1 v BOROUGH COUNCIL MEETING HELD ON DECEMBER 19, 2007 A special borough council meeting was held on Wednesday, December 19, 2007, at 10:00 a.m., in room 205 of the borough hall located at 4555 rue de Verdun. CA ADOPTION OF THE AGENDA IT WAS PROPOSED by councillor Marc Touchette SECONDED by councillor Alain Tassé RESOLVED THAT the agenda of the special borough council meeting held on Wednesday, December 19, 2007, at 10:00 a.m. be adopted. CA QUESTION PERIOD Question period did not take place in the absence of an audience. CA AUTHORIZE BOROUGH MAYOR CLAUDE TRUDEL TO SIGN, ON BEHALF OF THE BOROUGH, AN AGREEMENT WITH THE DEPARTMENT OF SUSTAINABLE DEVELOPMENT, ENVIRONMENT AND PARKS FOR USE RESTRICTIONS RELATIVE TO THE CONSTRUCTION OF A RETIREMENT HOME ON THE NORTH SIDE OF PARC ARTHUR-THERRIEN (LES SOMMETS DE LA RIVE). IT WAS PROPOSED by councillor Ginette Marotte SECONDED by councillor Josée Lavigueur Thériault

2 2 RESOLVED THAT borough mayor Claude Trudel be authorized to sign, on behalf of the borough, an agreement with the Department of Sustainable Development, Environment and Parks for use restrictions relative to the construction of a retirement home on the north side of parc Arthur-Therrien (Les Sommets de la Rive) CA AUTHORIZE THE DIRECTION DE L APPROVISIONNEMENT DE LA VILLE DE MONTRÉAL TO CALL TENDERS FOR THE BOROUGH S FUEL SUPPLY CONTRACTS FOR THE PERIOD FROM DECEMBER 1 ST, 2007, TO NOVEMBER 30, IT WAS PROPOSED by councillor André Savard SECONDED by councillor Paul P. Beaupré RESOLVED as follows: 1. TO authorize the Direction de l approvisionnement de la Ville de Montréal to call tenders for the borough s fuel supply contracts for the period from December 1 st, 2007, to November 30, 2011; 2. TO authorize Mrs. Ester Pizzichemi, division chief, Immeubles et approvisionnement, to sign said contracts CA RATIFY A CONTRACT INCREASE IN THE AMOUNT OF $18, INCLUDING ALL APPLICABLE TAXES, TO LES TOITURES VICK & ASSOCIÉS INC. FURTHER TO THE AWARDING OF CONTRACT S07/011 UNDER RESOLUTION CA FOR THE REPAIR OF ROOF BASINS A-1 AND A-2 (PUBLIC WORKS) AND E-1 (BOROUGH HALL). IT WAS PROPOSED by councillor Marc Touchette SECONDED by councillor André Savard RESOLVED as follows: 1. TO ratify an expenditure of $18, including all applicable taxes, for additional work required for the repair of roof basins A-1 and A-2 (Public Works) and E-1 (Borough Hall), including all incidental fees, if case may be; 2. TO authorize an additional payment of $18, including all applicable taxes, to Les Toitures Vick & associés inc. (supplier #138992) bringing the initial contract of $143, to $162, including all applicable taxes; 3. TO charge this expenditure as per information mentioned in the report. This expenditure will be entirely financed by the borough

3 3 CA RATIFY AN EXPENDITURE OF $78,192.82, INCLUDING ALL APPLICABLE TAXES, FOR THE CONSTRUCTION OF SIDEWALKS AND MISCELLANEOUS CIVIL WORK AT PARC NORMAN-DAWE AND PARC DE LA MÉTAIRIE AS PER PRICE TENDERED IN CONTRACT S05/020 AWARDED TO LES ENTREPRISES CATCAN INC. IT WAS PROPOSED by councillor Josée Lavigueur Thériault SECONDED by councillor Paul P. Beaupré RESOLVED AS FOLLOWS: 1. TO ratify an expenditure of $78, including all applicable taxes, for the construction of sidewalks and miscellaneous civil work at parc Norman- Dawe and parc de la Métairie, as per price tendered in contract S05/020 awarded to Les Entreprises Catcan inc.; 2. TO authorize the payment of $78, including all applicable taxes, to Les Entreprises Catcan inc. (supplier #119239) in accordance with the price tendered in contract S05/020; 3. TO charge this expenditure as per information mentioned in the report. This expenditure will be entirely financed by the borough CA RATIFY THE PAYMENT TO CLUB RICHELIEU VERDUN OF $1,000 TO SPONSOR THE GRAND CASINO RICHELIEU 2007 EVENT HELD ON MARCH 30, 2007, AT THE BOROUGH HALL. IT WAS PROPOSED by councillor Josée Lavigueur Thériault SECONDED by councillor André Savard RESOLVED TO ratify the payment to Club Richelieu Verdun of $1,000 to sponsor the Grand Casino Richelieu 2007 event held on March 30, 2007, at the borough hall, said expenditure was charged to budget item CA APPROVE THE BOROUGH S WITHDRAWAL FROM LEGAL PROCEEDINGS IN THE CASE VILLE D ANJOU ET AL AGAINST COMMISSION MUNICIPALE DU QUÉBEC AND VILLE DE MONTRÉAL CONCERNING THE COST OF DRINKING WATER FOR YEARS COURT OF APPEAL # IT WAS PROPOSED by councillor Ginette Marotte SECONDED by councillor Alain Tassé RESOLVED TO approve the borough s withdrawal from legal proceedings in the case Ville d Anjou et al against Commission municipale du Québec and Ville de Montréal concerning the cost of drinking water for years Court of Appeal #

4 4 CA AUCTION SALE OF VARIOUS ITEMS FURTHER TO EVICTIONS. WHEREAS, on the day of the auction sale, the borough will have stored items abandoned and unclaimed for more than sixty (60) days; WHEREAS the Civil Code and Montréal s city charter authorize the holding of auction sales to dispose of various items abandoned on the public roadway and unclaimed for more than sixty (60) days; WHEREAS the city council, at its meeting held in September 2003, adopted resolution CM giving borough councils the power to hold such auction sales to dispose of items abandoned and unclaimed for more than sixty (60) days. IT WAS PROPOSED by councillor Paul P. Beaupré SECONDED by councillor Marc Touchette RESOLVED TO authorize the holding of an auction sale to dispose of various items stored for more than sixty (60) days and further to evictions from the following addresses: Address Date of eviction 421 rue Régina August 31, rue Hickson September 10, boul. LaSalle, apt. 515 September 12, rue Rielle September 25, rue Argyle September 28, e Avenue September 28, rue Galt, apt. 2 October 9, rue Elgar, apt. 203 October 12, rue Woodland, apt. 3 October 29, e Avenue October 30, rue Gertrude November 8, rue Landreville, apt. K November 9, rue François, apt. 309 November 9, 2007 FURTHER RESOLVED THAT the services of Mr. Marcel Sabourin, bailiff, be retained for such purposes CA REQUEST FOR APPROVAL BY SITE PLANNING AND ARCHITECTURAL INTEGRATION PROGRAM (SPAIP) SUBMITTED SO AS TO ALLOW THE CONSTRUCTION OF A COMMERCIAL BUILDING ON LOT (550 RUE DE L ÉGLISE). CONSIDERING THAT, unanimously, members of the urban planning advisory committee recommended to the borough council to turn down the request to build a commercial building and suggested that a revised site plan be submitted to modify the following elements: The building s height; The size of second-floor windows; The masonry work to reflect surrounding buildings; The façade to be compatible with nearby buildings.

5 5 CONSIDERING THAT the borough council approved the demolition of buildings located at 366 to 376 rue de l Église, 378 to 388 rue de l Église and 392 to 396 rue de l Église for the CLSC expansion exclusively; CONSIDERING THAT the urban planning advisory committee approved the CLSC expansion project on November 15, 2007; CONSIDERING THAT the commercial building at 392 to 396 rue de l Église, adjacent to the current CLSC, must be demolished and rebuilt for purposes of relocating the existing business and, further to the demolition of all three buildings, allow the CLSC expansion on the entire site; CONSIDERING THAT the urban planning advisory committee will examine a modified site plan to allow, further to the demolition of all three buildings, the CLSC expansion on the entire site; CONSIDERING THAT the site plan for the construction of a commercial building was modified as per the recommendations of the urban planning advisory committee; CONSIDERING THAT such modifications meet the conditions set by the urban planning advisory committee as well as the objectives and criteria applicable to this zone; IT WAS PROPOSED by councillor Alain Tassé SECONDED by councillor Marc Touchette RESOLVED TO approve this revised site plan for the construction of a commercial building on lot CA NOTICE OF INTRODUCTION ZONING BY-LAW Councillor Ginette Marotte gave notice that, at a future borough council meeting shall be submitted a by-law amending Zoning By-law 1700, as amended, so as to: Require gas emission detection and ventilation system in Zone H02-123; Prohibit dwellings below ground level in Zones H02-36 and H CA FIRST DRAFT ZONING BY-LAW SUBMITTED first draft by-law modifying Zoning By-law 1700, as amended, so as to: Require gas emission detection and ventilation system in Zone H02-123; Prohibit dwellings below ground level in Zones H02-36 and H IT WAS PROPOSED by councillor Ginette Marotte SECONDED by councillor Marc Touchette RESOLVED THAT first draft by-law be adopted as submitted.

6 CA ADOPTION BY-LAW RCA BY-LAW AUTHORIZING A LOAN OF $657,000 TO REPLACE BOROUGH VEHICLES AND EQUIPMENT. WHEREAS the notice of introduction given by councillor Paul P. Beaupré at the regular borough council meeting held on December 4, 2007, resolution CA , of a By-law bearing number RCA ; WHEREAS copy of By-law authorizing a loan of $657,000 to replace borough vehicles and equipment was already distributed to each member of the borough council; WHEREAS, in accordance with section 356 of the Cities and Towns Act, all members of the borough council declared having read said by-law and renounced to its reading; WHEREAS the subject, the purpose and the cost are detailed in said loan bylaw as well as in the report submitted to this effect. IT WAS PROPOSED by councillor Paul P. Beaupré SECONDED by councillor André Savard RESOLVED TO adopt By-law RCA entitled By-law authorizing a loan of $657,000 to replace borough vehicles and equipment subject to its approval by persons qualified to vote and by the ministère des Affaires municipales et des Régions CA ADOPTION BY-LAW RCA BY-LAW AUTHORIZING A LOAN OF $1,726,000 FOR PARK DEVELOPMENT AS WELL AS PLAYGROUNDS AND RIVERBANKS. WHEREAS the notice of introduction given by councillor Josée Lavigueur Thériault at a regular borough council meeting held on December 4, 2007, resolution CA , of a By-law bearing number RCA ; WHEREAS copy of By-law authorizing a loan of $1,726,000 for park development as well as playgrounds and riverbanks was already distributed to each member of the borough council; WHEREAS, in accordance with section 356 of the Cities and Towns Act, all members of the borough council declared having read said by-law and renounced to its reading; WHEREAS the subject, the purpose and the cost are detailed in said loan bylaw as well as in the report submitted to this effect. 7 7 RESOLVED TO adopt By-law RCA entitled By-law authorizing a loan of $1,726,000 for park development as well as playgrounds and riverbanks subject to its approval by the ministère des Affaires municipales et des Régions CA ADOPTION BY-LAW RCA BY-LAW AUTHORIZING A LOAN OF $332,000 TO RENOVATE BOROUGH BUILDINGS. WHEREAS the notice of introduction given by councillor Paul P. Beaupré at a regular borough council meeting held on December 4, 2007, resolution CA , of a By-law bearing number RCA ; WHEREAS copy of By-law authorizing a loan of $332,000 to renovate borough buildings was already distributed to each member of the borough council; WHEREAS, in accordance with section 356 of the Cities and Towns Act, all members of the borough council declared having read said by-law and renounced to its reading; WHEREAS the subject, the purpose and the cost are detailed in said loan bylaw as well as in the report submitted to this effect.
