2 WORKSHOP: TIME-RELEASE SURVEY Lima, December 2007 Purpose: Know best practices The Time-Release Survey is an item within the Collective Action Plan (CAP) which was approved in the 2005 APEC Sub Committee on Customs Procedures first meeting and is based on WCO Guide to Measure the Time Required for the Release of Goods. Economies coordinating its implementation are Japan, Indonesia and Korea. This workshop is acknowledged as a tool to measure transaction time and costs reduction comprising an aid to find burden in customs procedures in order to improve them. Key Activities: 1. The Workshop: - It was held on 4-5 December 2007, at the DoubleTree El Pardo Hotel (Jr. Independencia 141, Miraflores Lima 18) in Lima, Peru; - Attendance was required and there were experts presentations, group discussion to analysis cases. - The aim was to raise awareness in customs administrations regarding benefits to consider this survey as a support tool for management. 2. Participants: Representatives from different departments were invited to the Workshop, such as National Associated Superintendency of Customs, Customs Technical Operations National Intendency, Information Systems National Intendency, Quality Technical Secretariat, Maritime Intendency of Callao, Air Intendency of Callao, Fiscal Supervision and Customs Duties Collection Management Intendency, Border Control and Prevention of Smuggling Intendency, National Associated Superintendency of Customs Advisors and APEC Logistic Support Group. There were a total of 42 participants in the workshop which lasted 18 hours. 3. Experts and Presentations: Mr. Yasuo Kawai, Nagoya-Japan Customs: TRS Japan Experience and economic challenges for implementation Mr. Tomohiro Kato, Tokyo-Japan Customs: Japan Customs Procedures, authorized economic operators and concurrent control 1
3 Mr. Byun Dong-Ook, Clearance Facilitation Bureau, Korean Customs: Advise on methods to reduce time-release and facilitate legal trade and customs procedures in Korea. Mr. Rafael Reaño, Manager of Procedures, Nomenclature and Operators, representative of Peruvian Customs: Brief description of Peruvian Customs Procedures, government agencies roles regarding clearance procedures applied to goods and transportation means. Mr. Javier Garcia, Quality Technical Secretariat, representative of Peruvian Customs: Peruvian challenges to improve foreign trade competitiveness and Peruvian experience in implementation of Goods Time-Release Survey. 4. Developed Agenda: TRS Concept - WCO Guide to Measure the Time Required for the Release of Goods Mr. Yasuo Kawai made a presentation on WCO Guide to Measure the Time Required for the Release of Goods. He outlined aspects that should be considered to measure average time and aspects to determine required time assessment. He also reported on advantages and outcomes for Customs Administrations using TRS and highlighted some methodologies to follow to efficiently use proposed tool. To measure average time: - Between goods arrival and release; - Determine efficiency in customs clearances; - Compare different measurements in customs offices; - Assess client s affreightment and other pre-established work rules; - Identify barriers To determine: - If there are problems or delays in goods clearance customs processing; - Kinds of problems/delays; - Reasons for problems/delays; - Possible solutions to any problem. Support Customs Administrations to: - Identify limits affecting customs release; - Obtain a general perspective according to its functions; - Consider possible solutions in partnership; - Compare survey outcomes with prior surveys to measure effect in new procedures; - Identify areas requiring procedure simplification. Outcomes: - Restructure within administration; - Elaborate or modify customs legislation; - Simplify and automate customs procedures; - Reassign resources - Start measures to improve enforcement or detection - Resolve matter with other agencies involved in goods clearance. 2
4 Designate a working group: members maximum; - Directive officials in Customs shall be in charge; - Trade agents and operators shall participate and be involved; - The Project responsibles shall decide the scope and the design of project; TRS Software: - It was developed together with World Bank founded by Japan (known as TR Software) - Automated System assess the average release time and a standard deviation - Include source code for administrations to adopt it according their requirements - Available for dissemination Customs Procedure in Japan Authorized Economic Operators: Mr. Tomohiro Kato, - Customs of Tokyo, Japan: Customs procedure in Japan, authorized economic operators and concurrent control. In Japan, clearance in any time is the most important. The release could be delayed if it is done at midnight upon importer s request. Examination and document review can not be done in that moment by Customs. In 2001, The Government of Japan had two days maximum as general parameter. A time was not established, we use a process, the TRS as tool for cargo procedure. Japanese Customs use manual controls. In 2007, Framework of AEO Programs as a sustained reform in Customs and Business sector partnership was established. AEO Program Reform for importers/exporters and introduction to the warehouse operators. Conditions and requirements for AEO and for validation process and authorization procedure were explained. Also, benefits for importers, exporters and authorized operators of warehouse were mentioned. Korean experience on TRS and economic challenges for implementation. This presentation was interesting because we can know how Korean Customs Services implemented TRS surveys, whose outcomes support the TRS tool efficiency as a good management instrument by outcomes for customs administrations, benefiting trade facilitation. It was briefed that Korea has a Balanced Scorecard maintained in the Balanced Scorecard (KCS BSC) where participants with a user and password can check on line arrival and release times. According the before mentioned, it was noted that Korean System is too heavy and it is unlikely to be used in other countries as each Customs administration has its own situation. 3
5 Another system that support logistic control in Korean Customs is CLIS which contains logistic information and supports in the innovation promotion of trade logistics used by Trade community. Experiences in Korean Customs on TRS and impacts TRS was established in automated system which assesses total time of a cargo from port arrival to release by client. It can be seen by internet and clients use it by this means. TRS surveys allows Korea to improve logistic competitiveness from foreign trade operators and governmental institutions which participate in Customs clearance process obtaining an effective process of cargo and a trust increase by all participants. Customs Procedure in Korea Customs Procedure in Peru A presentation on regime processes and customs operations was carried out according to current legal rules. Import regime procedures and definite export were highlighted. It was informed about roles and participation of Agencies of government in clearance procedures applied to goods and means of transportation. Peruvian challenges for improving foreign trade competitiveness A time clearance survey in Peru which was carried out with the methodology of Quality Management System was presented. It is briefed Scopes and how the information within the clearance process was generated, considering participation from different participants. The issued evaluation comprised survey carried out in Maritime Customs Intendency in 2006 since cargo arrival to release authorization. In the phase corresponding to document presentation to Customs, it is noticed that 45% clearance delays less than 48 hours and the remaining 55% delays between 2-7 hours as there are incidences and notifications. 5. Conclusions TRS Survey allows us to determine: - Know and apply WCO TRS methodology - Identify in customs clearance of goods any problems/existing delays - Types and reasons of problems/delays and its possible solutions - Identify restrictions which affect Customs release. - Consider possible solutions in cooperation with other sectors - Make a comparison between Survey outcomes and prior outcomes in order to propose new ones or improve procedures. 4

Korean experience on TRS and economic challenges for implementation Customs Procedure in Japan Authorized Economic Operators Korean Customs experience on TRS and its impacts Customs Procedure in Korea Customs Procedure in Peru Peruvian challenges for improving the foreign trade competitivity Discussion on effective implementation of TRS 3 TRS WORKSHOP SUMMARY LIMA PERU - In 2007 Japan Customs established the framework of Authorized Economic Operators (AEO) Program for importers, exporters and warehouse operators as supported reform in Customs and Business Partnership; Currently eight TRS has been carried out, the last one in 2006, which have allowed to improve the administration in customs clearance process in sea an air cargo. - Korean Customs established TRS in its automated system which estimates the total time from the cargo arrival to the port until its clearance by the client; It has a Balanced Scorecard (BSC of KCS), and also CLIS system on logistics information where users can check clearance time by Internet. 4 2
8 TRS WORKSHOP SUMMARY LIMA PERU - Peruvian Customs made a presentation on Customs Procedures and import and export processes flows considering Peruvian legislation. - There was a briefing on roles and participation of other government agencies in import and export clearance procedures applied to goods and transportation means. - There was a briefing on Time-Clearance survey made with a methodology created by Peruvian Customs and on its outreach and how information was generated within clearance process by sea from cargo arrival to goods release. 5 TRS WORKSHOP CONCLUSIONS LIMA PERU 2007 TRS survey allows us to: - Know and apply the WCO TRS methodology; - Identify existing problems/delays in Customs clearance of goods; - Types and reasons of problems/delays and their possible solutions; - Identify limitations which affect Customs release; - Consider possible solutions in cooperation with other sectors; - Compare survey outcomes with prior surveys in order to propose new procedures or improve these. 6 3
