Opening of Meeting The meeting opened at 1:00 p.m., with 10 members of the Committee in attendance. 2. Minutes/Notes from Previous Meeting A motion was made to approve the Minutes of the December 8, 2011 meeting. Moved by: J. Dorris Seconded by: D. Tipler CARRIED A Joint Committee of: Professional Engineers Ontario; Consulting Engineers Ontario; Ontario Association of Architects; Ontario Building Officials Association; Large Municipalities Chief Building Officials; and Toronto Area Chief Building Officials Committee

2 A motion was made to approve the Minutes of the March 7, 2012 meeting, as modified. The term prime consultant was replaced by coordinating design professional in the March 7, 2012 meeting Minutes. Moved by: M. Bendix Seconded by: T. Tipping CARRIED 3. Municipalities as Leaders in Energy Efficiency M. Seiling sent information regarding air door tests. The MMAH has come up with a series of forms for Energy Efficiency Design for Part 3 Large Buildings and Part 9 Non-Residential Buildings, which supplement the earlier Part 9 Residential Buildings checklist. There forms are available on the MMAH website at From a design perspective, the Energy Efficiency forms seem like an afterthought. These forms should have support from EABO. G. Conway will table, for information, the MMAH Energy Efficiency Design Forms at the OAA Practice Committee meeting. J. Vera to send the following MMAH Energy Efficiency Checklists to C. Roney for his comments: - Energy Efficiency Checklist for Large Buildings - Simplified Checklist for Part 9 Non-Residential Is the coordination of the different disciplines covered in the MMAH Energy Efficiency Design Forms? In the Energy Efficiency Checklist for Large Buildings and Part 9 Non- Residential Checklist, an architect, mechanical designer and electrical designer need to sign it. In the new MMAH OBC SB-10 checklists, the modeling software must be specified on Forms A, 5.6 and 11. Do the Building Departments receive modeling results from engineers? Building Departments ask that architects or mechanical engineers sign off a document indicating that the modeling has been done. 2.

3 Other issues were brought up, such as condos not complying with ASHRAE. These issues are beyond the scope of this topic and may need to be addressed at another meeting. 4. Coordination Between Professional Designers Engineer of Record J. Vera reported that the Professional Standards Committee ( PSC ) and the Structural Engineering in Buildings subcommittee do not currently have a position on having a coordinator of all engineering disciplines, but the subcommittee has endorsed having a Primary Structural Engineer in cases when multiple companies are involved in structural work. Proposed Changes to Ontario Building Code, Division C, Part 1, Section 1.2, Design and General Review J. Vera received comments from the Chair of the PSC regarding the proposed changes to the OBC initiated by G. Conway. Does coordination apply to retrofits? Yes, coordination applies to retrofits as well. It is expected that both the OAA and PEO will define the consultant coordination requirements in their performance standards, much the same way a general review has performance standards for architects and engineers. J. Vera to follow up with PEO s Professional Standards Committee ( PSC ) on the above issue. J. Vera reported that PEO is currently in talks with the MMAH regarding how the OBC will be updated to comply with the May 17, 2007 court decision. On May 17, 2007, the court ruled for PEO, finding that certain articles of the Building Code are invalid. It also held that certain provisions of the Building Code Act and the Building Code conflict with the exclusive regulatory jurisdiction of PEO and do not apply to any holder of any licence or certificate issued under the Professional Engineers Act. 3.

4 OAA PractTip Consultant Coordination Comments J. Vera reported that he received comments from PSC members on OAA Consultant Coordination PractTip. The OAA Practice Tip coordination document has now been posted by the OAA. The Chair will contact Alek Antoniuk of the MMAH regarding coordination. 5. General Review of Construction General Review Without Permit J. Vera reported that the following document was included in the agenda package: Review Commitment 2012 Draft Version 6 with OAA amendment J. Vera reported, at the December 8, 2012 EABO meeting, that there was an action item for EABO to propose to PEO if a clause could be added to the form that is acceptable to PEO, such as, general review does not commence until a permit is issued. J. Vera sent this document to PEO (C. Roney) for their comments. Please refer to attached comments. G. Conway sent this document to OAA (K. Doyle) for their comments. This document was revised by the members; refer to: Review Commitment 2012 Revision Draft v7 Below is a summary of the discussion: If there is no Building Permit, there cannot be General Review. There is no law that an engineer cannot go onsite without a building permit. What about cases when an engineer does general review without a permit and submits the general review report after a permit is issued? OAA s view is that, if an architect goes onsite, they are causing to construct. There are some issues with Item 4 on this form. 4.

5 As far as OAA is concerned, general review occurs when an architect goes onsite. J. Vera to the revised form to G. Pask. D. Dengler provided the members with hard copies of their comments on this form. J. Vera to the comments to the members. G. Conway to send D. Dengler feedback on the comments. The members liked the comments; particularly, the idea of using the language of the OBC on this form. Furthermore, both PEO and OAA will decide if the section on Coordinator of the Work should be left on this form. 6. Structural Requirements for Solar Collector Installations J. Vera followed up with C. Roney regarding this issue. C Roney has not met with the MMAH about this issue, but a project they had initiated to revise the roof framing provisions of Part 9 of the OBC has been set aside for the time being. J. Vera followed up with the MMAH (Brenda Lewis, who is Denise Evans replacement), but has yet to receive a response. If a collector is a new system, doesn t it need to comply with the whole OBC? There are major and minor renovations. A solar panel does not necessarily change the use of a building. If a load is being added, it cannot make a building less safe. The members mentioned that perhaps solar panels retrofitted on new buildings should not be installed as Part 11 since they are a new system. 7. Information M. Seiling sent the Complete Application Best Practice Guide and attachments to OAA, and they were posted on their EABO website. 5.

6 Temporary Stages and Tents J. Vera asked the members the following questions: (1) Do temporary stages and tents require building permits? (2) Do temporary stages and tents require a general review? (3) Do temporary stages and tents require inspection? Answers: (1) Temporary stages on wheels do not in Milton. In Toronto, all temporary stages require permits. Tents over 60 metres square are covered by the OBC and require permits. (2) The OBC requires review of temporary stages over 100 feet square. Tents over 225 metres square require a structural engineer and, therefore, a general review. (3) Temporary stages over 100 feet square and tents over 225 metres square require inspection. In general, these structures require a professional engineer. 8. Training J. Vera reported that, at the December 8, 2011 meeting, there was an action item to draft a letter to Ron Colby of OBOA requesting a discount for OAA and PEO members. J. Vera began drafting this letter. Please refer to the attached letter, with the Chair s comments. J. Vera to contact the Ontario Society of Professional Engineers ( OSPE ) regarding this letter. 9. Planning Act J. Vera reported that, at the previous meeting, there was a request to add concerns with the Planning Act into the agenda. This issue will be discussed at the next meeting. 6.

7 10. New Business Mandatory Electronic Submission J. Vera reported an issue regarding mandatory electronic submissions in Toronto and the problems with having an unsecured sealed engineering drawing. Idea: Problem: Are the building plans the property of the engineer or architect? Yes, but the public has the right to see them. In Toronto, the request goes back to the architect or engineer for copies to be sent. In Milton, a sticker with the author s name is sent with the copies. Should the engineer submit directly to the City? Usually, drawings are submitted as one package. Drawings in tender sets are a problem since they go to the public for bidding. J. Vera to send PowerPoint presentation to members. Glass Balconies The City of Toronto has new policies on their website for glass on balconies. The Ministry of Housing issued OBC SB-13, effective July 1, 2012, with new requirements for glass balconies. J. Vera added the web link in the Minutes. Please see the link below: Closed Loop Geothermal Systems Should these systems be added to applicable Law? J. Vera to draft a letter to the Ministry of the Environment to find out if these systems require a separate law. Monitoring the Accessibility for Ontarians with Disabilities Act (AODA) Should EABO monitor this new Act to see how it affects the OBC? This item will be added to the agenda of the next meeting. 7.
