4 Expression of Interest for empanelment of plantations agencies undertaking plantation and maintenance work along the National Highways 1. Objectives of this Expression of Interest (EoI) The objective of this EoI is to solicit applications from the eligible (qualifying eligibility norms as per this EoI) for empanelment as Plantation Agency. The agencies which are empanelled through this process will be eligible to participate in project specific RFPs that will be released by NHAI from time to time for undertaking roadside plantations, landscaping, beautification and maintenance works along National Highways. The EoI intends to bring out the details with respect to scope of services that are deemed necessary in the opinion of NHAI to share with the interested/eligible agencies. 2. EoI Issuing Authority This EoI is being issued by Green Highways Division - NHAI for inviting expression of interest from interested/eligible agencies for empanelment. The decision of GHD with regard to the short-listing of agencies through this EoI shall be final and GHD reserves the right to reject any or all the applications without assigning any reason whatsoever, and no agency shall object/protest/demur/challenge the said decision of GHD in any manner whatsoever and no solicitation in this regard shall be entertained by GHD. About Green Highways Division NHAI Under the aegis of the Green Highways (Plantation, Transplantation, Beautification & Maintenance) Policy 2015, Green Highways Division (GHD) under NHAI has been entrusted with the task for implementing entire green highways program for the MoRTH, NHIDCL and NHAI. 3

Green Highways (Plantation, Transplantation, Beautification & Maintenance), Policy 2015 (GHP 2015) Ministry of Road Transport & Highways, Government of India has recently promulgated Green Highways (Plantation, Transplantation, Beautification & Maintenance) Policy-2015, with the vision of developing eco-friendly highways with farmers, NGOs, private sector, institutions, government agencies and the Forest Department for economic growth and development in a sustainable manner. The objectives envisaged from the implementation of GHP 2015 are as follows:- i. evolve a policy frame work for plantation along National Highways. ii. reduce the impact of noise and air pollution as trees and shrubs are known to be natural sink for air pollutants iii. provide much needed shade on glaring hot roads during summer iv. arrest soil erosion at the embankment slopes v. prevent glare from the headlight of incoming vehicles vi. moderate the effect of wind and incoming radiation vii. create employment opportunities for local people The Policy document is available on the Ministry s website Thus, all works to be carried out pursuant to and in relation to this EOI, shall be under the spirit of GHP and the amendments thereof. 5. Scope of Work Agencies found eligible for empanelment will be eligible for participating in project specific RFPs (for plantations, landscaping, beautification and maintenance works on different stretches of National Highways) that will be published by NHAI from time to time. 6. Who can apply? All the Plantations agencies such as Private Limited Company, Proprietorship Firm, Cooperative, NGOs, Registered Societies, SHGs, Gram Panchayats, JFMCs, Watershed Committees, etc. having qualified manpower, experience and expertise in 4

6 Plantations/ Transplantation/ landscaping and maintenance can apply empanelment. for 7. Eligibility Criteria Given below is the eligibility criteria for different types of agencies. However, all the type of agencies as mentioned below should not be facing any kind of winding up/ dissolution/ criminal proceedings, as the case may be, detrimental to the objective sought to be achieved under this EoI. S Resources Technical Eligibility Criteria no 1 Team Leader 1. Minimum 3 years of Experience in Plantation / Transplantation / Landscaping Activities 2. Educational Qualification: Post Graduation / Graduation in Forestry / Agriculture / Horticulture or other relevant stream. 2 Team Supervisor 3 Team Members 1. Minimum 2 years of Experience in Plantation / Transplantation / Landscaping Activities 2. Educational Qualification: Post Graduation / Graduation in Forestry / Agriculture / Horticulture or other relevant stream. 1. Minimum 1 year of Experience in Plantation / Transplantation / Landscaping Activities Minimum work experience criteria Experience of implementing plantation / horticulture / landscaping work of minimum Rs 5 lakh. Other eligibility norms : 1. Any agency whether registered Company, Proprietorship Firm, NGOs, etc will be eligible for empanelment subject to fulfilment of following norms NGOs/ Trusts are required to be registered under NGO Darpan portal of Govt. of India. MSME/ Start-ups are required to be registered under Udyog Adhaar portal of Govt. of India Agency has to submit work order and work completion certificate for considering their previous work experience. Start-ups are exempted from work experience criteria, however technical eligibility criteria as prescribed above shall be fulfilled. 5

7 Important Condition 1. Consortium will be required to submit a legal joint venture certificate along with affidavit for a lock in period of 2 years. Consortium can have a maximum of two members with minimum stake of 26 % with each member. 2. The proposed technical team composition will be for plantation work up to 10 km. Number of technical resource person will be increased as per the scope and requirement of the project. Same will be prescribed by GHD in project specific MoU to be signed with agencies. 3. One resource person can only be part of one agency. If duplicity of same resource person is found in more than one agency, then credentials of that particular resource person will not be considered by GHD. 4. All necessary documents that are to be submitted along with empanelment application is mentioned in Format enclosed at Annexure -1. Relevant Work Experience Plantation agencies should have completed plantation projects of minimum Rs 5 lakh project cost. *STARTUPs will be exempted from work experience qualifications, but they will be required to fulfill technical credential criteria. 7.2 Empanelment of Community Based Organizations/LSGs such as FPOs/ SHGs/ JFMCs/ Watershed Committees/ Gram Panchayats etc. Community Based Organizations/ LSGs will be considered for empanelment based on the accreditation received from Revenue/Forest/ Horticulture Department or RO/PIU office of NHAI. Coverage of the proposed work EoI can be downloaded from the website ( under Empanelment section. The applicants are expected to examine all instructions, application form, terms, requirements and other details in the EoI documents. Failure to furnish complete information as mentioned in the EoI documents or submission of application not substantially responsive to the EoI document in every respect will be at the applicant s risk and may result in rejection of the application. 6

EoI Processing Fee A non-refundable processing fee of a) Rs. 2500/- in case of companies and proprietorship firm, b) Rs.100/- in the case of SHGs / JLGs/ Watershed Committees; and JFMCs c) Rs. 500/- for all other eligible agencies (NGOs, Cooperative, Registered Society) In the form of a Demand Draft or Pay Order or Banker s Cheque drawn in favour of the National Highways Authority of India payable at New Delhi has to be submitted along with the application. Applications received without required EoI Processing fees will not be considered for evaluation. 9. Documents to be uploaded along with empanelment application 9.1 Certificate of registration and other relevant document such as MoA, AoA, and Income Tax return of last financial year. (CBOs/LSGs are only required to submit registration document along with accreditation from Collector/Forest Department/Horticulture Department or RO- NHAI/MoRTH. 9.2 Relevant document in support of work experience such as Work Order, Work Completion, Photographs of plantation site. CBOs/LSGs/ Start Ups are not required to submit work experience certificate. 9.3 Detailed CV of Team Leader, Team Supervisor and other members along with relevant experience and education qualification documents. 9.4 Affidavit certifying that all the information submitted by the agency is true to best of his/her knowledge. 9.5 Scanned copy of Demand Draft 10. Last date for submission of proposals and Opening of Proposals Applications, complete in all respects as specified in the EoI, must be submitted online on latest by 05:00 PM on 15/02/2018. After which the online empanelment process will be closed. Further Original Copy of Demand 7

9 Draft / Bankers Cheque shall reach GHD office not later than 05:00 PM on 20/02/2018 at the following address: Green Highways Division - NHAI First Floor, MTNL Building Sector 19, Dwarka, New Delhi GHD may, in exceptional circumstances and at its discretion, advance or extend the last date for submission of applications by issuing an addendum to be made available on the GHD website A prospective applicant requiring any clarification on the EOI document may request GHD through at nationalgreenhighways@gmail.com on or before 05:00 PM 10/02/2018. Requests received for clarification within the stipulated date, which are found relevant in the opinion of GHD for submission of EOI will be replied by GHD. In the event, no reply/clarification is provided by GHD latest by 12/02/2018, it shall be deemed that such clarification as sought by the prospective Applicant is unsolicited for and GHD shall not be obligated to make any correspondence in this regard to such prospective Applicant. At any point of time prior to the deadline for submission of Application, GHD reserves the right to modify/amend any content(s) of this EoI by issuing an addendum (the Addendum). Any Addendum thus issued will be put up on the website. In the event of issuance of such Addendum, GHD may extend the Application deadline in order to afford the prospective/intending Applicants reasonable time to take into consideration the Addendum while applying for this EoI.. However, agencies who have already submitted their registration application pursuant to the release of this EoI, need not apply again. 10 11. Conditions under which this EoI is issued i. This EoI is not an offer and is issued with no commitment to empanel any or all the applicants. GHD reserves the right to withdraw the EoI and change or vary any part thereof at any stage. GHD also reserves the right to disqualify any applicant, if necessary, at any stage. ii. GHD reserved the right to call fort site specific proposals from empanelled agencies for further short-listing and accordingly the formal award of work will be issued to shortlisted agencies by GHD, iii. Timing and sequence of events resulting from this EoI shall ultimately be determined by GHD. iv. No oral conversations or agreements or promises or assurances by/with any official, agent, or employee of GHD shall affect or modify any term of this EoI and any alleged oral agreement or arrangement or promise or assurances made by/with an applicant shall be treated as binding on GHD unless a definitive agreement is executed and affected resulting out of this EoI process. v. Neither the applicants nor any of the applicants representatives shall have any claims whatsoever against GHD or any of their officials/employees, agents, consultants and their respective employees arising out of, or relating to or concerning this EoI or these procedures. vi. Applicants who are found to canvass, influence or attempt to influence in any manner the qualification or selection process for empanelment, including without limitation, by offering bribes or other illegal gratification, shall be disqualified from the process at any stage and also shall be debarred from the future processes for specific period as may be decided by GHD and besides, in such cases, GHD shall be at liberty to draw appropriate legal proceedings against the delinquent applicant. vii. Each applicant shall submit only one application against the invitation for EoI. viii. One resource person can only be part of one agency. If duplicity of same resource person is found in more than one agency, then credentials of that particular resource person will not be considered by GHD. ix. GHD reserves the right to call project specific EoI for implementing technical tasks such as Hydroseeding/Transplantations. 9

11 x. GHD reserves the right to verify original documents of the applicants at any point of time, which shall not be questioned or objected in any manner by the applicant agencies. xi. Disputes relating to or concerning or arising out of this EoI shall be subject to the exclusive jurisdiction of courts in Delhi only. xii. The Head - GHD or on his behalf, his duly appointed/nominated person/agent, shall be the only competent authority to interpret the contents, words, sentences, terms and conditions etc. of this EoI and the interpretation of Head - GHD or on his behalf, of his duly appointed/nominated person/agent, shall always prevail and shall be binding on the applicants. xiii. If, on verification, any of the information provided in the EoI is found to be misleading or any document is found to be forged or tampered or any concealment of material information/substance is detected during the short listing process or any other stage thereafter resulting out of or concerning the objective of this EoI, the applicant / agency shall be liable to be dismissed from the selection process or, if already selected, or already awarded contract for execution of a project, in that case, 12. Rights to the content of the proposal For all the applications received before the last date and time of submission, the proposals and accompanying documentation of the application will become the exclusive property of GHD and will not be returned to the applicants. GHD is not restricted in its rights to use or disclose any or all of the information contained in the proposal and accompanying documents and can do so without consideration of compensation of whatsoever kind to the applicant. GHD shall not be bound by any language in the proposal or in any other document indicating its confidentiality or any other restriction on its use or disclosure. 13. Acknowledgement of Understanding of Terms By submitting application, each applicant shall be deemed to acknowledge that one has carefully read and understood all sections of this EoI, including application form, schedules and annexure hereto, and has fully informed itself as to all the existing terms and conditions and limitations and unconditionally and irrevocably accepts all 10

12 the terms and conditions and limitations of this EoI, being fully aware about the intent and purpose thereto. 14. Language The Application and all related correspondence and documents should be written in English/Hindi language. In case, if the supportive documents are in regional/ local language, a duly translated and self-attested copy has to be sent. 15. Application Procedure An applicant agency may submit their application online on However, Demand Draft / Banker s Cheque in original shall be sent by Speed Post / General Post. The last date of receiving Speed Post / General Post is Appraisal of EoI applications GHD shall adopt such mode/procedure as may be deemed proper for the purpose of determining the appraisal of the Applicants. GHD reserves the right to call for any additional information or document or seek clarification at any point from the applicant for appraisal of EoI. 17. Empanelment Procedure The agencies qualifying in respect to eligibility criteria stipulated in para 7 of this document will be empanelled with GHD. Successful agencies will be issued a formal letter confirming their empanelment. The list of empanelled agencies will be declared and displayed on the website The GHD is not obligated to notify any unsuccessful agencies about the reasons of their being unsuccessful. 18. Period of validity of empanelment Empanelment of agency will remain valid till such time, NHAI intends to take up roadside plantation works. However, agency may be removed from the panel either on its own request by providing at least 15 (Fifteen) days notice in writing to GHD or on the motion of GHD, if at any point of time, GHD is of the opinion that the 11

13 empanelled agency has acted contrary to the spirit of this EoI, which includes without limitation breach/violation of terms and conditions of this EoI. 12
