1 Contra Costa Transportation Authority STAFF REPORT Meeting Date: October 15, 2014 Subject Summary of Issues State Route 4 Widening Loveridge Road to Somersville Road (Project 1406/3003) No. 6 to Agreement No. 234 with URS Corporation Americas (URS) for Additional Design Services During Construction URS Corporation Americas (URS) is the designer-of-record for the State Route 4 Widening Project Loveridge Road to Somersville Road. Agreement No. 234 was initially executed for URS to provide design services during construction of the storm drainage pump station and subsequent amendments were executed for the SR4 mainline and interchange construction phase. Construction of the SR4 mainline and interchange is complete, however, additional engineering services are required to complete project close-out, including preparation of electronic as-built plans and right-of-way engineering services to support Caltrans with the decertification of excess project parcels. Additional and unanticipated design services during the final stages of the project have nearly exhausted the funds under Agreement No. 234 and additional funds are required. An amendment to Agreement No. 234 is necessary for URS to continue providing design services during construction of the SR 4 mainline phase through project close-out. Additional services are estimated at $60,000. No. 6 will increase the budget for design services during construction, extend the term of the agreement through December 31, 2015, and revise the total contract amount to $1,280,000. Recommendations Authorize the Chair to execute No. 6 to Agreement No. 234 with URS for additional design services during construction and right-ofway engineering services, increasing the funding by $60,000 and extending the term of the agreement through December 31, Financial Implications Sufficient funds are programmed in the 2013 Measure J Strategic Plan, as adopted, to cover this request. 2.A.5-1

However, Caltrans requires the Authority to have the project designer-of-record available during the construction phase for various on-call services. Attachments A. Changes from Committee N/A Background URS consultants prepared the Plans, Specifications, and Estimates (PS&E) for the State Route 4 Widening Project Loveridge Road to Somersville Road. This project includes mainline State Route 4 widening and interchange reconstruction at Loveridge Road and reconstruction of the Century Boulevard Undercrossing. This project also includes a new storm drainage pump station at the SR4/Loveridge Road interchange that was constructed during a separate phase of construction prior to the SR4 mainline and interchange. URS consultants were retained by the Authority under Agreement 234 as the design firm to provide engineering services during construction on an as-needed basis as Caltrans requires the design firm to be available to perform such services. Substantial completion and acceptance of the SR4 mainline interchange occurred in June However, contract close-out activities, punch list, and right-of-way close-out activities continue. The original Agreement No. 234 was executed in July 2007 and was ultimately amended by No. 5 to extend the term to December 31, 2014 to accommodate changes in the project schedule and increase the budget to $1,220,000 to include additional project services. Subsequent to No. 5, numerous unanticipated design changes and additional services were requested by Caltrans and others. Also, additional right-of-way issues have developed that required additional effort to fully resolve, and additional biological monitoring at Antioch Creek was requested by Caltrans. As a result, nearly all available funds for URS design services during construction under Agreement No. 234 have been exhausted. An increase in funding under Agreement No. 234 is necessary to complete project close-out. 2.A.5-2

3 Contra Costa Transportation Authority STAFF REPORT October 15, 2014 Page 3 of 3 No. 6 will increase the budget for design services during construction by $60,000 for a total budget of $1,280,000. This total budget is approximately 1.64% of the estimated final construction contract capital cost of $74.5 million and is consistent with the Authority s historical practices of 1% to 2% of the construction capital cost. The current end date for this Agreement is December 31, However, due to project delays staff recommends an extension of the Agreement term through December 31, This extension will accommodate completion of the as-built plans and the selling of excess land, both of which will not occur until Authority staff has reviewed the estimated additional budget to complete the required services and concurs with the estimated amount, recognizing that it is extremely difficult to accurately forecast these on-call services. Therefore, staff recommends approval of the amendment. 2.A.5-3

4 Attachment A Agreement No. 234 With URS Corporation Americas For State Route 4 Widening Project Loveridge Road to Somersville Road Design Services during Construction October 15, 2014 AMENDMENT No. 6 WHEREAS, the Contra Costa Transportation Authority and URS Corporation Americas entered into Agreement No. 234 on July 24, 2007 with an effective date of August 1, 2007, for design services during construction of the Storm Drainage Pumping Plant with a termination date of June 30,2008 and a Total Agreement Value of $50,000; and WHEREAS, No. 1 to Agreement 234 was approved on May 21, 2008, to extend the term of the Agreement to December 31, 2009; and WHEREAS, No. 2 to Agreement 234 was approved on September 16, 2009, to include design services during construction, biological surveys & monitoring during construction, and extend the term of the Agreement to June 30, 2013, and increase the compensation by $705,000 for a new Total Agreement Value of $755,000; and WHEREAS, No. 3 to Agreement 234 was approved on July 20, 2011, to include additional design services during construction, and increase the compensation by $395,000 for a new Total Agreement Value of $1,150,000; and WHEREAS, No. 4 to Agreement 234 was approved on June 19, 2013, to extend the term of the Agreement to June 30, 2014; and WHEREAS, No. 5 to Agreement 234 was approved on December 18, 2013, to include right-of-way support services, prepare as-built plans, extend the term of the agreement through December 31, 2014, and increase the compensation by $70,000 for a new Total Agreement Value of $1,220,000; and WHEREAS, the parties now wish to include additional design services during construction and increase the compensation; now therefore be it 2.A.5-4

5 MUTUALLY AGREED: (1) That the Agreement is amended to include additional funds for design services during construction services for the project as outlined in the letter from URS Corporation dated September 8, 2014, attached hereto; (2) That the Total Agreement Value and maximum compensation limit is increased by $60,000 for a new limit of $1,280,000; (3) That the dollar values shown under Article III of the Agreement are replaced in its entirety as follows: Pump Station Design Services during Construction $50,000 Mainline Design Services during Construction $1,211,000 Mainline Right-of-Way Engineering $15,000 Contingency $4,000 Total Agreement Value $1,280,000 (4) That Article II of the Agreement is amended to extend the term of the Agreement to December 31, 2015; (5) That all other items and conditions of the Agreement shall remain in effect. 6 Attachment B SR4 (East) Widening Project Loveridge Rd To Somersville Rd September 8, 2014 Mr. Ross Chittenden Deputy Executive Director, Projects Contra Costa Transportation Authority 2999 Oak Road, Suite 100 Walnut Creek, CA Attn: Ms. Susan Miller Subject: SR4 (East) Widening Project - Loveridge Road to Somersville Road Design Services During Construction (Agreement No. 234) Extra Work Request Excess Land and As-Built Drawings Dear Ms. Miller, URS Corporation has been providing on-call Design Services During Construction for the SR4 (East) Widening Project - Loveridge Road to Somersville Road, to support Caltrans and the Contra Costa Transportation Authority during this construction effort. Subsequent to the previous No. 5, numerous unanticipated, extra work was required by Caltrans to complete the construction activities. Also, additional right-of-way issues have developed that will require further efforts to fully resolve. The following is a list of these additional tasks. I have discussed this proposed budget estimate with Jon Hamaguchi of Parsons and he is in concurrence with it. Excess Land Exhibits and Additional Plat Maps & Legal Descriptions - $9,000 URS will provide the following additional Right-of-Way services: Fourth Parcel A fourth parcel has now been identified as an additional excess R/W parcel. It is located east of Century Blvd and south of Route 4. A Plat Map & Legal Description will be provided. Flooring Site There is an expanded effort at the Flooring Site at the southwest quadrant of the SR4/Loveridge Interchange due to a R/W line adjustment during construction. After the R/W line is adjusted, fence placed and area surveyed, URS will determine the utility easement limits, negotiate final easement locations, and create final plat maps and legal descriptions. Safety Review and Additional Design Enhancements - $48,000 Caltrans has performed a Safety Review of the project and identified multiple areas for enhancements: Sign Structure E Modification Caltrans has requested to modify this standard sign to reduce the possibility of graffiti and vandalism. This will require significant modifications to the sign structure and involves the disciplines of structure, signage, electrical, and lighting. Curb/Sidewalk Modification at Motel 6 Caltrans and the City have requested to modify the curb and sidewalk design on Loveridge Road at the Motel 6 site. 7 Mr. Chittenden September 8, 2014 Page 2 Sidewalk Modification at Loveridge/California Caltrans has requested to modify the sidewalk horizontal location and longitudinal slope at the southwest quadrant of the Loveridge/California intersection. Sidewalk Modification on westbound California Avenue at the Public Storage site Caltrans has requested to modify the sidewalk at this location. Other Miscellaneous Modifications - Caltrans has requested to make other miscellaneous modifications, including changes to pedestrian signal heads, pavement markings, pavement delineation, signage, pedestrian push buttons, and drainage features. Biological Review/Monitoring for Other Design Segments - $3,000 The efforts for this task were assumed to have been completed. Additional involvement was requested by Caltrans for work and reporting at Antioch Creek. Due to the unknown full extent of these tasks, URS will perform these services on a time and materials basis. An estimated total budget of Sixty Thousand Dollars ($60,000) for completion of the construction support is required.
