Goodlett Place, Room 244 San Francisco, CA Tel Fax TO: FROM: LAFCO Commissioners Nancy Miller, Interim Executive Officer DATE: March 25, 2011 SUBJECT: Item 4: Report on the Issuance of the Request for Proposal (RFP) for a Study on Refuse Collection, Hauling, and Disposal in the Greater Bay Area, including Ratification of Contract with Selected Provider (Discussion and Possible Action Item) During the February 28 th meeting, the Commission provided input on the proposed RFP for a consultant team to study refuse services, and authorized staff to publish the RFP. On March 1, 2011, staff published the RFP. Proposals were submitted on March 14, 2011, by three consultant teams, including: 1. R3 Consulting Group 2. Rosenow Spevacek Group, Inc. 3. HDR, Inc. Interviews with the three teams were held on March 21, The interview panel consisted of representatives from SF LAFCO staff, the City of Oakland, and the San Francisco Department of the Environment. Staff also checked three references for each consultant team. Based on the quality and competitiveness of their proposal, their qualifications, their references, and their performance in the interview, the consultants from R3 Consulting Group were selected as the preferred consultant. R3 Consulting Group was the lowest bidder, and has no conflicts of interest, as they are not working with any of the potential service providers identified for inclusion in the study. At the February 28 th meeting, the Commission authorized the Executive Officer, to enter into a contract with the preferred consultant selected, subject to the Commission Chairperson s approval and ratification by the Commission. A contract will be provided for ratification by the Commission at the March 25 th meeting.

As set forth in R3 Consulting Group s proposal, attached hereto, the consultant s scope of work shall include the following: 1. The Study shall include a brief discussion of the San Francisco Department of the Environment s procedures for selection of a provider for refuse collection, hauling and disposal services including a discussion of the current procedure. 2. The Study shall explore policies and procedures put in place by surrounding Greater Bay Area jurisdictions, as set forth below, for the selection of providers for refuse collection, hauling, transfer, transport, recycling and disposal services, focusing on those jurisdictions that transport refuse outside their jurisdictional boundaries. The Consultant shall be responsible to gather data on the process or procedures used in the Bay Area Communities set forth below, via research, telephone surveys, s and, as necessary, in-person meetings. 3. The Study shall include a comparison of the results of (1) and (2) above. 4. The Study shall include a brief history of the selection process for each refuse providers for each reviewed jurisdiction. 5. The Consultant shall review current location and capacity information of the landfills used by each reviewed jurisdiction, as well as gather franchise fees, vehicle impact fees, AB 939 fees and other fees received related to refuse collection, hauling, and disposal. These findings shall be compared in a Final Report. 6. The Study shall compare rates, level of services provided, diversion rates, franchise fees, and other significant criteria as designated. 7. The Study shall include a brief history of rail hauling of refuse, as well as the potential for barging in the City and County of San Francisco by the San Francisco Port Authority. The Consultant will meet with the San Francisco Port Authority and provide a short summary of the Port s ability to provide refuse barging services, if any. The Study shall also include an analysis of the beneficial impacts/revenue potential with barging and rail, as well as detriments. The Study shall be organized in a clear and concise manner that will allow decision makers to effectively compare the range of options.

We believe that our project team s experience and our proposed project approach will provide a high quality product to the City and County of San Francisco. R3 is a management consulting firm established in 2002 to exclusively serve municipal agencies responsible for solid waste management we do not work for solid waste haulers or facility owners/operators. Our corporate office is in Sacramento, California. Our three partners have more than 70 years of combined solid waste operations and consulting experience, and during the past 35 years have conducted hundreds of solid waste management consulting projects for clients throughout California and nationally. Our current work in Bay Area Communities includes Marin County, Alameda County, Sonoma County, and South Bayside Waste Management Authority. In addition, R3 team members recently completed projects with the City of Fairfield on a contracting options, the U.S. Army Corps of Engineers surveying 206 cities, 6 counties and 45 landfill facilities, and have conducted refuse and recycling services and rate surveys for over 150 California jurisdictions. Practice Areas PROCUREMENT ASSISTANCE SERVICES R3 provides a range of procurement assistance services for our municipal clients, ranging from assisting jurisdictions with sole-source negotiations with an existing service provider to managing all aspects of a competitive procurement process for refuse collection, recycling, processing and disposal services. We typically provide full-service procurement assistance, meaning that we work closely with our client staff on all aspects of a competitive procurement project. R3 first works with staff and community members to develop the scope and design of programs, facilities and services. Once this is complete, R3 prepares the Request for Proposals package, drafts the franchise agreement or operating contract, conducts pre-proposal meetings with potential contractors and written responses to questions, assists the evaluation team with proposal evaluations, and prepares staff reports and presentations to support the committee recommendations. Finally, we typically prepare and conduct workshops and community forums to solicit direct input on program design from residents, business groups, and elected officials. Our procurement services include the following: Development and evaluation of policy and programmatic alternatives that meet the specific needs of the community; Design of performance standards, incentives and penalties related to Contractor performance; Development of an annual adjustment mechanism to the Contractor compensation and user rates and fees; Preparation and distribution of the Request for Proposals package, including the franchise agreement and operating contracts; Assistance with the technical and financial evaluation of proposals; and Section 1-2

SOLID WASTE PLANNING, AB 939 IMPLEMENTATION, ZERO WASTE PLANNING AND EXTENDED PRODUCER RESPONSIBILITY R3 staff have designed and implemented numerous solid waste collection, recycling, composting and disposal programs and facilities for cities, counties and regional authorities in California and throughout the United States. R3 emphasizes the creation of technically and financially-sound solutions that can be effectively implemented and maintained over the long-term. Our broad experience has allowed R3 to address a variety of issues that typically confront our municipal clients during the implementation of programs and facilities, including regulatory compliance, community outreach and public education, land-use planning and permitting, interjurisdictional coordination, AB 939 planning requirements and diversion mandates, labor issues and customer service and billing functions. 16 Section 2 The R3 Project Team R3 team members have provided solid waste management consulting services to hundreds of municipal clients representing more than 1,000 solid waste management engagements throughout the United States. The project team members assigned to this engagement have significant relevant experience assisting clients with rate reviews and financial and rate analysis of solid waste management systems. At R3, we offer a unique approach to managing and executing all of our projects that sets us apart from our competitors. We actively involve at least two of our Principals in all of our major projects. This staffing approach serves several important functions to the benefit of our clients: Real and effective collaboration of experienced staff throughout the project; Assurance of availability of senior staff who know the project and can respond to client needs in a prompt manner; and Multiple senior staff supporting all project requirements and deliverables. A discussion of the staff assigned to this project and their responsibilities is provided below. Staffing and Availability The R3 Project Team is available to meet the proposed schedule with a completion date within three weeks of execution of the contract. For this project, we have assigned two Principals of our firm; Richard Tagore-Erwin and Ric Hutchinson who will have primary responsibility for all project tasks. Richard Tagore-Erwin will serve as project manager. He will manage the day-to-day project responsibilities and be the main point of contact with the San Francisco Local Agency Formation Commission (SF LAFCo). As project manager, he will be responsible for guiding the project through the Scope of Work outlined in Section 4 within the schedule parameters. Mr. Hutchinson will serve as assistant project manager and will serve as a secondary point of contact for the SF LAFCo. 17 Staff Qualifications Biographical Summaries R3 Consulting Group Richard Tagore-Erwin, Principal Mr. Tagore-Erwin s project work encompasses all aspects of solid waste management and environmental consulting. Over the past 25 years, Mr. Tagore-Erwin has conducted over 140 solid waste projects for a variety of public agencies throughout California and Arizona. Mr. Tagore-Erwin has also administered hauler monitoring and reporting programs, conducted competitive procurement of solid waste services, and managed performance audits and financial reviews. His solid waste planning projects have encompassed developing Universal Waste management options for the CIWMB, preparing COIWMPs, AB 939 plans, waste reduction plans, Buy-Recycled plans, business and strategic plans, and feasibility studies for developing Eco- Industrial Parks. He routinely conducts public workshops and participates in Board of Supervisor and City Council hearings. Mr. Tagore-Erwin holds both a Bachelor and Master of Arts Degree in Political Science, and is a certified meeting facilitator. Ric Hutchinson, Principal Mr. Hutchinson is a Florida Certified Public Accountant with more than 35 years of experience in the fields of accounting, auditing, and financial and management consulting for state and local governments. He has an extensive background in performing rate audits and providing financial analysis, in addition to procurement of solid waste collection and recycling services, and preparation of solid waste and construction and demolition ordinances. Mr. Hutchinson recently completed financial analysis and modeling projects for El Dorado County, California and the California Cities of Dublin, Santa Rosa, San Jose, Citrus Heights and Rancho Cordova. Mr. Hutchinson holds a Bachelor of Arts Degree in Accounting. Section 2-2

18 William Schoen, Principal Mr. Schoen is an engineer with more than 25 years of solid waste operational and consulting experience. He has managed recycling and landfill operations and assisted numerous jurisdictions with the review and assessment of both municipally operated and franchised solid waste management systems. His primary expertise lies in the areas of solid waste operations and financial analysis. Mr. Schoen has reviewed the performance of numerous municipal and private sector solid waste management operations including divisions of Waste Management, BFI, Republic Services and other regional and local solid waste management services providers. He has also managed numerous rate reviews of private sector service providers for the contracting entities and assisted municipal operations with the development of financial rate models. He is currently managing our performance review of the City of Tacoma's Solid Waste Management Division, and was the lead operations analyst for our recent performance reviews for the cities of San Bernardino and San Leandro franchised solid waste collection operations. Mr. Schoen holds a Bachelor of Science Degree in Bioengineering. Steve Grimshaw, Manager Mr. Grimshaw is a California Certified Public Accountant (inactive) with more than 27 years of experience in the fields of accounting, auditing, financial modeling and applications development. He has extensive experience with state and local governments in the areas of financial analysis and development of analytical tools utilizing Microsoft Access and Excel. Mr. Grimshaw developed our Rate Model for the City of Rohnert Park and was the primary staff analyst responsible for the development of our Rate and Cost of Service Model for the City of Merced. He is serving in a similar capacity for our Rate and Cost of Service Model projects for the cities of Berkeley, Folsom and Sacramento. Mr. Grimshaw holds a Bachelor of Science Degree in Accounting. Carrie Baxter, Associate II With over three years of experience, Ms. Baxter has been involved in a range of projects. She has assisted with the gathering of data in support of refuse vehicle impact fee analysis, solid waste and recycling benchmarking surveys and with the competitive procurements of solid waste and recycling programs and facilities throughout California. Ms. Baxter recently assisted in solid waste and recycling benchmarking surveys for the cities of Pasadena, Pomona, and Santa Monica. Ms. Baxter has conducted comprehensive rate surveys, gathered data for waste generation studies and assisted with the implementation of Staff Qualifications Section 2-3

19 Staff Qualifications used oil block grants. Ms. Baxter holds an Associate of Applied Science Degree in Computerized Business Administration. Jared Zitron; Associate I Mr. Zitron has been involved in a wide range of projects since joining R3 earlier this year. He is currently the lead data analyst on our landfill siting study for the U.S. Army Corps of Engineers, and has performed various numerical based modeling studies. He has assisted in the development of zero waste plans, and has experience using EPA s WARM model to predict greenhouse gas emissions. Mr. Zitron has analyzed and consolidated data from the Department of Resources Recycling and Recovery, and has performed numerous rate reviews and financial analyses for cities and counties. Mr. Zitron holds a Bachelor of Science in Earth Sciences from the University of California, Santa Cruz. Melody Lasiter; Associate I Ms. Lasiter has been involved in a wide range of projects since joining R3 in She was the lead analyst for our rate review for the City of Petaluma and is currently scheduled to perform a similar function for our rate review for the City of Concord. As part of her work for the City of Petaluma, she was responsible for assuring that the rate application included all of the required information. She also reviewed the accuracy of the projected adjustments to all expense line items, including projected tonnages and tipping fees for solid waste, yard waste and recyclables. She is currently the lead data analyst on our rate survey for the City of Albany and she recently assisted with recertification of facilities as part of the City of San José s nationally recognized construction and demolition debris diversion program. Ms. Lasiter has a Bachelor of Arts in Environmental Studies. Section 2-4

Phase I will engage a collaborative process between the R3 Project Team and City staff to select and design a new system built on the principles of redesign, reduce, reuse, and recycle, and to propel the City toward its goal of achieving Zero Waste. 42 Marin County and its cities have been leaders in environmental programs and have implemented many highly successful diversion programs. The Marin County Hazardous and Solid Waste Management Joint Powers Authority (JPA) was formed as a regional agency to represent 11 incorporated Cities, the County, and 10 Special Districts (Member Agencies) that provide for or administer solid waste programs. The JPA has established goals of 80 percent waste diversion by 2012 and Zero Waste by To address these goals, the JPA requested R3 Consulting Group (R3) to draft a Zero Waste Feasibility Study. The Zero Waste Feasibility Study is a working document that focuses on timeframes and instruction for specific program implementation to properly meet the JPA s goals of 80 percent waste diversion by 2012 and Zero Waste by R3 s work tasks have been divided in two Phase. In Phase I, we focused on the development of a regional Zero Waste Strategic Plan adopted by the JPA. During this phase, R3 team members: Evaluated existing programs; Selected and investigated options for program improvement and potential new programs to implement; Prepared a draft and final Zero Waste Feasibility Study; Held stakeholder meetings; and Held project management and project progress meetings. 43 Related Experience San José, CA Solid Waste Procurement Services Benefits: Saved city residents approximately $70M over contract term; and Expanded residential and commercial solid waste and recycling programs. San José (City) utilizes franchise haulers to provide collection of refuse, yard trimmings and recyclables to approximately 200,000 single-family residential units and 85,000 multifamily residential units. In 2000, the City was interested in administering a competitive procurement process for these services in an effort to reduce program costs and strengthen the franchise agreements. A primary goal of the City in this project was to minimize disruption to the residents throughout the procurement process and hauler transition period. The City engaged R3 team members Ric Hutchinson and Richard Tagore-Erwin to provide assistance on this project. As part of the RFP preparation process, Mr. Hutchinson and Mr. Tagore-Erwin met with City staff to develop the initial project plan and clarify the steps in the RFP distribution and evaluation process. At the conclusion of the project planning phase, the team members assisted the City in the preparation of the RFP package, including a project description and background, proposal instructions, draft contract language, cost proposal forms and various appendices. The City elected to divide the services into the following Service Types and Service Districts: single-family solid waste and recycling collection services (3 districts); multi-family solid waste and recycling collection services (2 districts); and yard trimmings collection and residential street sweeping services (3 districts). The proposers were allowed to submit cost proposals on any combination of services and districts; however the City determined that it would not award more than two of the three single-family or yard trimmings/street sweeping districts to any one hauler, but would award either one or two of the multi-family districts to a single hauler. In addition to assisting in the preparation of the RFP documents, Mr. Hutchinson and Mr. Tagore-Erwin were asked to develop an evaluation methodology that would allow the City to determine the service district combinations that would provide the lowest and best service for the City. This required that an evaluation model be developed to quantify and evaluate over 7,000 service rating and cost rating combinations. This competitive procurement process allowed the City to execute agreements with several haulers, allowing the City to save an estimated $70M over the contract term. SBWMA is a joint powers authority comprised of 12 member agencies in San Mateo County. It assists member agencies in the provision of cost-effective waste reduction, recycling and solid waste programs through franchised collection services and the operation of the SBWMA s Shoreway Recycling and Disposal Center (SRDC). The current collection agreements, and the SRDC operating contract, expire on December 30, The SBWMA service area encompasses over 90,000 homes and 10,000 businesses. The procurement provides for breaking the SBWMA Service Area into to relatively equal size zones. Separate contractors may be selected for each zone or a single contractor may be selected to provide collection service throughout the service area. Operation of the SRDC may be awarded to a contractor selected to provide collection services or an entirely different company. 45 Related Experience Sonoma County Waste Management Agency, CA R3 was engaged by the Sonoma County Waste Management Agency (County) to evaluate various solid waste management system program options for the County s franchised services. R3 s primary objective was to evaluate a wide range of options related to, among other things, the size and number of service districts and the structure of the franchise agreements. The pros and cons of each of the options were presented and compared to current franchise requirements. Issues evaluated included the following: Analysis of Franchise Districting and Program Options Benefits: Provided base service levels and hauler performance standards; Developed balanced district sizes; and Documented disposal and diversion tonnages. Boundaries for exclusive franchise areas (number of service areas, waste sheds for current transfer stations); Exclusive vs. open market for commercial recycling and debris box services; Mandatory collection vs. subscription service for specific service areas (countywide, urban, rural, etc.); The appropriate amount of franchise fees; Bundled customer rates for commercial recycling; Performance standards for various programs; Street sweeping included in the exclusive franchise versus a separate agreement; Collection Vehicle Requirements ( Clean-air vehicles, Split body vs. conventional trucks, Weight limit on collection vehicles, etc.); and Proposition 218 compliance requirements. The analysis identified the potential impact on customers, haulers, and the County in terms of program requirements, costs, revenue to the County, and the impact on a future competitive procurement process. R3 developed the analysis on these various issues and will be assisting County staff with the presentation of the findings to the County Board of Supervisors. 46 R3 was engaged by the South Bayside Waste Management Authority (SBWMA) as part of a consulting team to assist it with the review of various program and facility alternatives. The SBWMA is a joint powers authority comprising 11 member agencies in San Mateo County. There are approximately 90,000 single-family households and 10,000 commercial accounts in the SBWMA area. The SBWMA owns the San Carlos Transfer Station and MRF and contracts with BFI/Allied for residential and commercial solid waste collection and recycling services, operation of the transfer station and MRF and long-term disposal services. Both the collection franchise and facility operating agreements with BFI expired in 2009 and the SBWMA undertook a process to evaluate various program and facility options as part of its efforts to procure collection, material processing and transfer services. The objective of this effort was to identify program and facility options that the SBWMA may wish to include in its future collection and facilities contracts. R3 had the lead role in evaluating residential collection options and facility program options and provided support for the review of multifamily and commercial recycling options. One of the key issues addressed as part of the process was the potential for converting from the manual bin recycling system to either a dual stream split cart or single stream cart based recycling system. That analysis, which R3 led, included assessing the potential impact of dual stream and fully commingled cart based systems on diversion levels, recovered material quality, collection and processing costs and material sales revenue. As part of that review, consideration was given for the ability to convert the SBWMA s current materials processing system, which is designed for source separated materials, to a fully-commingled processing system. The analysis built upon a related analysis that was conducted by Mr. Schoen several years ago as part of the development of the SBWMA s Long Range Plan. 47 Related Experience Citrus Heights and Rancho Cordova, CA Solid Waste Procurement Services for Multiple Jurisdictions Benefits: Cost efficiencies through economies of scale; Increase in number of interested vendors due to larger customer base; and Potential for rate reduction due to larger customer base. The Cities of Citrus Heights and Rancho Cordova engaged R3 to assist on a concurrent Request for Proposals (RFP) process for residential solid waste collection and recycling services. The Cities had received solid waste services from the County of Sacramento since the late 1960 s. After incorporation, both Cities chose to solicit proposals for solid waste services in order to gain local control over the program selection and implementation. The Cities engaged R3 to assist on the project, and developed the following project goals: Increase the range of materials accepted in the curbside recycling and bulky waste collection programs to maximize landfill diversion; Require the selected hauler to provide solid waste collection and recycling services to City facilities and bus stops at no additional charge; Increase the level of Franchise Fees collected during the Contract term; and Reduce rates. R3 recommended that the Cities administer a Concurrent RFP Process, whereby a single RPP document would be distributed for the two City Service Areas. Under this approach, each City would have the ability to design its own programs and execute Contracts with separate vendors. The primary objectives of the concurrent process were to save on the RFP process administration costs and to generate a high degree of competition by offering a larger account base. R3 worked extensively with staff and residents of both Cities to develop the RFP documents, including the procurement instructions, the draft contract language and the proposal cost and evaluation forms. 48 The Rancho Murieta Community Services District (CSD) engaged R3 Consulting Group to administer a full service procurement process for residential solid waste collection and recycling services. The CSD has received residential solid waste and recycling services from the Sacramento County Department of Waste Management and Recycling since the late 1960 s. The primary objective of the CSD Board of Directors in the decision to administer a procurement process was to have a contractual relationship with the solid waste service provider. This will allow the CSD to design collection programs, control service rates, collect a Franchise Fee and allow the community to give input into the design and selection of new programs. R3 team member Richard Tagore-Erwin conducted a series of workshops to allow the community to provide feedback into the procurement process. The community meetings focused on several important issues, including the following: Weekly vs. bi-weekly collection of greenwaste and recyclables; The use of alternative fuel vehicles in the collection fleet; Responsiveness of the service provider to the needs and requests of the community; The size, color and configuration of collection carts; and Implementation of an on-call bulky waste collection program, with each resident allowed to request up to four collection events per year. Based on results from the proposal, R3 anticipates that the CSD will receive increased service and approximately 30 percent reduction in customer rates. As part of this project, R3 will also prepare a billing system and solid waste ordinances for the CSD to administer. 49 Related Experience Sonoma County Waste Management Agency Development of Program Fee and Companion Financial Model Benefits: Retains revenue neutrality; Provides a stable source of revenue to the Agency; and Provides financial incentive that promotes diversion programs. R3 was recently engaged by the Sonoma County Waste Management Agency (Agency) to assist it with revising its current financing system. Since its inception, the funding source for the Agency has been an Agency Surcharge on tonnages delivered to the County s transfer stations and landfill. As disposal tonnages continue to decrease due to: increased waste reduction and recycling efforts; varying economic conditions; and lack of direct flow control revenues to fund the Agency have decreased resulting in an unsustainable funding model. The Agency retained R3 to conduct a study to develop a sustainable funding mechanism that converts the current Agency Surcharge based on solid waste at the point of disposal to one based on the quantity of solid waste, organics and recyclables set out for collection or self-hauled for disposal within the County. The major objectives of any proposed changes to the current Agency Surcharge system include the following: There should be no net change in the Agency revenues (i.e., revenue neutral for the Agency); There should be no net change in the revenues paid by the residential or commercial rate payers in each Member Agency jurisdiction (i.e., revenue neutral for each Member Agency); The per unit amount of any fee(s) should be the same for all Member Agencies; The Agency Surcharge should not place additional administrative requirements on the Member Agencies, including any requirements for the Member Agencies to collect fees; The Agency Surcharge should provide incentives to promote diversion over disposal; and The Agency Surcharge should provide a means for generating a stable funding source regardless of changes in disposal tonnages. As part of the work efforts to date, R3 developed a financial model to project tonnage by jurisdictions, hauling methods, type of materials collected, facilities used, and revenue associated with each of the tonnage flows. This information was used to develop three funding options to meet the project objectives. Measure D set forth countywide goals for the reduction and diversion of nonhazardous solid waste from landfills, created a framework for comprehensive source reduction and recycling programs, imposed a surcharge on waste landfilled in the unincorporated county to fund those programs and established the Recycling Board to oversee the distribution of funds and the conduct of countywide programs. The Audit involved a comprehensive financial review of Measure D revenues and expenditures for fiscal years 2001/2002 through 2003/2004 along with monitoring and reporting on compliance with the mandates of Measure D. The first phase of the audit focused on the receipts and expenditures of Measure D Funds of the Agency, and the Member Agencies along with those not-for-profit agencies receiving Grants from the Agency. In addition, the first phase included compliance testing of Measure D requirements as they relate to the receipt and expenditure of those funds. 51 Related Experience Hemet, CA Collection System Privatization Customer Rate Comparison Survey R3 was engaged by the City of Hemet (City) to estiamte the value of the Solid Waste Division s operations to a private contractor, accounting for the following: Estimated value of vehicles, containers and other equipment, less any outstanding capital depreciation not realized by the City; Estimated value of the contract based on the projected revenues over the contract term that would be realized above a reasonable target profit level, accounting for the current rate schedule with an agreed upon annual adjustment methodology; Estimated value of the contract for the good will value due to an increase in market share by acquiring the City s operations; and Estimated value of the contract to raise the average customer rates in the surrounding area communities. R3 adjusted the projected value of the Solid Waste Division s operations to a private contractor to project the net value to the City for outsourcing services to a private operator to account for those City costs that would remain under private operations. These costs included direct and indirect staffing and operational costs (maintenance functions, customer service and billing) and any City overhead charges to the Enterprise Fund that would be reallocated to other City departments (corporation yard, management staff, insurance, etc.). R3 developed an estimate of the impact of outsourcing on customer rates. By outsourcing, the City can receive a substantial up-front payment and ongoing payments (franchise fees, vehicle impact fees, AB 939 Fee, etc.) from the hauler to fully cover the City s current net general fund transfers and any costs that would remain after outsourcing, but this may result in higher customer rates. As part of this project, R3 also conducted a rate survey comparing the City s rates and services to rates and services in surrounding jurisdictions. 52 R3 assisted the City of Pomona (City) determine whether it should continue to perform residential curbside collection services inhouse, or if the City should seek competitive proposals (Request for Proposals) for outside company(ies) to perform such services. As a first step, R3 analyzed the existing operations. Our review focused on the following: Determining if the Department is providing services with appropriate vehicles and crew sizes and achieving reasonable productivity levels; Determining the general condition of the Department s vehicles and containers, assessing the reasonableness of the Department s current vehicle and container replacement schedule and determining any additional funding required to provide for necessary vehicle and container replacement; Documenting the Department s safety record; Determining the value of the vehicles and containers currently used to provide collection services, including support vehicles, spares and inventory; Analyzing of potential revenue to the General Fund from in-house operations compared to franchised operations; and Analyzing of any operational costs that would continue to be borne by the General Fund under a franchised system. This will entail confirming the desired franchised services, drafting a franchise agreement, preparing an RFP, providing a final valuation of the Department s existing equipment, establishing an evaluation process and ranking system, distributing the RFP, conduction a pre-proposal conference and responding to questions, evaluating the proposals, interviewing top ranked proposer(s), briefing the City Council, assisting with negotiating the final agreement, presenting final negotiated information to City Council, and finalizing the franchise agreement. 53 Related Experience San Carlos, CA Construction and Demolition Debris Ordinance and Program Enhancements Benefits: Developed C&D reporting procedures and forms; Trained staff on C&D program requirements; and Identified C&D haulers and C&D facilities. R3 was engaged by the City of San Carlos to assist with expanding its construction and demolition (C&D) debris diversion program and increasing C&D diversion. The project objectives were to: 1. Develop administrative procedures, protocol, outreach and training that are in accordance with the C&D Ordinance; 2. Implement a process that will provide longevity of efficient and cost effective management of the C&D Waste Management Plans and deposits; 3. Develop suggestions on how to improve the C&D Ordinance including ways to increase reported diversion of materials and ways to integrate the C&D Ordinance with the City s Permit Streamlining program; and 4. Assist the Building Division with the administration, enforcement and reporting requirements of the City s C&D Ordinance. R3 presented the City with various recommendations for both increasing C&D diversion and streamlining the compliance process for both the Project Applicants and City staff. R3 also prepared revised Staff Policies and Procedures and supporting documents, as well as an automated Project Tracking Form to enable City staff to more effectively process and track Covered Projects and the compliance of those projects with the requirements of the C&D Ordinance. R3 project tasks include the following: Determine the composition of incoming and outgoing C&D materials at certified disposal sites; Analyze local markets for recycled C&D materials and identify potential partnerships or parallels that could be integrated into the C&D program; Survey other C&D recycling programs and obtain information on those programs that can be used as a basis for recommending options and enhancements to the City s current C&D; Identify and incorporate opportunities for increased diversion, highest and best use of recovered materials, and effectively align the CDDD Program with the City s waste reduction and environmental sustainability goals; Train City staff on facility operations (including trends in technologies), and historic, current and future C&D markets, and develop a comprehensive CDDD facility certification manual; Prepare a comprehensive CDDD Facility Certification Instruction Manual; Develop new compliance forms, data management processes and reporting procedures; and Audit and recertified C&D facilities, including analysis of materials used as alternative daily cover and beneficial use, local markets for recycled C&D and identification of potential partnerships and parallels that could be integrated into the CDDD Program. 55 Related Experience Western Placer Waste Management Authority Review of Landfill and Materials Recovery Facility Contracts R3 team members were engaged by Western Placer Waste Management Authority (WPWMA) to perform a review and evaluation of the WPWMA Western Regional Sanitary Landfill s (Landfill) and Western Placer Materials Recovery Facility s (MRF) contractual and operational arrangements, including general consulting services agreements and current management, administrative economic, and operational practices. The primary objective was to assist WPWMA in the overall improvement of two key solid waste management services: materials recovery and final disposal. The ultimate goal was to provide these two solid wastes services with a high level of customer satisfaction, balanced with cost-effective, environmentally sensitive and efficient management and operational practices. The methodology of the review consisted of interviews with both the WPWMA s staff and the Landfill and MRF contract operators and their staff, review of historical operating data, and analysis of operator performance through site visits. In addition, a benchmark survey of surrounding jurisdiction s processing and disposal rates, levels of diversion, and methods of operation was also completed to provide a measurement of the WPWMA s program as compared to peer communities. The review s analysis of the efficiency and effectiveness of the current administrative structure and management activities included: The effectiveness of the manner in which operator, consultant and staff duties and responsibilities are currently divided; The applicability of the contracts used to define those duties along with the effectiveness of the contract language; The manner in which the contracts are currently administered; and The effectiveness of current materials recovery and final solid waste disposal practices, as well as potential strategies for optimizing operational performance. Operational and contractual options and alternatives related to the Landfill, MRF and Western Placer Household Hazardous Waste Facility were developed as part of this review. Where appropriate the economic analysts and value measurement as to the alternatives strong and weak points accompany each option and alternative presented. 56 R3 was engaged by the City of Los Altos (City) to assist the City in an evaluation of proposals for collection and processing of recyclables, plant trimmings and other compostable organics and the collection and disposal of garbage. R3 worked directly with evaluation committee members consisting of City staff and the Chairman of the Environmental Commission staging several work meetings and conducting interviews with the three proposers. The evaluation team recommended that the City award a franchise agreement to Mission Trail Waste Systems (MTWS) based on evaluation of their proposal. Improvements to the franchise agreement included: More frequent (weekly) collection of recyclables and compostables; Higher diversion rates, 78 percent landfill diversion rate target; Significant expansion of recycling programs; New and clean CNG powered vehicles; No-charge commercial organics program; Automated collection; All new City waste and recycling carts; Full container backyard service; Seven day downtown waste pick up; Fully updated web page and GPS monitoring technology; Weekly curbside limited hazardous waste pick up; and Twice a year large item/bulky pick up. R3 was also retained by the City following the award of the franchise agreement to MTWS to assist with the transition from its current franchised hauler to MTWS. R3 s primary role is to provide technical support and to assist the City s staff with the management of the transition process. R3 will prepare a detailed compliance checklist specifying all contractual requirements and implementation schedules. In addition, we will facilitate project meetings with the transition team comprised of City staff and the new service providers. R3 assisted the Castro Valley Sanitary District (District) in conducting a competitive process to procure high quality services using state-of-the-art technologies for solid waste, recyclables and compostables collection and processing services. The District wanted to use the procurement process to improve residential and commercial programs and update the franchise agreement in order to meet their goal of achieving a 75 percent diversion level. R3 acted as an extension of District staff and assisted in the following aspects of this procurement project: Worked with City and StopWaste.org staff to develop new program requirements. Prepared the RFP package, including program requirements, the franchise agreement, pricing options and service cost forms etc.; Conducted a series of community workshops (2); Participated in Solid Waste Committee meetings (6); Participated in District Board meetings (5); Developed a mailing list of potential proposers; Issued the RFP to qualified waste haulers; Conducted a pre-proposal conference with potential proposers; Prepared written responses to questions submitted regarding the RFP, and preparing addenda as necessary; Conducted interviews with proposers; Assisted in the evaluation of responses from proposers; Assisted District staff with the presentation of the results of the evaluation process and staff recommendation to the District Board; Conducted negotiation sessions with the selected hauler; Finalized the franchise agreement; and Assisted District staff with staff reports, memorandums, and presentation materials for the Board. 58 The City of Colton was experiencing severe programmatic and financial problems with its municipally operated solid waste collection system. The City s solid waste enterprise fund was operating at a $2 million annual deficit, refuse containers were collected manually and many commercial customers were not properly billed for service. The first phase of this project focused on evaluating the City s solid waste and recycling operations, including a management analysis of the City s Sanitation and Recycling Division. R3 team member Richard Tagore-Erwin led the project team in determining the capital and operating costs necessary to increase the efficiency of the City s collection system while decreasing the cost to ratepayers. This entailed providing recommendations on routing, collection vehicles and staff utilization and collection container alternatives. Additional analysis was performed on the potential cost savings to the City if collection operations were privatized. Several options were presented to the Colton City Council, after which the Council voted to privatize the collection operations. Mr. Tagore-Erwin then prepared a detailed Request for Formal Qualifications and a Request for Formal Proposals, evaluated responses to the procurement documents and negotiated the franchise agreement. The project resulted in the following benefits to the City: Residential rates decreased by approximately 20 percent, while moving to a fully automated collection system; Implementation of commercial recycling programs; The City received a cash payment of approximately $2.8 million for its outdated collection fleet; and The City receives annual franchise fee revenues of approximately $700,000. In addition, R3 identified related references in other areas of the Municipal Code that needed to be revised for consistency in terminology on the proposed language. R3 prepared draft language that followed current Municipal Code format incorporating topics into the revised Municipal Code to include items such as: Definitions (solid waste, garbage, recyclables, etc.); Hauler collection services requirements (operating hours, truck size, noise, etc.); Collection containers (access to property for on-premise collecting, where to place containers for curbside collection, use of contractor provided containers); Hours and days for residents to set out and remove carts for collection; Landscapers/gardeners use of residential organic carts; Use of biodegradable bags; Recyclables and organic waste overages; Restrictions and unacceptable materials (E-Waste, U- Waste, burning, stockpiling, burying solid waste, etc.); Construction and demolition materials (diversion requirements, tie in with building permits, etc.); and Rate setting (by City Council resolution, public hearings, etc.).
