B & DESCRIPTION OF PROPOSED AMENDMENT Add new requirements that reflect new sub-objectives and functional statements related to protection of the environment and limitations on greenhouse gas emissions. EXISTING 2006 BUILDING CODE PROVISION(S) Part 12 Resource Conservation Section General Application Scope (1) The scope of this Part shall be as described in Subsection of Division A Application (1) This Part applies to resource conservation in the design and construction of buildings. Section Energy Efficiency General Energy Efficiency Design (1) Sentences (2) to (5) apply to construction for which a permit has been applied for before January 1, (2) Except as provided in Sentences (3) and (5) and permitted in Sentence (4), the energy efficiency of all buildings shall be designed to good engineering practice such as described in, (a) the ANSI/ASHRAE/IESNA 90.1, Energy Standard for Buildings Except Low-Rise Residential Buildings and Supplementary Standard SB-10, or (b) the CCBFC, Model National Energy Code for Buildings and Supplementary Standard SB-10. (a) conform to the thermal insulation requirements of Subsection , (b) conform to the thermal design requirements of Subsection , (c) provide a rating of 80 or more when evaluated in accordance with NRCan, EnerGuide for New Houses: Copyright Queen's Printer for Ontario 2011 Page 1 of 7

2 (d) Administrative and Technical Procedures, or conform to Supplementary Standard SB-12. (4) The energy efficiency of a building or part of a building may conform to the design requirements of Subsection if the building or part of the building, (a) is within the scope of Part 9, (b) does not contain a residential occupancy, (c) does not use electric space heating, and (d) is intended for occupancy on a continuing basis during the winter months. (b) buildings intended primarily for manufacturing or commercial or industrial processing Energy Efficiency Design After December 31, 2011 (1) Sentences (2) to (5) apply to construction for which a permit has been applied for after December 31, (2) Except as provided in Sentences (3) and (5), the energy efficiency of all buildings shall be designed to exceed by not less than 25% the energy efficiency levels attained by conforming to the CCBFC, Model National Energy Code for Buildings. (a) meet the performance level that is equal to a rating of 80 or more when evaluated in accordance with NRCan, EnerGuide for New Houses: Administrative and Technical Procedures, or (b) conform to Supplementary Standard SB-12. (4) Reserved. (b) buildings intended primarily for manufacturing or commercial or industrial processing Motion Sensors Motion Sensors (1) Lighting installed to provide the minimum illumination levels required by this Code may be controlled by motion sensors except where the lighting, (a) is installed in an exit, (b) is installed in a corridor serving patients or residents in a Group B, Division 2 or Division 3 occupancy, or (c) is required to conform to Sentence (5). (2) Where motion sensors are used to control minimum lighting in a public corridor or corridor providing access to exit for the public, the motion sensors shall be installed with switch controllers equipped for fail-safe operation and illumination timers set for a minimum 15-minute duration. (a) meet the performance level that is equal to a rating of 80 or more when evaluated in accordance with NRCan, EnerGuide for New Houses: Administrative and Technical Procedures, or (b) conform to Supplementary Standard SB-12. (4) Reserved. (b) buildings intended primarily for manufacturing or commercial or industrial processing Greenhouse Gas (GHG) Emissions and Carbon Dioxide Equivalents (CO 2 e) Limiting Annual Carbon Dioxide Equivalent (CO 2 e) by Design (Provisions referenced below to be read in conjunction with E-B ) (1) The annual CO 2 e emissions from buildings required to comply with Sentence (2) shall meet the requirements of Sentences (2) to (5). (2) Buildings required to comply with Clause (2)(a) shall have an annual CO 2 e less than or equal to that achieved by compliance with Sections 5 to 10 of ANSI/ASHRAE/IESNA 90.1, Energy Standard for Buildings Except Low-Rise Residential Buildings (2010 Edition) and the modifications introduced to those Sections through Supplementary Standard SB-10. (3) Buildings required to comply with Clause (2)(c) shall have an annual CO 2 e less than or equal to that achieved by compliance with Part 1 to Part 7 of Division B of the CCFBC, National Energy Code for Buildings Draft 2011, and the modifications introduced to those Parts through Supplementary Standard SB-10. (4) Buildings required to comply with Clause (2)(b) or (d) and where the annual CO 2 e is reduced by a percentage equal to the percentage required for the reduction in energy use or where the annual CO 2 e is equal or less than levels permitted in Sentence (2) or (3), the building shall be deemed to be in compliance with this Article. (5) For the purposes of this Article, the annual CO 2 e value shall be based on the values given in Table in Supplementary Standard SB-10 Copyright Queen's Printer for Ontario 2011 Page 4 of 7

(2) Buildings required to comply with Clause (2)(a) shall have the same or less peak electric demand than achieved by compliance with Sections 5 to 10 of ANSI/ASHRAE/IESNA 90.1, Energy Standard for Buildings Except Low-Rise Residential Buildings (2010 Edition) and the modifications introduced to those Sections through Supplementary Standard SB-10. (3) Buildings required to comply with Clause (2)(c) shall have the same or less peak electric demand than achieved by compliance with Part 1 to Part 7 of Division B of the CCFBC, National Energy Code for Buildings Draft 2011, and the modifications introduced to those Parts through Supplementary Standard SB-10. 6 RATIONALE FOR CHANGE Problem / General Background Starting with the 2006 edition, Ontario's Building Code has been "objective-based". Prescriptive and performance requirements ("acceptable solutions") set out in the Code are linked to one or more underlying objectives. These objectives are related to safety, health, barrier-free accessibility, protection of buildings, resource conservation, environmental integrity and conservation of buildings. Most objectives include sub-objectives. For example, the resource conservation objective includes sub-objectives which specifically reference the conservation of energy and water. Sub-objectives under the existing environmental integrity objective related to greenhouse gas reduction/climate change mitigation are being included for consideration in this consultation. The change under consideration here would establish greenhouse gas emission performance requirements for large buildings thereby tying into the new objective related to the reduction of greenhouse gas emissions. The sub-objectives involve including requirements and provisions that would conserve energy in order to limit carbon emissions and peak electrical demand. The underlying objectives, together with functional statements that specify what function an element of a building is intended to perform in order to support an objective, can also be used to evaluate innovative "alternative solutions". Municipal Chief Building Officials can approve such solutions provided that they support the objectives and achieve the same that will achieve the level of performance required by the applicable acceptable solutions. Justification / Explanation Potential changes to the Building Code included in the second round of consultation would set out a series of sub-objectives that would include specific reference to limiting greenhouse gas emissions and peak electric demand. The sub-objectives could be used to support Code proposals in these areas, and to create a framework for the evaluation of alternative solutions at the local level. These new sub-objectives would support new acceptable solutions and the approval of alternative solutions that align with government priorities related to greenhouse gas reduction, environmental protection, and reducing pressure on existing infrastructure, including the provincial electrical power grid. The rationale for proposing new sub-objectives under the Environmental Integrity objective is to expand the objective's use beyond on-site sewage systems in order to enable code changes that help to reduce greenhouse gas emissions, pollution and infrastructure insecurity. While the existing Resource Conservation objective makes reference to infrastructure issues, infrastructure capacity issues should be set out as a separate Code sub-objective, given the challenges that Ontario is facing with respect to its current electrical grid, and the "embedded energy" required to construct new infrastructure. Cost / Benefit Implications Negligible additional design work. While there would be no impact when the prescriptive requirements are followed, this proposal would discourage consumption of electricity. Copyright Queen's Printer for Ontario 2011 Page 6 of 7
