The consultant must have experience in preparing the CDP/Revised CDP of at least 02 metropolitan cities having population more than 10 lacs. The last date for sale of tender document is up to 12:00 Hrs. and last date of receiving the completed tenders in the PROJECT CELL of JNNURM, Kanpur Nagar Nigam, Motijheel, Kanpur is till 15:00 Hrs. Tenders will be opened on the same day in the office of Additional Municipal Commissioner- II at 4.00 P.M. The tenders invited on will be treated as cancelled. Cost of tender document is Rs. 5000/-. Non compliance of these will render your tender liable for rejection. CONDITIONS : 1. The consultant must have experience of preparing the CDP/Revised CDP of at least 02 metropolitan cities having population more than 10 lakhs. 2. No conditional tender will be accepted. 3. The Income Tax Clearance Certificate valid up to date of receipt of tender should accompany the tender. 4. Telegraphic offers and tenders received late will not be accepted. 5. The tender shall remain open for acceptance for the period of 120 days from the date of its submission. 6. The Consultant will have to start the work within 7 days of receipt of assignment order, failing which his agreement shall stand terminated automatically without giving any further notice. 7. The Municipal Commissioner reserves the right to accept or reject any or all the tenders received, without assigning any reason thereto. 8. The tenderer who does not fulfill the requirement of earnest money which is to be enclosed with tender in the form of NSC/FDR in favour of the Chief Accounts Officer, Kanpur Municipal Corporation and above mentioned requirements; his tender shall be treated as invalid. 9. The period of contract is One Year.The tenderer shall sign all the documents attached herewith and shall submit to the Municipal Commissioner, Kanpur Municipal Corporation in a sealed envelope issued by office. 10. If a tenderer is not interested to quote his rates then he should return all the documents attached herewith duly written blank at the top of envelop and tender form. Blank tender must reach on or before the scheduled date and time of opening of the tenders, failing which he will not be allowed to participate in future tenders of the Kanpur Municipal Corporation. 11. (ITEM RATE WORK CONTRACT) SUB : TENDER FOR ENGAGEMENT OF CONSULTANT FOR THE PREPARATION OF REVISED CITY DEVELOPMENT PLAN OF KANPUR CITY UNDER JNNURM DURING THE YEAR Sealed tenders are invited from experienced and competent organizations/ consultants empanelled in Government of India list Dated 29 Oct for the Preparation of II Generation City Development Plan (CDP) of Kanpur City, in accordance with guidelines under Jawaharlal Nehru National Urban Renewal Mission including modified guidelines, toolkits and instructions issued by GoI, Ministry of Urban Development. The interested parties are required to submit financial Bid consisting of the tender document issued by the office, in which the rate of charge be quoted. The sealed tender envelope must be submitted in tender box along with earnest money amounting Rs. 50,000/- only in the form of NSC pledged in favour of CAO, Kanpur Municipal Corporation, kanpur. The successful tenderer shall be required to prepare the revised CDP after carrying out detailed survey, physical supervision and determination of data required for the purpose, at his own cost, to the entire satisfaction of KMC as well as, other competent authorities and directions/requirements under JNNURM. Copies of the letter inviting tender, tender form and general conditions of contract, and other documents connected with the work are signed for the purpose of identification by the KMC. The tenderers shall be deemed to have satisfied themselves generally as to the scope of the work to be done, whether he has inspected them or not. Tenderers are required to inspect the site of Kanpur City with regard to the scope of work before tendering. 2. The applicants / firms interested in tendering for the above work shall submit an application to the Municipal Commissioner, KMC, requesting for issue of tender document. The Municipal Commissioner, will after necessary scrutiny of the applications received in this behalf, will issue tenders documents to the eligible contractors/firms on date as specified hereinbefore. The tender documents will be issued to those firms/organizations which are empanelled in the list of GoI dated 29 th October, The tender documents and other connected documents will be issued on payment of Rs.5000/= in cash/dd. The conditions of contract and other relevant information can be seen in the office of KMC during any working day in office working hours by the interested parties. 3. Rs.50,000/= as earnest money in shape of NSC in favour of CAO, KanpurMunicipal Corpoation, shall be required to be enclosed by the tenderer, with the tender, otherwise the tender shall be liable for rejection. 4. The contractor should be very careful in quoting the rates, as once a tender is accepted no representation with a view to amendments in rates will be considered. The tenderers shall quote rates against the item /material required to be supplied, appearing on subsequent Pages of this tender. Page 6

8 5. The submission of a tender by a tenderer implies that he has read this notice and conditions of contract agreement, and, has made himself aware of the scope of work and has carefully studied local conditions and other factors involved for the proper execution of work. 6. The Municipal Commissioner, KMC, will return the earnest money wherever applicable to all unsuccessful tenderness on receipt of an application. 7. The successful tenderer will have to deposit security money to the tune of 10% of the quoted rate in the form of F.D.R./NSC duly pledged in favour of the CAO or Demand Draft in favour of The CAO, KMC. The security money shall have to be deposited within seven days from the receipt of intimation along with necessary non judicial stamp papers of the appropriate value, for execution of contract agreement failing which the Municipal Commissioner shall have the right to forfeit the earnest money in whole or part, at his discretion, without any intimation to the tenderer, and the tenderer shall be deprived of the work. 8. After depositing the security money and the non judicial stamp paper for execution of agreement, if the contractor fails to execute or to sign the contract agreement within seven days from the receipt of the intimation, the Municipal Commissioner, KMC, shall be at its liberty to forfeit the earnest money, security money as the case may be, and the contractor shall be deprived of the subject work, as well as, future tender activities/works in KMC. 9. The Additional Municipal Commissioner II, KMC, will open the tenders in the presence of the tenderers or their duly authorized agents, present at the time and date fixed for the purpose. 10. The security deposit will be released / refunded to the successful tenderer after the lapse of one year from the date of completion of work. 13. A penalty to the extent of 10% of the contract amount shall be imposed as fine by the KMC, in case of cancellation of the contract on default of the contractor or non- completion of entire work of the contract by the contractor. The decision of KMC shall be final, binding and conclusive on the contractor. 14. Income 2.25 % of work done amount or as per the prevailing rate fixed by Income Tax Department (Govt. of India) for the financial year in which the subject work is being executed, on such type/ nature works, shall be recovered by the KMC and paid to the Income Tax Department. This amount will be adjusted towards actual assessment of tax payable by the contractor and a certificate of deduction shall be given to him. 15. No liability shall be incurred by the KMC nor shall the acceptance of a tender be considered binding until the final contract documents has been signed by the authority competent and the contractor. 16. Terms of the contract will be rigidly enforced and no excuse will be considered for incompletion of works especially if such excuse is based merely on fact that the work is not profitable to the contractor. 17. Submission of tender by contractor implies that he has read this notice and conditions of the contract and has fully understood the scope and specifications of the works to be carried out. Page 7

9 18. This tender document shall on acceptance of tender be attached to and to be deemed to form part of the contract document. Corrections in tender should be initiated. Conditional, incomplete and unsigned tender shall be rejected. All pages of tender documents shall have to be signed by the tenderers. In case of variation of rates written in figures and in words the lower of the two shall be considered. No special rate, if quoted by any tenderer shall be accepted. 19. The contractor must write their correct and complete address in tenders and arrange to take delivery of all letters. If any letter is sent through registered post is received back undelivered, it will be the contractors own responsibility and contractor shall be bound for action as required through the contents of such letter. 20. PERIOD FOR REMAINING TENDER OPEN: The tender shall remain open for acceptance for a period of 120 days from the date specified for its submission. 21. SECURITY OF CLASSIFIED DOCUMENTS: The contractor shall not communicate any classified information regarding the works either to sub contractor or others without prior approval of the KMC in writing. No subletting of contract shall be permitted without approval of the KMC. 22. In case the tenderer submitting a Blank Tender, he is required to indicate same on envelope duly signed by him. If the tenderer does not desire to submit the tender on any pretext, he must return the tender form and documents to the office with reasons for not submitting the tender, failing which he will be deprived of the next tender and a penalty of Rs.5000/= (Rupees five thousand ) shall be imposed on him. 23. The time period for completion of work is specified hereinafter. In case the contractor fails to complete particular work within specified time, as per work order, the Municipal Commissioner, KMC shall be empowered to impose a penalty to the tune of 1% of the cost of work order, per week, if in the opinion of the Municipal Commissioner, KMC the delay in completing the work is caused due to laxity improper performance or negligence on the part of the contractor. In spite of the above penalty, in case the contractor further delays in completing the work till a time period of two months, after the targeted date of completion, as specified in the work order, the matter should be referred to the consideration of the KMC for its decision to get the work executed through other agency/contractor, at the risk and cost of the contractor. However, if in the opinion of the Municipal Commissioner the delay in completing or commencing the work is caused due to any accident or natural calamity or any unavoidable circumstance, the Municipal Commissioner KMC is empowered to grant extension of time, as deemed fit, at the sole discretion, and decision in this regard shall be final and conclusive. 24. Service Tax Deduction: Service Tax imposed by the Govt. of India as per rate or percentage fixed by the Govt. for the type of work mentioned in this tender document will be paid to the concerned department by the successful tenderer and a Certificate of deduction of service tax will have to be submitted in the KMC Office. 25. The tender notice shall form part of the contract. 26. Minimum Wages Act. The tenderer / contractor shall abide by all the provisions of Minimum Wages Act and other enactments applicable to labour laws during the execution of the work and period of contract. The tenderer/contractor shall be fully responsible for Page 8

10 implementing the Minimum Wages Act and ensuring that nothing is adverse to the provisions of the said Act during the execution of contract. An under taking to the effect has to be given by the applicant tenderer to the KMC. 27. The tenderer shall act as a consultant to the KMC, and the project to be undertaken is as specified hereinafter the detailed scope of work and deliverables shall be as per the Appendix 1 of (TOR) term of reference appearing hereinafter. The area of Kanpur City is the territorial limits of Kanpur Municipal Corporation as specified within KMC boundary limits. The tenderer shall be required to prepare the revised City Development Plan (CDP) for Kanpur. The CDP shall be prepared as per the tool kits, guidelines and instructions provided by the MoUD and MoUEPA and the Department of Urban Development (DoUD), Government of Uttar Pradesh (GoUP) from time to time. 28. DURATION OF THE ASSIGNMENT The time for completion of the project will be Ninety Days (90) as mentioned in the Appendix-I of TOR. The commencing date of the Assignment will be deemed to be date of execution of the agreement. Time schedule and payment terms shall be same as indicated in Appendix-I of TOR which are re-produced below: Sl. Any modifications to the terms and provisions of this agreement shall be subject to the mutual consent of the parties. English shall be the governing language for the purpose of operation of this agreement. 30. FINAL REPORTS The successful tenderer shall inform in writing and shall submit one copy of the reports for each stage as per Para 8 of Appendix-I of TOR. One original copy of the Final CDP Report, 15 copies and six electronic sets will be submitted on the receipt of the comments/approval of the KMC on draft report. Page 9

11 31. PERFORMANCE STANDARD The tenderer will have to perform the services with the highest standards of professional and ethical competence and integrity. The consultants shall promptly replace any employees assigned under this contract that the KMC considers unsatisfactory. 32. CONFIDENTIALITY The consultant/tenderer shall not, during the term of this contract and within one year after its expiration, disclose any proprietary or confidential information relating to the services, this contract or the / KMC s business or operation without the prior written consent of the KMC. In the event of termination of contract before the completion of assignment, the consultant will provide the KMC with any reports or parts their off or any other information and documents gathered under this agreement prior to the date of termination. 33. OWNERSHIP OF MATERIAL Any studies, report or other material, or otherwise prepared by the consultants for the KMC under the present Contract shall belong and remain the property of the KMC. The consultants may retain a copy of such documents; but shall not use them for purposes unrelated to this contract without prior written approval of the KMC. 34. The successful tenderer/consultant shall depute necessary manpower/technicians/ experts for general survey and collection of desired data/information of Kanpur City area required for preparation of the revised CDP at his own cost and the list of such personnel will submit to KMC. He is required to determine the exact measurements/dimensions of all roads, drains/nullah, pathways, fields, lands, parks, highways, including general MS levels etc required for proper completion of work. 13 Appendix 1. Terms of Reference (TOR) 1. Backdrop: Efficient performance of urban economy depends upon availability of infrastructure and basic services such as transport, roads, water supply, sanitation and solid waste management etc. Since the level of investments required for this sector is of a very high order it is felt that the national level initiative is required that would bring the Central, State and Urban governments together to ensure proper flow of necessary funds to bring about improvements in these sectors to an acceptable levels in tune with the international standards. Against this background, the JNNURM has been launched by the Ministry of Urban Development (MoUD) and the Ministry of Urban Employment and Poverty alleviation (MoUEPA), Government of India (GoI). The Mission s Statement is: to encourage reforms and fast track planned development of identified cities. Focus is to on efficiency in urban infrastructure and urban services delivery mechanisms, community participation and accountability of ULBs / Parastatal agencies towards citizens. The Mission s main focus is on : improving and augmenting the economic and social infrastructure of cities, ensuring the basic services to the urban poor including security of tenure at affordable prices, initiating wide ranging urban sector reforms whose primary aim is to eliminate legal, institutional and financial constraints that have impeded investment in urban infrastructure and services, and Strengthening municipal governments and their functioning in accordance with the provisions of the 74 th Constitutional Amendment Act, The Mission s objectives are to ensure that the following are achieved in the urban sector: - Focused attention to the integrated development of infrastructure services covered under the Mission, - Establishment of linkages between asset-creation and its management through a slew of reforms for long-term project sustainability, - Ensuring adequate funds to meet the deficiencies in urban infrastructural services, - Planned development of identified cities including peri-urban areas, out growths and urban corridors leading to dispersed urbanization, - Scale-up delivery of civic amenities and provision of utilities with emphasis on universal access to the urban poor, - Special focus on urban renewal programme for the old city areas to reduce congestion, and - Provision of basic services to the urban poor including security of tenure at affordable prices, improved housing, water supply and sanitation, and ensuring delivery of other existing universal services of the government for education, health and social security. Availability of Public Transport; as recommended in Kanpur Comprihensive Mobility Plan of Kanpur. 100% coverage of toilets and fully sanitized city as per Kanpur City sanitation Plan. Civic amenities, with standards as mentioned in service level benchmark Efficient, Transparent working of Manpower of KMC 2. Context: The strategy to achieve the outcomes of the Mission consists of : preparing the City Development Plan (CDP) which must reflect Master plan of the city, Comprehensive Mobility Plan of Kanpur, Kanpur City sanitation Plan, Achievable Service levels and activities required for capacity building of KMC Staff. preparing the Detailed Project Reports; release and leverage of Funds and in-cooperating the Private sector efficiencies in the urban management context. Mission s approach is reformed linked with a charter of reforms which the State governments and ULBs are expected to implement over the Mission s duration. It also provides an incentive to the selected cities/urban centers to undertake institutional, structural and fiscal reforms that are necessary for improved and sustainable service delivery systems address poverty and enhance local economic performance. 3. Objectives of the Assignment: All the Mission Cities under the JNNURM have prepared City Development Plans (CDPs) earlier. These first generation CDPs were prepared with significant enthusiasm and energy, and outlined the overall vision for development of the city in terms of infrastructure development and service delivery. However, these CDPs were largely focused on infrastructure requirements and had limited emphasis on cross-cutting issues such as urban poverty, environment and heritage. A general consensus has emerged that city development planning not be seen as one time activity, but should go through a periodic cycle of updation. This has led to a review and Page 13

15 revision of the toolkit for formulation of CDP, with a view of making it a sustainable/living document for guiding development processes of cities. The revised toolkit for preparation of CDP was launched on 3 rd December The Toolkit seeks to provide more detailed guidance on the process to be adopted and the final output to be achieved. This toolkit provides the necessary guidance to cities for taking a re-look at the current CDPs and also serves as a reference point for cities which are in the process of putting together a CDP for the first time (e.g. non-mission cities) or are preparing plans for cities that have undergone changes in jurisdiction. The City Development Plan provides the starting point for the reform by identifying core City challenges, a perspective and Vision for the future development of a City, its present stage of development (current status) and sets out a direction of change. The CDP is to focus on the development of economic and social infrastructure, policies and programmes addressing the specific issues of urban poor, strengthening of municipal governments, and their financial management and accounting processes, promoting transparency in their functioning etc. The CDP also provides a direction for cities and State governments to undertake urban sector reforms which will facilitate flow of investments into city based infrastructure. It is imperative for cities: to systematically think of the future and to determine how it wished to shape their future. The Consultants will be required to develop the revised City Development Plan for Kanpur for submission and approval by the Ministry of Development (MoUD) and the Ministry of Urban Employment and Poverty Alleviation (MoUEPA), GoI through the Department of Urban Development (DoUD), Government of Uttar Pradesh (GoUP). 4. Scope of work The revised CDP should focuses on the following key aspects: (i) (ii) The CDP should integrate developments in the KMC with its immediate spatial continuum extending to the peri-urban ULBs, Panchayats, areas falling within cantonment Board and peripheral areas. In context of urban agglomerations, the CDP shall cover the agglomeration area or the metropolitan area, as applicable. The revised CDP shall be comprehensive and inclusive, reflecting the development needs of the people while taking into account the trends and requirements of the city as a whole. The CDP should include, but not be limited to, land-use and infrastructure, heritage conservation and tourism development, environment, disaster management, social, livelihood and local economic development, institutional strengthening and investment requirements. Emphasis should be on addressing crosscutting issue like poverty, environment, heritage and other trans-municipal demands. The revised CDP should attempt to address the inter-sectoral as well as intra-sectoral linkages. For example, while dealing with water supply in the city, the entire value chain beginning with the assessment of the existing water resource management in the area, down to storage, treatment, supply, distribution, monitoring and collection of user charges have to be planned for. Integration of all the intra-sectoral aspects of water supply with other sectors like conservation of natural and cultural resources, road networks, power supply, drainage, sewerage has to be undertaken so that meaningful Page 14

16 (iii) inter-linkages for sustainable development can be achieved. CDP must reflect Availability of Public Transport; as recommended in Kanpur Comprehensive Mobility Plan of Kanpur.,100% coverage of toilets and fully sanitized city as per Kanpur City sanitation Plan, Civic amenities, with standards as mentioned in service level benchmark, must recommend activities required for Efficient, Transparent working of Manpower of KMC The revised CDP or the second generation CDP should not be restricted to only those sectors eligible for funding under the JNNURM. All sectors that make a difference to the quality of life experienced by the urban citizens should be covered in the CDP. Sectors such as power supply, rail transport, or higher education are outside the ambit of urban sector institutions. While the CDP itself may not plan for the growth and development of these sectors, the needs, demands and requirements from these sectors will need to be factored into the plans for land use, water supply and other basic urban infrastructure services, transport services and overall impact on the socio-economic development in the city. The toolkit emphasizes the role of community participation, suggests mechanism for identification and involvement of key stakeholders in the entire CDP preparations/revision process. Emphasis is given on appropriate institutional structures to be established at the agglomeration/city/ward/level/area level and the process that has to be followed to undertake the revision of CDP, so as to foster meaningful participation of the citizens. The revised CDP shall be prepared as per the tool kits, guidelines and instructions provided by the MoUD and MoUEPA and the Department of Urban Development, Government of Uttar Pradesh from time to time. The CDP revision process should be looked upon as an opportunity for the cities to document the consolidated improvements that have occurred under the Mission, and also map the benefits accrued to the citizens. In preparing their proposals, Consultants are required to provide an outline of their approach and also demonstrate how they will apply their approach in the specific contexts of Kanpur city. This assignment calls for multi-disciplinary approach to the preparation of the CDP and consists of the following elements:- A. The City Assessment 1. An analysis of the existing situation focusing on demographic analysis and economic activity, land use, financial, urban infrastructure and urban services (like transportation, water supply and sanitation, sewerage and solid waste management, drains, transport parking spaces etc.), physical and environmental aspects including heritage areas, water bodies etc. 2. The financial status of the city government and KMC parastatal and other agencies dealing with the service provision including an analysis of their credit worthiness, effectiveness and efficiency of the institutional frameworks needs to be under taken. 3. The process should include a critical assessment as well as projections of population growth, infrastructure needs and resource requirements in the short-term, mediumterm and long-term perspective. 4. The following issues also need to be specifically addressed: i) Urban poverty, characteristics of the slums e.g. social set up, availability of urban basic and social services and on-going slum improvement programmes etc. Page 15

17 ii) iii) iv) (a) Areas of the inner city (urban renewal) which needs to be redeveloped; an analysis of present status of availability of urban basic services including the condition of the infrastructure. (b) Identification of existing nature of commercial and industrial establishments and identification of those industries and commercial establishments which are not in conformity to the existing land-use planning and zoning regulations in the inner city areas. Heritage areas which includes Archaeological Heritage, Architectural Heritage and Architectural Conservation Areas The data collection has to be done by the consultancy firm itself. 5. To highlight the Strengths, Weakness, Opportunities and Threats (SWOT analysis) of the city government / KMC parastatal/ agencies and related government departments in the City s specific context to provide an understanding of the factors responsible for inefficient and inadequate production and delivery of urban services, their managerial deficiencies and financial constraints and to highlight critical factors which calls urgent remedial measures at the city and State governments levels. 6. Situational analysis needs to be done in consultation with all the stakeholders and civil society at the city level. B. Development of Strategic Agenda and A Vision for the City: 1. Based on the outcomes of the City assessment, the second stage envisages development of City Vision to guide the future development of the City highlighting the direction of change and working out an Action agenda with a specific time frame. 2. Based on the Vision, strategies focusing attention on growth management, urban infrastructure and basic services, social services, slum improvement, housing for EWS, provision of basic and social services for urban poor, protection of heritage areas, preservation of water bodies, re-development of inner city areas etc. need to be developed. A strategy identifying key strategic issues, risks and opportunities facing the city with focus on reform priorities. 3. In order to achieve an understanding on common vision, it is essential to define outcomes and milestones on the Vision and ensure that these are measurable and have a time frame. 4. Development of Vision needs to be done in consultation with all the stakeholders and civil society in the city. Public consultation should focus on broad assessment of municipal resources, possible impact on the municipal budget and the proposal for reform to support development. Public consultation should also make a review of the results of rapid city assessment relating to population growth, infrastructure needs and resource requirements in the shortterm, medium-term and long-term perspective etc. C. Evolving strategies for Development: 1. This element of work involves highlighting interventions to operationalise the Vision and future development of the city. This includes- Identification of options and strategies and their evaluation keeping in view their contribution to the goals, objectives and the reform agenda of the JNNURM. Translating the strategies into programmes and projects and Page 16

18 Identifying the programmes which will have maximum/optimum contribution to the achievement of city s Vision and medium-term perspectives. 2. Prioritization of the strategies, programmes and projects needs to be done on a consultative process with all the stakeholders. D. Developing a City Investment Plan and Financing Strategy. 1. Preparation of City Investment Plan (CIP) which will include the level of investment requirements to implement the CDP by adopting the financial norms or standards for service provision and their up-gradation, restoration, relocation etc., and directly estimating the cost of implementing the reform agenda. 2. Evaluation of financial options and strategies for financing the Vision as enumerated in the CDP. 3. Areas in which city government could finance by mobilizing resources or in association with other tiers of government or financing institutions; access to capital market or enlist the private sector participation and the steps needed to facilitate its participation etc also need to be detailed out. 5. Consultation Process The Consultants are required to adhere to the following processes for ensuring participation of all stakeholders in the preparation of CDP: Compliance with normal conditions for public disclosure in tune with the legislative/ administrative frame work of the GoI and GoUP. Organize consultative meetings and workshops at critical stages of the process to obtain the necessary inputs, keep stakeholders informed and validate the findings of the assessment and broad direction of the CDP; Regular interaction with the DoUD, GoUP and other related State agencies, and the management of the KMC throughout the planning process. 6. Methodology The methodology needs to be in tune with the guidelines contained in the Tool Kits issued by MoUD and MoUEPA, GOI and directions issued by the DoUD, GoUP from time to time. The proposed methodology on City assessment provides a perspective that should assist Consultant s in the process of validating the completed assessments. 7. Timeframe 1. An inception report at the formal initiation of the assignment to be presented to the KMC, DoUD, GoUP and other stakeholders within ten days of taking up of the assignment; 2. Presentation of Rapid Assessment Report to the KMC, DoUD, GoUP, and other stakeholders, within 20 days of taking up of the assignment. Page 17

19 3. Preparation and presentation of draft CDP to the KMC, DoUD, GoUP, and other stakeholders within 60 days of taking up of the assignment. 4. The finalization and presentation of revised CDP to the KMC/Pararstatal Agencies, DoUD, GoUP, and other stakeholders within 90 days of taking up of the assignment. The timeframe is inclusive of approvals at the level of KMC, and DoUD, GoUP. 5. The consultant firm will be required to submit revised CDP to Municipal Commissioner, KMC and to other stake holders, if required, for examination. 6. The offer will be valid for 120 days from the date of submission. 8. Deliverables The main deliverables are: a) Inception report outlining the overall approach of the assignment and its presentation to the KMC and other related government departments, DoUD, GoUP if required, for approval. b) A validation of the Rapid Assessment Report of the KMC area and discussions on the assessment with the KMC and related State Government departments and the DoUD, GoUP for approval. c) The Consultant s are required to present the draft revised CDP for discussion with the KMC and DoUD, GoUP for approval. d) A final comprehensive revised City Development Plan Report supported by an executive summary and annexure, Maps etc. e) 15 hard copies and six soft copies of complete document of the Revised CDP should be made available. f) A table containing information about Proposed programmes and projects, their resource applications and time frame for implementation needs to be provided in a tabular form; g) Appropriate presentations and consultations under taken by the Consultants in the process of preparation of various reports including the CDP and a record and outcomes of the meetings held with the stakeholders at the City levels and also with the DoUD, GoUP at the State level needs to form part of the final CDP document. 21 APPENDIX 2. Proposal Submission and Related Matters 1. Introduction 1. The applicant firm must be fully informed itself with the local conditions of the Kanpur for which the firm proposes to submit the proposal for the preparation of the revised CDP and take them into account in preparing the proposal. 2. Please note that the costs of preparing the proposal and of negotiating the contract, include visits to the KMC, and if required to the Department of Urban Development (DoUD), GoUP and the KMC is not reimbursable, and all expenses involved towards this to be borne by the tenderer/applicant consultancy firm. KMC shall not make any payment towards such expenses. 2. Clarifications 1. Consultants/Organizations requiring clarification on any aspects must notify the KMC in writing. 2. At any time before the submission of reports, the KMC may, for any reason, whether at its own initiative or in response to a clarification requested by an invited Consultant, modify the reports by amendment. 3. Preparation of Reports 1. During preparation of the report, the consultant must give particular attention to the following: (i) (ii) Proposed staff must have experience of working under similar conditions. A good working knowledge of English and Hindi is essential for key professional staff on this assignment. The report should be in English. 4. Termination of the Contract 1. If Consultancy Firm fails to comply with the conditions and do not work in the prescribed time as stipulated then the KMC may call for explanation by issuing notice to the agency. 2. The KMC shall be entitled to terminate this contract in the Event of Default of the Firm and shall do so by issuing 7 days show cause notice calling the explanation form the Firm as to why the contract shall not be terminated for the reason stated therein. If the satisfactory explanation is not received, the KMC shall be empowered to terminate the contract. 3. The KMC upon serving of such notice shall have powers to: (i) Take possession of the work done so far by the Firm. (ii) Undertake an assessment of the works and other aspects of the project to ascertain the amount of work completed by the Consulting Firm. (iii) Carry out the remaining incomplete work by deploying another suitable agency at its discretion, or at the risk and cost of the Consulting Firm. (iv) A Panel comprising as appointed by the KMC would undertake the assessment of the said compensation and decision of the panel shall be final and binding on the Consulting Firm. 4. The KMC shall forfeit the security deposits and the KMC without prejudice to their rights to recover from the Consulting Firm any amount that may be due to it. 5. The Consulting Firm shall have no claim to compensation to any loss sustained to them by reason of having purchased or procured any material or entered into any commitments or made any advance on account of or with a view to the execution of the Page 20

22 project of the performance of the contract and the Consulting Firm shall not be entitled to recover or be paid any sum for any work actually performed under the contract. 6. In the event of the Consulting Firm failing to discharge its liability, the KMC have the right to initiate appropriate legal proceedings to recover such dues. 5. Payment Schedule: Sl.
