4 General Conference Resolutions The RSLS forum is supported by four previous General Conference Resolutions on Measures to strengthen international cooperation in nuclear, radiation, transport and waste safety GC (56)/ RES/9: Encourages Member States to participate in the International Working Forum for the Regulatory Supervision of Legacy Sites 4
5 Legacy sites present unique problems in that they Exist currently Were generally poorly managed (by today s standards) Are sometimes abandoned and/or uncontrolled Present a situation where remediation is needed but the necessary regulatory infrastructure is lacking Have safety issues that require appreciable financial resources to address 5
6 Opening The meeting was opened by Dr. Alexey Ferapontov (Deputy Chairman, Rostechnadzor) Dr. Vladimir Romanov (Deputy Head, FMBA of Russia) Mr. John Rowat (Unit Head, NSRW, IAEA) Review of Goals of the Meeting and Agenda Dr. Ronald Stenson (NSRW, RSLS Scientific Secretary) The workshop was chaired by Mr. Arnaldo Mezrahi (Brazil National Nuclear Energy Commission) 6
7 Goals of the workshop Exchange of information on nuclear legacy site restoration plans, and the role of regulatory supervision in planning activities Generation of mutual support through presentation and discussion on how regulatory supervision can be made effective and efficient Collection and collation of information on nuclear legacy sites and the historical experience of legacy supervision All of the participants are currently engaged in legacy site issues in their countries RSLS has to date focused on uranium; however, other legacies exist and were discussed at this workshop. This was the first RSLS workshop to introduce presentations and discussion of more complex legacy sites. 7

15 Operating uranium sites. Today: Kazakhstan - Monitoring of uranium legacy sites is carried out by the sanitary epidemiological, environmental bodies together with local executive bodies - Monitoring does not systematized - It is necessary to submit propositions on long-term monitoring Activity on modernization of legal documents: - New version of Regulation for Safe Transport of Radioactive Materials - Regulation on Physical protection of nuclear materials and installations - Regulation on preparation of QA program for PP nuclearentities - Regulation on preparation of QA program for A&C of nuclear materials and radiation sources - Regulation on emergency response during transportation of NM 15
16 Tajikistan What kind of threats: The objects are in seism-dangerous zone Objects arranged in the basin of Sir-Darya river Have become mudflows Fixed 4 happens washing out of tailing pits in Taboshar and Adrasman districts On the base of Law RT On Radioactive waste management some regulations are in the process of developing: - Rules on radioactive waste management - Rules on monitoring during and after remediation - Safety requirements for decommissioning of uranium facilities by liquidation, conservation or reprofiling - Guidance for inspection of decommissioning facilities 16
17 Kyrgyz Republic The state strategy of the uranium legacy remediation includes: Establishing fundamental principles to be used as a basis for the tailings remediation Generation of a legal framework to ensure coherent and consistent approahes to remediation Coordination and avoidance of duplication 17
18 Malawi Although Malawi is relatively new in uranium mining, there is still a need to ensure that the industry is properly regulated especially on prevention of creating legacy sites which are expensive to rehabilitate Efforts by various institutions and RSLS in particular are appreciated as they provide Malawi with vital information and guidance on the subject matter 18
19 Niger Although Niger has a long experience in mining much remains to be done in the following fields for site remediation: Institutionnel, Legislative and Regulatory Technical and financial These challenges need to be overcome 19
20 Bulgaria The activities involving the uranium mining consequences liquidation are being performed in a systematic way There is a number of legal instruments and institutional framework in place to support and supervise those activities Significant efforts have been made for the inventory, assessment, classification, remediation and monitoring of the legacy sites As a result the process of technical liquidation of the former mining sites has been completed and the technical, the biological reclamation has been finalized for 28 sites and is still ongoing for the rest of the sites 20
21 Romania Social and economic effects of the closure and remediation of sites uranium : - Creating each year new jobs - with positive economic effects for local communities - Improving water quality in surface hydrographic network - Protection of groundwater against pollution caused by natural radionuclides and heavy metals - Providing physical comfort for local communities located near the site uranium Priorities today on the closure and remediation of uranium sites - Completion of closure and remediation at uranium mines in Banat, Bihor areas, Crucea, Suceava county - Finding the best technical options closure and remediation of former uranium - Sites from the point of view of the benefit / cost. Preparing project closure and rehabilitation as the best option 21
22 Regulatory framework France Main principles relating to the management of polluted sites: - Apply the polluter pays principle - Prevent future pollution - Identify, monitor and manage the impact of the pollution - Put the polluted sites in a safe state - Manage the sites in accordance with their future or current uses - Retain a record of the pollution and of the remediation done in the past - Inform the public about the risks linked to these sites These principles are implemented through the legal framework and guidance documents 22
23 Specific challenges and needs: Brazil The evaluation and demonstration of safety of the remediation project The establishment of specific regulation defining clearance levels and unconditional release Political and psychosocial aspects related to radioactive waste disposal Financial provisions Definition of a site for long term storage of the radioactive waste generated New technologies and safety standards have resulted in the need for: developing and updating safety regulations and guides, accrediting laboratories the establishment of common grounds among federal institutions responsible for the licensing of Nuclear Installations the partnerships with the TSO needs to be targeted towards enhancing their technical assistance for the regulatory body 23
24 Summary (1) 1. Many countries have no legislation related specifically to legacy sites. Regulatory regimes tend to be complex and regulatory responsibility is often spread between many agencies. Better coordination between regulatory agencies was a common theme of the workshop 2. Some countries are enacting new legislation to deal with the sometimes confusing distribution of authorities. A more unified legislative approach is clearly seen as a benefit to the safe, long-term management of these legacies 24
25 Summary (2) 3. A strong regulatory framework is also essential in order to make a strong case to attract funds for remediation. There is still a wide range in the level of maturity in the regulatory regimes 4. Some presentations credit previous RSLS meetings and workshops as helping with the development and application of strategic and regulatory approaches to legacy site issues within their countries. References to previous meetings and workshops, demonstrate the effectiveness of the RSLS forum 25
26 5. The presentations from Member States included legacy issues beyond the uranium focus, which has been the main theme of RSLS during the first three year cycle of the forum. Although significant work still remains to be done on uranium tailings management, the focus of RSLS in its second three year cycle would benefit from nonuranium historic sites and the problems associated with their regulation and management Summary (3) 26
