(310) Architectural Commission Report Meeting Date: Subject: Wednesday, November 15, SOUTH SANTA MONICA BOULEVARD Winnie Couture (PLi ) Request for approval a façade renovation, building identification signage, business identification signage and awnings for Winnie Couture. Pursuant to the provisions set forth in the California Environmental Quality Act (CEQA), the Architectural Commission will also consider adoption a Categorical Exemption for this project. Project Agent: Gidas Peteris - Architects, Inc. Recommendation: Conduct a public hearing to discuss the project details and provide the applicant with an approval, as conditioned. REPORT SUMMARY The applicant is requesting review and approval a façade renovation, building identification signage, business identification signage and upper-floor awnings for Winnie Couture located at 9437 South Santa Monica Boulevard. The project includes the following components: Façade Modifications. New upper fenestration with dark bronze aluminum frames. Starphire glazing. Sunbrella awnings along the second story. Building and business identification signage Building Identification Signage SOUTH SANTA MONICA BOULEVARD Location Size Quantity Illumination Material South façade 14 SF 1 Non-Illuminated Polished stainless West façade 14 SF 1 Non-Illuminated Polished stainless TOTAL SIGN AREA: 2$ SF (2 SIGNS) Pursuant to BHMC , the Architectural Commission may grant a sign accommodation to allow a greater number building identification signs or to allow such signs to be located in areas other than those otherwise permitted (less than 25 -O above grade), provided that the signs located on any one side a building do not exceed two percent (2%) the vertical surface area that side, excluding penthouse walls. Based on a vertical surface area 4,850 square feet, the maximum allowable area for building identification signage is 96 square feet. Non-Ground Floor Business Identification Signage SOUTH SANTA MONICA BOULEVARD Location Size Quantity Illumination Material Stairwell entry 1.5SF I Non-Illuminated Stainless Steel Painted Black TOTAL SIGN AREA: 1.5 SF (1 SIGN) Pursuant to BHMC , A business located above or below the ground floor any building and not having its main entrance or address on or abutting a courtyard shall be permitted one business identification sign, or a portion there, at each ground floor entrance to such building. The sign shall not exceed six (6) square feet in area. The sign shall be shared by all such businesses desiring signage. As such, the proposed business identification signage is within the maximum standards set forth in the BHMC. URBAN DESIGN ANALYSIS The building was constructed in 1928 and was designed by the Master Architect firm Henry Koerner and William Gage, designers Beverly Hills City Hall, as well as many other historically important structures. The building was constructed for Hollywood notable Jack Warner and was originally named the Chamber Commerce Building. The building has been altered over time with the replacement all upper-story glazing units as well as the storefronts systems along the ground floor, but the structure retains many the character-defining features that make the building an historic resource which is eligible for designation. The current proposal involves the replacement all non-original upper-story windows with new fixed units and the reconfiguration three groupings these second-story punched openings at the corner the building to form larger display window areas. The Secretary the Interior fers guidelines for the rehabilitation, restoration and adaptation historic structures, but discourages the reconfiguration original window openings. These guidelines do fer allowances for the reversibility proposed changes, and the architectural team in this scenario has allowed for the return to the original window configuration in a future iteration the upper floor the building at such time as a full restoration the facades may be contemplated. The project also proposes awnings along the second floor and a Building Identification Sign at the corner structure at South Santa Monica Boulevard and Beverly Drive. A Building Identity sign currently exists at the site at the ground floor and over the main entry for the upper floor tenants on South Santa Monica Boulevard The Commission will need to consider the appropriateness this secondary sign at the corner for a major building tenancy on the upper floor at this site. ZONING CODE COMPLIANCE Applications for architectural review are preliminarily evaluated for compliance with the zoning code. Applicants are encouraged and have the option requesting a comprehensive review

Formal compliance review will occur when a building permit application is filed (plan check). The applicant has been advised that changes during plan check may require revisions and subsequent approval from the Architectural Commission or staff, as appropriate. ENVIRONMENTAL ASSESSMENT The subject project is exempt from the California Environmental Quality Act (CEQA Public Resources Code 21OOO 21178), pursuant to Section 15061(b)(3) the State CEQA Guidelines in that the project includes the review building design, colors and materials to the façade the building, front yard landscaping or minor low-scaled accessory structures, such as fences or walls. It can be seen with certainty that there is no possibility that the subject activity could result in a significant effect on the environment. The project has also been reviewed and found to be a potential historic resource and was designed by a Master Architect. The proposal appears to have been designed in compliance with the Secretary the Interior s Standards, as the proposed work is reversible and the original fenestration unit openings may be restored at a future date. The project is also exempt from the California Environmental Quality Act, pursuant to Section (Historical Resource Restoration/Rehabilitation) the State CEQA Guidelines, as the proposal appears to be in compliance with the applicable guidelines for the treatment historic properties, as referenced above. PUBLIC OUTREACH AND NOTIFICATION Public outreach and notification were not required for this project.

8 Architectural City Beverly Hills Page 6 12 Review Application SECTION 4 DESIGN ANALYSIS AND FINDINGS (for Commission level applications only) A Clearly identify how your project adheres to each the required findings the Architectural Review Commission: 1. Describe how the proposed building or structure is in conformity with good taste and good design and, in general, contributes to the image Beverly Hills as a place beauty, spaciousness, balance, taste, fitness, broad vistas and high quality. The modifications will be accomplished using matching and complementary materials. The glazing specifications will exceed the existing and the awnings will help to define the corner and add to the Village quality found throughout Beverly Hills. 2. Describe how the proposed building or structure indicates the manner in which the structure is reasonably protected against external and internal noise, vibrations, and other factors which may tend to make the environment less desirable. The minor modifications will not serve to change the existing environmental characteristics the space. If anything, the awnings will shade some the glazing to reduce solar gain. The low iron glazing will allow additional light into the space and the dual glazing option would reduce sound transmission. 3. Describe how the proposed building or structure is not, in its exterior design and appearance, inferior quality such as to cause the nature the local environment to materially depreciate in appearance_and value. The proposed glazing is low iron and greater quality than the existing which allows for greater visibility into the space. The awnings will visually activate the second floor and will, in turn help to further define this prominent corner. The improvements should serve as a complement to the existing structure. 4. Describe how the proposed building or structure is in harmony with the proposed developments on land in the general area, with the general plan for Beverly Hills, and with any precise_plans adopted pursuant to the general plan. Although the existing building is modest in form and detailing, it does contribute to the established look and feel the existing streetscape along South Santa Monica Boulevard. The proposed improvements will not alter or deter the General Plan s intent and will improve aesthetics. 5. Describe how the proposed development is in conformity with the standards the municipal code and other applicable laws insar as the location and appearance the buildings and structures are involved. The minor alteration exterior elements does not greatly effect overall code compliance or aesthetic standards dictated in the Municipal Code. A sign accommodation to add Business Identification and Building Identification signage would not have significant impact to the appearance this structure or those in near proximity.

AC XX-17 RESOLUTION OF THE ARCHITECTURAL COMMISSION OF THE CITY Of BEVERLY HILLS CONDITIONALLY APPROVING AN ARCHITECTURAL REVIEW PERMIT TO ALLOW A FACADE RENOVATION, BUILDING IDENTIFICATION SIGNAGE, BUSINESS IDENTIFICATION SIGNAGE AND UPPER-STORY AWNINGS FOR THE PROPERTY LOCATED AT 9437 SOUTH SANTA MONICA BOULEVARD (PL WINNIE COUTURE). as follows: The Architectural Commission the City Beverly Kills hereby finds, resolves and determines Section 1. Gidas Peteris, agent/architect, on behalf the property owner, 4670 Beverly, LLC, and the tenant, Winnie Couture (Collectively the Applicant ), has applied for architectural approval a façade renovation, building identification signage, business identification signage and awnings for the property located at 9437 South Santa Monica Boulevard. Section 2. Beverly Hills Municipal Code Article 30, Chapter 3 Title 10, authorizes the Architectural Commission the authority to approve, approve with conditions, or deny design-related aspects projects located in the city s commercial and multi-family districts, subject to findings set forth in Beverly Hills Municipal Code Section Section 3. Consistent with Beverly Hills Municipal Code Section , this resolution documents the ficial action the Architectural Commission with respect to the project. Section 4. The subject project has been reviewed pursuant to the provisions set forth in the California Environmental Quality Act (CEQA Resource Code Sections 21000, et seq.), the State CEQA Guidelines (California Code Regulations, Title 14, Sections et seq.), and the city s local CEQA Guidelines. The subject project is exempt from the California Environmental Quality Act (CEQA Resources Code pursuant to Section (b)(3) the State CEQA Page 1 5 AC XX-17

18 Guidelines in that the project includes the review building design, colors and materials to the façade the building, front yard landscaping or minor low-scaled accessory structures, such as fences or walls. It can be seen with certainty that there is no possibility that the subject activity could result in a significant effect on the environment. The proj ect has also been reviewed and found to be a potential historic resource and was designed by a Master Architect. However, the project has been designed to be consistent with the Secretary the Interior s Standards, as the proposed work is reversible and the original fenestration unit openings may be restored at a future date. Therefore, the project is exempt from the California Environmental Quality Act, pursuant to Section (Historical Resource Restoration/Rehabilitation) the State CEQA Guidelines. Section 5. The Architectural Commission conducted a duly noticed public hearing on November 15, 2017 at which time oral and documentary evidence was received concerning the application. Section 6. Based upon the evidence presented at the hearings, including the staff report(s), oral and written testimony, the Architectural Commission hereby makes the following findings: A. The plan for the proposed building or structure is in conformity with good taste and good design and, in general, contributes to the image Beverly Hills as a place beauty, spaciousness, balance, taste, fitness, broad vistas, and high quality. Specifically, the project incorporates an appropriate balance color, high quality materials and appropriate architectural design principles to reinforce the city s urban form and promote the image Beverly Hills. B. The plan for the proposed building or structure indicates the manner in which the structure is reasonably protected against external and internal noise, vibrations, and other factors which may tend to make the environmental less desirable. The proposed project is proposed to be constructed Page25 ACXX-17

19 using contemporary building materials and practices, and, as conditioned, compliant with all applicable building codes, including standards that protect against unwanted noise and vibrations. C. Proposed building or structure is not, in its exterior design and appearance, inferior quality such as to cause the nature the local environment to materially depreciate in appearance and value. Specifically, the commission has reviewed the design and construction materials proposed for the project, which incorporates contemporary building material known quality and durability. Moreover, the project selected materials. design is appropriate to the building and surrounding improvements and is well matched to the D. As conditioned, the proposed building or structure is in harmony with the proposed developments on land in the general area, with the general plan for Beverly Hills, and with any precise plans adopted pursuant to the general plan. The proposed project complies the applicable goals and policies set forth in the general plan, and, as conditioned, designed in a manner that complies with local ordinances. The overall design is consistent with and appropriate to other improvements in the general vicinity. with E. The proposed development is in conformity with the standards this code and other applicable laws insar as the location and appearance the buildings and structures are involved. As conditioned, the project will be designed in compliance with all applicable regulations. F. The proposed development is designed in a manner that protects and preserves those exterior elements the building which the Planning Commission found contributed to the determination the project as a character contributing building in accordance with section this title. The proposed project does not include a request and has not been determined by the Planning Commission to be a project that qualifies as a character contributing building under section Therefore, this finding is not applicable to the subject project. Based on the foregoing, the Architectural Commission hereby grants the request defined in this resolution subject to the following conditions: Project-Specific Conditions No project-specific conditions are proposed. Standard Conditions 1. Revised Plan Submittal. For all projects that are approved with project-specific conditions, a revised plan set that has fully incorporated all such conditions shall be submitted to the project planner, both in hard copy format and in electronic format, prior to submitting for the building permit plan check process. 2. Architectural Approval. Project approval is for the design-related aspects the project only. No approval is implied or granted with regard to applicable city zoning or technical codes, which may require review and approval from other city commissions or ficials. 3. Compliance with Municipal Code. Prior to issuance a building permit, the applicant shall demonstrate compliance with all applicable provisions the city s municipal code and applicable conditions imposed by any discretionary review approval. 4. Compliance with Special Conditions. Any special conditions that require approval by the Director Community Development, or designee, shall be submitted to the staff liaison to the commission within fourteen (14) days approval or prior to submittal the plan check review application, whichever is greater. 5. Project Rendering. Prior to issuance a building permit, the applicant shall incorporate into the building permit set plans, an updated color rendering all building facades. The quality and detail the rendering shall be subject to approval from the Director Community Development, or Page45 ACXX-17

21 designee, and shall include sufficient design information to evaluate project compliance during construction. 6. Approval Resolution. A copy the signed resolution approval shall be scanned onto the cover sheet(s) the building permit set plans. 7. Substantial Compliance with Approved Plans. The Director Community Development, or designee, shall determine if changes to the approved project are in substantial compliance with the commission s action. This determination shall be subject to applicable fees and charges. A substantial modification to the approved project requires approval from the Architectural Commission. 8. Validity Permits. The rights granted by this approval shall remain valid for three (3) years from the date approval, unless extended pursuant to Beverly Hills Municipal Code Section Section 8. The Secretary the Architectural Commission shall certify to the passage, approval, and adoption this resolution, and shall cause this resolution and its certification to be entered in the administrative record maintained by the Community Development Department. Section 9. Decisions the Architectural Commission may be appealed to the City Council within fourteen (14) days the final action by filling a written appeal and paying appropriate fees with the City Beverly Hills City Clerk.
