2 NOTICE TO BIDDERS Competitive sealed proposals for Professional Janitorial Services will be required to be received at: Trophy Club Municipal Utility District No Municipal Drive Trophy Club, Texas by the following day and time: April 5, 2013 at 5 p.m. Proposals submitted to Trophy Club Municipal Utility District No. 1 (TCMUD) for consideration must be clearly marked on the outside of the sealed envelope with the words: Professional Janitorial Services Attention: Terri Sisk Professional Janitorial Services RFP documents will be available online at or in person at 100 Municipal Dr., Trophy Club, T Information requests can be made to Terri Sisk at or tsisk@tcmud.org. TCMUD reserves the right to reject any or all proposals and waive any or all irregularities. Proposals shall be valid for a period of sixty (60) days from the date proposals are opened. 2

4 SECTION ONE: SCOPE OF SERVICES A. PURPOSE Trophy Club Municipal Utility District No. 1 (TCMUD) is requesting proposals from qualified, bonded janitorial companies for professional janitorial services. Minimum specifications and general conditions are detailed in this Request for Proposal. B. WORK TO BE PERFORMED Janitorial services are to be performed at the follow facilities, totaling 13,960 square feet (Police Department Building is not presently being used; services will begin there when it becomes occupied): FACILITY SQ FT FREQUENCY Main TCMUD Building 5, Days/Wk, Tuesday & Thursday Public Services Building 4,200 2 Days/Wk, Tuesday & Thursday Police Department Building 4,100 2 Days/Wk, Tuesday & Thursday (*Future Modular Building) C. TCMUD is a municipal utility district that provides water, wastewater treatment and fire protection to the Town of Trophy Club and parts of Solana in the Town of Westlake. 4

5 SECTION TWO: CONTRACT PERIOD & RENEWALS A. This Contract will contain two distinct time frames. The first time period is to begin on May 1, 2013 and run to September 30, The second time period is to begin October 1, 2013 and end September B. At the end of the second time period Contract, TCMUD has the option to extend the Contract for four (4) additional one-year periods (Oct-Sep). TCMUD reserves the right to reconsider the Contract on an annual basis and notify BIDDER if TCMUD will be continuing the Contract. C. Pricing stated in response to TCMUD s RFP shall remain valid during the term of the Contract unless the scope of work required changes during the Contract. If the scope of work changes during the Contract term, then the pricing will be renegotiated between BIDDER and TCMUD. D. Should BIDDER initiate a price increase for professional janitorial services, BIDDER shall notify TCMUD in writing of such price increase. Should TCMUD choose not to accept BIDDER s proposed price increase, TCMUD shall give BIDDER THIRTY (30) DAYS WRITTEN NOTICE THAT THE CONTRACT SHALL TERMINATE. E. Either party may terminate the Contract for convenience at any time upon THIRTY (30) DAYS WRITTEN NOTICE. F. BIDDER shall not subcontract or assign Contract to anyone, in whole or part, without the prior written consent of TCMUD. Such consent, if granted, shall not relieve the original BIDDER of any responsibilities under the terms of the Contract. G. BIDDER shall be an independent contractor and not an agent of TCMUD. 5

6 SECTION THREE: SUPPLIES, MATERIALS & EQUIPMENT A. BIDDER will be required to supply the following consumables: toilet paper, paper towels, and plastic trash liners. BIDDER shall also supply all tools, cleaning supplies, materials and equipment necessary to perform the work as specified. BIDDER shall maintain all tools and materials in good repair. BIDDER shall be held liable for any and all damages caused by improper use and/or maintenance of tools, supplies and materials. B. TCMUD shall not be responsible in any way for any damage that may occur by fire, theft, accident or otherwise, to BIDDER s supplies, materials or equipment on TCMUD s premises nor shall TCMUD be responsible for any personal belongings brought on or into TMCUD s premises by BIDDER s employee(s). SECTION FOUR: SAFETY REQUIREMENTS A. BIDDER shall be responsible for complying with the provisions of the Texas Hazard Communication Act, Texas Health & Safety Code, Section including but not limited to providing notice to employee of the Act and its provisions, conducting at least annual education and training to employees, developing a work place chemical list, preparing appropriate paperwork and documentation, and all other requirements of the said Act. B. BIDDER shall comply with all protection measures prescribed in the 2009 International Fire Code, a copy of which is on file in the Office of the Fire 6

7 Marshall. All sweeping compounds, dust cloths, and mop treatment materials, and floor treatment materials (exclusive of waxes) shall be products that are free of spontaneous heating tendency. BIDDER shall not store combustible supplies, including but not limited to rags and paper, near possible sources of ignition. BIDDER shall consider contaminated buckets, mops, cloths and brushes as potentially subject to spontaneous heating/combustions and shall not store such items in TCMUD s buildings. SECTION FIVE: BIDDER S PERSONNEL A. BIDDER should be established in the business of janitorial services for a minimum of three (3) continuous years. B. BIDDER shall furnish sufficient qualified, trained and experienced personnel to perform the work as specified. UPON SELECTION, BIDDER SHALL SUBMIT TO TCMUD THE NAMES OF EMPLOYEES ASSIGNED TO EACH OR ALL BUILDINGS. ALL BIDDER EMPLOYEES WILL BE SUBJECT TO ADDITIONAL BACKGROUND CHECKS DONE BY THE TROPHY CLUB POLICE DEPARTMENT. C. All BIDDERS employee s will be interviewed and personally screened by BIDDER s employing office before (s)he is employed by BIDDER and assigned to TCMUD s buildings. The following employee records shall be kept by BIDDER and shall be available to TCMUD during business hours Monday through Friday and at such other times as an emergency may demand: Employees application for employment including I-9; Termination record chart; 7

8 Timecard showing employee s name & hours worked in TCMUD s buildings Other employee records BIDDER usually maintains D. All of BIDDERS personnel assigned to TCMUD buildings must be satisfactory to TCMUD. If any personnel are unsatisfactory, TCMUD reserves the right to request and receive replacement personnel. E. BIDDER must be available by telephone or during business hours in order to address in a satisfactory manner, any and all problems in connection with the providing of professional janitorial services. F. BIDDER s employees shall be responsible for reporting any unusual or suspicious event or presence to the BIDDER who shall report such event or presence as soon as possible to TCMUD. G. BIDDER shall secure each exterior building door at the beginning of the cleaning shift and work behind locked doors while cleaning TCMUD s buildings. BIDDER shall lock and secure TCMUD s buildings upon conclusion of each cleaning shift. BIDDER will be provided with appropriate items for entry whether badge and/or keys. H. BIDDER is not permitted to allow any person, known or unknown, into TCMUD s buildings at any time with the exception of BIDDER S employees employed by BIDDER to perform work as specified. I. BIDDER shall not use desk phones or any office equipment in TCMUD s 8

9 buildings. Food, food supplies, and kitchen supplies in TCMUD s buildings shall not be consumed or removed by BIDDER S personnel. J. BIDDER shall turn off all lights at the end of the cleaning shift, leaving only designated lights on. BIDDER shall maintain the janitor closet(s) in a clean orderly condition. K. BIDDER will not duplicate any keys for the term of Contract with TCMUD. In the event a key is broken, BIDDER will immediately bring the broken key to TCMUD for replacement. BIDDER warrants and ensures the safekeeping of all badges and building keys issued to BIDDER and/or employees by TCMUD for the purposes of performing the work as specified in this RFP. L. All of TCMUD s buildings are tobacco-free. The use of tobacco products inside TCMUD s buildings is prohibited. SECTION SI: PROTECTION & DAMAGE A. BIDDERS performing work on TCMUD property shall provide a certificate of insurance evidencing the coverage and coverage provisions identified herein. BIDDERS shall provide evidence that all subcontractors performing work shall be included under the contractor s policy. TCMUD may require a certified copy of the policy. B. ALL INSURANCE COMPANIES, COVERAGE AND BONDING MUST BE ACQUIRED FROM INSURERS AUTHORIZED BY THE TEAS DEPARTMENT 9

10 OF INSURANCE TO TRANSACT BUSINESS IN THE STATE OF TEAS AND MUST BE ACCEPTABLE TO TCMUD. C. Listed below are the types and amounts of insurance required. TCMUD reserves the right to amend or require additional types and amounts of coverage or provisions depending on the nature of the work: TYPE OF INSURANCE AMOUNT PROVISIONS Commercial General (Public) Liability to include coverage for: a. Contractual Liability Business Auto Liability Worker s Compensation & Employers Liability $500,00 Each Occurrence & $1,000,000 General Aggregate; Or $1,000,000 Combined Single Limits Minimum limits as required by the State of Texas Statutory Limits- Minimum $100,000 Each Accident Trophy Club Municipal Utility District No.1 is to be listed as additional insured and provided with a thirty (30) day notice of cancellation or material change in coverage. Contractor s insurance shall be primary N/A TCMUD to be provided with a waiver of subrogation. 10

11 SECTION SEVEN: QUALITY CONTROL A. Variance in schedule shall require PRIOR APPROVAL from TCMUD. B. Inspections of all contracted locations will be made by BIDDER on a regular basis. C. TCMUD will maintain a system for recording complaints concerning nonperformance of work as specified. TCMUD will communicate all complaints to BIDDER and request the complaint be corrected. Failure to take corrective action within a reasonable time may result in the work being undertaken by others and the resulting cost charged to the BIDDER. MORE THAN THREE (3) COMPLAINTS OF SIMILAR NATURE WITHIN A TIME SPAN OF THIRTY (30) DAYS WILL BE DEEMED UNSATISFACTORY WORK PERFORMANCE. D. If it is determined by TCMUD that BIDDER has failed to perform the work as specified, an amount proportionate to the related effort and/or expense may be deducted by TCMUD from the BIDDER s monthly payment, and TCMUD shall notify BIDDER of TCMUD s intent to deduct such expense in writing or TCMUD, at its option, may impose a monetary penalty should failure to perform in accordance with the contract occur. Penalties will be as follows: FAILURE TO PROVIDE SERVICE ON SCHEDULED TIMES/DATES: $250 PER EVENT FAILURE TO KEEP ANY SERVICES FACILITY SECURED BOTH DURING AND AFTER PROVIDING SERVICES: $500 PER EVENT E. If BIDDER s performance is found to be unsatisfactory a second time as per the terms in this contract, immediate termination of the contract may result. 11

12 SECTION EIGHT: SPECIFIC PROPOSAL REQUIREMENTS A. All proposals must be received by TCMUD prior to April 5, 2013, 5:00 P.M. B. Proposals submitted must include the following: BIDDER Information Form - Appendix C General Work Plan showing the number of personnel to be used, the equipment to be used and how the work will be done. Three Current References - Appendix D Proposal Cost Detail Form - Appendix E Conflict of Interest Questionnaire-Appendix F Proposals must be signed by the BIDDER with a full signature. If the BIDDER is a partnership or corporation, the proposals must be signed by a person having the authority to bind the company. BIDDERS shall submit THREE (3) ORIGINAL proposals. Proposals may be hand delivered, mailed or scanned with an original signature and ed to tsisk@tcmud.org C. 13 D. Submitted proposals will be evaluated by a Selection Committee and will be evaluated using the following weighted criteria: Price 70% Operational Plan (Personnel & Equipment) 15% Experience & References 15% E. The Selection Committee will make a recommendation to the District s Board of Directors at the April 16, 2013 Board meeting. The recommended BIDDER will be invited to attend the meeting. F. BIDDER selected by the Board of Directors will receive written notification and a contract will be executed by May 1, The District s Board of Directors has authority to approve the recommended BIDDER, select another BIDDER, and/or reject all bids. G. All proposals not containing the required information or received after the submission deadline will rejected as non-responsive. TCMUD is not responsible for the non-delivery of mail and the date/time it is received at TCMUD shall be the official time receipt. H. TCMUD is exempt by law from payment of Texas Sales Tax. DO NOT INCLUDE TA IN THE PROPOSAL. I. TCMUD may choose to reject all proposals and not award any contract. If TCMUD does not award a contract within thirty (30) days following the submission deadline, all proposals are deemed to be rejected by TCMUD. 13

14 J. The BIDDER shall comply with all insurance requirements as specified within this RFP. Failure to meet such requirements shall disqualify the BIDDER from award. If selected, BIDDER shall be required to submit a valid insurance certificate within ten (10) days of selection. K. THE BIDDER SHALL INDEMNIFY, DEFEND, AND HOLD TCMUD, ITS OFFICERS, AGENTS AND EMPLOYEES HARMLESS FROM ANY LIABILITY, CLAIMS, SUITS, ACTIONS, CAUSES OF ACTION, COSTS, EPENSES, CHARGES OR FEES, INCLUDING ATTORNEY S FEES, FOR INJURY TO ANY PERSON (INCLUDING DEATH) OR DAMAGE TO OR DESTRUCTION OF ANY PROPERTY; AND, ANY ACT OF OMISSION OF BIDDER, ITS BIDDERS, SUBCONTRACTORS, SUPPLIERS, OR AGENTS, IN CONNECTION WITH OR ARISING OUT OF, WHETHER DIRECTLY OR INDIRECTLY, THIS AGREEMENT. 29 APPENDI B: CLEANING SPECIFICATIONS A. Trash Collection & Removal Empty all waste containers and replace the trash liners. B. Recycling Collection & Removal Collect all recycling containers located in each building near the main copier and place them outside in the designated area for trash pickup on Fridays. C. Dusting & Furniture Maintenance Wipe dust from all office furniture, fixtures and accessories with treated dust cloth, sheepskin duster or feather duster. Wipe dirt, fingerprints, smudges, etc. from all horizontal and vertical surfaces of file cabinets, desks, ceiling fans, tables, chairs and furniture using a dusting cloth. Wipe all chair arms, backs, bases, and legs free of dust, dirt, soil marks, etc., using a clean cloth. Wipe dust from all window coverings. Sanitize telephones. D. Remove fingerprints, smudges and graffiti from: Exit/Entrance/Passage Doors, Door Frames, Door Handles/Knobs, Thresholds, Push Plates, Kick Plates, All Window Sills, Wall Surfaces, Switch Plates, Wall Accessories, Baseboards, Trim Work, All Window Panes, and Tables/Chairs E. Floors Sweep all floors. Damp mop all floors. Machine scrub floors as needed. Vacuum all carpet areas. F. Drinking Fountain Remove all litter. Clean all exposed surfaces and parts with an approved disinfectant solution. Wipe dry. G. Bathroom Specifications Empty trash and replace trash bags. Clean and disinfect all toilets, toilet seats, urinals and sinks with a no-scratch disinfectant cleaner. Wipe dry. Toilet seats are to remain in upright position after cleaning. Remove stains from all toilets, urinals and sinks. Clean and polish all mirrors. Remove splash marks from all surfaces. Refill paper towels, toilet paper, seat covers and soap dispensers. Sweep all floors and then damp mop all floors with a disinfectant solution. Spray buff all bathroom floors weekly. Bathroom entrance doors including door trim and door framework are to be spot cleaned with disinfectant to eliminate fingerprints and soil marks. 29

30 H. Kitchen Areas & Vending Machines Empty trash and replace trash bags. Wipe down countertops, cabinets, walls, chairs, microwave oven, and refrigerator with disinfectant solution. Sinks should be scrubbed with a no-scratch sink cleaning power that includes bleach. Faucet should be wiped down with a disinfectant solution and dry polished. Vending machines should be wiped down with disinfectant solution and dry polished. 30
