Section 2. Automatic Annual Rate Increase. Consistent with and pursuant to Section (3) (c), Florida Statutes, the Board hereby adopts annually, effective the first day of October, 1984, and on the 1st day of October each year
2 thereafter, an automatic increase each year of three percent (3%) of the monthly rates, fees, and charges set forth in the Wastewater and Pollution Control Charge Schedule in effect on the day immediately prior to the effective date of such annual increase. Automatic increases shall not apply to Specific Service Charges or sewer capital fees and charges. The Board further directs that on the effective date of each annual increase the Schedule of Wastewater and Pollution Control Charges in effect immediately prior to the effective date of such increase shall be revised to include the three percent (3%) increase in charges and that a copy of such revised Schedule of Wastewater and Pollution Control Charges shall be maintained for inspection by the Clerk to the Board of County Commissioners. Section 3. Biennial Rate Review. Consistent with and pursuant to any applicable provisions of Chapter 153, Florida Statutes, the Board shall conduct review of the rates, fees, and charges set forth in the Orange County Wastewater and Pollution Control Charge Schedule on a biennial basis. Section 4. Annnual Notice to Customers. Beginning in January, 1984, and during each January of each year thereafter, the Board shall send annual written notification to all customers of the Orange County Wastewater System of the County's then current monthly user rates, fees, and charges as set forth in the then current Orange County Wastewater and Pollution Control Charge Schedule. Section 5. Economic Impact Determination. The Board does hereby determine and find, pursuant to Section 1-27(2)(b), Orange County Code, that sufficient information has been provided for the Board to assess the economic impact of this Resolution on the development of real property in Orange County. The Board does hereby determine and find that no further economic impact statement or economic impact information is required in this matter. Secton 6. Severability. If any provision of this Resolution or the application thereof to any person or

FOOTNOTES (1) Bills for sewer service shall be rendered monthly in accordance with applicable state law. (2) In addition to the Minimum Monthly Charge, all customers (other than those customers who pay flat rates or industrial customers paying other individually established volume charges) shall pay a Volume Charge based on metered water consumption. The following classes of customers shall not be charged a Volume Charge for sewage discharge (as measured by metered water consumption) in excess of the following gallon amounts: Residential, Single Family Multiple Residential, 2-4 Units Mobile Homes 25,000 gallons per month (3) Deposit to be calculated as twice the monthly flat rate equivalent charge. The flat rate equivalent charge is to be determined on the basis of a $1.36 customer charge per account plus a volume charge of $2.68 per 1,000 gallons based upon Equivalent Residential Unit ("ERU") factors as provided in Section 5 of the Orange County, Sewer Capital Charge Ordinance, or as it may be amended from time to time.

Service piping from the meter to the building is to be installed by and/or at the expense of the property owner or builder.

(4) Does not include any cost associated with construction of a water lateral from the meter to the water main providing service; in the majority of cases, the developer constructs the lateral. In situations where the County would be responsible for the lateral, the cost of the lateral would be charged to the customer on a time, materials, and pro rata overhead cost basis. (5) May be waived if the customer dedicates an appropriate easement or right-of-way to the County for access to the hydrant or hydrants. (6) Based upon same ratio as current deposit.
