2 Flakeboard Compliance with CARB Phase 1 & Phase 2 Emissions In April 2007, the California Air Resources Board voted to implement limitations for formaldehyde emissions that will apply to composite panels including particleboard and medium density fiberboard (MDF). The regulation with be applied in two phases and will also affect the products that are manufactured from composite panels (such as cabinets, store fixtures, flooring, molding, millwork, etc.) that are sold, supplied, offered for sale, or manufactured for sale in California. With regards to this regulation, all particleboard and MDF manufactured by Flakeboard mills after September 1, 2008 is certified by the Composite Panel Association (CPA), an approved CARB third party certifier (TPC-1), to comply with the applicable CARB Phase I emission standard specified in CCR (a). Flakeboard is also certified to EPP CPA 3-08 emission limits. These limits are equal to those stated in CARB Phase 1 effective January 1, Product labeling (particleboard or MDF unit /bundle tags) and a statement of compliance (stated on each invoice and bill of lading) indicates the products are certified by CARB approved third party certifier TPC-1 to comply with the applicable CARB Phase 1 or 2 emission standard shown in the tabulation below: Phase 1 and Phase 2 Formaldehyde Emission Standards for Hardwood Plywood (HWPW), Particleboard (PB), and Medium Density Fiberboard (MDF) 1 Phase 1 (P1) and Phase 2 (P2) Emission Standards (ppm) Effective Date PB MDF Thin MDF January 1, 2009 P1: 0.18 P1: 0.21 P1: 0.21 January 1, 2011 P2: 0.09 P2: 0.11 January P2: 0.13 (1) Based on the primary test method[astm E (2002)] in parts per million (ppm). 4 10/7/2010 May 2010 Formaldehyde California Proposition 65 and ATCM Composite wood manufacturers must comply with two different formaldehyde regulations for products sold in the California market. ChemRisk was asked to review how these regulations affected the composite wood industry and to perform indoor air modeling to understand the relationship between the requirements of each rule. Under the California Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65), all products that contain significant concentrations of chemicals listed on California s annually published register of chemicals believed to be carcinogenic (including formaldehyde) must be marked with a warning. The safe harbor level represents the theoretical exposure level at which there is no significant increase in risk as adopted by the California Office of Environmental Health Hazard Assessment. In 2007, a phased regulation known as the Airborne Toxic Control Measure was adopted by the California Air Resources Board (CARB) setting limits on formaldehyde emissions from composite wood products such as hardwood plywood, particleboard, and medium density fiberboard with the first phase initiated beginning in January of The hypothetical excess lifetime cancer risk was calculated for each of the Phase I and Phase II CARB standards for hardwood plywood, particleboard and medium density fiberboard using a simplified version of the U.S. Environmental Protection Agency (EPA)/Versar Formaldehyde Exposure Model. Results were compared to Proposition 65 s risk criterion of 1 in 100,000. Our results suggested that based on expected target operating levels (limits that incorporate a margin such that the products emissions are not likely to exceed the applicable ceiling standard), most hardwood plywood meeting the CARB Phase I standards, as well as all products meeting the CARB Phase II standards, would comply with the Proposition 65 safe harbor level assuming typical conditions.

Methods: The hypothetical excess lifetime cancer risks corresponding to each of the Phase I and Phase II CARB standards for hardwood plywood, particleboard and medium density fiberboard were calculated using a simplified version of the U.S. Environmental Protection Agency (EPA)/Versar Formaldehyde Exposure Model to compare those risk estimates to Proposition 65's risk criterion of 1 in 100,000. Results and Conclusions: Using this model, composite wood products with ASTM E (2002) chamber test results of 0.09 ppm or lower at the default ASTM loading rates of 0.13 ft 2 /ft 3 (industrial panels and particleboard), 0.29 ft 2 /ft 3 (wall paneling) and 0.08 ft 2 /ft 3 (medium density fiberboard) were estimated to cause less exposure (e.g., daily intake) than the Proposition 65 safe harbor level for formaldehyde (40 μg/day). Furthermore, it was concluded that based on expected target formaldehyde emission rates (limits that incorporate a margin such that the products emissions are not likely to exceed the applicable standard) hardwood plywood meeting the CARB Phase I emission standards, as well as all products meeting the CARB Phase II emission standards, would cause less exposure (e.g., daily intake) than the Proposition 65 safe harbor level for formaldehyde of 40 μg/day Lippincott Williams & Wilkins, Inc. 10/7/2010
