5 Page 5 of 6 APPLICATIONS HEARD PREVIOUSLY THAT WILL BE HEARD ON SUBSEQUENT MEETINGS Planning and Zoning Staff; application PLPZ , for a text amendment to modify Section of the Town of Greenwich Building Zone Regulations, Flood Hazard Overlay Zone, as required by FEMA in order to remain in compliance with the National Flood Insurance Program (NFIP), as follows: TEXT IN BOLD TO BE ADDED; TEXT IN STRIKETHOUGH TO BE DELETED (Continued from the 6/25/2013 meeting) AMEND SECTION (c) (39) Substantial Damage - means damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed 50% of the market value of the structure before the damage occurred. "Substantial damage" also means flood-related damages sustained by a structure on two separate occasions during a 10-year period for which the cost of repairs at the time of each such flood event, on the average, equals or exceeds 25 percent of the market value of the structure before the damage occurred. AMEND SECTION (f)((11)(D) Fully Enclosed Areas Below Base Flood Elevation. New construction or substantial improvements of Non- Residential buildings not flood proofed per Section (f) (11) (c) and all Residential Buildings that include fully enclosed areas formed by foundation and other exterior walls below the base flood elevation shall be designed to preclude finished living space and designed to allow for the automatic entry and exit of flood waters to equalize hydrostatic flood forces on exterior walls. Designs for complying with this requirement must either be certified by a professional engineer or architect and meet the following minimum criteria: (2/9/2000) (i) Provide a minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding; openings shall be on at least two sides of the enclosed area; alternatively, an Individual Code Council Evaluation Service (ICCES) must be submitted to document that the design of the openings will allow for the automatic equalization of hydrostatic flood forces on exterior walls. (ii) The bottom of all openings shall be no higher than one foot above grade; and and equal to or below the elevation of the floor.
