1 Notification of Ministry of Industry No (B.E. 2551) (2008) Issuance in pursuant to the Industrial Standard Act B.E (1968) Re Stipulating Industrial Standard on Electrical and Electronic Equipment that may contain Hazardous Substances: Restriction of the Use of Certain Hazardous Substances By virtue of Section 15 of the Industrial Standard Act B.E (1968), the Ministry of Industry hereby issue a notification stipulating industrial standard on electrical and electronic equipment that may contain hazardous substances: restriction of the use of certain hazardous substances, TIS , as per the detailed list annexed to this notification. 2 Industrial Standard on Electrical and Electronic Equipment that may contain Hazardous Substances: Restriction of the Use of Certain Hazardous Substances 1. Scope 1.1 This Industrial Standard shall apply to electrical and electronic equipment falling under the categories 1, 2, 3, 4, 5, 6, 7 and 10 set out in Annex B to this Notification, and to electronic light bulbs and luminaires in households. 1.2 This Industrial Standard does not apply to spare parts for the repair, or to the reuse, of electrical or electronic equipment placed on the market prior to the entry into force of this Notification. 2. Definition The definition of terms using in this Industrial Standard shall apply as the following: 2.1 Electrical and electronic equipment means equipment which is dependent on electric currents or electromagnetic fields in order to work properly; and equipment for the generation, transfer and measurement of such currents and fields falling under the categories set out in Annex B to this Notification and designed for use with a voltage rating not exceeding volts for alternating current and volts for direct current. 3. Prevention 3.1 Electrical and electronic equipment shall not contain lead, mercury, cadmium. hexavalent chromium, polybrominated biphenyl (PBB) or polybrominated diphenyl ethers (PBDE). Remark: For the purpose of this requirement, it is deemed that not containing these hazardous substances in case where concentration of lead, mercury, hexavalent chromium, polybrominated biphenyl (PBB) or polybrominated diphenyl ethers (PBDE) containing up to 0.1% in homogeneous material by weight, concentration of cadmium containing up to 0.01% in homogeneous material by weight. 3.2 Paragraph 3.1 shall not apply to the application listed in Annex A. 3.3 This Industrial Standard may be amended, as soon as scientific evidence is available, and in accordance with the principles on chemicals policy, on the prohibition of other hazardous substances and the substitution thereof by more environment- friendly alternatives which ensure at least the same level of protection for consumers. 4. 3 Unless agreed otherwise among stakeholders, it is recommended to demonstrate compliance with the requirements in accordance with Annex C. Page 3 of 10
4 Annex A The certain applications of lead, mercury, cadmium. hexavalent chromium, polybrominated biphenyl (PBB) or polybrominated diphenyl ethers (PBDE) that are exempted from Paragraph 3.1 to the Notification 1. Mercury in compact fluorescent lamps not exceeding 5mg per lamp. 2. Mercury in straight fluorescent lamps for general purposes not exceeding: - halophosphate 10mg - triphosphate with normal lifetime 5mg - triphosphate with long lifetime 8mg. 3. Mercury in straight fluorescent lamps for special purposes. 4. Mercury in other lamps not specifically mentioned in this Annex. 5. Lead in glass of cathode ray tubes, electronic components and fluorescent tubes. 6. Lead as an alloying element in steel containing up to 0.35% lead by weight, aluminium containing up to 0.4% lead by weight and as a copper alloy containing up to 4% lead by weight. 7. lead in high melting temperature type solders (i.e. lead based alloys containing 85% by weight or more lead) lead in solders for servers, storage and storage array systems, network infrastructure equipment for switching, signalling, transmission as well as network management for telecommunications lead in electronic ceramic parts (e.g. piezoelectronic devices). 8. Cadmium and its compounds in electrical contacts and cadmium plating except for applications banned under international regulation (i.e. the EU Directive 76/769/EEC relating to restrictions on the marketing and use of certain dangerous substances) or relevant regulations. 9. Hexavalent chromium as an anti- corrosion of the carbon steel cooling system in absorption refrigerators. 9a 9b deca brominated diphenyl ethers in polymer uses Lead in lead- bronze bearing shells and bushes 10. (None) 11. Lead used in compliant pin connector systems. 12. Lead as a coating material for the thermal conduction module c- ring. 13. Lead and cadmium in optical and filter glass. Page 4 of 10
5 14. Lead in solders consisting of more than two elements for the connection between the pins and the package of microprocessors with a lead content of more than 80% and less than 85% by weight. 15. Lead in solders to complete a viable electrical connection between semiconductor die and carrier within integrated circuit Flip Chip packages. 16. Lead in linear incandescent lamps with silicate coated tubes. 17. Lead halide as radiant agent in High Intensity Discharge (HID) lamps used for professional reprography applications. 18. Lead as activator in the fluorescent powder (1% lead by weight or less) of discharge lamps when used as sun tanning lamps containing phosphors such as BSP (BaSi2O5:Pb) as well as when used as speciality lamps for diazo- printing reprography, lithography, insect traps, photochemical and curing processes containing phosphors such as SMS ((Sr,Ba)2MgSi2O7:Pb). 19. Lead with PbBiSn- Hg and PbInSn- Hg in specific compositions as main amalgam and with PbSn- Hg as auxiliary amalgam in very compact Energy Saving Lams (ESL). 20. Lead oxide in glass used for bonding front and rear substrates of flat fluorescent lamps used for Liquid Crystal Displays (LCD). 21. Lead and cadmium in printing inks for the application of enamels on borosilicate glass. 22. Lead as impurity in RIG (rare earth iron garnet) Faraday rotators used for fibre optic communications systems. 23. Lead in finishes of fine pitch components other than connectors with a pitch of 0.65 mm or less with NiFe lead frames and lead in finishes of fine pitch components other than connectors with a pitch of 0.65mm or less with copper lead- frames. 24. Lead in solders for the soldering to machined through hole discoidal and planar array ceramic multilayer capacitors. 25. Lead oxide in plasma display panels (PDP) and surface conduction electron emitter displays (SED) used in structural elements; notably in the front and rear glass dielectric layer, the bus electrode, the black stripe, the address electrode, the barrier ribs, the seal frit and frit ring as well as in print pastes. 26. Lead oxide in the glass envelope of Black Light Blue (BLB) lamps. 27. Lead alloys as solder for transducers used in high- powered (designated to operate for several hours at acoustic power levels of 125dB SPL and above) loudspeakers. 28. Hexavalent chromium as an anti- corrosion of the uncoated steel sheet and joint assembly used as an anti- corrosion and anti- disturbance in the electromagnetic as defined in Annex B Categories 3 (IT and telecommunications equipment). 29. Lead bound in crystal glass. Page 5 of 10
6 Annex B Categories of electrical and electronic equipment (Paragraph 1.1 to the Notification) 1. Large household appliance large cooling appliance; refrigerator; freezer; other large appliances used for refrigeration, conservation and storage of food; washing machine; clothes dryer; dish washing machine; cooking appliance; electric stove; electric hot plate; microwave oven; other large appliances used for cooking and other processing of food; electric heating appliance; electric radiator; other large appliances for heating rooms, beds, seating furniture; electric fans; air conditioner appliance; other fanning, exhaust ventilation and conditioning equipment. 2. Small household appliance vacuum cleaner; carpet sweeper; other appliances for cleaning; appliance used for sewing, knitting, weaving and other processing for textiles; irons and other appliances for ironing, mangling and other care of clothing; toaster; fryer; grinder, coffee machine and equipment for opening or sealing of containers or packages; electric knife; appliance for hair- cutting, hair drying, tooth brushing, shaving, massage and other body care appliance; clock, watch and equipment for the purpose of measuring, indicating or registering time; scales 3. IT and telecommunications equipment mainframe; minicomputer; printer; personal computer; laptop computer; notebook computer; notepad computer; copying equipment; electrical and electronic typewriter; pocket and desk calculator; other products and equipment for the collection, storage, processing, presentation or communication of information by electronic means; user terminal and system; facsimile; telex; telephone; cordless telephone; cellular telephone; answering system; other products or equipment of transmitting sound, images or other information by telecommunications. 4. Consumer equipment radio set; television set; video camera; video recorders; hi- fi recorder; audio amplifier; musical instruments; other products or equipment for the purpose of recording or reproducing sound or images, including signals or other technologies for the distribution of sound and image than by telecommunications 5. Lighting equipment luminaires for fluorescent lamp (with the exception of household luminaires); straight fluorescent lamp; compact fluorescent lamp; high intensity discharge lamp, including pressure sodium lamp and metal halide lamp; low pressure sodium lamp; other lighting equipment for the purpose of spreading or controlling light (with the exception of filament bulb) Page 6 of 10

Electrical and electronic tools (with the exception of large- scale stationary industrial tools) drills; saw; sewing machine; equipment for turning, milling, sanding, grinding, sawing; cutting; shearing; drilling; punching; folding; bending or similar processing; tool for mowing or other gardening activities 7. Toys, leisure and sports equipment electric trains or car racing set; hand- held video game console; video game; computer for biking, diving, running, rowing, etc.; sports equipment with electric or electronic components; coin slot machines 8. Medical device (with the exception of implanted and infected product) radiotherapy equipment; cardiology; dialysis; pulmonary ventilator; nuclear medicine; laboratory equipment for in- vitro diagnosis; analyzer; fertilization test; other appliances for detecting, preventing, monitoring, treating, alleviating illness, injury or disability 9. Monitoring and control instruments smoke detector; heating regulator; thermostat; measuring, weighing or adjusting appliance for household or as laboratory equipment; other monitoring and control instruments used in industrial installations (e.g. in control panel) 10. Automatic dispenser automatic dispenser for drinks; automatic dispenser for hot or cold bottles or cans; automatic dispenser for solid products; automatic dispenser for money; all appliances which deliver automatically all kind of products Page 7 of 10
8 Annex C Compliance (Recommendation) (Paragraph 4 to the Notification) In demonstrating compliance with the requirement, the following documentation shall be required: - - Technical documentation stating an assurance of producers of electrical and electronic equipment to prevent that any materials, components, assemblies or equipment do not contain more than the permitted level of any of the six restricted hazardous substances (lead, mercury, cadmium. hexavalent chromium, polybrominated biphenyl (PBB) or polybrominated diphenyl ethers (PBDE)) Evidence ensuring efficiency and effectiveness of proceeding as specified. The producers of electrical and electronic equipment shall present the technical documentation as briefly shown in Table C.1 and Table C.2, either documentation of conformity Type A - processed based conformity; or documentation of conformity Type B - product/part based conformity or mixture of both types. Table C.1 List of documentation (overview) Information of contact point Contact point of organization responsible for application to this Industrial Standard. Information of business This information includes size of organization, manufactured products, and estimated sales level. Compliance to the requirements Documentation in this item should be in general overview of compliance system as set out by organization and as appropriated in compliance with this Industrial Standard. Overview of information quality system Documentation in this item should include risk assessment, acceptance criteria, purchasing procedure and other relevant documents. The documentation can be presented in both types, i.e. Type A or Type B or mixture of both types. Page 8 of 10
9 Table C.2 List of general evidence Documentation of conformity Type A Process- based technical documentation (general information relating to internal system of organization assuring the compliance to the requirement of this Industrial Standard) Compliance Assurance System: CAS 1. Purpose of system, requirement and important technical qualification: The documentation shall include compliance procedure to this Industrial Standard, both within organization or within supply chain. 2. Requirements that are officially specified: to implement requirements in the system, and proceedings to comply with such requirements are integral into a part of quality system and management system of organization. 3. Technical documentation system (paper document and/or electronic document): to facilitate measures on compliance assurance system, including training, tools and basic structure as necessary. Evidence ensuring compliance to CAS 4.Internal audit and supplier audit: to assure the validation of compliance assurance system and/or procedure (i.e. supplier s capacity to assure the compliance). 5.Evidence showing compliance with the system as set out, including conformity assessment, for example, product assessment (and examining product to be fallen under category in Annex B of this Industrial Standard and application of exemption in Annex A of this Industrial Standard), material declaration, purchasing control, inventory and production control, and analysis of hazardous substances quantity as appropriated. Documentation of conformity Type B Product/part- based technical documentation (general information relating to physical elements of product/assembly assuring the compliance to the requirement of this Industrial Standard) 1. Certificate or warranty from producers or suppliers declaring the use of hazardous substance containing no more than the permitted level. 2. Completed material declaration from producers or suppliers for all pieces of assembly (including adjusted assembly), and categorizing in the category in Annex B of this Industrial Standard. In applying exemption as specified in Annex A of this Industrial Standard, the material declaration shall apply only to specified hazardous substances, not to all materials. 3. Analysis report of homogeneous materials. The test result should refer to homogeneous material. 4.For Type B, the documentation assuring the compliance to the proceedings of material declaration assessment shall be presented in order to examine credibility of such documentation. In addition, assessment authority may have necessity to examine documented compliance procedure. 6.Overview of any information system using in Page 9 of 10
