5 Cultural change under a National System

6 The National Law & its instruments National Law & regulations set out the general safety obligations and requirements for domestic commercial vessel (DCV) operations. Marine Orders: detail the requirements for obtaining National Law certification. point to the National System Commercial Vessel (NSCV) as the standard that applies to DCV for design, construction, stability, operations, crewing and qualifications.

7 Safety Management Systems (SMS) Operators must have a Safety Management System (SMS). It is not about ticking a box. Its about understanding your risk in your operation and making changes to remove or minimise risk. We want to make sure people go home safe each and every day. 8 What does Grandfathering mean? Grandfathering : - is an arrangement where existing permissions, approvals or conditions made under a previous state or territory law are automatically recognised under the National Law - no need for further action by vessel owners - includes the applicable design, construction and survey standards as well as the crewing arrangements

9 When does a vessels grandfathered status change? An existing vessel is only taken to be a new vessel if the National Regulator considers that: it has been altered to an extent that it must be reassessed for construction, sub-division or stability; or its operations have changed so that there is an increased level of risk or it changes its operational area this will be assessed based on risk.

Now achievable under a national system: Single qualification system (potentially including NZ) One vessel survey regime with services provided by 3 rd parties on a competitive pricing basis remember you are the client! Single approach to developing and maintaining standards Standards that are applicable to the circumstances and address the risk Other safety approaches such as PLBs & AIS for high risk operations Need to identify safety risks when considering fisheries management measures
