AFCN Radioprotection in Belgium Transposition de la Directive-BSS (2013/59/ Euratom) ABR-20/10/2017-A. Vanderlinck
1. History 2. Legislative change in Belgium 3. Hierarchy of the Federal Regulations 4. National policy and strategy for nuclear safety 5. Framework for safety 6. Main steps After 2018 ABR-20/10/2017-A. Vanderlinck
1. History < 2001 Only state facilities and NPPs licensed by RD. Other facilities/practices (± 8500) licensed by provinces. Only basic regulation available (precursor of GRR-2001). No guides available (use was made of external` regulations and guides, e.g. US). Many items not or only partially covered: clearance, legacy situations, disposal, decommissioning, security, ~ 2001 FANC charged with review and assessment of all facilities and activities and licensing of class II and III facilities FANC charged by law to make proposals for new regulatory texts or for modification of existing texts. Large amounts of regulatory initiatives. Driving force: Expansion in terms of people, activities and expertise Increased international participation and development of international standards At present Many initiatives with respect to regulations (e.g. extensions of SRNI) The need to establish guides has arisen (e.g. in relation to SRNI) The laws and royal decrees are regularly updated, and completed. Still long timeframe for final approval of regulatory texts Active involvement in (inter)national fora and projects 3
2. Legislative change in Belgium A. IRRS 2013 Action plan Follow up 27/11-05/12/2017 B. Directive 2013/59/Euratom Project N 1 GAP Analysis Project N 2 Legislative coordination ABR-20/10/2017- A. Vanderlinck
3. Hierarchy of the Federal Regulations Constitution Laws and International Conventions, approved by Parliament Royal decrees, signed by the King and at least one Minister Ministerial decrees FANC decrees + FANC guides and recommendations (non binding) + European legislation (binding in EU Member States)
4. National policy and strategy for nuclear safety Belgian constitution : protection of a healthy environment Belgian Parliament actively involved - Special Parliamentary Commission for nuclear safety Contracting party of a number of international conventions Directives 89/618/Euratom; 90/641/Euratom; 96/29/Euratom; 97/43/Euratom and 2003/122 Euratom are already transposed and implemented
5. Framework for safety 1. FANC law = basis of specific regulations 2. Several royal decrees : general regulation for radiological protection (workers, patients, general public) requirements for the safety of nuclear installations; requirements for medical and pharmaceutical applications regulation of import, transit and export of radioactive substances; requirements for the safe management of radioactive waste; requirements for the safe transport of radioactive substances; requirements for the security of nuclear installations; monitoring the environment for possible radioactive pollution; requirements in case of emergencies 3. FANC Decrees = Technical guidelines Acceptability criteria for equipment Level for protectives measures in emergency planning Guidelines for incident/accident melding, About 20 FANC Decrees
6. Main steps Modification FANC law Individual radiological monitoring 2014/01/26 - In force on 2017/03/06 Responsibilities of the regulatory bodies and undertaking /05/07 Medical physics first state of obligatory consultation - Q3/ RD Emergency preparedness and response /10/17 Post accidental phase; international collaboration Regulatory modification under drafting - Q4/ RD Transport Regulation TS-R-1 IAEA in force; exemption values for transport ; use of TS-G-1.1 Final state of obligatory consultation - Q1/ RD GRR rst Modification Responsibilities: regulatory body, undertaking, health physics Dpt, RPE, RPO. Recognition of RPE Stakeholders consultation Q2/2017 First state of obligatory consultation- Q3/2017

7. After 2018 A process is established for the development of regulations with extensive consultation of interested groups : Agreement of department of MPE (Law and RD) Establishing additional guides Establishing updated decision criteria for protectives measures Establishing updated strategies for remediation (Financial costs managed by NIRAS/ONDRAF) Formalized international collaboration in case of emergency preparedness (neighbouring countries) Harmonisation in EC (good practices = radon)
