The E.O.I. documents along with separate terms & conditions are obtainable on payment of Rs 500/- either by cash or by way of DD drawn in favor of BRBN Ltd. Which can also be downloaded from our website: brbn.bih.nic.in in such cases the tenderer has to deposit Rs 500/- along with the filled in E.O.I. form. The sealed E.O.I. duly filled in will be received at BRBN Ltd Patna up to hrs. on and will be opened on same day at hrs in the presence of tenderers or their authorized representatives if any BRBN Ltd reserves right to accept or reject either in full or part of the E.O.I. or all the E.O.I. without assigning any reason. FOR ORGANIZING SEED PRODUCTION PROGRAMME OF HYBRID SEED OF MAIZE AND PADDY BRBN Ltd. intends to produce 1500 qtls of hybrid Paddy and 2000 qtls hybrid Maize During Rabi & which is to be procured during September-October 2014/2015 duly packed and tagged in BRBN Ltd. bags from reputed seed producers hereinafter called as seed producer in two bid system. Offers be quoted on enclosed proforma for certified seed production for the varieties as per given below: S.N. Crop Variety Class Qty. (in Qtls.) 1 Paddy DRRH-2 C.S. hyb qtls 2 Maize HQPM - 1 HQPM 5 HQPM -7 Vivek QPM-9 Shaktiman - 3 Shaktiman - 4 C.S hyb qtls Note:- Last date of acceptance of E.O.I. at BRBN Ltd. Patna is up to hrs. and will be opened on the same day at 15:30 hrs. in presence of committee and representatives/tenderers, if any. TWO BID SYSTEM A. Sealed envelope should be prepared as detailed below: 1. ENVELOPE NO. 1 (SEALED) This envelope should be marked as ENVELOPE NO. 1-TECHNICAL BID FOR PRODUCTION OF CERTIFIED SEED DURING Rabi / And should contain following papers with covering letter on letter head (Seed producer should invariably mention their name, address etc,. on left hand side of envelope for clear identification) a. Part A (Technical Bid) b. E.M.D. details. 2. ENVELOPE NO.-2 (SEALED) This envelope should be marked as ENVELOPE No.-2 PRICE BID FOR PRODUCTION OF hybrid Paddy & hybrid Maize seed in Rabi / And should contain PART B (Seed producer should invariably mention their name. Address etc. on left hand side of envelope for clear identification).

3 3. Both the envelops should be enclosed in one big sealed envelope super scribing E. O. I. FOR PROCUCTION OF hybrid Paddy & hybrid Maize seed in / The sealed E.O.I. should be delivered in the office of the BRBN Ltd. Mithapur, Patna. 4. Seed producer must affix seal and put address on each envelope. 5. Eligibility Criteria For Seed Organizer:- 1. Seed Organizer are primarily engaged in seed Production and were registered as seed production unit in their respective state. 2. Seed Organizer have own registered processing unit and storage facilities. 3. Seed Organizer has already engaged in hybrid seed production in past. 4. They should have tie up for seed production with state seed corporation or National level seed co-operative in past. 5. There will be no criminal case against Seed Organizer regarding seal production and at no point of time they were procedural under court of law regarding seed production, supply & Marketing of seed. TERMS AND CONDITION: 1. Sealed E.O.I. to be submitted to BRBN Ltd. Patna in the enclosed prescribed format part A & B separately for technical bid and commercial bid. Both the sealed bids A&B separately be further sealed in another envelope super scribed as E.O.I FOR HYBRID SEED PROCUCTION of Paddy & Maize Sealed E.O.I. duly filled in will be received at BRBN Ltd. Patna up to 1500 hrs. on and technical/financial Bid will be opened on the same day at hrs in presence of tendrers or their authorized representatives. 2. The parent material foundation seed will be distributed by seed organizer producer in the name of individual seed grower and certification charges will be deposited by seed organizer in BRBN office along with all necessary documents required for registration f seed production program with S.S.C.A. at least 20 days before last date of registration prescribed by S.S.C.A. and in turn BRBN will submit the documents along with requisite certification charges to S.S.C.A. for registration of program in the name of BRBN Patna. 3. The contract is quantity oriented. The registration of the area from which the seed produced is to be delivered to BRBN is required to be registered with concerned State Seed Certification Agency in the name of BRBN Patna. The registration fee, Inspection fees, seed testing. Sample testing and another charges if applicable will be borne by the seed producer. 4. The seed plots from which the seed will be supplied to BRBN will be inspected by BRBN staff randomly as per discretion and actual need basis. Besides inspections by The State Seed Certification Agency for certification. 5. The produce from the plots certified by Certification Agency is to be processed and packed only after meeting the STL & BRBN QCL seed test results. The relevant certification charges such as godown charges.tag cost, regarding charges and late fee if any towards packing will be borne by the seed producer. 6. The Procurement price for the certified tagged and packed seed shall be at par to the of concerned State Seeds Corporation procurement price. The procurement price paid by BRBN (at par with State Seed Corporation to seed producer will be passed on to the identified seed growers & BRBN has full rights to verify the same from the records of seed producer. In case SSC does not take up production program of particular Crop/Variety rate of Repective State Agricultural University/IARI Institute will give second priority in case of non availability of some other Corporation /last year rates will be paid. Custom rates/services charges as quoted per qlt. Over the above the procurement price. Including all taxes. For all operations from raw seed receipt. Processing testing storage. Final packing up to delivery will be the remuneration of seed producer who is entering into agreement for production with BRBN Patna.

4 7. The seed organizer s offer shall be valid for the least 60 days and should be for the least for 1500 qtls Paddy/2000 qtls of Maize. 8. The raw seed arrival and processing of raw seed shall be carried out at their own designated processing plant. 9. Rate may be quoted ex-producer s processing plant/store. 10. The parent material will be arranged by seed organizer at his own cost. 11. In case of complaint form fields regarding quality of seed responsibility will rest upon the seed producers. 12. BRBN will have no commitment/responsibility to the individual seed grower. The seed organizer or his representative may sign each and every document of BRBN on behalf of individual seed growers selected by him for BRBN seed Production program. 13. Certification/Packing material i.e, bags and labels shall be obtained by seed organizer form BRBN packing will be in standard size as per BRBN requirement. 14. Insurance cover will be obtained against fire. Thefts & burglary in name of BRBN for the seed quantity produced for BRBN By the seed organizer at his cost for the period from receipt of raw seed till supplies to BRBN. 15. The raw seed shall be received. Processed and packed at seed organizer processing plant/store. Hence entire seed shall be in the custody of seed organizer concerned. Till the tagged and bagged seed is received by BRBN official. In case of any loss to BRBN on account of seed stored in the premises of seed organizer be will be solely responsible and liable to pay entire loss amount to BRBN Patna. 16. Seed produced for BRBN under the contract shall not be pledged with the bank or other financial institution. 17. Advance payment will be on average highest APMC rates of grains collected from designated Mandi and specified period by BRBN On 80% of raw see for minimum qtls raw seed arrival on weekly basis subject to submission of insurance cover in favor of BRBN and physical verification by BRBN s representative. Advance payment will be made against 100% irrevocable Bank guarantee valid up to at least 28 th February The seeds of hybrid Maize should be ready by last week of September 2014 and for Paddy March/April Failure to deliver less than 90% of approved quantity by Seeds Producer, shall entitle BRBN to impose 10% of the value of the shortfall in the supply at the rate agreed to. The penalty for short supply will remain at 10% of the value of the quantity not supplied against 90% benchmark. For deliberately delayed supplied, Penalty of Rs 2/- per day per qtl may be charged. 20. The successful seed organizer has to enter into an agreement with BRBN on the mutual agreed terms and conditions on the non judicial stamp paper of Rs 100/ Offer/application for taking up seed production programme shall be accompanied with EMD of 2% of the total value of the quoted rates or Rs 1,00,000/- whichever is less in the form of DD in favor of Bihar Rajya Beej Nigam Ltd. Patna offer/application form without EMD shall be rejected. 22. The successful parties shall also have to remit security deposit of Rs 20,000/- per thousand qtl of offered production programme minimum of Rs 50,000/- whichever is more in form of demand draft payable at Patna/RTGS/irrevocable Bank Guarantee valid up to 31 st Oct Within fifteen working days after finalization of production programme and hearing form BRBN. Failure to remit the security deposit may imply forfeiture of EMD. Security Deposit will be returned after 120 days from the date of supply/billing. EMD can be refunded after execution of agreement/deposit of security.

5 23. The rates may be quoted and submitted on or before 15 hrs by the party to BRBN Patna. The contract seed grower shall abide by the production program on above terms & Conditions. OTHER TERMS AND CONDITIONS:- 1. BRBN shall not be responsible for fluctuation of the market rate of the ordered seed. The seed producer shall be required to supply the seed at agreed rate only. The agreement can be terminated at any time due to non performance of any of the terms and conditions of the agreement to the satisfaction of the Corporation BRBN has right to forfeit the security. 2. The BRBN reserves the right to accept to reject either in full or part of the E.O.I. or all the E.O.I. without assigning any reason. BRBN further reserves the right to award contract/issue the order for supplies to more than one seed producer. 3. In case of dispute arising out of the contract. The Seed organizer /Seed organizers shall have to agree to the decision of the sole arbitrator appointed by BRBN whose decision will be binding on both the parties. 4. The court of law situated at Delhi will have the jurisdiction in matter related this E.O.I and dispute during the performance of the contact. 5. The seed producer shall be responsible for State Sales Tax/ Central Sales Tax/VAT and Income Tax liabilities. If any BRBN will not carry any tax liability related with the transaction. 6. BRBN Will not be responsible for the losses incurred to the seed producer due to change in Govt. decisions, Natural calamities, Which are beyond the control of BRBN. 7. Quality control inspectors of the concerned State may draw the samples of stocks. In case the stocks failed in sampling the seed producer will be responsible for the consequences of violation of Seed Act and Seed Laws. 8. The weight of the seed container shall be checked at any point of transaction and in case shortage found in the container. BRBN will not pay any cost against such supplies and the seed producer shall be responsible for the legal consequences of Weights and Measures Department. If any. 9. The seed producer will have to give name of the firm, name of the processing plant. Godowns their postal addresses. Telephone Nos. .
