1 ROLE PROFILE Role title Location Reporting structure Group Employment Relations Manager Netcare Head Office: Sandton General Manager: Human Resources South Africa Closing date 25 August 2017 ROLE SUMMARY The Group Employment Relations Manager will assume responsibility for applying and managing best and most effective operational employee relations practices, systems and procedures at Business Unit Level for the Netcare Group, including the Lesotho operations. The incumbent will be required to have an advanced level of knowledge and understanding of legislative frameworks that influences and safeguards employers and employees. This includes identifying, evaluating, prioritising and mitigating against non compliance to Company policies and legislation. The Group Employment Relations Manager will be responsible for keeping the organisation s vision and values at the forefront of decision making and inspiring and engendering enthusiasm in others to participate in the HR focus by encouraging shared commitment to the vision, values and objectives of employee relations practices in a dynamic and diverse business context. KEY WORK OUTPUT AND ACCOUNTABILITIES OPERATIONAL EXCELLENCE Benchmarking and Compliance Advise the business on best practice in terms of labour relations matters and other legislation that impacts on employee relations. Study, interpret and advise business units on applicable international labour legislation and ensure compliance where applicable. Ensure the updating, interpretation and implementation of employment relations policies and agreements. Prepare and present best practice solutions to the business to minimise risk, including management reporting and benchmark statistics. Conduct research, study, interpret and advise business on new labour legislation. Investigate the financial and other implications of legislative changes in conjunction with the Remuneration Manager and other specialists and devise and implement solutions to minimise the potential risk. Devise action plans for the implementation of legislative changes, monitor implementation and report back to the business on the progress and / or further potential risks.

2 Benchmark against best practices and ensure best practice is followed with regard to the IR framework and practices. Maintain current knowledge of tools and best practices within Industrial Relations. Ensure compliance with responsibilities imposed by health and safety legislation, whilst maximising and promoting the health of all employees as well as reducing the risk of cases of occupational ill health development. Develop and manage an effective framework for Occupational Health and Safety processes and procedures for the Group, conduct research, interpret Occupational Health and Safety legislation and consult with the business on required policy and procedure updates. Identify any potential risks related to Occupational Health and Safety and consult with the business to implement action plans to minimise these risks. Ensure HR due diligence exercises for all merges, acquisitions and outsourcing projects and manage the process in line with the requirements of section 197 of the Labour Relations Act and other relevant legislation. Process Efficiency Manage and coordinate IR process efficiencies. Develop new employment relations policies and procedures in consultation with HR, and line where applicable, and within the context of legislation and the Netcare business strategy. Update and manage the custom IR systems on the HR portal. Manage and facilitate the applicable Service Level Agreement with Temporary Employment Agencies. Manage and coordinate capturing and deduction of union membership fees and data. Analyse and communicate union representation levels in regard to organisational and collective bargaining rights to HR Managers and applicable unions. Manage and coordinate capturing and reporting of IR processes and activities which include discipline, performance, grievances and dispute resolution activities.provide management reporting with regard to the IR framework by analysing reported employment relations activities. ACCELERATING TRANSFORMATION Transformation and Diversity Ensure achievement of transformation goals as set out by the Transformation Committee. Support inclusive diversity in the business and manage any behaviour that does not support this value. GROWING WITH PASSIONATE PEOPLE Build and Maintain Stakeholder Relationships Build relations with Divisional, Regional, Area and Business Unit Line and HR Managers and ensure continuous feedback on all employment relations activities. Build relations with representative trade unions by coordinating and maintaining regular National management and union meetings. Ensure regular feedback to unions in regard to all relevant employment relations issues and union membership status.

3 Coordinate the quarterly National Transformation Forum meetings and National Consultative Forum meetings between the unions and the business. Develop, maintain and encourage open communication channels between relevant stakeholders. Employment Relations and Risk Management Effective Management of the IR related function of all Netcare business units and divisions including Lesotho operations. Manage all strike and related processes. Employee Relations Consulting Act in an advisory capacity for all CCMA referrals in terms of conciliation and arbitrations. Attend, manage and monitor all CCMA arbitrations, Labour Court matters and related labour activities. Liaise with referred attorneys. Advise on the interpretation, implementation and compliance of union collective agreements. Assist and advise Regional and Area HR Managers to develop clear business case proposals with regards to all restructuring and contemplated operational requirement dismissals. Ensure standardised application of disciplinary and grievance procedures. Provide IR plan reviews and make recommendations for business improvement. Provide regular feedback to HR and line managers in regard to IR news and case law. Provide sound expert advice and assistance to Regional and Area Managers on employment relations activities and IR related matters. Collective Bargaining Act as a member of National Collective Bargaining Team. Coordinate and manage annual negotiations process and communication between stakeholders. Coordinate and prepare formal communication and updates to the business on progress on wage negotiations. Prepare for annual wage negotiations, including research of the industry norms and current economic status. Draft collective agreements and other agreements. Ensure communication, implementation and compliance of collective agreements. People Management and Development Manage the performance and delivery of the IR team and provide guidance and up skilling of the HR structures to provide sound IR support and advice to line managers and HR personnel. Manage the line function responsibilities of the National Full Time Shop Stewards in consultation with the applicable unions. Manage the performance and provides guidance and up skilling of the National Full Time Shop Stewards. Manage and coordinate IR related training for all HR and line managers in consultations with National Training Department and Regional and Area HR Managers.

SKILLS PROFILE EDUCATION A relevant 3 year Bachelor s degree in Labour Law or related qualification or equivalent NQF level 7 qualification. A LLB Degree or related Legal qualification is preferred. A Master s Degree in Labour Law / Employee Relations will be advantageous. WORK EXPERIENCE Minimum of 3 years Industrial Relations work experience. Co ordination of requisite legislative committees. Extensive practice of IR principles and practices in the healthcare context. KNOWLEDGE Extensive knowledge of IR principles and practices in the healthcare context.
