1 Responding to Renewable Energy Conditions RTPI Case Studies The Merton Rule & planning for on-site renewable energy Paul McQuillan Principal Philip Oliver Consultant BEng(Hons) MSc CEng MCIBSE LCC Phil Oliver Principal Engineer 17 th March 2010 The Merton Rule The Merton Rule takes its name from a UDP policy introduced by Merton Borough Council. The policy text, introduced in October 2003, states: The council will encourage the energy efficient design of buildings and their layout and orientation on site. All new non residential developments above a threshold of 1,000sqm will be expected to incorporate renewable energy production equipment to provide at least 10% of predicted energy requirements. The use of sustainable building materials and the re-use of materials will also be encouraged, as will the use of recycled aggregates in the construction of buildings. This will be subject to the impact on the amenity of the local environment, taking into account the existing character of the area. more than 120 authorities now have a policy adopted or in draft form in their development plan (TCPA, 2006)
2 PPS22 Planning Policy Statement 22 (PPS 22) makes the following statement: Local planning authorities may include policies in local development documents that require a percentage of the energy to be used in new residential, commercial or industrial developments to come from on-site renewable energy developments. Such policies: (i) should ensure that requirement to generate on-site renewable energy is only applied to developments where the installation of renewable energy generation equipment is viable given the type of development proposed, its location, and design; (ii) should not be framed in such a way as to place an undue burden on developers, for example, by specifying that all energy to be used in a development should come from on-site renewable generation. BREEAM Ene 1 Reduction of CO2 Emissions recognises and encourages buildings that are designed to minimise the CO2 emissions associated with their operational energy consumption. Ene 5 Low or Zero Carbon Technologies (LZC) reduces carbon emissions and atmospheric pollution by encouraging local energy generation from renewable sources to supply a significant proportion of the energy demand. However, equally common was a commitment to reduce carbon emissions by 10% (TCPA, 2006) The most cost effective way of reducing energy use by about 10% was by improving the fabric of the building envelope and the efficiencies of its services (NHBC Foundation, 2009)
