7 Key dates 1 April 2014 Operators can apply to Maritime New Zealand to enter the MOSS system 1 July 2014 Operators must comply with the new MOSS rules.
8 Most commercial operators in NZ waters will be in MOSS If an operation is NOT covered by: ISM SOP Safety Case Barge Safety Certificate then it WILL be covered by MOSS
9 MOSS also applies to surveyors From 1 July 2014 a person must hold a Certificate of Surveyor Recognition to: survey a ship for the purpose of issuing a Certificate of Survey or issue a Certificate of Survey.
10 MOSS Transition a staged approach Operators, vessels and surveyors are deemed to be in MOSS on 1 July 2014 based on their current SSM status Operators, vessels and surveyors are then required to apply for full MOSS entry once their SSM status expires.
11 Operators On 1 July 2014, if an operator has a valid SSM Certificate, their operation will automatically be in MOSS. Their SSM certificate will become a deemed Maritime Transport Operator Certificate. The operator won t have to do anything at this stage but they MUST continue to: be a fit and proper person meet the requirements associated with their SSM Certificate have valid fit for purpose certificates for each vessel From 1 July 2014 operators are no longer required to be a member of an SSM company.
12 Surveyors Current SSM recognised surveyors On 1 July 2014, all current SSM recognised surveyors will automatically be in MOSS. Their SSM recognition will be deemed to be a MOSS recognition. After 6 months (31 December 2014 is when SSM recognition expires) all surveyors wishing to continue to work under MOSS must have applied for and be issued a MOSS Certificate of Surveyor Recognition. New surveyors Any new surveyors must apply for and be issued a MOSS Certificate of Surveyor Recognition from the time they wish to commence surveying ships.
13 When are MOSS certificates required? Operation An operation needs a Maritime Transport Operator Certificate when: the vessel s SSM certificate expires (single-vessel operations) the first SSM certificate in the operation expires (multi-vessel operations) Vessel(s) A vessel needs a Certificate of Survey when: its Fit for Purpose certificate expires OR its SSM certificate expires OR it reaches an inspection date (vessel survey) under its SSM maintenance plan
14 Operators - from 1 July 2014: operating under a deemed certificate While operating under a deemed certificate operators must continue to meet their requirements associated with their SSM Certificate - as if rule 21 had not been revoked (but no longer a member of the SSM company) From 1 July 2014 MNZ will undertake audit activity formerly carried out by their SSM company (against rule 21 reqs) The operation does not have to comply with Parts B and C of rule 19 Operators should start your Maritime Transport Operator Plan to apply for a Maritime Transport Operator Certificate in time
15 Operators under a Maritime Transport Operator Certificate Carry out the Operator Plan as documented Ensure the Operator Plan continues to be up to date Obtain MNZ approval for changes to maritime transport operator details in my plan Notify MNZ when a ship enters or exits the operation Keep a copy of the Operator Plan on-shore AND ship specific safe operating procedures on board Ensure each ship continues to meet the requirements of the rules Maintain employee qualifications and training records as part of the operator plan
16 Operators under a Maritime Transport Operator Certificate (cont) Ensure the log is carried on board at all times and includes any non-commercial use Ensure that ships operate with a valid certificate of survey Ensure a recognised surveyor completes surveys for each ship when required Ensure all corrective actions given by the surveyor are completed Display the certificate of survey for each ship >6m on the vessel in a prominent position
17 MOSS Entry - what operators need to do Operators need to provide the following: Maritime Transport Operator Certificate application form Fit and proper person application form(s) Operator Plan Application fee The assessment of the Maritime Transport Operator Certificate application will take up to three months

24 What an audit is not An audit is not: Survey SSM compliance check Assessment Site visit Inspection Investigation
25 Audit For operators who are issued with Maritime Transport Operator Certificates MNZ will use a risk-based approach to determine audit frequency First audit not more than 2 years after award of Maritime Transport Operator Certificate Subsequent audits not more than 4 years apart For operators with deemed Maritime Transport Operator Certificates MNZ will seek to follow the existing SSM audit cycle (but may choose to amend that if appropriate)
