Box 382 Monette, AR RE: City of Monette WWTP NPDES Compliance Inspection AFIN: NPDES Permit No.: AR Dear Mayor Qualls: On September 07, 2011, I performed a routine compliance inspection of the waste water treatment facility in accordance with the provisions of the Federal Clean Water Act, the Arkansas Water and Air Pollution Control Act, and the regulations promulgated thereunder. This inspection revealed the following violations: 1. It appeared that wastewater has gone over the top of the walls of the treatment plant in several places. Sludge buildup was also observed on top of the walls of the treatment plant. These are unpermitted discharges and a violation of the Federal Clean Water Act and the Arkansas Water and Air Pollution Control Act - A.C.A (b)(1). 2. Solid waste was on the ground near the outfall weir. This violates Part III, Section B. Item 6. of the permit which requires solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of waste waters to be disposed of in a manner such as to prevent any pollutant from such materials from entering the waters of the State. Solid waste (tampon applicators) was also observed in one of the sludge drying beds. This is not acceptable waste for land application and must not be comingled with sludge destined for land application. The above items require your immediate attention. Please submit a written response to these findings to the Water Division Enforcement Branch of this Department. This response should be mailed to the address below, or ed to Water-Enforcement-Report@adeq.state.ar.us. This response should contain documentation describing the course of action taken to correct each item noted. This corrective action should be completed as soon as possible, and the written response with all necessary documentations (i.e. photos) is due by October 16, 2011.

Box 382 Monette, AR RE: NPDES Permit No.: AR , AFIN: , Response to Inspection Dear Mr. Lamar: The Department has reviewed the response dated October 10, 2011 and the additional information dated October 18, 2011 pertaining to the September 7, 2011 inspection of the City of Monette s wastewater treatment facility by District Field Inspector Michael Greenway. The information provided sufficiently addresses the violations referenced in the inspection report. Furthermore, during an October 17, 2011 telephone conversation, the city s progress toward eliminating violations of the effluent limits for Total Suspended Solids contained in the Permit was discussed. The Department recognizes and certainly appreciates the city s efforts toward eliminating the above referenced effluent violations, and while no enforcement action is planned at this time, the Department will consider such action should these violations continue. The Department will keep the inspection and response on file. If future violations occur that require enforcement action, the Department will consider the inspection and response as required by the Pollution Control and Ecology Commission Regulation No. 7, Civil Penalties. This regulation requires the Department to consider the past history of your facility and how expeditiously the violations were addressed in determining any civil penalty that may be necessary for any future violations.
