29 BioPreferred and biobased purchasing requirement. establish an annual target for the number of contracts to be awarded with BioPreferred and biobased criteria and dollar value of BioPreferred and biobased products to be delivered and reported under those contracts in the following fiscal year. to establish this target, agencies shall consider the dollar value of designated BioPreferred and biobased products reported in previous years, the specificacons reviewed and revised for inclusion of BioPreferred and biobased products, and the number of applicable product and service contracts to be awarded, including construccon, operacons and maintenance, food services, vehicle maintenance, and janitorial services.

33 CONTRACTING FAR Part 23 Use of Recovered Materials and Biobased Products (a)(2) - Refer to USDA s list of USDA- designated when purchasing supplies or when purchasing services where biobased products can be used (b)(2) - Once an item has been designated by USDA, agencies shall purchase conforming products (a) Insert the provision at , Biobased Product CerCficaCon, in solicitafons that (1) Require the delivery or specify the use of USDA- designated items; or (2) Include the clause at (b) Insert the clause at , AffirmaCve Procurement of Biobased Products Under Service and ConstrucCon Contracts, in service or construccon solicitafons and contracts, unless the contract will not involve the use of USDA- designated items

34 CONTRACTING Biobased Product CerCficaCon As required by the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005 (7 U.S.C. 8102(c)(3)), the offeror cercfies, by signing this offer, that biobased products (within categories of products listed by the United States Department of Agriculture in 7 CFR part 3201, subpart B) to be used or delivered in the performance of the contract, other than biobased products that are not purchased by the offeror as a direct result of this contract, will comply with the applicable specificacons or other contractual requirements.

35 CONTRACTING AffirmaFve Procurement of Biobased Products Under Service and ConstrucFon Contracts (a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)- designated items unless (1) The product cannot be acquired (i) CompeCCvely within a Cme frame providing for compliance with the contract performance schedule; (ii) MeeCng contract performance requirements; or (iii) At a reasonable price. (2) The product is to be used in an applicacon covered by a USDA categorical exempcon (see 7 CFR (e)). For example, all USDA- designated items are exempt from the preferred procurement requirement for the following: (i) Spacecrab system and launch support equipment. (ii) Military equipment, i.e., a product or system designed or procured for combat or combat- related missions. (b) InformaCon about this requirement and these products is available at hdp:// (c) In the performance of this contract, the Contractor shall (1) Report to hdp:// with a copy to the ContracCng Officer, on the product types and dollar value of any USDA- designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and (2) Submit this report no later than (i) October 31 of each year during contract performance; and (ii) At the end of contract performance.

38 ContracFng Officer Role Related to Federal ReporFng of Biobased Product Purchases Ensure FAR Clause is in your contracts. NoCfy winning Contractor that the Contractor must report their BioPreferred product purchases - product types and dollar value of any USDA designated Biobased product purchased by the Contractor to input the data to the SAM. Ensure that the contraccng officer receives a copy of the reporcng data from the Contractor as required in FAR Clause. Periodically remind Contractor of this reporcng requirement.

39 ContracFng Officer Role Related to Biobased Product Purchase ReporFng The trigger for Contractor reporcng of biobased product purchases in the System for is for the ContracCng Officer to correctly enter SecCon 8L on the FPDS. Complete FPDS data element 8 L. Select the Biobased from the drop down menu. Training will be provided for ContracCng Officers in June via live streaming. Look for opportunity to register shortly.

40 Contractor ReporFng of Biobased Product Purchases Pursuant to a legislacve mandate in the 2008 Farm Bill, Prime Contractors are required to report the category of product, type of product, and dollar value of all United States Department of Agriculture (USDA) designated biobased products that they purchase during the previous fiscal year.

41 Contractor ReporFng Requirement ReporCng of biobased product purchases will be completed by contractors through a portal in the System for Award Management or SAM. Contractors will report the product type and dollar value of any USDA designated biobased products purchased by the Contractor. ReporCng must be completed by the end of October for the previous encre fiscal year (October 1 - September 30).
